Participation and Legitimacy : Actor Involvement for Nature ConservationRabe, Linn January 2017 (has links)
This PhD thesis in environmental science aims to contribute to the theoretical and empirical understanding of the relation between participation and legitimacy in multi-level environmental governance. It is widely assumed that actor involvement has great potential to improve the legitimacy of nature conservation through long-term acceptance and target achievement. However, local resource conflicts problematize the way a relation between participation and legitimacy is depicted on other administrative levels. Studies exploring the effect that participation has on legitimacy are relatively rare, especially in multi-level arrangements of coastal conservation. In this thesis the relation between participation and legitimacy on the local level is examined, as well as how this relation is conditioned by multi-level governance and power. The relation is empirical studied with two local implementation processes of the Helsinki Convention’s network of marine protected areas (HELCOM MPAs). The cases are located in Sweden. Sweden and the Baltic Sea region are in the forefront of participation in nature conservation, and therefore act as a strong case for the exploration of institutional participation. However, despite apparent political will and international support, the efficiency of actor involvement for nature conservation has been questioned, also for the HELCOM MPA and especially on the local level. Based on the results of this study, I question the assumption that weak legitimacy predominantly is an issue of insufficient information sharing. The findings show that involving actors to legitimize the adoption of strict adherence to a pre-established model of conservation likely fails to create long term support for conservation. Instead, relocation of power to the affected actors seems essential in order to make participation establish legitimacy. It appears important to create room for local influence in the design, management and implementation of a particular conservation area in the particular place/context. In both examined cases, there are elements of participation that support legitimacy, for example the development of a shared vision. There are also elements that hamper legitimacy, such as, for example, the high expectations different actors have on participation to reach consensus on protective values. These unmet expectations seem to fuel conflicts of interests among actors on different levels. / Världens hav är i kris. Med ett stort internationellt tryck för att skydda dem har den svenska regeringen satt ambitiösa mål för etablering av marina reservat. Beslutsfattare och forskare har höga förväntningar på att lokalt deltagande underlättar etableringen. Men utan verkliga möjligheter för lokalt deltagande att påverka besluten så verkar förväntningarna orealistiska, med allvarliga konsekvenser för legitimitet av miljöskydd. Avhandlingen undersöker relationen mellan deltagande och legitimitet i svensk östersjöförvaltning genom att studera samrådsprocesserna för Gräsö marina naturreservat och St Anna-Missjö marina skyddsområde. Studien visar på både positiva och negativa samband mellan deltagande och legitimitet, beroende på kvalitén av deltagande. Olika lokala aktörer är djupt engagerade i resursfrågor och vill ha möjlighet att diskutera dessa med staten. Lokala aktörer uttrycker besvikelse och frustration om samråden har en begränsad inverkan på faktiska beslut. Besvikelsen kan underminera stödet för naturskydd och försämra relationen mellan stat och lokala aktörer i längden. I ett av de undersökta fallen var de lokala aktörerna engagerade i att formulera en gemensam vision för området tillsammans med myndigheterna, något som annars är ovanligt. Det visade sig ha en mycket positiv effekt på samrådsprocessen och legitimiteten av naturskyddet.

Cette recherche a porté sur quelques enjeux importants liés à la gestion des aires marines protégées (AMP) en Indonésie en examinant comment celles-ci sont en mesure d'adapter leurs politiques afin de mieux répondre à l'évolution des conditions socioéconomiques et écologiques, quels ont été les impacts socioéconomiques de ces aires, et quelles sont les préoccupations environnementales des acteurs locaux dont les moyens de subsistance dépendent des ressources règlementées. Le «livelihoods framework » a servi de guide pour notre analyse des changements socioéconomiques dans la région, tandis que la notion d’« environmentality » d’Agrawal a fourni les bases théoriques pour l'examen de la formation de sujets environnementaux au parc national de Karimunjawa. Cette étude a montré que les changements de politique apportés au plan de la gestion du parc sont un pas dans la bonne direction, mais que les objectifs importants liés sa cogestion n'ont jamais été entièrement réalisés dans la pratique. Les résultats montrent également que d'importants changements socioéconomiques surviennent dans le parc, de nombreux pêcheurs se tournent vers des moyens de subsistance alternatifs, afin de compenser la baisse des prises de poissons. Enfin, cette étude a révélé que d'importants changements positifs dans les préoccupations environnementales sont survenus depuis la modification du zonage du parc, mais que ceux-ci ne se sont pas entièrement traduits en conformité avec les règles et règlements de l'AMP. / This research examined a few important issues related to marine protected area (MPA) management in Indonesia by looking at how MPAs are able to adapt their policies in order to better suit evolving socioeconomic and ecological conditions, what socioeconomic impacts have been felt as a result of MPA implementation, and what are the environmental subjectivities of local actors whose livelihoods are dependent on the resources that are being regulated. Lastly, this study uncovered that significant positive shifts in environmental subjectivities have occurred since the re-zoning of the park, but that these have not fully translated into compliance towards the rules and regulations of the MPA.

A ocorrência de AS e os fatores que a afetam foram investigados por meio de análise documental, observação de processos em andamento e levantamento da percepção dos indivíduos envolvidos com a gestão participativa de uma área marinha protegida (AMP) no Brasil. A hipótese central é que AS pode qualificar a participação e aprimorar a GCI. Esta pesquisa caracterizou a gestão da AMP e identificou processos de AS e como eles foram favorecidos/prejudicados, com atenção especial ao papel de instituições de ensino e pesquisa e à promoção de troca de conhecimento. Previous issue date: 2014-02 / Capes / A Política Nacional de Recursos Hídricos, Lei n° 9.433/97, e o Plano Nacional de
Gerenciamento Costeiro, Lei n° 7.661/88 e Decreto Federal n° 5.300/04, estabelecem
entre suas diretrizes a necessidade de integração da gestão de recursos hídricos com o
gerenciamento costeiro. Diante disso, o Conselho Nacional de Recursos Hídricos criou
a Câmara Técnica de Integração da Gestão de Bacias Hidrográficas e dos Sistemas
Estuarinos e Zona Costeira, que objetiva analisar e propor mecanismos de integração
das mencionadas políticas, visando a minimização ou solução de conflitos de uso de
recursos hídricos em ambiente costeiro. A inerente complexidade da interação entre as
bacias hidrográficas e zonas costeiras e os múltiplos usos da água a montante da zona
costeira da bacia, que reduzem a afluência e, consequentemente, a disponibilidade de
água doce na região costeira, além de poderem provocar alterações no leito dos rios na
faixa costeira devido a deposição de sedimentos bem como alterações na flora e fauna
dessas regiões, tornam prementes estudos que contemplem estas interações. Como
estudo de caso, foi escolhida a Região do Baixo Curso da bacia hidrográfica do rio
Paraíba, em função de conflitos relacionados aos múltiplos usos da água, bem como
alterações no leito do rio. Objetiva-se compor um diagnóstico situacional que subsidie
ações para minimizar ou solucionar os conflitos existentes, face a aplicação integrada
dos vários instrumentos de gestão. Com uma abordagem qualitativa baseada no método
dedutivo, utilizando-se da pesquisa bibliográfico-documental como base exploratória,
faz-se uma análise das interfaces legais e institucionais, destacando as articulações
operacionais possíveis entre os instrumentos de planejamento e gestão. A análise de
compatibilidade, entre os instrumentos de gestão da PNRH e do PNGC, demonstra que
a articulação é possível. Recomenda-se ao setor competente do estado da Paraíba, a
elaboração do Plano de Gestão da Zona Costeira e o Zoneamento Ecológico-Econômico
Costeiro, articulados com o Plano Estadual de Recursos Hídricos e o Plano da Bacia
Hidrográfica do rio Paraíba. A partir deste, o Comitê da Bacia e a Comissão de
Gerenciamento Costeiro deverão articular ações, visando a conservação e a resolução de
conflitos derivados dos múltiplos usos da água. Conclui-se que o processo de integração
entre a gestão de recursos hídricos e o gerenciamento da zona costeira envolve a
descentralização do poder de gestão, a participação da sociedade civil e usuários, e a
harmonização e inter-relação dos instrumentos da gestão de recursos hídricos com o do
gerenciamento costeiro, bem como depende de uma coordenação entre os níveis federal,
estadual e municipal, e que cada qual tem interesse e formas de contribuir para essa
integração. / The National Water Resources Policy, Law 9.433/97, the National Coastal Management
Plan, Law 7.661/88 and Federal Decree 5.300/04, establish, among their guidelines, the
need for integration of water management with coastal management. Thus, the National
Water Resources Council established the Technical Chamber of Integration of the
Watershed Management and Estuarine and Coastal Zone Systems, which aims to
analyze and propose mechanisms for the integration of the above policies, aimed at
minimizing or solving conflicts of water resources use in the coastal environment. The
inherent complexity of the interaction between watersheds and coastal areas and the
multiple uses of water from upstream of the coastal zone of the basin, which reduce the
rivers flow and, consequently, the availability of fresh water in the coastal region, may
cause changes in the rivers bed of the coastal zone due to sediment deposition as well as
changes in the flora and fauna of these regions demand continuous studies that address
these interactions. As a case study, it was chosen the region of the lower course of the
Paraiba river basin in reason of the water conflicts from the multiple uses of water as
well as changes in the river bed. The objective is to compose a situational diagnosis to
subsidize actions to minimize or solve the existent conflicts, given the application of
different management and integrated tools. With a qualitative approach based on
deductive method, utilizing the bibliographic and documentary research as an
exploratory basis, an analysis of the legal and institutional interfaces is made,
highlighting the possible operational links between the instruments of planning and
management. The analysis of compatibility between management tools of the PNRH
and PNGC, demonstrates that the linking between them is possible. It is recommended
to the competent sector of the Paraíba state to provide the preparation of a Management
Plan Coastal Zone and Coastal Ecological - Economic Zoning, articulated with the State
Water Resources Plan and Plan Basin of the Paraíba River. From this, the committee of
the Paraíba river basin and Coastal Management Commission shall coordinate actions in
order to preserve the environment and provide the solution of conflicts arising from the
multiple uses of water. It is concluded that process of integration between water
management and coastal zone management involves the decentralization of power
management, the participation of civil society and users, and the harmonization and
inter-relationship of the components of water resources management with the coastal
management and depends on coordination between federal, state and municipal levels,
and each one has its own particular interests and ways to contribute to this integration.

A retrospective assessment of the Port Alfred linefishery with respect to the changes in the South African fisheries management environmentDonovan, Bruce 18 July 2013 (has links)
Since the study on the Port Alfred/Kenton-on-Sea/Boknes linefishery by Hecht and Tilney (1989) there have been substantive changes to the linefish management environment in South Africa. Using the Port Alfred linefishery as a model, the aim of this study was to evaluate the effectiveness of the linefish management regulations that were implemented by Marine and Coastal Management (MCM) since 1992, and to assess the behaviour and 'status' of the fishery in response to these changes. Changes to both the licensing structure and catch regulations have had a significant effect on the functioning of many aspects of the Port Alfred linefishery (fishing effort, catch composition, cpue) as well as on the structure of the fishery and its socio-economic profile. Overall commercial cpue decreased from 1985 to 1998. Since 1998 there has been a significant increase in cpue (from 2.3 Kg.fisher⁻¹ hour⁻¹ to a peak of 4.8 Kg.fisher⁻¹.hour⁻¹ in 2005. This was attributed to good catches of geelbek, particularly in 2005, 2007 and 2008 (during these years geelbek contributed an average of 35% to the total landings in comparison to a mean contribution of II % between 1985 and 2004). However, size spectra analysis suggests that the increase in overall cpue since 1998 misrepresents the actual status of the fishery. If geelbek is excluded from the analysis on the grounds that it is the only species in the fishery that is highly migratory, susceptible to recruitment fluctuations and it does not contribute to the catches on a year round basis, then the results suggest that the fishery is still in a declining phase despite the 80% reduction in commercial effort and numerous stricter catch regulations (e.g. size/bag limits). Furthermore, the cpue of silver kob, which has been the "mainstay" species of the fishery, has consistently declined over the last 23 year period (from 1.69 Kg.fisher⁻1 .hour1 in 1986 to 0.86 Kg.fisher⁻1.hour⁻1in 2007). The substantial reduction in commercial effort in the fishery from 33 vessels in 2001 to 13 in 2002 resulted in a shift from commercial to recreational fishing. The number of active commercial vessels in Port Alfred alone decreased from 29 in 1989 (Hecht 1993) to four in 2008. During the same timeframe, the number of regularly active recreational vessels had almost doubled (16 in 1989 to 26 in 2008). Despite the greater number of recreational boats in the fishery they only landed approximately half the average yearly tonnage of the commercial vessels (21,5 and 44,7 tonnes,annum-I , respectively) between 2006 and 2008, This was ascribed to the differences in catch regulations for the two sectors, Furthermore, it was speculated that increasing operating costs and narrowing profit margins have contributed to lower levels of compliance in both the commercial and recreational sectors since 2006, For example, 16% of silver kob landed during 2006-08 were under the minimum size, Despite the changes made to the regulations since 1998 and the 60,6% reduction In legislated commercial effort in the fishery between 2001 and 2002 it was concluded that the fishery has continued to decline, Except for the good recruitment of geelbek (which may be due to regulatory changes made in 1992) the changes in the management environment have had no measurable positive effect on this fishery, It is recommended that commercial effort should not be allowed to increase beyond the current number of active boats, that there should be an area restriction on all commerciallinefish vessels, that the current recreational bag limit for silver kob should be re-assessed, there should also be a concerted and nationally funded effort to educate recreational anglers about the merits of catch and release, and the frequency of catch inspections of both sectors should be increased, / KMBT_363 / Adobe Acrobat 9.54 Paper Capture Plug-in

No abstract. / Coastal and marine ecosystems are some of the most heavily exploited with increasing degradation. This alarming situation appeals for urgent and effective actions. The optimal balance between use and conservation of ecosystems theoretically requires all costs and benefits to be considered in decision-making, including intangible costs and benefits such as non-market use and non-use values. The broad aim of this PhD is to examine how these economic values associated with coastal and marine ecosystem services can be measured, and how the economic valuation exercise may be considered and influence management decision- making.The first analytical part of the thesis focuses on assessing non-market use and non-use values, through econometric methods. The characterization and estimation of non-use values are complex and controversial, especially when the valuation exercise is focusing on individuals who are users of the ecosystem services being considered. An original approach based on a stated preference method, namely choice experiments, is developed then empirically applied in quantifying non-market values for marine and coastal ecosystems in two areas in New Caledonia. It allows the estimation of non-use values for populations of users in an implicit way. An in-depth analysis of the individuals’ choice heuristics during the valuation exercise is also conducted, with a focus on payment non-attendance. This issue is dealt with by comparing multiple modelling approaches in terms of: (1) inferred attendance, in relation to stated attendance; (2) attendance distribution according to several socio-economic variables; and (3) welfare estimates.After noting that the potential influence of economic valuation in decision making is unclear and largely unexplored in the literature, the second major component of this PhD aims to examine if, how and to what extent the economic valuation of ecosystem services, including measures of non-market values, influence decision-making regarding coastal and marine ecosystems management in Australia. Based on two nation-wide surveys, the perceived usefulness of the economic valuation of ecosystem services by the general public and decision-makers is studied, and the reasons why decision-makers may or may not fully consider economic values are elicited. Using a multi-criteria analysis, a part of the surveys also aims at examining the relative importance of different evaluation criteria (ecological, social and economic) when assessing the consequences of a hypothetical coastal development project on commercial activities, recreational activities and marine biodiversity.

Conservation criminology as a derivative of environmental criminology is considered in this dissertation through a strategic/empirical investigation of the illegal exploitation of a cross-section of certain, essentially fiscally attractive marine resources, as a form of environmental crime in the Western Cape province.
Through primarily qualitative and quantitative interviewing techniques,
augmented by the application of a survey questionnaire, significant and pragmatic insight was obtained from knowledgeable functionaries. The study elucidates the purview and dynamics of the marine crime phenomenon by focussing specifically on issues such as modus operandi, crime scenes, causation, operational efficacy, and social/biological repercussions. Conservation criminology as a derivative of environmental criminology is considered in this dissertation through a strategic/empirical investigation of the illegal exploitation of a cross-section of certain, essentially fiscally attractive marine resources, as a form of environmental crime in the Western Cape province.
Through primarily qualitative and quantitative interviewing techniques,
augmented by the application of a survey questionnaire, significant and pragmatic insight was obtained from knowledgeable functionaries. The study elucidates the purview and dynamics of the marine crime phenomenon by focussing specifically on issues such as modus operandi, crime scenes, causation, operational efficacy, and social/biological repercussions.
