Discretion : an art of the possible : education committees in the Swedish system of government

Discretion is commonly analyzed as the scope for choice set by formal superiors. This study aims at developing an alternative theory of discretion which also takes into account the assumptions of the actors in implementing positions. The theory is constructed with the purpose of being an empirical tool for analyzing discretion on a nation-wide basis and in a central-local government context. It concerns two main questions: to what extent does discretion vary and how can this variation be explained? The theory section concludes with a number of empirically testable hypotheses. The concept of discretion is defined as the scope for choice available to actors, in formally subordinate positions, vis-à-vis their superiors. It is seen as a special case of autonomy, as it is attributed to subordinates and primarily concerns one dimension of autonomy, namely freedom of action. In the second half of the study, the theory is applied empirically to the discretion available to Swedish local government Education Committees. A questionnaire study of all Education Committee Chairpersons and Chief Education Officers and in-depth interviews of a selected sample of these have been undertaken. The empirical study clearly indicates that there is variation in discretion. In spite of the uniformity of the system of governing local education, it is found that the limits for discretion are set differently by different Education Committee representatives. The variation follows a pattern which has been, at least partly, reconstructed. Variables which appear as important in explaining variation include: the extent to which the control system is regarded as efficient; the size and population density of the local authority; and individual traits such as length of experience and gender. However, our analysis also shows that these explanations are more valid in certain contexts than in others, which points the way for further research. / digitalisering@umu

The overarching aim of this dissertation is to study divergences in assessments of social assistance in Swedish social welfare offices. ‘Assessments’ here refers to whether applications for social assistance are granted or not, as well as the size of subsidies. Another aim with the dissertation is to explore whether differences in assessments have changed over time. A primary focus in this study is the importance of elements of changing character, e.g. varying organizational and individual conditions. Among these elements, the main focus is on the relation between organizational factors and professional discretion among social workers. Primary data used for the study has been assembled among social workers (n=121) in eleven municipalities in the northern Stockholm area. The main section of the questionnaire used for assembling data consists of six vignettes, each describing a different situation. Data is supplemented with secondary material that derives from a similar study conducted in 1994. Overall, findings show considerable divergences in the way social workers make their assessments. Some of the divergences are explained by different organizational conditions, e.g. varying levels of specialization and size of caseloads. Individual factors, such as sex, age and varying professional characteristics, e.g. work experience, influence the assessments only to a limited degree, while attitudes among social workers play a larger role. The study also indicates a substantial decrease in generosity over time. This might to some extent be explained by changed and elaborated set of regulations in the sphere of social assistance. Further, the individual divergences in assessments have increased over time. A plausible interpretation of the results is that an increasing number of regulations combined with professional discretion, entails a larger scope for social workers’ opinions and individual screening among rules.

Prosecutor Selected Youth Diversion: Identifying the Circumstances and Conceptualizing the Cases

Crown selected youth diversion has received little academic attention in Canada. As a process that channels offenders out of the formal legal system, diversion purports to achieve contradictory self-serving system and offender-based goals. Using 50 randomly selected prosecution files – half of which the Crown diverted and half of which the Crown prosecuted – a mixed method investigation of diversion assesses cases through quantitative content analysis and grounded theory method. Based on the quantitative analysis, it is argued that there is an emerging patterned nature of Crown selected diversion that is not completely benign. This patterned nature of diversion unearths a distinctive discourse of diversion/non-diversion. Qualitatively, it is argued that the cases are organized around three temporal moments that create an area for distinctions to be made in terms of threat, responsibility, (in)tolerableness and recourse. Seemingly, there is a persistent paradoxical existence of the diversion process that emerges from the case files.

Bedömningsgrunder för boendestöd : en intervjustudie med biståndshandläggare i Uppsala kommun

This bachelor thesis aims to investigate how social workers in Uppsala describe their procedure when investigating applications for housing assistance (i.e. boendestöd). Boendestöd is a specific type of services for people with disabilities, which aim to assist them in their lives. This welfare service is one of many regulated by the framework legislation that is the social services act (SoL 2001:453). Previous research indicates that civil servants who make decisions based on goal-oriented framework legislations like SoL, have a great freedom to act when they make judgments and decisions. A consequence of this can be that they make judgments and decisions largely based on their own personal interpretations of this legislation. The previous research points to the fact that the individual civil servants freedom to act can be viewed as an infringement of individual rights, but also that this freedom is necessary when it comes to assessing the needs of help seeking persons in the context of social work.   We have carried out six interviews with social workers in Uppsala. These social workers primarily investigate the needs of persons with mental disabilities who apply for different forms of assistance from the city. The analysis suggests that the social workers interviewed are relatively unanimous when it comes to which grounds for judgment or criteria they use when investigating applications for boendestöd. This in spite of the fact that their judgments are based on individual cases as well as their own personal assessments of them.

I spänningsfältet mellan kontroll och stöd : en kvalitativ studie om hur socialsekreterare kan uppleva sin yrkesroll / In the tension between control and support : a qualitative study of how social workers can experience their professional role

This is a qualitative study based on two focus group interviews with a total of six social workers who work with assessing financial aid in two municipalities. The study aims to examine how the social workers experience and handle their ambiguous professional role, on the basis that they are expected to support and control the client. The theoretical framework is the theory about discretion and role theory. The results show that social workers find it difficult to combine these different approaches. Two different groups of strategies that social workers use to manage their professional role have been distinguished, the first is used to combine the different approaches (combination strategies), which are: empathy, to be distinct and to "blame" the organization. The second is used to manage the professional role (managing strategies) and are: support of work colleagues, support of manager, "squareness" and distance. / Detta är en kvalitativ studie som bygger på två fokusgruppintervjuer med totalt sex socialsekreterare som arbetar med att handlägga ekonomiskt bistånd i två kommuner. Studiens syfte var att undersöka hur socialsekreterare som arbetar med ekonomiskt bistånd upplever och hanterar sin dualistiska yrkesroll, utifrån att de förväntas stötta och kontrollera klienten på en och samma gång. Studiens teoretiska ram utgörs av teorin om handlingsutrymme samt rollteori. Resultatet visar att socialsekreterarna upplever det svårt att kombinera dessa olika förhållningssätt/roller och att svårigheterna främst uppstår då de tvingas fatta beslut som går klienten emot. Två olika grupper av strategier som socialsekreterarna använder sig av för att hantera yrkesrollen har kunnat urskiljas, den första används för att kombinera de olika förhållningssätten (kombinationsstrategier), vilka är: visa empati, tydlighet och “skylla” på organisationen. De andra används för att hantera yrkesrollen (hanteringsstrategier) och är: stöd av arbetskollegor, stöd av chef, “fyrkantighet” och distans.

Principals' perspectives on discretion and decision making

Principals are required to continuously exercise their discretion on a variety of matters that affect schools, teachers, children and communities. In spite of this reality, not much study has been done in this area of the principal’s job. In this study I examine discretionary decision-making in areas of discipline, budgets and staff management. I found that principals seek to balance the needs of their students against defensibility of their actions within the context of seemingly conflicting school board policies, school policies and superintendents expectations. I present a new conceptual model for discretion and a call for careful policy writing, increased understanding of discretion by administrators and further studies which would include the perspectives of those affected by principals’ decisions. / May 2006

The aim of this essay was to create an understanding of teachers strategies to respond to children in economic hardship in school and if these children can participate on equal terms in school. To examine this, we chose to do semi-structured interviews which is a qualitative method. Eight teachers were interviewed from four different elementary schools. In our interviews, we found that all the schools both had elements of inclusion and exclusion, which can result in both equal and unequal terms for participation in school. We also found that the school with the most students in economic hardship had the most inclusive strategies. Another thing we discovered was that the Swedish school law is ambiguous, because it says that school should be free of charge but at the same time accepts that the school takes out an insignificant cost from the students. Because there is no definition of the insignificant cost and the policy about school related costs are vague, it gave the teacher some discretion to define how much and at which time the insignificant cost could be relevant. The teachers’ could use their discretion to support the children who lived in economic hardship, by reducing the risk for their economic situation to be visible to others and enable them to participate on more equal terms, for example by having extra snacks or money with them during school

The overall aim of this study is to investigate how social workers who are dealing with financial assistance are experiencing discretion in their daily work. The aim of the study is also to examine how social workers who are dealing with financial assistance relates to the controlling and the supporting functions of their daily work and how this in turn affects the attitude to the client. In order to examine the aim of the study, qualitative method was used. Eight social workers have been interviewed and presented with two fictitious cases that they have been able to discuss. Theories regarding the street-level bureaucrat and its discretion have been used to interpret and understand the collected material. Kerstin Svenssons’ (2001) theory regarding the social worker’s position has also been used to analyse the study’s gathered material. The study shows that social workers consider themselves to have a relatively large discretion in their daily work. However, the majority of the social workers agree that despite the great discretion they can at times feel limited in their work. Findings of the study also show that social workers are either more controlling or more supportive in meeting with the client.

Socialsekreterares arbetsmiljö : En kvalitativ studie / The Work Environment of Child Welfare Workers : A Qualitative Study

Det övergripande syftet med studien är att undersöka och analysera socialsekreterares erfarenheter av att arbeta inom sektionen för myndighetsutövning inom barn- och ungdomsverksamheten för att få en inblick i hur de själva upplever och påverkas av eventuella hinder respektive möjligheter i arbetsmiljön. Studien bygger på kvalitativ metod och består av enskilda forskningsintervjuer. Samtliga socialsekreterare i studien beskriver sin arbetssituation som väldigt tuff med ett högt ärendeinflöde som är svårt att påverka. Många menar att det är svårt att hinna med arbetsuppgifterna inom de tidsramar som finns reglerade i socialtjänstlagen. Av resultaten i studien framgår det att socialsekreterarnas arbetsmiljö präglas av olika kulturer som inverkar på varandra, begränsar socialsekreterarnas handlingsutrymme och genererar stress. Detta har en negativ inverkan på socialsekreterarnas arbetsmiljö och leder i förlängningen till hög personalomsättning. / The overall aim of this study is to investigate and analyze the child welfare workers’ experiences of working within the public welfare agencies and to gain an insight into how they experience and how they are affected by obstacles and opportunities in their work environment. The study is based on a qualitative methodological approach and consists of individual research interviews. All child welfare workers in the study describe their work situation as very tough with a high inflow of cases which is difficult for the workers to influence. Many child welfare workers consider it to be difficult to find the time to finish their work within the timescales that are regulated in the Social Services Act. The results of the study reveal that the child welfare workers’ work environment is characterized by different cultures that influence each other, limiting the child welfare workers’ discretion and generate stress. This has a negative impact on the child welfare workers’ work environment and ultimately results in high turnover.
