Restriction of the Teacher's Rights of Work in Universities¡GFocus on the Faculty¡¦s Promote System

This article is based on the restriction of the teacher¡¦s rights of work in university, focusing on discussion of faculty¡¦s qualification assessment and promotion system in Taiwan. First, about the teacher¡¦s rights of work, it will emphasize on human nature dignity, academic freedom and legal system safeguard. Second, regarding the restriction of the teacher¡¦s rights of work, government uses teacher's legal qualification and the certificate to limit it. This article will claim law authorization, public interest, and proportion principle. Finally, The third part is mainly the comments on the review, jurisdiction, institution, content, procedure and the relief of faculty¡¦s qualification assessment and promotion system. It will suggest legal retention principle, legal system uniformization, professional assessment principle, due process of law, relief system effectiveness and authorized discretion. Therefore, the reform of faculty¡¦s qualification assessment and promotion system is completely return university autonomy, taking the teacher qualifications by the special work's disciplinary power examination the standard. Government only makes the principled low density standard and afterward the legal surveillance.

Because of the situation around the world with war and poorness many people need to leave their homeland and find safeness in other countries. A big amount of this group is children without company of an adult, so called unaccompanied children. The numbers of unaccompanied children who seek safeness in Sweden grow every year. The aim of this study was to investigate how social workers in four municipalities in south of Sweden experience their work with investigating the needs of unaccompanied children. The aim was also to investigate how the social workers experience their opportunities to meet the children’s needs with personalized interventions. The study is built on semi-structured interviews with six social workers who all have experience or are now working with investigating unaccompanied children. The results of the interviews were analyzed using a system theory perspective and Andrew Abbotts profession theory. We also used the terms grassroots bureaucrats and discretion. The results of our study has shown us that the social workers often feel a certain restriction when it comes to their ability to meet the children’s needs because of the lack of available accommodations. The study also shown that the social workers experience a limitation when it comes to the authority they have as their decisions must be approved by others and not based solely on the individual workers assessment.   The social workers in our study also experience that their work is not taken as seriously as others investigation of children from Swedish families which influence the status and legitimacy that they describe that their profession should have.

Explaining the "Female Victim Effect" in Capital Sentencing Decisions: A Case for Sex-Specific Models of Capital Sentencing Research

The potential influence of extralegal characteristics on the outcome of post-Furman capital cases (1972) has been a focus of criminal justice researchers and legal scholars. Much of this literature has assessed the impact of victim and defendant race on the likelihood of receiving the death penalty while a relatively underdeveloped body of research focuses on how victim sex may affect capital sentencing decisions. The present study uses focal concerns theory and the chivalry hypothesis to test the potential mediating effect of theoretical variables on the relationship between victim sex and juror capital sentence decision-making. In addition, it uses victim sex specific logistic regression models to examine if different theoretical and/or control variables are important predictors of receiving the death penalty for male victim cases versus female victim cases. Findings demonstrate that victim rape mediates the relationship between victim sex and juror death penalty decision-making. In addition, findings reveal that sex specific models better explain juror decision making than the full model including victims of both sexes and that different extralegal and legal characteristics predict juror decision to choose the death penalty in cases with male victims versus female victims. Theoretical and legal implications as well as directions for future research are discussed.

Discretion to Act : A case study of how the environment affects top managers' degree of discretion

The purpose of this dissertation is to analyze how managerial discretion is influenced by the environment and, thereby, increase the theoretical knowledge of the concept. Hambrick and Finkelstein (1987) introduced environment as a level affecting managerial discretion. However, the authors only discussed it in an industry context. Moreover, in this dissertation we developed the environmental level by adding two more contexts. Thereby, a theoretical input –and output model were created. These include three environmental sublevels: Industry characteristics, public sector and transition economy. The analysis is under a strategic perspective, which defines top managers’ discretion as the latitude of strategic actions. Hence, managerial discretion varies in the scope of available actions influenced by environmental factors. To fulfill the purpose of this dissertation, the methodical approach is a case-study. Thus, the data consists of interviews, observations and public documents collected in a governmental organization. The findings have shown that a dynamic environment, such as a country undergoing a transition, provides context-specific factors affecting the degree of managerial discretion. Context-specific factors, such as powerful outside forces and quasi-legal constraints can increase and/or decrease the degree of top managers’ degree of discretion. The conclusion summarizesthe findings of how the different factors within each sublevel, affect the degree of managerial discretion. Moreover, the conclusion also contains the contributions of this dissertation. Firstly, the study contributes to the theory of managerial discretion, by introducing context specific factors within the public sector and a transition economy. Secondly, the study enhances the empirical knowledge about the concept, by providing new empirical evidence of managerial discretion. Finally, the results of this dissertation can help policy makers as guidelines when implementing policies. Recommendations for future research include adding the governance perspective, and/or conducting a comparison research with different organizations/contexts.

Bakgrunden tills studien är dels att förstå innebörden av begreppet ensamkommande barn, dels vilka riktlinjer för delaktighetsgörandet som finns för socialsekreteraren i arbetet med ensamkommande barn. Jag vill få en kunskap om socialsekreterarens delaktighetsfrämjande arbete med ensamkommande barn och socialsekreterarens handlingsutrymme och svårigheter i arbetet. Syftet med studien är att utifrån socialsekreterares upplevelser beskriva och analysera det delaktighetsfrämjande arbetet med ensamkommande barn. En kvalitativ studie med semistrukturerade intervjuer där empirin består utav fem transkriberade intervjuer. Intervjupersonerna har valts utifrån ett strategiskt val med kriteriet att vara socialsekreterare som arbetar med ensamkommande barn. En intervjuguide utformades för att få svar på intervjufrågorna. Det empiriska materialet har analyserats utifrån studiens teoretiska perspektiv symbolisk interaktionism samt de två teoretiska begreppen delaktighet och handlingsutrymme. Resultatet visar att samtliga intervjupersoner upplever sitt handlingsutrymme i arbetet som stort och att de är tämligen fria i arbetet. Socialtjänstlagen ger socialsekreterarna ett stort handlingsutrymme då lagen enbart är en ramlag med allmänna riktlinjer. Fortsättningsvis visar resultatet att intervjupersonerna upplever stora svårigheter vid användandet av telefontolk i samtal med ensamkommande barn. Det framkommer i resultatet att intervjupersonerna upplever svårigheter vid att skapa en förtroendefull relation med det ensamkommande barnet med anledning av barnets tidigare erfarenheter. Vidare visar resultatet på att intervjupersonerna upplever deras arbete med ensamkommande barn som delaktighetsfrämjande genom att låta barnet få ta del av information samt genom att barnet får dela med sig av sina åsikter som beaktas i den beslutsfattande processen. / The background to the study is the first to understand the concept of unaccompanied children, and the guidelines for the participation announcement that exist for the social worker in the work with unaccompanied minors. I want to gain knowledge of the social workers participative work with unaccompanied children and the social workers discretion and the difficulty of the work. The purpose of the study is that based on the social worker's experience to describe and analyze the participative work with unaccompanied children. A qualitative study using semi-structured interviews in which empirical data consists of five transcribed interviews. The interviewees have been selected by a strategic choice of the criterion of social workers who work with unaccompanied minors. An interview guide was designed to find answers to interview questions. The empirical data were analyzed based on the study of theoretical perspectives symbolic interactionism and the two theoretical concepts of participation and discretion. The results show that all the respondents perceive their freedom of action in that big and that they are relatively free of work. The Social Services Act gives socialworkers a wide discretion when the law is merely a framework law of general guidelines. Henceforth, the results show that the respondents are experiencing great difficulties when using telephone interpreter in conversation with unaccompanied minors. It emerges from the results that the respondents experiencing difficulties increating a relationship of trust with the unaccompanied child because of the child'sprevious experiences. Furthermore, the result shows that the interviewees perceive their work with unaccompanied children who participative by letting the child take part of the information and by the child may share their opinions taken into account in the decision-making process.

Bakgrund: Det finns ett begränsat utbud av vetenskaplig forskning omrevisorsassistenter, men av tillgänglig forskning framgår att revisorsassistentergenomför en stor del av revisionens granskning. Okunskap om hur revisorsassistenternasjälva upplever sin arbetssituation - handlingsutrymme och comfort - motiverar vårstudie. Syfte: Syftet med vår uppsats är att utforska relationen mellan revisorsassistentersupplevda handlingsutrymme och comfort. Metod: För att uppnå vårt syfte utfördes tio semistrukturerade intervjuer. Åtta av dessaintervjuer utfördes med revisorsassistenter och två stycken med före dettarevisorsassistenter som lämnat yrket inom det senaste året. Slutsats: Vi kommer fram till att det framförallt är erfarenhet, personlighet ochstructure/kontroller som påverkar relationen mellan revisorsassistenters upplevdahandlingsutrymme och comfort / Background: The research regarding audit associates is limited, but available researchshows that audit associates perform a great deal of the audit. Our study is motivated bythe lack of research concerning the audit associates own experience of their worksituation, discretion and comfort. Purpose: To explore the relationship between audit associates perceived discretion andcomfort. Method: We performed ten semistructured interviews. Eight of these with auditassociates and two with former audit associates who left the occupation the latest year. Conclusion: We conclude that the main factors that affect the relationship betweenaudit associates perceived discretion and comfort is experience, personality andstructure/controls.

Motiverande samtal Inom Kriminalvården MIK : En kvalitativ studie om frivårdsinspektörers upplevelser av MIK

The purpose of this essay is to describe how probation service officers regard their professional role and their liberty of action within the motivational treatment program, MIK, and the probation organization. To answer the purpose three questions were formulated: 1) Does the probation service organization affect the individual discretion for the probation service officers, and in that case how? 2) Does the motivational treatment program, MIK, influence the probation officers’ professionalism and their professional role? 3) What advantages and disadvantages do the probation service officers consider MIK being related to? The method conducted in the study was interviews with five probation service officers in Stockholm. The interviews were combined with a theoretical framework based on themes as organization, professional role, professionalism and motivation. The result showed that probation officers consider themselves to have a relatively high discretion within their work. They also think that work with treatment programs generally increases their professionalism and it provides a more distinct professional role in meeting with clients. An advantage of MIK is that it is more suited to the client. A disadvantage is that it can be perceived as difficult to know how big effect the program will have in the long term.

Darbe formuluojama ginčų dėl nedidelių sumų nagrinėjimo sąvoka, pristatomi ir apibūdinami šios sumarinio proceso rūšies pagrindiniai procesiniai požymiai, uždaviniai bei tikslai. Analizuojant darbe keliamus klausimus pagrindinis tyrimo objektas buvo šiame procese pagrindinį vaidmenį atliekantis teismas, įstatymų jam suteikta prerogatyva šio proceso atžvilgiu. Autorius analizuoja Lietuvos Respublikos Civilinio proceso kodekse įtvirtintas bylinėjimosi ginčų dėl nedidelių sumų formas ir daro prielaidą, jog šios rūšies procese įstatymo leidėjas teismui suteikia per didelę prerogatyvos teisę. Atsižvelgiant į tai, jog pastarasis procesas laikytinas bylinėjimosi forma, kuria siekiama greitesnio nei įprasta bylos išnagrinėjimo ir nereikalaujama tokio bylos aplinkybių ištyrimo laipsnio, koks yra būtinas nagrinėjant bylas bendrąja ginčo teisena dar nereiškia, jog šalims neturi būti suteikta atstovavimo teisė, ribojama teisė būti išklausytam. Tačiau įvertinant tai, jog yra suteikta galimybė surašyti trumpesnį, supaprastintos formos sprendimą, kuris palengvina teismo bei pagalbinio personalo darbą, nestabdo civilinės apyvartos ilgais bylinėjimosi laikotarpiais ir yra veiksminga proceso koncentruotumo priemonė, teismas savo nuožiūra galėtų ir turėtų labiau populiarinti bei praktikuoti šį civilinio proceso kodekse reglamentuojamą ginčų sprendimo būdą. / In the work Small claims litigation: does the implementation of the Court’s discretion have limits? the conception of Small claims litigation is formulated, the main attributes, goals and objectives of this sort of summary process are determined and described. When analyzing the problems, raised in this work, the main object of the research became the Court, which plays the leading role in this process due to prerogative power, given by the law. The author of this work analyzes the different forms of Small claims litigation, established in the Civil Process Code of the Republic of Lithuania, and makes an assumption that in this sort of process the prerogative power given to the Court by legislative bodies is excessive. Although the process in question is regarded to as a form of litigation, which is used to speed up investigation of a case without requiring the level of fact-finding as high as it is necessary in cases of common legal proceedings, it does not mean that the parties’ should not be given the right to be represented, or their right to be heard should be limited. Considering the fact, that the opportunity has been given to draw up a more concise and streamlined solution, which would facilitate the work of the Court and ancillary staff, would not impede civil turnover with long litigation periods, and would be a good measure of process concentration, the Court at its discretion should put more efforts popularizing and practicing this method of dispute procedure... The aim with our study has been to examine how preschool-staffs resonate about the notification requirements according to Chapter 14, section 1, The Social Services Act, when a child fare badly or is suspected to fare badly: first, in relation to the municipality´s policies, but also in relation to the preschool staff´s actions in individual cases. Our study was conducted by qualitative research with semi-structured interviews. Total has two child´s nurses and six preschool-teachers, active within Växjö´s municipality, been interviewed. The result showed that the municipality´s guidelines on the one hand, underpinned by giving a prescribed pattern of behavior for preschool staff on how to act if the suspected that a child to fare badly. On the other hand preschool staff also experienced the guidelines diffuse as there were nothing described of the transition of how much they should document and observe before a notification could be initiated to the headmaster. Noteworthy was that the munici-pality´s guidelines in this case was inconsistent with the provision in Chapter 14, section 1, The Social Service act. A report should be made immediately. In addition, the preschool-staff could not establish a notification, just initiate it to the headmaster, which is also contrary to the statutory provisions. Furthermore the result showed that the preschool-staff experienced more disadvantages than advantages with the duty to report. The results also showed that the preschool staff´s actions were influenced off various circumstances. The behavior before initiating a notification to the headmaster showed to differ in individual cases. This confirms the preschool-staffs personal discretion even though the duty to report prevails.

Guaranteed cohabitation of elderly couples is a new law that gives elderly couples the right to live together in special housing. Even if only one of the spouses has an administrator’s decision to live in special housing. The aim of this study is to describe and understand how three municipalities materialize the social rights guaranteed for the elderly couples’ cohabitation. This qualitative study is based on four semi-structured interviews and official documents. Those who participated in the study work as various officials and the aim of the interviews were to find out how the officials work and offer the guaranteed cohabitation of elderly couples in their community.  The results of the study show that the officials have a good discretion when it comes to working with the guaranteed cohabitation of elderly couples. Although the guarantee cohabitation of elderly couples gives elderly couples the right to live together. There are not any rules or guidelines to how the rights should be implemented. So each municipality can decide for themselves how they want to provide elderly couples cohabitation.
