L’implication des enfants en médiation familiale : le point de vue et l’expérience des parents dans un contexte de partage des responsabilités parentales

Cette recherche, de type exploratoire et descriptif, s’intéresse à l’expérience et au point de vue des parents à l’égard de l’implication directe de leurs enfants en médiation familiale. La méthodologie privilégiée pour réaliser cette étude est qualitative, et la perspective théorique utilisée est la phénoménologie. L’échantillon est constitué de huit parents, tous ayant participé à une entrevue semi-dirigée au sujet de l’implication de leurs enfants dans le processus de médiation familiale. Les données ont été recueillies entre le mois de mai et octobre 2013, et ont été analysées en s’appuyant sur la méthode d’analyse de contenu telle que proposée par L’Écuyer (1990) ainsi que Mayer et Deslauriers (2000). Il ressort de cette recherche que l’implication directe des enfants en médiation familiale a une influence considérable sur le processus. En effet, la majorité des participants de la présente étude ont rapporté que l’implication de leurs enfants a été déterminante afin de conclure une entente au sujet du partage des responsabilités parentales. Aussi, les résultats suggèrent que la majorité des participants ont vécu de manière positive la participation de leurs enfants et sont satisfaits des retombées de l’implication. Par contre, quelques parents ont vécu de manière négative cette expérience. De tels résultats mettent en lumière les limites et risques liés à l’implication directe des enfants en médiation familiale. De plus, les modalités d’implication choisies par les médiateurs familiaux semblent avoir influencé le vécu des parents et de leurs enfants dans le processus. Les résultats donnent également accès à la perception des parents au sujet du vécu de leurs enfants avant, pendant et après le processus d’implication. Une suggestion qui émane de cette recherche est que l’enfant, bien qu’amené à prendre parole dans la médiation familiale, ne doit pas être tenu responsable d’une décision liée au partage des responsabilités parentales. Les conclusions de ce mémoire alimentent une stratégie en médiation familiale qui est peu documentée à partir de l’expérience et du point de vue des parents. / This exploratory and descriptive research focuses on the experience and perspective of parents with regard to the direct participation of children in family mediation. To carry out this study, a qualitative research method was used and the phenomenology theoretical perspective was chosen. The sample consists of eight parents, all who participated in a semi-structured interview on the involvement of their children in family mediation. Data was collected between May and October 2013, and was analyzed based on the content analysis method as proposed by L'Ecuyer (1990) and Mayer and Deslauriers (2000). It is clear from this research that the direct involvement of children in family mediation has considerable influence on the process. Indeed, the majority of participants in this study reported that their children’s involvement was crucial to reach an agreement about shared parenting. Also, the results suggest that the majority of participants had positively experience the participation of their children and were satisfied with the benefits of the involvement. However, some parents lived this experience in a negative way. Those results highlighted the limitations and hazards associated with the direct involvement of children in family mediation. The terms of involvement chosen by family mediators also appeared to have influenced the experiences of parents and their children in the process. The results of this research provide access to the perception of parents about their children’s experiences before, during and after the process. A suggestion that comes from this study is that the child, although brought to give an opinion in family mediation, should not be held responsible for any decision related to shared parenting, for example the choice of care arrangements. The conclusions of this paper feed a family mediation strategy that is poorly documented from the point of view and experience of parents.

L’intervention en médiation familiale en présence de violence conjugale : dépistage, pratiques d’intervention, défis et préoccupations

Au Québec, la médiation familiale en contexte de violence conjugale est controversée, mais la pratique est très peu documentée et est donc mal connue. L’objectif principal de ce mémoire est de comprendre comment les médiateurs familiaux composent avec la présence de violence conjugale dans le cadre de leur pratique. Les objectifs spécifiques sont les suivants : (1) connaître comment les médiateurs familiaux dépistent la violence conjugale ; (2) savoir comment ils interviennent en présence de violence conjugale une fois cette violence dépistée ; et (3) identifier les défis et les préoccupations rencontrées par les médiateurs dans ces dossiers. Cette étude qualitative fut menée auprès de 8 médiateurs issus des domaines juridique et psychosocial. Les participants furent rencontrés dans le cadre d’entrevues semi-dirigées. Les médiateurs rencontrés insistent sur l’importance d’offrir une formation avancée portant sur la problématique de la violence conjugale et sur les outils de dépistage à tous les médiateurs au Québec et de bonifier la formation actuelle en adressant la dangerosité, le risque de récidive et d'aggravation de la violence et l’appréciation du risque d’homicide conjugal. Les résultats de l’étude suggèrent également l’importance de bien différencier le terrorisme conjugal de la violence situationnelle et de mettre en place des pratiques d’interventions spécifiques à chacun de ces types de violence. La médiation familiale en présence de violence conjugale devrait être un champ de pratique spécialisé et le travail de collaboration avec les ressources spécialisées en violence conjugale nécessiterait d’être renforcé. / In Quebec, family mediation cases regarding domestic violence are controversial, and the interventions used are not well documented or known. The main purpose of this thesis is to understand how family mediators deal with cases of domestic violence within their own practice. The specific research goals include the following: (1) understanding how family mediators screen for domestic violence; (2) learning how they intervene in domestic violence cases, once they have been identified; and, (3) identifying the challenges and concerns the mediators face when working with these cases. This qualitative study was conducted with eight mediators from the psychosocial and legal fields. Semi-constructed interviews were conducted with these participants. Those interviewed brought forth the importance of offering in-depth advanced training regarding domestic violence and screening tools to all mediators across Quebec and to add to the current training by addressing the issues of dangerousness, the risk of recurring or increase of domestic violence, as well as the evaluation of risk for spousal homicide. The results of this study also demonstrate the importance of distinguishing between intimate terrorism and situational couple violence, as well as the implementation of best intervention practices specific to each type of violence. Family mediation that includes the presence of domestic violence cases should be a specialized field of practice that promotes collegial collaboration in order to access pertinent and useful resources.

This thesis is a theoretical study that characterizes shared childcare after divorce as the most suitable post-divorce arrangement. This assumption is based on developmental changes in the European family from the time of the French Revolution, the development of family law and important aspects of family law, as well as on the needs of children, and definitions of maternal and paternal love. This hypothesis is also supported by the results of foreign research, which compares the lives of children in different post-divorce arrangements. The following paper discusses mediation as an appropriate way of helping parents achieve a solution that is suitable for all participants in the dispute. In the conclusion some case studies are presented.

The study had four moments: in the introduction, we indicate the objectives and the motivations for the investigation of this theme. In the second moment, we discuss the constitution of contemporary families and their challenges, ranging from the historical aspects of family formation to the analysis of the importance of the State and Social Policies focused on the family. In the third, we treat Mediation as a way of access to justice, where the main concepts were approached; its use in other countries, as well as the importance of mediation as Public Policy in the perspective of Family Law. At the end, we locate the Comarca de Pelotas; the scope of the research; the data collected with the blog of the Judicial Center for Conflict Resolution and Citizenship (CEJUSC) and also the subjects of the research that were composed of mediators and a Magistrate of the same Region, as well as reflect the use of mediation in contemporary cases. The methodological paths adopted for this research were bibliographic, documentary and questionnaire application with open and closed questions analyzed under content analysis and organized into graphs. The subjects of the research were seven (7) mediators of CEJUSC and one (1) magistrate acting in cases of family mediation between August 2016 and August 2017 in the city of Pelotas. The results obtained through the investigation indicated the need to recognize family mediation as an instrument of Access to Justice and Public Policy, since it is not widely publicized and has no financial incentive from the State and the Court of Justice, nor from the of lawyers for its use, thus not preventing further prosecution. The survey found that Pelotas has two units of CEJUSC acting and the most recurring cases are linked to divorce, child support and child custody. However, there is a need for greater investment by the State to implement and recognize this Policy / A presente pesquisa analisou a utilização da Mediação Familiar e sua relação com a Política Pública na cidade de Pelotas. O estudo teve quatro momentos: na introdução, indicamos os objetivos e as motivações para a investigação dessa temática. No segundo momento, discorremos sobre a constituição das famílias contemporâneas e seus desafios que irão, desde os aspectos históricos sobre a formação das famílias, até a análise da importância do Estado e de Políticas Sociais focalizadas na família. No terceiro, tratamos a Mediação como via de acesso à justiça, onde se abordou os principais conceitos; sua utilização noutros países, bem como a importância da mediação como Política Pública na perspectiva do Direito de Família. Ao final, situamos a Comarca de Pelotas; o âmbito de abrangência da pesquisa; os dados coletados junto ao blog do Centro Judiciário de Solução de Conflitos e Cidadania (CEJUSC) e também aos sujeitos da pesquisa que foram compostos de mediadores e um Magistrado da mesma Comarca, bem como refletimos o uso da mediação nos casos contemporâneos. Os caminhos metodológicos adotados para esta pesquisa foram levantamento bibliográfico, documental e aplicação de questionário com perguntas abertas e fechadas analisadas sob análise de conteúdo e organizadas em gráficos. Os sujeitos da pesquisa foram sete (7) mediadores do CEJUSC e um (1) magistrado atuantes nos casos de mediação familiar entre agosto de 2016 a agosto 2017 na cidade de Pelotas. Os resultados obtidos através da investigação indicaram a necessidade do reconhecimento da mediação familiar como um instrumento de Acesso à Justiça e Política Pública, pois o mesmo é pouco divulgado e não possui incentivo financeiro por parte do Estado e do Tribunal de Justiça, e tampouco por parte dos advogados para a sua utilização, não evitando, consequentemente, que mais processos sejam judicializados. A pesquisa constatou que Pelotas possui duas unidades do CEJUSC atuantes e os casos mais recorrentes estão ligados ao divórcio, pensão alimentícia e guarda de filhos. Contudo, há necessidade de maior investimento por parte do Estado para efetivação e reconhecimento desta Política.

Disputed custody and the people involved : an ecosystemic perspective

Custody disputes have traditionally been considered a legal matter. More recent trends have seen the recognition of divorce and custody as both legal and psychological events. This necessitated the involvement of professionals of the helping services in custody recommendations. Such a multidisciplinary approach is currently taken by the Office of the Family Advocate, Pretoria, in disputed custody matters. It is suggested that the way in which the problem of custody is currently defined, is on a pragmatic level, and does not include a higher-order awareness as implied by an ecosystemic epistemology. Such an awareness denotes self-reflexivity, and calls for a more aesthetic emphasis. The dialectic between aesthetics and pragmatics is maintained by means of a descriptive look at the various systems involved in a disputed custody case. Adopting an ecosystemic epistemology is recommended, through the metaphor of mediation, as a further evolution of an already changing process. / Psychology / M.A. (Clinical Psychology)

Les modes alternatifs de règlement des litiges en matière familiale se développent considérablement en droit français. Divers types ont pu être observés : médiation familiale, droit collaboratif, ou encore convention de procédure participative. Cette étude a pu mettre en évidence que le droit substantiel de la famille donne une consistance particulière aux modes alternatifs qui y sont concevables. Ils se détachent d’un droit commun des modes alternatifs pour s’émanciper et devenir autonome. Les modes alternatifs de règlement des litiges donnent un cadre structuré de négociation aux membres de la famille. Toutefois, il existe certaines normes impératives dont les individus ne peuvent s'écarter dans leurs conventions, des principes considérés comme fondamentaux qui imposent d’encadrer la volonté privée : le rôle du juge est irréductible en droit de la famille / Alternative forms of litigation settlement in familial matters have been considerably developing in French law. Several of them now exist: familial mediation, collaborative law, or participative procedure convention. This study has shown that substantial law of family gives particular consistency to the alternative forms that are subject to it. They detach themselves from common law alternative forms of settlement and have become autonomous. Alternative forms of litigation settlement give a structured framework to the negotiations between family members. However, individuals are not exempt from several imperative norms in their convention, principles that are considered as fundamental and which dictate that private will be ruled: the judge's role is irreducible in family law

Dentro da perspectiva dos estudos da Linguística Aplicada de base Interacional, objetivamos compreender como essa atividade profissional é organizada, tendo em vista os discursos ali construídos. O contexto jurídico e a mediação familiar ganham destaque nesta pesquisa, considerando a ênfase dada às formas alternativas de resolução de controvérsias no Brasil, que culminaram na promulgação da Lei da Mediação e nas disposições sobre mediação e conciliação no Código de Processo Civil, respectivamente, em vigor, a partir de 2015 e 2016. Na tentativa de pensar a vida social considerando o ponto de vista daqueles que, em geral, não têm voz nas pesquisas acadêmicas (MOITA LOPES, 2006), realizamos um estudo qualitativo e interpretativo (DENZIN; LINCOLN, 2000), no qual as identidades, dos participantes- construídas discursivamente -, são os norteadores para as análises depreendidas. Os dados de mediação retratados nesta pesquisa são dados reais de fala-em-interação, gerados em uma Vara de Família do Fórum de uma cidade do interior do estado do Rio de Janeiro, no ano de 2008. Os dados foram gravados em áudio e, em seguida, transcritos de acordo com o modelo Jefferson de transcrição (LODER, 2008). Como resultados do trabalho, foram encontradas, após o mapeamento das entrevistas de pré-mediação, cinco fases referentes ao tipo de atividade em análise, quais sejam: “Esclarecendo as Regras do Jogo”, “Conhecendo os Participantes”, “Historiando os Conflitos”, “Entendendo o Processo” e “Combinando a Próxima Etapa”. Tais fases apresentam características distintas compostas de ações específicas dos participantes. A compreensão acerca das fases pode contribuir para a profissão do mediador e, em uma instância mais ampla, para os usuários do sistema judiciário brasileiro, oferecendo subsídios para um fazer profissional que compreenda a mediação como um espaço pedagógico de prevenção de conflitos, a fim de que os participantes dessa atividade de fala possam se tornar protagonistas de suas decisões e, com isso, lidar com as questões conflituosas, as quais precisarão passar ao longo de suas vidas social e familiar. / This paper presents a proposal for mapping the phases of the communicative activity pre-mediation interview. Within the perspective of the studies of Applied Linguistics Interational basis, aims to understand how this professional activity is organized, in view of the speeches built there. The legal context and family mediation are highlighted in this study, considering the emphasis given to alternative forms of dispute resolution in Brazil, which culminated in the promulgation of the Mediation Law and the provisions on mediation and conciliation in the Civil Procedure Code, respectively, in 2015 and 2016. In the attempt to think social life considering the point of view of those who, generally, do not have voice in academic research (MOITA LOPES, 2006), a qualitative and interpretative study is carried out (DENZIN; LINCOLN, 2000), in which the identities, of the participants – constructed discursively –, are the guiding principles for the analyzed analyzes. The data of mediation portrayed in this research are real speech-in-interaction data, generated in a Family Court of the Forum of a city in the interior of the state of Rio de Janeiro, in the year 2008. The data were recorded in audio and, And then transcribed according to the Jefferson transcription model (LODER, 2008). As a result of the study, five phases were analyzed, after the pre-mediation interviews were mapped: "Clarifying the Rules of the Game", "Knowing the Participants", "Storing Conflicts", "Understanding the Process" and "Combining the Next Step." These phases present distinct characteristics composed of specific actions of the participants. The understanding of the phases can contribute to the profession of the mediator and, in a broader instance, to the users of the Brazilian judicial system, offering subsidies for a professional doing that understands mediation as a pedagogical area of conflict prevention in order to That the participants in this speech activity can become protagonists of their decisions and thereby deal with the conflicting issues that they will need to pass through in their social and family lives.

Text in Afrikaans / Globally divorce is an increasing phenomenon. If not handled correctly it may be significantly destructive for the people involved. The new Children’s Act, Act 38 of 2005 regards the best interests of the child paramount in all matters concerning the care, protection and well-being of a child. It underpins the importance of the full, or specific parental responsibilities of parents, the importance of a conciliatory and non-confrontational approach to the settlement of child-centred disputes. It also mandates that the child has the right to participate in an appropriate way in any matter concerning that child and that his views must be given due consideration. Further Act 38 of 2005, provides for parenting plans to be agreed upon determining the exercise of their respective responsibilities and rights. The goal of this research was to explore, develop and implement a process of family mediation with reference to Act 38 of 2005. Five families affected by divorce and their children were selected as case studies for qualitative research. Applied research was done within the context of intervention research and the first four phases of Rothman and Thomas’ Intervention Research model was used. Problems caused by divorce were identified and the goal was to address the best interests of the child by improving the co-parenting relationship, parent-child relationships and the quality of parenting. Information gathering and synthesis took place by using existing information sources, studying natural examples and identifying functional elements of successful models.An observational system was designed. It included the natural observing of the five case studies, specific procedural elements and intervention. Mariage et divorce : harmonisation des normes civiles et religieuses dans une perspective de droit préventif

Les couples mariés qui ont des convictions religieuses fortes doivent respecter deux ordres juridiques parallèles: l’ordre étatique et l’ordre religieux. Des conflits peuvent surgir entre ces deux ordres, notamment lors du divorce des parties. Une brève présentation du droit québécois du mariage et du divorce ainsi que des droits religieux catholique, musulman et juif permet d’effectuer des comparaisons entre ces droits et d’identifier un certain nombre de points de jonctions normatifs. Des voies permettant d’harmoniser les deux univers normatifs sont explorées, dans une perspective de droit préventif: l’adaptation du contrat de mariage civil et du processus de la médiation familiale et la rédaction des ententes entre conjoints. / Married couples with strong religious beliefs must respect two parallel legal orders : the state order and the religious order. Conflicts can arise between these two orders, in particular when the parties divorce. A brief presentation of Quebec’s marriage and divorce laws and catholic, muslim and jewish religious law allows comparison between these systems of law and reveal some normative jonction points. In a preventive law perspective, ways to harmonize these two normative universes are explored : arrangement of the civil marriage contract, of the family mediation’s processus and of the writing of the agreements between partners.

To the male parent it usually remained the right to biweekly "visits" and the child s financial support. This resulted in disencouraging the strengthening of the paternal-filial relationship. Thus, the aim of the thesis was to question whether the judicial decisions concerning the child arrangements order would effectively meet the child's best interest. Moreover, it questioned if these decisions are able to break the conflictual dynamics. The hypothesis is that in matters relating to family law and, more precisely, in the conflicts involving children and teenagers, the court decision is not the most appropriate way. The choice of the subject is justified given that currently the parental roles are no longer so strictly defined, with the women entering the labour market and, in parallel, the father's search for a more active role in their children's lives. Therefore, given the breakdown of the relationship of the parents, it must be chosen a family arrangement, covering the constitutional principles of the best interests of the child and responsible parenthood. This thesis was based in legislative, doctrinal and jurisprudential analysis, as well as a substantial part of its research conducted in England, where significant changes relating to parental responsibility have occured in recent years, which may be relevant to Brazil. The results of this study demonstrate the importance of using other means, not only the court for the maintenance and strengthening of emotional bonds due to the transformation of that nuclear family. In this sense, conflict mediation and collaborative practice can greatly assist parents in such troubled times that is the disruption of the relationship. This is another approach that seeks to focus on the responsibility of parents and common interests, rather than on the logic of seeking to blame the responsible for the relationship breakdown. Moreover, the mere enactment of laws on child arrangements order without a systemic change that involves society and the State will not provide representative advances / Na conjuntura das últimas décadas, observava-se que a guarda dos filhos era comumente determinada à mãe e ao pai somente em casos excepcionais. Ao genitor masculino cabia o direito quinzenal de visitas e o pagamento da pensão alimentícia. Isso acabava desestimulando o fortalecimento da relação paterno-filial. Diante disso, o objetivo da tese foi questionar se as decisões judiciais relativas à guarda dos filhos vão, efetivamente, ao encontro do melhor interesse da criança. E mais, se essas decisões são capazes de romper a dinâmica de conflito. A hipótese é que nas questões relativas ao Direito de Família e, mais precisamente, nos conflitos envolvendo crianças e adolescentes, a sentença judicial não é o caminho mais adequado. Justifica-se a escolha do tema, tendo em vista que atualmente os papéis parentais já não estão mais tão definidos, havendo a inserção da mulher no mercado de trabalho e, paralelamente, a busca do pai por uma participação mais ativa na vida de seus filhos. Por isso, diante da ruptura do relacionamento dos genitores, é preciso escolher um arranjo familiar que contemple os princípios constitucionais do melhor interesse da criança e da paternidade responsável. Essa tese contou com a apreciação normativa, doutrinária e jurisprudencial, além de pesquisas realizadas na Inglaterra, onde mudanças expressivas relativas à autoridade parental ocorreram nos últimos anos, as quais, este trabalho argumenta, podem ser relevantes para o Brasil. Os resultados desse estudo demonstram a importância da utilização de outros meios, que não somente o judicial, para a manutenção e fortalecimento dos laços afetivos diante da transformação do núcleo familiar.
