O situar-se explicitamente em uma área de concentração que interfaceia Filosofia e Educação caracteriza esta tese, desenvolvida a partir de estudos bibliográficos, essencialmente teóricos e subsidiariamente históricos, tomando como prioritárias as fontes primárias, especialmente as obras filosóficas de Enrique Dussel e de outros filósofos europeus e latinoamericanos por ele abordados. O autor em questão vem se dedicando desde a década de 1970 ao desenvolvimento de uma filosofia que guarde profunda relação com o contexto sóciohistórico latino-americano, tendo sua produção adquirido forma de uma filosofia da libertação. O esforço do presente trabalho destina-se, especialmente, à contribuição no sentido de sistematizar e melhor definir conceitos-chave desta expressão filosófica, em particular as noções de libertação, filosofia e metafísica esta estritamente compreendida como filosofia primeira. Para alcançar tais objetivos, o trabalho divide-se em duas partes, a primeira dedicada à explicitação dos fundamentos filosóficos, históricos e antropológicos da filosofia dusseliana, com destaque para sistematização esquemática e didática da original proposta de interpretação da história procedida pelo filósofo em estudo. Na segunda parte, são sistematizadas algumas das elaborações filosóficas próprias de Dussel, às quais se somam outras elaborações e, em menor escala, críticas procedidas pelo autor da tese. Nesta etapa, propõe-se a materialidade dos corpos, sua carnalidade concreta, como critério de validação dos processos de libertação almejados pela filosofia em questão. Para que possa contribuir factualmente com a libertação dos corpos, apresenta-se esta filosofia como uma pedagógica, que tenha a ética e não a ontologia como sua metafísica, sua filosofia primeira. Por fim, constam desta tese apontamentos iniciais sobre a política da libertação, atualmente em desenvolvimento pelo autor em referência, bem como a indicação de outros temas a serem desenvolvidos pelos interessados nesta problemática filosófica contemporânea. / The lie explicitly in an area of concentration that interfaces Philosophy and Education that characterizes this thesis, essentially theoretical and secondary historical, taking as priorities the primary sources, especially the philosophical works from Enrique Dussel and others Europeans and Latin Americans philosophers that he discusses. The author in question has been dedicating since 1970, to the development of a philosophy that keeps profound relation with the Latin America socio-historical context, having his works acquired form of a liberation philosophy. The effort of the present work intends, specially, to the contribution in a way to systematize and better define key-concepts of this philosophical expression, particularly the notions of liberation (freedom), philosophy and metaphysics this one strictly understood as first philosophy. To achieve these objectives, this work is divided in two parts, the first of which is dedicated to make explicit the basis of philosophic, historical and anthropological of dusselian philosophy, with emphasis on schematic and didactic systematization of the original proposal for the interpretation of history preceded by the philosopher in study. In the second part are systematized some of the philosophical elaborations specific from Dussel, which add others elaborations and to a lesser extent, reviews conducted by the author of the thesis. This step proposes the bodies materiality, its concrete carnality, as criteria for validation of the liberation processes sought by the philosophy in question. In order to contribute factually to the liberation of the bodies, presents this philosophy as a pedagogical, which has the ethics - and not the ontology - as its metaphysics, its first philosophy. Finally, included in this thesis notes on the early release policy, currently under development by the author in question, as well as the names of other themes to be developed by interested parties in contemporary philosophical issues.

The exteriority precisely, is regarded here as the main category of Marx's legacy and fundamental theoretical assumption, which enables the speech Dussel, especially in radical option for the victim, his philosophical thinking brand. Through this, here assumes the thesis that there is a partiality in Dussel by the victim: your thinking is built purposely in favor of the victim. The effort of this work is to show that the choice of the victim shall be the guiding principle for all their thinking as Philosophy of Liberation, through the Ethics and the Politics, coming to the bringing of an Economic Liberation. For this, as a strategic approach, the externality and liberation categories delineate the philosophical analysis to the necessary approach to their theme, by reading the major works of Dussel, in dialogue with the philosophy of praxis Marx. As an extension of the hypothesis proposed, it intends to show how the choice of victim charges the Philosophy of Liberation critical pretense of thought, from three perspectives: through an Ethics of Liberation, as a critical pretense of kindness, from a Politics of Liberation, guided by a political pretense of justice, and an Economy of Liberation, requiring an economic pretense of fairness. Thus, the philosophical work is challenged and provoked by the real need to assist the victim, a requirement of the Latin American people in their path of liberation. In terms of results, beyond the current importance of Marx's thought for the comprehension of reality and the critique of capitalism, emphasizes the relevance of the theoretical and practical of Dussel‟s thoughts to Political Philosophy as a whole, for their contributions in the contemporary scenario, the courage to point toward another society, trans-modern and trans-capitalist, already in progress in collective practices of Living Well. / Este estudo tem por objeto apresentar a Filosofia Política Crítica da Libertação em Enrique Dussel, analisando sua gênese e evolução e mostrando a influência decisiva da filosofia da práxis de Karl Marx para esse pensamento, em especial a partir do conceito de exterioridade, entendida como sendo o âmbito onde o outro se revela, onde permanece livre em seu ser distinto. A exterioridade, precisamente, é tida aqui como a categoria principal do legado marxiano e pressuposto teórico fundamental, que viabiliza o discurso de Dussel, sobretudo na opção radical pela vítima, marca de seu pensamento filosófico. Mediante isso, aqui se assume a tese de que há em Dussel uma parcialidade pela vítima: seu pensamento está construído, propositalmente, em favor da vítima. O esforço deste trabalho é o de mostrar que a opção pela vítima será o fio condutor de todo seu pensar enquanto Filosofia da Libertação, passando pela Ética e pela Política, chegando à propositura de uma Economia da Libertação. Para isso, como estratégia de abordagem, as categorias exterioridade e libertação balizam a análise filosófica para a aproximação necessária com o tema investigado, através da leitura das principais obras de Dussel, em diálogo com a filosofia da práxis de Marx. Como desdobramento da hipótese levantada, intenciona-se mostrar como a opção pela vítima cobra da Filosofia da Libertação uma pretensão crítica de pensamento, sob três perspectivas: através de uma Ética da Libertação, enquanto pretensão crítica de bondade; de uma Política da Libertação, guiada por uma pretensão política de justiça; e de uma Economia da Libertação, exigindo uma pretensão econômica de equidade. Assim, o labor filosófico é desafiado e provocado pela necessidade real de auxiliar a vítima, exigência do povo latino-americano em seu caminho de libertação. Em termos de resultado, para além da importância atual do pensamento marxiano para a compreensão da realidade e a crítica ao capitalismo, ressalta-se a relevância teórico-prática do pensamento dusseliano para a Filosofia Política como um todo, pelas suas contribuições no cenário contemporâneo, pela coragem em apontar em direção a outra sociedade, trans-moderna e trans-capitalista, já em curso nas práticas coletivas de Bem Viver.

The relevance of the research is justified primarily as a theme that Dussel addressed in his Philosophy of Liberation emphatically in the 1970s, not exploring it later in the course of his work, which constitutes an internal redemption in the work of the author. The social relevance that the work brings is related to the world reality faced by men, transsexuals, lesbians and people in general who are oppressed by the exclusionary and heteronormative chauvinist system. The central problem of the research was: how from the carnality (corporal relation) can one project the liberation? The development took place in four chapters that sought to embrace the problematic, at different times laying the groundwork to answer it. The methodology used was the bibliographical research of the Philosophy of Liberation, feminist thought and distinct corporeal identities. The first chapter aimed, through Dussel's methodology, to establish an analytical starting point (starting from the victim of the erotic relation) in order to project its liberation. Already in this chapter the approach of eroticism occurred beyond the man-woman relationship (predominant in Dusselian thought). The second chapter aimed to trace a history of Dussel's thinking about erotica, specifically, in the male-female relationship. The separation was done for didactic purposes, since, there are specifics in affective relationships that can not be treated under the same nickname. Some questions are hormonal, psychic or biological have their specifics, and therefore need to be worked in different ways. The third chapter dealt with the material ethics of Dussel, widely discussed in Ethics of Liberation (1998). As the theme of research is erotic the content of ethics has been worked around the flesh (body) in relationships involving erotica. Initially the formation of ethical and moral conscience was distinguished from the biological and neurological exposition that Dussel made in the first hundred pages of the work. Then it was tried to treat how the body constitutes itself as content of the ethics and which the ways for its liberation. The last chapter dealt, for the most part, with homosexual erotic in some of its variants and the relation that Dussel established with the feminist thought, especially, of years 1960-70. The consideration of feminism was only an appendix which sought to warn of the danger that in the name of the rupture with an oppressive Totality one might construct another equally oppressive Totality. In the case of homosexual erotic some relationships were punctuated from their specificities and it was noticed that the question is object of several discussions that gain different day to day, so much that, in what matter of months or of few years some approaches or categories have become obsolete and / or have reached new contours. It was concluded that the carnal liberation begins by the awareness of the victim of oppression from its distinction in relation to the oppressive heteronormality. / O tema da pesquisa foi a erótica e a libertação carnal (corporal) a partir do pensamento de Enrique Dussel. A relevância da pesquisa se justifica primeiramente por ser um tema que Dussel abordou em sua Filosofia da Libertação de maneira enfática na década de 1970, não o explorando, posteriormente, no decorrer de sua obra, o que configura um resgate interno na obra do autor. A relevância social que o trabalho traz relaciona-se com a realidade mundial enfrentada por homem, transexuais, lésbicas e pessoas em geral que são oprimidas pelo sistema machista excludente e heteronormativo. A problemática central da pesquisa foi: como a partir da carnalidade (relação corporal) pode-se projetar a libertação? O desenvolvimento se deu em quatro capítulos que buscaram abarcar a problemática, em momentos distintos lançando bases para respondê-la. A metodologia utilizada foi a pesquisa bibliográfica da Filosofia da Libertação, pensamento feminista e identidades corporais distintas. O primeiro capítulo visou, através da metodologia de Dussel, estabelecer um ponto de partida analético (partindo da vítima da relação erótica) para se projetar sua libertação. Já nesse capítulo a abordagem da erótica deu-se para além da relação varão-mulher (predominante no pensamento dusseliano). O segundo capítulo visou traçar um histórico do pensamento de Dussel sobre a erótica, especificamente, na relação varão-mulher. A separação foi feita para fins didáticos, uma vez que, há especificidades nas relações afetivas que não conseguem ser tratadas sob a mesma alcunha. Algumas questões sejam de ordem hormonal, psíquica ou biológica possuem suas especificidades, e por isso necessitam ser trabalhadas de formas distintas. O terceiro capítulo tratou da ética material dusseliana amplamente exposta em Ética de la Liberación (1998). Como o tema da pesquisa é a erótica o conteúdo da ética foi trabalhado em torno do carne (corpo) nas relações que envolvem a erótica. Inicialmente pontuou-se a formação da consciência ética e moral partido da exposição biológica e neurológica que Dussel fez na primeira centena de páginas da obra. Em seguida buscou-se tratar como o corpo constitui-se como conteúdo da ética e quais os caminhos para sua libertação.O último capítulo tratou, em sua maior parte, da erótica homoafetiva em algumas de suas variantes e da relação que Dussel estabeleceu com o pensamento feminista, sobretudo, dos anos 1960-70. A ponderação sobre o feminismo foi somente um apêndice que visou alertar para o perigo de em nome da ruptura com uma Totalidade opressora construir-se outra Totalidade igualmente opressora. No caso da erótica homoafetiva algumas relações foram pontuadas a partir de suas especificidades e notou-se que a questão é objeto de várias discussões que ganham a cada dia contornos diferentes, tanto que, em que questão de meses ou de poucos anos algumas abordagens ou categorias tornaram-se obsoletas e/ou atingiram novos contornos. Concluiu-se que a libertação carnal inicia-se pela tomada de consciência da vítima da opressão a partir de sua distinção em relação à heteronormalidade opressora.

O caso da Vila Itália : direito como luta e práxis transformadora /

Orientador: David Sanchez Rubio / Resumo: Vila Itália. Vila chamada de Vila que é favela. Situa-se em São José do Rio Preto, no estado de São Paulo, sendo uma das cidades mais ricas do Brasil. São José do Rio Preto viveu um boom imobiliário, e para a construção muitos de fora vieram. Acabou o boom, e estourou o ‘problema’ da cidade: aquelas pessoas que eram de fora, que eram os outros, que se tornaram ninguneados, foram jogados à própria sorte. O estudo versa sobre os direitos humanos fundamentais, aqui especificamente do direito social à moradia, mostrando-se desde como que a moradia alçou o status de direito fundamental, passando-se ao estudo de caso da Vila Itália, feito a partir de entrevistas narrativas, de observação e de pesquisa bibliográfica e encerrando-se com um pequeno aprofundamento nas questões econômicas, políticas e filosóficas que envolvem o tema. O fundamento se dá através do materialismo-histórico dialético, que fundamenta também a Teoria Crítica do Direito, base da pesquisa. Em tempos sombrios como os que se vive na atualidade, o tema tem grande pertinência, pois se vive num momento do neoliberalismo que expõe por onde passa a intenção de desconstruir, negativamente, todos os direitos sociais arduamente conquistados e que tão pouco foram efetivados. Discute-se, através da Filosofia da Libertação e da ética da alteridade, o próprio papel do direito, e a quem ele serve. Como resultado, tem-se mais de 15 entrevistas feitas e transcritas, um processo judicial analisado integralmente, a história da cid... It is located in São José do Rio Preto, city in the state of São Paulo, being one of the richest cities in Brazil. São José do Rio Preto experienced a real estate boom, and for construction many outsiders came. The boom was over, and the city's 'problem' broke out: those outsiders, the others, who became ninguneados, were thrown to their own devices. The study deals with the fundamental human rights, specifically here the social right to housing, showing from how the housing raised the status of fundamental right, turning to the case study of Vila Itália, made from narrative interviews, observation and bibliographical research and ending with a little deepening in the economic, political and philosophical questions that involve the subject. The foundation is through dialectical historical materialism, which also underlies the Critical Theory of Law, which is also the basis of research. In dark times, such as those currently being lived, the theme has great relevance, since it is lived in a moment of neoliberalism that exposes where it intends to deconstruct, negatively, all the hard-won social rights that were so little realized. Through the Philosophy of Liberation and the ethics of otherness, the very role of law, and its servant, is discussed. O objetivo deste trabalho é apresentar as duas principais categorias presentes na filosofia de Leopoldo Zea: circunstância e mestiçagem, buscando elementos que possam contribuir para o pensamento educacional. O pensamento de Leopoldo Zea, filósofo mexicano do século XX, está na base da Filosofia da Libertação e iniciou suas pesquisas com o objetivo de compreender o homem a partir de sua realidade mais próxima, o México. Entende o homem como pessoa concreta, de carne e osso, inserido em suas circunstâncias, com as quais dialoga de maneira dialética: transforma-as, ao mesmo tempo, que é transformado por elas. As circunstâncias constituem sua situação vital, nas quais manifesta sua concretude e expressa sua liberdade. O homem é concebido como um ente histórico que participa da tripla dimensão temporal (passado-presente-futuro) e constrói a história à medida que enfrenta os problemas apresentados pelas circunstâncias. Sob essa perspectiva, busca a identidade do homem latinoamericano que deve se compreender como mestiço e reconhecer sua condição de dependência sócio-cultural para que possa iniciar um processo de libertação de qualquer situação de opressão. A libertação do homem de seu estado de dependência sócio-cultural só é possível através da compreensão histórica e do conhecimento de si mesmo. Daí decorre a proposta de que educar é formar homens livres, exigindo-se uma educação crítica e popular que dialogue com a realidade concreta. / The aim of this dissertation is to show the two main categories present in the philosophy of Leopoldo Zea: circumstance and miscegenation, seeking evidence that could contribute to the educational thought. Thought of Leopoldo Zea, Mexican philosopher of the twentieth century is the basis of Philosophy of Liberation and began his research with the aim of understand the man from his reality more closer, the Mexico. Does the man can as a concrete person, of flesh and bone, inserted in their circumstances, with which dialogue dialectically: it transforms them at the same time, which is transformed by them. The circumstances are their life situation, in which he demonstrates their concreteness and express their freedom. The man is conceived as a historical entity that participates in the triple temporal dimension (past-presentfuture) and builds the history as it faced the problems presented by the circumstances. From this perspective, search the identity of the Latin American man who must understand how mestizo and recognize his condition dependency socio-cultural so he can begin a process of release of any situation of oppression. The liberation of man from his reliance on sociocultural is only possible through the historical understanding and knowledge of oneself. Hence the proposition that education is to train men free, requiring a critical and popular education to dialogue with the concrete reality

It brings it as a hypotheses that liberation philosophy can help in the construction of this autonomy. The aim is to research how teachers who are teaching from the liberation philosophy perceive the pedagogical task of developing autonomy with their students, and to what extent and how the practice of these teachers can bring future contributions for the teaching of Philosophy itself. It discusses possible contributions of liberation philosophy to the promotion of autonomy of high school students. In this sense it is justified by the existing relationship between liberation philosophy and the critical theories of curriculum with the freirean project of education as a process of liberation. For the elaboration of this dissertation, the argumentative movement started with the resumption of the historical trajectory of education in Brazil with emphasis on High School, with critical analysis of the tactics that help the understanding of current problems of High School. It was developed in continuity to the analysis of the traces of youth in a dialogue with several areas of knowledge. Analysis were carried out about theories of curriculum and focus was given on the positions brought by Michael Apple. There is in the dissertation a constant dialogue between the perspectives of Dussel and Freire, being listed moments in which Dussel takes Freire as a basis for reflection. Finally, it is given the content analysis of the interviews granted by teachers with experience in philosophy teaching in High School who work based on critical theories in a more specific philosophy of liberation / Esta dissertação parte do problema da recorrente dificuldade de desenvolvimento da autonomia dos estudantes no Ensino Médio. Traz como hipótese que a filosofia da libertação pode ajudar na construção dessa autonomia. O objetivo geral é pesquisar como os professores que estão lecionando a partir da filosofia da libertação percebem essa tarefa pedagógica de formação da autonomia dos jovens e em que medida e como as práticas desses professores podem trazer contribuições futuras para o ensino de Filosofia. Discorre sobre as possíveis contribuições da filosofia da libertação para a promoção da autonomia dos estudantes do Ensino Médio. Ela se justifica pela relação existente entre a filosofia da libertação e as teorias críticas do currículo e com a concepção freireana de educação como processo de libertação. Para a elaboração desta dissertação o movimento argumentativo se deu a partir da retomada da trajetória histórica do Ensino no Brasil com destaque ao Ensino Médio, com análises críticas sobre os processos que ajudam a entender os atuais problemas do Ensino Médio. Desenvolveu-se em continuidade a análise dos traços das juventudes num diálogo com várias áreas do conhecimento. Foram elaboradas análises sobre as teorias do currículo e se deu foco às posições trazidas por Michael Apple. Há na dissertação um diálogo constante entre as perspectivas de Dussel e Freire, sendo elencados momentos em que Dussel toma Freire como base de reflexão. Por fim, dá-se a análise de conteúdo das entrevistas concedidas por professores com experiência no ensino de filosofia no Ensino Médio e que trabalhem pautados nas teorias críticas, de forma mais específica a filosofia da libertação

O objetivo deste trabalho é apresentar as duas principais categorias presentes na filosofia de Leopoldo Zea: circunstância e mestiçagem, buscando elementos que possam contribuir para o pensamento educacional. O pensamento de Leopoldo Zea, filósofo mexicano do século XX, está na base da Filosofia da Libertação e iniciou suas pesquisas com o objetivo de compreender o homem a partir de sua realidade mais próxima, o México. Entende o homem como pessoa concreta, de carne e osso, inserido em suas circunstâncias, com as quais dialoga de maneira dialética: transforma-as, ao mesmo tempo, que é transformado por elas. As circunstâncias constituem sua situação vital, nas quais manifesta sua concretude e expressa sua liberdade. O homem é concebido como um ente histórico que participa da tripla dimensão temporal (passado-presente-futuro) e constrói a história à medida que enfrenta os problemas apresentados pelas circunstâncias. Sob essa perspectiva, busca a identidade do homem latinoamericano que deve se compreender como mestiço e reconhecer sua condição de dependência sócio-cultural para que possa iniciar um processo de libertação de qualquer situação de opressão. A libertação do homem de seu estado de dependência sócio-cultural só é possível através da compreensão histórica e do conhecimento de si mesmo. Daí decorre a proposta de que educar é formar homens livres, exigindo-se uma educação crítica e popular que dialogue com a realidade concreta. / The aim of this dissertation is to show the two main categories present in the philosophy of Leopoldo Zea: circumstance and miscegenation, seeking evidence that could contribute to the educational thought. Thought of Leopoldo Zea, Mexican philosopher of the twentieth century is the basis of Philosophy of Liberation and began his research with the aim of understand the man from his reality more closer, the Mexico. Does the man can as a concrete person, of flesh and bone, inserted in their circumstances, with which dialogue dialectically: it transforms them at the same time, which is transformed by them. The circumstances are their life situation, in which he demonstrates their concreteness and express their freedom. The man is conceived as a historical entity that participates in the triple temporal dimension (past-presentfuture) and builds the history as it faced the problems presented by the circumstances. From this perspective, search the identity of the Latin American man who must understand how mestizo and recognize his condition dependency socio-cultural so he can begin a process of release of any situation of oppression. The liberation of man from his reliance on sociocultural is only possible through the historical understanding and knowledge of oneself. Hence the proposition that education is to train men free, requiring a critical and popular education to dialogue with the concrete reality

The work aims to provide new foundations for the study of agrarian law, in a context of paradigmatic crisis, through the development of new theoretical models that rearticulate legal thought before institutional transformations. The research is theoretical and it is based primarily in the works of Dussel, and in the constitutions of Venezuela, Ecuador and Bolivia. It can be concluded, according to Dussel, that praxis is the foundation and condition to the understanding of subjects in community and that linguisticity, instrumentality, historicity and intersubjectivity are articulated in the necessarily intentional and projective constitution sense, in view of, ultimately, the care of specific needs of the subjects living in community. Law is constituted in the praxis of subjects such as mediation institutionalized by power to satisfy those needs in everyday life and in multiple fields of existence. The Philosophy of Liberation, in turn, worries about the situation of domination, victimization, denial of rights, alienation that precludes the exercise of authentic interpretation, non participation in the institutionalization of law and its meaning as well as the instrumentalization of the interpreter for strange understanding that are negativ to their needs. In this sense, the modern property is interpreted in itseconomic, ecological, cultural, legal and geopolitical negativity, from the revelation of the mechanisms that make it servesto a project that denies the dignity of nature and human work for the benefit of a economic world system that pressuposes and asserts itself with the generation of systemic poverty, non-central countries dependency in the world-system, environmental and cultural destruction, and denial of rights. The crisis of this world system opens new institutional possibilities and demands the affirmation of new projects for Latin American peoples, with the consequent need for statement of rights. In this context, the Latin-American Transformative Constitutionalism faces the issue of access to land and denies the negativity of modern agrarian property in its various dimensions, through his transformation, and in view of new rights. This positivity from the victimsconstitute new foundations for the legal use of the land and transform the agrarian property models of interpretation. / O tema da presente dissertação de mestrado é o da intepretação do direito de propriedade imobiliária agrária, a partir de fundamentos jurídico-constitucionais, com base na proposta hermenêutica da Filosofia da Libertação elaborada pelo filósofo latino-americano Enrique Dussel e nas mudanças da propriedade agrária decorrentes do Novo Constitucionalismo Latino-americano. O trabalho visa constituir novos fundamentos para o estudo do direito agrário, num contexto de crise paradigmática, por meio da concepção de novos modelos teóricos que rearticulem o pensamento jurídico diante de transformações institucionais. A pesquisa realizada tem caráter teórico e está fundamentada, primeiramente, nas obras de Dussel, e nas constituições da Venezuela, Equador e Bolívia. Pode-se concluir, de acordo com Dussel, que a práxis é o fundamento e a condição da compreensão dos sujeitos em comunidade e que linguisticidade, instrumentalidade, historicidade, e intersubjetividade se articulam na constituição necessariamente intencional e projetiva de sentido, tendo em vista, em última instância, o atendimento de necessidades concretas dos sujeitos viventes em comunidade. O direito é constituído na práxis dos sujeitos como a mediação institucionalizada pelo poder para a satisfação dessas necessidades na cotidianidade e em múltiplos campos da existência. A Filosofia da Libertação, por sua vez, se preocupa com a situação de dominação, de vitimização, de negação de direitos, de alienação que impossibilita o exercício autêntico da interpretação, de não participação na institucionalização do direito e de seu sentido, bem como com a instrumentalização do intérprete por compreensões alheias e negadoras de suas necessidades. Nesse sentido, a propriedade moderna é interpretada em sua negatividade econômica, ecológica, cultural, geopolítica e jurídica, a partir da revelação dos mecanismos que a fazem servir a um projeto de negação da dignidade da natureza e do trabalho humano, em benefício de um sistema econômico mundial que pressupõe e se afirma com a geração de pobreza sistêmica, dependência dos países não-centrais no sistema-mundo, destruição ambiental e cultural, e negação de direitos. A crise desse sistema-mundo inaugura novas possibilidades institucionais e exige a afirmação de novos projetos para os povos latino-americanos, com a consequente necessidade de afirmação de direitos. Nesse contexto, o Constitucionalismo Transformador Latino-americano encara a questão do acesso à terra e nega a negatividade da propriedade agrária moderna em suas diferentes dimensões, por meio de sua transformação, e tendo em vista novos direitos. Essa positividade, desde as vítimas, constitui novos fundamentos para conceber juridicamente o uso da terra e transformar os modelos de interpretação do direito de propriedade imobiliária agrária.

Com efeito, a relação de dominação do Eu do centro sobre o Outro da periferia pode ser transformada a partir da atitude crítica do dominado desde a não aceitação das imposições do sistema. Um povo só consegue perceber-se oprimido se souber ver-se livre. Para isso, deve ter desenvolvido a capacidade crítica de ver o mundo que o cerca. Tanto em Dussel como em Freire há denúncia da opressão e anúncio da libertação. Além disso, tanto um pensador quanto outro defende o princípio de que a via pela qual a libertação pode ser alcançada mais depressa é a pedagógica. Um povo que procura a libertação deve, acima de tudo, primar pela estima da cultura própria e pela sua capacidade crítica de ver o mundo. O trabalho seguiu um caminho demonstrativo. Da teoria de Dussel para a sua prática, a Pedagógica com elementos da pedagogia de Freire que enriquecem a prática. Enrique Dussel busca elementos da cultura helênica e semita para compreender melhor a identidade do povo latino-americano. Estas duas culturas servem de embasamento respectivamente para a dominação e a libertação.
