The Study on the Strategy Taiwan Far Sea Tuna Industry used to respond to the International Quota Limit

HSIEH, CHEN-LIEN 13 June 2006 (has links)
Abstract It was on Nov 19th 2005 that the Japanese Fishery Delegation announced in the annual conference of International Commission For The Conservation of Atlantic Tuna (ICCAT) that Taiwanese Atlantic Tuna Fishing Vessel Fleet laundered the fish at the high sea, violating the regulations on the Conservation of Tuna. As a result, they completely amputated the quota of tuna fish sales to Japan (quota) and cancelled the status of member nation in ICCAT. Finally, Taiwanese Fishery Delegation remained the member nation status unchanged after our efforts to explain the tough situation facing Taiwanese Tuna Fishing industry to Japan, but the quota was greatly downsized to 4,600 Metric Tons. Such severe action of revenge not only resulted in the complete collapse of Taiwan¡¦s Tuna Fishing activities in the Atlantic Ocean but also exposed Taiwanese Far Sea Fishing management to the International Fishery nations¡¦ practical competition crisis. The development of Taiwan¡¦s Far Sea Tuna Fishing Industry has extended across Tri-ocean. Taiwan has the most Tuna Long Liners, and our catches have exceeded those from some other countries, ranking No.1 in the world. Therefore, it has undeniably had a great influence on the development of some other nations¡¦ fishing industry. Moreover, Taiwanese fishing business owners have taken every opportunistic ways to sell the fish out of the quota to Japan. We were able to survive by good luck in the transitional period of fishing development before the year of 2000. But Tri-ocean Tuna Conservation Commissions have greatly increased the awareness of concept of Tuna Conservation in recent days, so it was unavoidable that they will impose as certain of regulations on the catch. If both Taiwan¡¦s government and fishing business owner don¡¦t find a solution to this sticky problem, it is just a matter of time that Taiwanese Long Liners will be evicted from Tri-Ocean. This research was started in the development process of Taiwan¡¦s Far Sea Tuna Industry, introducing the Tuna Conservation organizations of Tri-Ocean, (ICCAT, WCPFC, IATTC, IOTC, CCSBT), and the profiles on nutrition facts of Tuna Fish, fishing method and Fishing cooperation. This research also further groped and analyzed how both Taiwanese Fishing Authority and Fishing business owners reacted to the sanction pressure facing Taiwan in Tri-Ocean regions. This research will be used as the reference for both Taiwan¡¦s far sea Tuna Business owners and its decision-makers in face of meeting the severe pressure created by international quota. It will be instrumental to promoting Tuna fish consumption also. Keywords: Flag Of Convenience, Fishing Cooperation, Quota¡FTuna Long Liner, Sashimi Fishing Vessel.

Szanto, Imola, Nawrin Oxing, Lucas January 2020 (has links)
The aim of this paper has been to investigate and problematize the roles of the flag state and the classification societies in regard to their maritime safety control function. Questions have been raised regarding what obligations flag states on one hand, and classification societies on the other hand, have regarding ship construction and ship safety. Furthermore, the paper has also addressed the question of what maritime safety-related effects may arise from the flag state delegating their duties to classification societies. To answer the questions, a qualitative document study has been conducted, with some elements of legal dogmatics in certain parts in order to find the current legal situation. The material for the document study has been selected by thorough research into literature and dissertations in the area. Therefore, the chosen material has been previously reviewed and gone through a selection process and was thus considered relevant for this paper. The result has shown that there is some overlap in the control function for both the flag state and the classification societies. Delegating obligations from the flag state to the classification societies is not necessarily problematic. However, delegation of the said duties can have negative effects on maritime safety in cases where the classification societies are not on par with the flag state or both parties lack an effective control apparatus to enforce high standards. Should delegation occur to a classification society that has a good control apparatus with high requirements, possible shortcomings that exist within the flag state, such as lack of resources and skills, can be remedied by the high standard performance of the classification society. Even though the system might seem satisfactorily at first glance, there is room for further research in the area in order to investigate how the existing problems can be managed and prevented in the future.

The relation between marine safety and marine environment protection : essay on the emergence of an environmental marine safety in international and European Union law

Farre-Malaval, Margerie 12 October 2011 (has links)
Begun with the study of the European Union rules engendered by the wreck of Erika, the present research was refined around the relation between marine safety and marine environment protection while growing rich of the observation of the international rules. From then on, the idea was to study the collision between two elements neither equivalents, nor completely different and to see what this legal "big-bang" had provoke. The first part will envisage the renewal of the function of marine safety around the purpose of marine environment protection. Indeed, by the middle of the XXth century, the appearance of the environmental concerns comes to destabilize the classic distribution of the skills between the flag State and the coastal State. The freedom, founding principle of the order of seas, has been transformed to adapt itself to the realities of the marine environment protection. It becomes then the principle of sustainable use of the sea, the new key of the distribution of sovereignties on the sea. A shape of environmental governance of the maritime safety appears to establish around the International Maritime Organization and the European Union. The second part will allow to bring to light the redefining of the normative space of maritime safety in the prism of the objective of prevention of the pollutions. Originally, the regulations of marine safety aimed at protecting the sailormen against the dangers of the sea. Henceforth, it is today a question of protecting the biosphere, the humanity and its future generations. That is why the classic marine safety, become insufficient, evolves towards a more modern, " environmental " notion.
