Die steekproef het bestaan uit 99 kliente (tussen die ouderdomme van 15 en 50 jaar) wat die betrokke reproduktiewegesondheidsklinieke in die Kaapse Metropool besoek het. Die eerste 20 kliente wat die kliniek besoek het, is genader om 'n vraelys in te vul. Hierdie studie toon 'n algehele positiwiteit, naamlik 58,3% teenoor die houding van geregistreerde verpleegkundiges. Die meerderheid van die kliente (88,0%) het aangedui dat hulle weer die kliniek sal besoek wat dus die kliente se tevredenheid toon. / The effect of the client-registered nurse relationship on clients' choice and continuous use of contraceptive methods has until now received very little attention. The purpose of this study was to explore unmarried clients' perception of the attitude of the registered nurse. The sample existed of 99 clients (between the ages of 15 and 50 years) who visited the relevant reproductive health clinics in the Cape Metropole. The first 20 clients who visited the clinic were approached to complete a questionnaire. This study shows an overall positivity of 58,3% with regard to the attitude of registered nurses. Text in Afrikaans, abstract in Afrikaans and English / Die doel van hierdie navorsing was om te bepaal of betekenisvolle verskille bestaan tussen werknemerdoeltreffendheid en persepsies van gehalte van werklewe van bemagtigde en niebemagtigde skofwerkers in die Suid-Afrikaanse petrochemiese bedryf. Skofwerknavorsing het gedurende die afgelope dekade internasionaal toegeneem. Hiermee gepaardgaande het verskeie intervensies ontstaan om die doeltreffendheid van skofwerkers en hulle gehalte van werklewe te bevorder. Deur gebruik te maak van 'n gekombineerde vraelys ("Standard Shiftwork Index") en werklike data ten opsigte van afwesigheid en prestasiebeoordelings, is 'n steekproef van 102 gevalle geanaliseer. 'n 90 persent betroubaarheidinterval is gebruik om waardes ten opsigte van elke veranderlike te bepaal. Daar is bevind dat werknemerbemagtiging weinig invloed het op skofwerkers se werkbywoning. Daar is ook gevind dat werknemerbemagtiging nie lei tot 'n meer positiewe persepsie, by toesighouers, van skofwerkwerkers se algemene werkprestasie nie. Daar is egter bevind dat skofwerkers se persepsies van hulle gehalte van werklewe, ten opsigte van werkdissatisfaksie, chroniese vermoeidheid en tevredenheid met sosiale omstandighede, wel positiefbelnvloed word deur werknemerbemagtiging. Aanbevelings is gemaak ten opsigte van die aanwending van werknemerbemagtiging, as intervensie in skofwerkomgewings, asook vir verdere skofwerknavorsing in Suid-Afrika. / The purpose of this research was to determine if significant differences exist between employee effectiveness and perceptions of quality of working life of empowered and non-empowered shiftworkers in the South-African petrochemical industry. By using the Standard Shiftwork Index and real absenteeism and appraisal data, a sample of 102 cases was analysed. A 90 percent confidence interval was used to determine t-values for variables. It was found that empowerment has little influence on the work attendance of shiftworkers and that empowerment does not lead to more positive perceptions of general work performance of shiftworkers, among their supervisors. It was, however, found that shiftworkers' perceptions of their quality of working life are improved by empowerment in respect of work dissatisfaction, chronic fatigue and satisfaction with social circumstances. Suggestions were made concerning the use of empowerment, as an intervention, in shiftwork environments and for future shiftwork research in South-Africa. / Industrial and Organisational Psychology / M.Comm. AFRIKAANS : In hierdie studie is daar enersyds bepaal of daar spesifieke stressore aanwesig is wat tot werknemers van die betrokke tersiêre opleidingsinstelling se verhoogde stresvlakke en gepaardgaande siening van ‘n negatiewe gehalte van werklewe (GWL) bydra. Andersyds was die fokus op die effektiwiteit van die huidige Stresbeheerprogram (SBP), waar vasgestel is of deelname aan die spesifieke program tot 'n beter en meer positiewe ervaring in die werknemer se GWL bydra. Die studie het uitgebreide teoretiese perspektiewe op die gehalte van werk, stres, welstand en intervensies in die werkplek voorsien. Vanuit die literstuurstudie in gemelde hoofstukke 2, 3, 4 en 5 blyk dit duidelik dat verandering in die werksomgewing en die gevolglike stres wat dit meebring op die werknemer se belewenis van welstand en gehalte van werklewe impakteer, en dat die werknemer se reaksie op beide voorafgaande die deurslaggewende faktor in die bereiking van gesondheid en welstand is. Werkgewers het die verantwoordelikheid om ‘n gelukkige werkplek te vestig deur die benutting van intervensieprogramme ten einde werknemers in staat te stel om eienaarskap van hul lewens te aanvaar in die bereiking van optimale gesondheid en welstand. Die literatuurstudie is opgevolg deur ‘n empiriese ondersoek waartydens evaluatiewe navorsing benut is. Die kwantitatief-kwalitatiewe navorsingsbenaderings met fokus op Creswell se ‘dominant- less-dominant’ model is gebruik, waar die kwantitatiewe fases as oorheersende paradigma gebruik is. Die kwantitatiewe beskrywende opname-ontwerp se ewekansige kruisseksie-opname is benut om ondersoek in te stel na die aard, omvang en impak van stres op die GWL van werknemers aan die betrokke tersiêre opleidingsinstelling. Die aangepaste ‘ASSET’-posvraelys is aan respondente van die twee gekose fakulteite en respondente van die SBP voorsien. Die kwasieksperimentele navorsingsontwerp se een-groep voortoets-na-toets ontwerp en handafgelewerde vraelyste het gedien as tweede kwantitatiewe fase van die studie. Tydens fase drie, die kwalitatiewe fase, is die gevallestudie met fokus op kollektiewe gevallestudie as navorsingstrategie gevolg waartydens semi-gestruktureerde onderhoude met ‘n onderhoudskedule gebruik is om addisionele inligting te bekom. Die belewenisse en behoeftes van die respondente, wat die SBP opleiding voltooi het, is bepaal ten einde sodanige belewenisse en behoeftes tydens die aanpassings van die SBP in ag te neem. Die gestruktureerde vraelyste, sowel as die semigestruktureerde onderhoude is as voor- en na-toets gebruik om die effektiwiteit en die benuttingswaarde van die huidige SBP te bepaal. Die keuse van die onderskeie benaderings, strategie en ontwerpe, wat tydens die navorsingsproses gevolg is, was relevant en suksesvol ten einde die geformuleerde probleem aan te spreek, die navorsingsvrae sinvol te beantwoord, en die hipotese te bevestig. Die navorser kon dus daarin slaag om, deur gebruikmaking van metodologiese triangulasie, die kwantitatiefkwalitatiewe benaderings te kombineer waartydens meervoudige metodes aangewend is om alle moontlike aspekte van dieselfde fenomeen te beskou en te vergelyk, en sodoende die geldigheid daarvan te verifieer. Gebaseer op bevindinge, kan die gevolgtrekking gemaak word dat stressore wel by werknemers van die betrokke tersiêre opleidingsinstelling aanwesig is, dat stres ‘n wesenlike impak op die GWL van werknemers het, en dat die huidige Stresbeheerprogram wel ‘n verbetering in die GWL van werknemers teweeggebring het. ENGLISH : On the one hand this study determines whether there are specific stressors present, which lead to higher stress levels and contribute to the accompanying negative quality of worklife perspective of employees at the relevant tertiary institution (QWL). On the other hand the focus is on the effectiveness of the current Stress Management Programme (SMP), in order to determine whether participation in this specific programme contributes to a better and more positive experience of the employee's QWL. This study provides extensive theoretic perspectives on the quality of work, stress, wellbeing and interventions in the workplace. From the literature review in Chapters 2, 3, 4 and 5, it is clear that change in the work environment, and the subsequent stress it imposes, impacts on the employee's experience of quality of worklife and wellbeing and the employee's reaction to both these is the decisive factor in reaching health and wellbeing in the workplace. Employers have the responsibility to establish a healthy workplace by utilising intervention programmes in order to enable employees to accept ownership of their lives in reaching optimum health and wellbeing. The literature review is followed by an empirical investigation during which evaluative research was utilised. The quantitative-qualitative research approaches, with focus on Creswell's ‘dominant-less-dominant’ model was used where the quantitative phases were used as the dominant paradigm. The quantitative descriptive design's random cross section is utilized to investigate the nature, extent and impact of stress on the QWL of employees at the relevant tertiary education institution. The adapted ‘ASSET’ mailed questionnaire was provided to respondents from two chosen faculties and respondents who participated in the SMP. The quasiexperimental research design's one-group pre-test / post-test design and hand-delivered questionnaires served as the second quantitative phase of this study. During the qualitative third phase, the case study, with focus on a collective case study as research strategy, was followed during which semi-structured interviews with an interview schedule were used to obtain additional information. The experiences and needs of respondents, who completed the SMP training, were determined in order to take into account these experiences and needs when the SMP is adapted. The structured questionnaires, as well as the semi-structured interviews were used as pre-test and post-test to determine the effectiveness and the utilization value of the current SMP. The choice of the different approaches, strategy and design which were followed during the research process, were relevant and successful in order to address the formulated problem, to provide a sensible answer to the research question, and to confirm the hypothesis. The researcher could therefore succeed to, by using methodological triangulation, combine the quantitative-qualitative approaches, during which multiple methods were applied to explore and compare all possible aspects of the same phenomenon and to subsequently verify the validity thereof. Text in Afrikaans / The Convention on the Rights of the Child was adopted by the United Nations General Assembly on 29 November 1989. Included in the inherent rights set out in the Convention is the right to the highest attainable standard of health. In implementing the Convention states parties must refer to the requirements of article 2 of the Convention, which places them under a duty to respect and ensure the rights in the Convention to each child. The term “respect” implies a duty of good faith to refrain from actions which would breach the Convention. The “duty to ensure”, however, requires states parties to take whatever measures are necessary in order to enable children to enjoy their rights. A state party must also review its legislation in order to ensure that domestic law is consistent with the Convention. South Africa showed commitment to protecting and promoting children’s health when it ratified the United Nations Convention on the Rights of the Child in 1995 and subsequently adopted the Constitution of the Republic of South Africa, 1996, which includes provisions guaranteeing the health rights of children. South Africa also showed commitment to give legislative effect to the protection and promotion of children’s health by reviewing the Health Act 63 of 1977 (reviewed as the National Health Act 61 of 2003) and the Child Care Act 74 of 1983 (reviewed as the Children’s Act 38 of 2005). The review of the Child Care Act 74 of 1983 revealed that the act is virtually silent on the issue of child health. This led to the decision to identify and evaluate existing policy and legislation, as well as pending relevant law reform and policy affecting child health in order to assess how well South African legislation addresses the issue. The research showed that although much legislation exists, none provides comprehensively for child health rights. The legislation that does exist contains obvious gaps. Most importantly, there is no reference to the core minimum requirements for the state in providing for the health of children, particularly in the way of health services and nutrition. Further, there is a complete lack of legislation which protects the health needs of disabled children. A comparative study was also undertaken. Legislation of India and Canada were evaluated in order to make recommendations as to how the gaps in South African legislation can be rectified. However, the research showed that South Africa has made far more significant progress in promoting a rightsbased approach to children’s health in legislation. In order to ensure that the health rights of children are protected and promoted, I propose more comprehensive legislative protection. / Private Law / LL.D.

Stress occurs when one's perception of demands exceeds his perception of his abilities to meet them. Except for work related demands, a variety of demands and threats in the environment have to be faced continuously. As a result stress is created that manifest in people's behavior, work efficiency and socialization. In general, the education profession is considered among the most stressful careers in the world. This also applies to the South African educational system. U'hm teachers experience stress, it has a negative effect on their beloved ones. colleagues and the learners. Therefore teacher stress has a negative effect on the teaching system in general. Thus teacher stress can be considered to be a national problem. The real situation of teachers in South Africa was determined by means of an empirical study that \\as complimented by a qualitative investigation. In this study. stress is dealt with from the educational psychology. However. stress is a holistic multi-dimensional concept that can only by understood at best when it is approached from a multi-professional point of view. Equally all the actions to cope with stress are rnultidimensional actions. This research aims to develop among teachers an awareness of stress manifestations. with the purpose to identi6 and control stressors. These actions are strengthened by appropriate adaptations in life style and the management of resources. A comprehensive support program is suggested to guide teachers towards an understanding and control of stress. and the establishment of a social support system. while serious manifestations of stress should be addressed by means of professional services. Section 27(1)(a) of the Constitution of the Republic of South Africa, 1996, entrenches everyone's right of access to health care services. The purpose of this dissertation is to determine the manner in which this right must be interpreted and implemented in order to alleviate poverty to the optimal extent possible, in South Africa. As a point of departure, the relationship between poverty and health, as well as the theoretical basis of poverty, is addressed in terms of soft law. Thereafter, the theoretical basis of the right of access to health care service is analysed and explained from both an international and a South African perspective. This is followed by an investigation into international law. The manner in which the United Nations International Covenant on Economic, Social and Cultural Rights is interpreted and implemented and whether or not this contributes to poverty alleviation, is investigated. This is followed by an analysis of the right in terms of the Constitution and case law. Particular attention is paid to the manner in which the courts interpret the right of access to health care services. It is then determined whether the state is implementing the right in such a manner as to contribute to the optimal alleviation of poverty, in South Africa.
