La constitutionnalisation du droit du travail et le pouvoir de réglementation de l’employeur en contexte syndiqué : incidence des libertés fondamentales et des droits à l’intégrité, à la dignité et à la vie privée

Problématique : Les effets de la constitutionnalisation du droit du travail sur le contrôle arbitral du pouvoir de réglementation de l’employeur. La problématique de notre projet de recherche consiste à évaluer les effets du phénomène de la constitutionnalisation du droit du travail sur le pouvoir de l’employeur d’établir de la réglementation d’entreprise relative au travail, lequel pouvoir est une manifestation concrète de ses droits de direction. Notre projet de recherche, qui se limite au contexte syndiqué, met donc en relation deux grandes dimensions lesquelles sont le pouvoir de réglementation de l’employeur et le phénomène de la constitutionnalisation du droit du travail. Mentionnons que notre projet de recherche s’attarde aux limites, se trouvant tant dans la législation que dans la convention collective, permettant l’encadrement du pouvoir de réglementation de l’employeur. Concernant le phénomène de la constitutionnalisation du droit du travail, notre projet de recherche s’attarde tant à ses fondements qu’à ses effets sur le pouvoir de réglementation de l’employeur, ces derniers effets découlant principalement de la décision Parry Sound, laquelle est à l’effet que tous les droits et obligations prévus dans les lois sont contenus implicitement dans chaque convention collective, quelles que soient les intentions des parties contractantes. Ainsi, notre projet de recherche vise à démontrer empiriquement, en observant la jurisprudence arbitrale, dans quelle mesure le phénomène de la constitutionnalisation du droit du travail, en contexte syndiqué, modifie l’encadrement du pouvoir de réglementation de l’employeur puisque ce dernier doit dorénavant composer avec des normes étatiques fondamentales qu’il n’a ni négociées, ni déterminées. Mentionnons que le concept central de notre recherche se trouve à être le contrôle arbitral du pouvoir de réglementation de l’employeur relativement à la réglementation d’entreprise susceptible de faire intervenir les dispositions 1, 3, 4 et 5 de la Charte des droits et libertés de la personne et qu’il vise la classification dudit contrôle arbitral en deux grandes logiques : la logique I préalablement à la décision Parry Sound et la logique II postérieurement à cette même décision. Ainsi, notre hypothèse dominante est à l’effet qu’en matière de contrôle arbitral du pouvoir de réglementation de l’employeur, deux logiques existent et que dans une logique II, le contrôle arbitral est modifié en ce que les arbitres, situent au sommet de la hiérarchie des aspects à évaluer, la conformité de la réglementation d’entreprise aux dispositions de la Charte susmentionnées. / Issue : The effects of the « constitutionalization » of labor law on the arbitral review of employers’ regulatory power. Our research consists in evaluating the effects of the « constitutionalization » of labor law on employers’ regulatory power to establish corporate regulation related to work. Our research is limited to the unionized workplace and brings together two concepts: employers’ regulatory power which comes from their management rights and the « constitutionalization » of labor law. Our research concerns mainly the boundaries, both statutory and contractual, to employers’ regulatory power, which boundaries offer a legal framework to the application of said power. With regard to the « constitutionalization » of labor law, our research presents both its substance and effects on employers’ regulatory power. These effects are mainly consequences of the Supreme Court’s decision in the Parry Sound case, stating that every collective agreement benefits from an implicit content including all human rights and employment-related legislation. Thus, our research aims to demonstrate, while observing the arbitral jurisprudence, the extent to which the « constitutinalization » of labor law, in unionized workplaces, can modify the boundaries of employers’ regulatory power since they must now compose with fundamental standards that they have neither negotiated nor established. The central concept of our research is the arbitral review of employers’ regulatory power related to corporate regulation, wherein provisions 1, 3, 4 and 5 of the Charte des droits et libertés de la personne are likely to be found applicable. More specifically, our research aims to classify said arbitral review into two different logics: Logic 1 before Parry Sound and Logic 2 after Parry Sound. Therefore, our main hypothesis is that two logics exist when we refer to the arbitral review of employers’ regulatory power and that, when applying Logic II, the arbitral review is modified since the arbitrators tend to prioritize the compliance of the corporate regulation with the above-mentioned provisions of the Charte des droits et libertés de la personne.

Poverty and Conflict: A Self-Perpetuating Cycle in the Somali Regional State (Region 5), Ethiopia: 1960-2010

Region 5 is one of the most impoverished and insecure regions of Ethiopia. For decades, the region has suffered from a multitude of armed conflicts involving state and non-state actors. Region 5 is also one of the most underserved states of Ethiopia with some of the lowest levels of human development indicators nationwide. Although the adversities of poverty and conflict are widely acknowledged in their own respect, there has been little or no inquest into why poverty and conflict have prevailed under the same space for decades. Poverty and conflict have often been seen as separate phenomena that are dealt with using different sets of theories and practices in the real world. Nonetheless, a closer look at poverty and conflict in Region 5 reveals that both are strongly connected to each other. The poverty-conflict trap has been an on-going cycle in the region for the last five decades. The main intent of this research paper is analyzing the two-way relationship between poverty and conflict in Region 5. By studying this relationship, this analysis seeks to contribute to a new framework that brings peacebuilding and development closer.

台北市高職學生政治信任感之研究-學校社會化機制之觀察視角 / A Study on political trust of Taipei city vocational high school students: School as an agent of political socialization

本研究主要目的係由學校社會化機制探討台北市高職學生政治信任感,以及個人背景中性別、政黨偏好與政治信任感之關係。 本研究採問卷調查之量化研究方法,研究對象為台北市四所公立高職學生,使用的統計方法主要為次數分配、t考驗、單因子變異數分析、皮爾遜積差相關,以及多元迴歸分析。 經分析後主要研究發現: 台北市高職學生政治信任感普遍偏低,顯見其對於現今政府之施政績效並不滿意。  一、在個人背景部份,性別不會造成政治信任感差異;不同之政黨偏好與政治信任感則具有顯著差異。其中政黨偏好為「藍色」者政治信任感低於「綠色」及中立無反應;政黨偏好為「綠色」者政治信任感高於中立無反應及「都不喜歡」者;政黨偏好為中立無反應者高於「都不喜歡」者。 二、在學校社會化機制部分,申訴管道、學生自主性、年級等三項因素與政治信任感具有顯著差異。認為有申訴管道的學生其政治信任感較高;學生自主性愈高者,其政治信任感愈高;一年級較三年級學生具有較高之政治信任感。其他在學校控制度、教室民主氣氛、學校、科系等四部份,則與政治信任感間無顯著差異。 三、藉由多元迴歸分析,綜合考量申訴管道、學生自主性、年級以及政黨偏好四項因素,可看出申訴管道、年級以及政黨偏好對於政治信任感具有相當之影響,至於影響政治信任感高低之其他因素則有待進一步研究。 關鍵字:高職學生、政治信任感、性別、政黨偏好、學校、申訴管道、學生自主性、學校控制度、教室民主氣氛、年級、科系 / The purpose of this study aimed to understand the political trust of Taipei city vocational high school students by school as an agent of political socialization. Also, this study analyzed the relation among gender, party preference and political trust. The study employed quantitative approaches of questionnaire survey, and the subjects were the students of four Taipei municipal vocational high schools. Statistical methods included frequency distribution, t-test, oneway ANOVA, Pearson product-moment correlation and multiple regression analysis. Principal findings of the study were: 1.The political trust of Taipei city vocational high school students was universally low. It was obvious that nowadays the government did not make students satisfied. 2.In individual background, gender had no significant differences on political trust, but different party preference had significant differences on political trust. People whose party preference was “blue” had lower political trust than those whose party preference was “green” and neutrality with no response. People whose party preference was “green” had higher political trust than those whose party preference was “dislike” and neutrality with no response. People whose party preference was neutrality with no response had higher political trust than those whose party preference was “dislike”. 3.As for the school as an political socialization agent, grievance channels, student autonomy and grades had significant differences. Students who thought there were grievance channels at school had higher political trust. Students with higher autonomy had higher political trust. The first graders had higher political trust than the third ones. There were no significant differences between political trust and the four factors: school control, classroom democratic atmosphere, schools and majors. 4.By the multiple regression analysis of grievance channels, students autonomy, grades and party preference, there were influences among grievance channels, grades and party preference to a certain degree. As for other factors which influenced political trust, the further study needs researching. Corporate social responsibility and human rights; : An examination of the Swedish National Contact Point of the OECD and other possible alternatives.

This thesis firstly attempts to provide a theoretical basis for how the complex cases related to corporate misbehaviour in relation to human rights respect should be handled. Secondly, it attempts to critically examine how well the Swedish National Contact Point (SNCP) functionsin relation to its goals through the usage of elite interviews. Thirdly and finally it also explores the interest of concerned stakeholders in finding other non-judicial conflictmanagement mechanisms for cases within the CSR – human rights nexus at other mediation institutions such as the Stockholm Chamber of Commerce (SCC) and/or the InternationalChamber of Commerce (ICC). The thesis argues that it is possible and advisable to apply Dworkin’s idea of hard cases to the conflictual cases appearing within CSR-human rights nexus in Sweden. It directs criticism towards the usage of opaque social pressure currently applied when hard cases within the CSR-human rights nexus are to be solved. It argues that usage of such pressure both makes it hard to follow up on decisions made and makes it questionable whether victims of human rights abuses related to corporate conduct are provided with effective access to remedy. It suggests that Dworkin’s general principles of equal respect and concern is a least common denominator for the demands placed on conflict management mechanisms within the CSRhuman rights nexus by both relevant soft law instruments and respondents in the elite interviews carried out for the thesis. As a result of the interview survey the thesis draws the conclusion that the SNCP to a major extent seems to have failed in the fulfilment of its goals and the expectations placed upon it as stipulated by the OECD 2000 guidelines. What is more the SNCP seems little equipped to meet the requirements of the 2011 version of the OECD guidelines and the UN Guiding Principles unless some sincere and large scale efforts are made by the Swedish government and other concerned parties in the SNC’s regeneration. The thesis found the interest among concerned stakeholders for alternative conflict management mechanisms at the SCC and the ICC to be generally low. Respondents generally thought that the challenges for such private institutions to procure the confidence of both sides in a conflict would be too difficult for them to overcome.
