Hermenêutica jurídica: proposta semiótica / Legal hermeneutics: semiotics proposal

O presente trabalho pretende apresentar soluções alternativas para velhas questões que integram a problemática do Direito, tais como o conceito de norma jurídica, as fontes de direito dos diferentes sistemas jurídicos, bem como os critérios de interpretação da norma a fim de aplicá-la aos casos em concreto. Com o enfraquecimento dos paradigmas da Modernidade tanto no que se refere a valores culturais como no que tange a metodologia das ciências sociais os conceitos acima mencionados precisam ser revistos, a partir de novos pontos de vista. É assim que, por meio dos modelos da semiótica de linha francesa e da análise interdiscursiva e dialógica de textos, pretende-se romper com as estruturas dicotômicas do direito, passando a observá-lo como processo de produção de sentido. Nessa linha de raciocínio, por meio de método hipotético-dedutivo e com base na depreensão de sentido desvelado na análise de textos, busca-se o ser do sentido do discurso jurídico naquele discurso desenvolvido diuturnamente nos Tribunais. Como cumprir o propósito do direito de assegurar a harmonia e paz social em determinado Estado Democrático de Direito? Por meio de normas provenientes do Poder Legislativo ou por decisões provenientes do Poder Judiciário, na atividade de dizer o direito aplicável ao caso em concreto? Enquanto os discursos unificadores da Modernidade funcionaram bem, aparentemente, bastaria a leitura dos textos legais e sua aplicação literal na solução do caso em concreto para que se atingisse o anseio de segurança jurídica. Assim, no sistema da civil law, os Códigos dariam aos cidadãos e magistrados o norte para se determinar aquilo que seria /conforme/ e o que seria /em desacordo/ com o previsto em lei. Por seu lado, no sistema da common law, a casos iguais, dever-se-ia aplicar a mesma decisão extraída de case law análogo. Contudo, a partir de meados do século XX, as sociedades tornam-se tão complexas quanto os valores dos grupos sociais particulares, culminando na ruptura com o discurso absoluto, monológico, próprio dos textos centralizadores das codificações e das stare decisis. Com isso, as teorias da interpretação do direito também evoluíram, criando-se novos modelos que não partem da análise da norma jurídica (ou case law), mas sim da apreensão dos valores encontrados nos casos em concreto, sob prisma dos princípios gerais de direito, notadamente os direitos humanos fundamentais. É assim que se operam mudanças nos paradigmas do discurso jurídico, indicando que está menos no caráter prescritivo da norma jurídica e mais na solução de litígios de forma dialógica o caminho para a segurança jurídica. Sem negar o importante papel ocupado pelo discurso legislativo na estabilização das relações intersubjetivas, tudo indica que o padrão de produção legal não vence as constantes alterações que vêm ocorrendo sobretudo em direito de família, sendo que, aos poucos, o discurso legislativo cede espaço produção de direito pela jurisprudência. Neste trabalho procuramos demonstrar como é possível desenvolver modelo decisório que leve em consideração o discurso das partes em litígio para a criação de jurisprudência, de modo a lhe conferir legitimidade, abrindo caminho para adoção de sistema jurídico único para todas as nações ocidentais, restabelecendo a harmonia entre os Poderes, operando este novo sistema por Estatutos e Súmulas. / This work intends to present alternative solutions to old questions that integrate the issue of law, such as the concept of rule of law, sources of law of different legal systems, and the criteria for interpreting the rule to apply it to cases in concrete. With the weakening of the paradigms of modernity - both with regard to how cultural values regarding the methodology of the social sciences - the concepts mentioned above need to be revised, from new points of view. And so, by the models of French semiotics and interdiscursive and dialogic analysis of texts, intended to break the law dichotomous structures, going to observe it as a process of meaning production. In this line of reasoning through hypothetical-deductive method and based on the apprehension of meaning uncovered in text analysis, we seek the being of the sense of the legal discourse developed during the daytime in the Courts. How to fulfill the purpose of the law to ensure social harmony and peace in particular democratic state? Through standards from the Legislature or from decisions by the judiciary, saying the activity of the law applicable to the case at issue? While the unifying discourse of Modernity worked well, apparently, seemed to be enough reading legal texts and proceed its application in the literal solution to the particular case that reached the yearning of legal certainty. Thus, the system of civil law, the codes would give citizens and magistrates the way to determine what would be / as / and what would / disagree / with the provisions into law. For its part, the system of common law, the same cases, the duty would apply the same decision extracted from analogous case law. However, from the mid-twentieth century, societies become as complex as the values of particular social groups, culminating in absolute break with the speech, monologic, self centering of the encodings of the texts and stare decisis. Thus, theories of interpretation of the law also evolved, creating new models that do not depart from the analysis of the rule of law (or case law), but the seizure of the values found in cases where concrete prism under the general principles of law, notably fundamental human rights. That\'s how they operate changes in the paradigms of legal discourse, indicating that it is less the prescriptive character of the rule of law and more on solving disputes in a dialogical the path to legal certainty. Without denying the important role played by legislative discourse in stabilization of interpersonal relations, it seems that the standard of legal production does not bear the constant changes that are occurring primarily in family law, and gradually gives way legislative speech production to the jurisprudence. In this work we demonstrate how it is possible to develop decisionmaking model that takes into account the discourse of the parties to create case law in order to give it legitimacy, paving the way for adoption of the legal system unique to all Western nations, reestablishing harmony between the Powers, this new operating system by the Statutes and Precedents.

“The purpose of life is finding the largest burden that you can bear and bearing it.” : A study of the making of meaning among Jordan Peterson supporters

The aim of this thesis is to study, understand and explain the theories and work of the Canadian psychologist Jordan Peterson, whose controversial statements and lectures have made him a darling of certain factions of the political right, as he portrays himself as an enemy of progressive ideology. With a focus on understanding and explaining Peterson and how he provides meaning to his followers, the study will go through Peterson’s work in his two books Maps of Meaning and 12 Rules for Life in order to analyze their content and the follower’s reaction to the books as well as Peterson’s persona as a whole.   To analyze these works, hermeneutic methods based on the work of finnish theologian Björn Vikström will be utilized. The texts will be analyzed on a textual and intertextual level, but the role of the author as well as the readers will also be put under scrutiny in order to elaborate on many aspects of Peterson’s writing. To analyze how he provides meaning to his followers and the definition of the terms lifestance and meaning, the work of Swedish theologian Carl Reinhold Bråkenhielm will be referenced and compared to Peterson’s work.   While Vikström and Bråkenhielm will be the main sources of intertextual comparison with Jordan Peterson, they will also be supplemented with the work of other established theologians such as Hjalmar Sundén and others to further understand and compare the making of meaning undertaken by Jordan Peterson to other academic studies in the field of making meaning.

O objetivo principal é apresentar a importância da hermenêutica na constituição do sujeito não só no tocante à interpretação do “mundo do texto”, mas também em uma proposta ética renovada na qual o si-mesmo é gerado (constantemente) pela dialética entre a identidade ipse (outro) e a identidade idem (mesmo). O sujeito ricoeuriano se diferencia do “eu”, do ego, da consciência; é o “si” reflexivo de todas as pessoas. Muqātil ibn Sulaymān: a neglected figure in the early history of Qur'ānic Commentary

This study investigates Muqātil ibn Sulaymān's (d. 150/767) hermeneutics in his three extant Qur'an commentaries: al-Tafsῑr al-Kabῑr, Tafsῑr al-Khams Mi'at Āyah min al-Qur'ān, and al-Wujūh wa al-Naẓā'ir fῑ al-Qur'ān al-‛Aẓῑm. It explains Muqātil's understanding of the Qur'an, his exegetical approaches, and the theological concerns undergirding his endeavors. Despite his early importance, Muqātil is an understudied figure because of stigma attached to his views and methods. Later Muslim tradition accused Muqātil of anthropomorphism, inattention to transmission chains, fabrication of ḥadῑth (prophetic traditions), and overreliance on biblical narratives, thus rendering his work theologically and methodologically suspect. Two of these accusations are unfounded, and two are only partially correct but misleading as well as anachronistic. Existing modern scholarship on Muqātil and his commentaries has either focused on these accusations or on uncovering his views on specific topics. None has addressed Muqātil's hermeneutics, the focus of this study. Substantively, Muqātil maintains that the Qur'an consists of divine commands, prohibitions, promises, threats, and narratives of the past. Linguistically, the Qur'an is a complex structure containing utterances of different kinds, which he presents in a series of binaries: general-particular, clear-vague, equivocal-unequivocal, explicit-implicit, and so forth. Consequently, a proper understanding of the Qur'an necessitates interpretation. Muqātil uses three major exegetical methods, namely paraphrasing, crossreferencing, and narrative, and three techniques, namely fragmentation, specification, and completion. Muqātil's commentaries persistently focus on theological concerns revolving around the propagation of belief (ῑmān), in opposition to disbelief (kufr), with regard to the oneness of God (tawḥῑd) and the validity of Muhammad's prophethood (taṣdῑq). He uses theological criteria to evaluate non-Muslim communities as well as Muslims who had shown distrust of or rebellious acts against the Prophet Muhammad. Though theologically uncompromising, Muqātil is legally a pragmatist with regard to interreligious coexistence, especially in his conception of muḥkamāt al-Qur'ān as the perennially unchanging elements of revelation, which serves as the "Islamic Decalogue," laying a common ground for interreligious relations. Furthermore, Muqātil is ethically pacifist in advancing his uncompromising theology, including in propagating tawḥῑd and taṣdῑq and in understanding jihad not merely as an armed fight but also as civilized acts undertaken for God's cause. / 2016-10-01T00:00:00Z

It was an attempt to follow the steps of formation of his concept of symbol, which is central to that period. Decisive for this phase, also called philosophy of symbol, was to put forward the question to other disciplines that played an essential role in the analysis of symbolic language, among which is the structural anthropology of Lévi-Strauss. Thus, the terms - more specific to the dialogue established between Paul Ricoeur and Claude Lévi-Strauss on the analysis of the symbolic language of myth - were defined. Finally, this research provides a better understanding of the opening phase of the Ricoeur s hermeneutics as well as its alignments and divergences with the structuralism of Lévi-Strauss so widespread in the academic field / Este trabalho é resultado de uma análise das obras de Paul Ricoeur, que se encontram no limiar da inserção da hermenêutica em sua filosofia. Procuramos acompanhar as etapas de formação de seu conceito de símbolo, central para este período. Decisiva para esta fase, também chamada de filosofia do símbolo, foi a interpelação de outras disciplinas que se constituíram por meio da análise da linguagem simbólica, entre as quais se encontra a antropologia estrutural de Lévi-Strauss. À partir du constat de l'importance de l'argumentation scripturaire dans le discours du mépris du savoir mondain au Moyen âge et de la récurrence des versets employés, compte tenu de la dynamique intertextuelle ouvrant la citation sur sa tradition interprétative, notre thèse a pour but d'éclairer la signification de ce discours à travers le prisme exégétique. L'étude des commentaires bibliques médiévaux d'un corpus significatif, mettant en lumière pour chaque verset les perspectives de lecture retenues et les développements sémantiques opérés, permet alors une exploitation thématique transversale, caractérisant l’objet et la justification du mépris en question, dont la compréhension des différentes manifestations s'appuie ainsi sur l’apport du savoir sacré. Le recours à l’exégèse, inscrivant dans une continuité l’effort d’élucidation de l’expression biblique de la limitation de l'entendement humain, de la vanité de la science, de la réprobation des sages et de l’éviction de la sagesse de la parole dans la folie de la croix, permet d’appréhender de manière privilégiée, au cœur d’une confiance paradoxale dans le langage, les ressorts de la critique médiévale du dévoiement du savoir dans sa réception de l’héritage patristique et dans son orientation vers la connaissance salvifique. / Aknowledging as a key feature the recurrence of biblical verses within the argumentation conveyed by the medieval contempt of secular learning, given that the use of Scripture in the Middle Ages implies intertextual developments through exegesis, we offer to the understanding of this contempt the light of the medieval biblical commentaries upon a selection of preponderant verses. From the examination of the hermeneutical choices and semantic associations regarding each verse, we are then allowed to extend its contribution to an overview of this medieval approach towards knowledge and of its explanatory topics. The issues of secular versus sacred erudition are therefore received in a meaningful confrontation. By taking medieval exegesis as a reading key, from its insertion within a collective and progressive work of interpretation of Scripture, we offer to read the critic of the errance of knowledge in the Middle Ages in its reception of the patristic problematics and through the anagogical paradigm ; the biblical themes of the deficiency of human understanding, of the paucity and vanity of knowledge, and of the condemnation of the wise and of the wisdom of words in the foolishness of the Cross are then read through the paradoxical expression of the reliability of language.

Estética e hermenêutica: a arte como declaração de verdade em Gadamer / Aesthetics and hermeneutics: the art as a truth´s expression in Gadamer

A pesquisa tem como objetivo investigar o que justifica o caráter paradigmático da análise sobre a questão da verdade da arte para a elaboração da hermenêutica filosófica de Hans- Georg Gadamer em sua obra Verdade e método. A relação entre estética e hermenêutica, além de submeter o fenômeno estético a uma análise interpretativa, possibilita para a estética a recuperação do fenômeno da arte como experiência de verdade. A autonomia da reflexão sobre o domínio da estética e, especificamente, sobre o fenômeno da arte é garantida pelo propósito de uma análise crítica sobre o procedimento metodológico das ciências naturais. Para Gadamer, a pretensão exclusiva de demonstração de verdade baseada na verificabilidade de certezas é insuficiente para as ciências humanas. Examina-se a análise ontológicohermenêutica sobre a arte como condição de recuperá-la e reivindicá-la enquanto experiência de verdade. Analisa-se o caráter de subjetivação da estética, a partir da filosofia de Kant, como requisito fundamental para a retomada da questão da verdade a partir da arte. A tarefa hermenêutica da crítica à noção da consciência estética constitui-se como a abertura originária para se repensar a questão da verdade e sua relação com a arte. O que possibilita uma reflexão hermenêutica sobre a arte é sua análise ontológica tendo em vista a nova dimensão do compreender, segundo Heidegger, e o conceito de experiência a partir da dialética de Hegel. A experiência hermenêutica da arte é pensada como experiência ontológica de finitude, a partir das categorias de jogo, símbolo e festa, que, por sua vez, revelam o seu modo de ser. Identifica-se na estrutura de Verdade e método um intercâmbio entre os três domínios da experiência analisados: a arte, a história e a linguagem, o que possibilita à experiência da arte ser pensada a partir do princípio da história dos efeitos (Wirkungsgeschichte) e como determinação do fenômeno universal da lingüisticidade (Sprachlichkeit). Ressalta-se como elemento de análise o caráter declarativo da arte tendo em vista seu estatuto históricotemporal e interpretativo. A análise sobre a questão da verdade (aletheia) é articulada à explicitação ontológica sobre o caráter universal da linguagem (Sprach) e a crítica à pretensão de certeza apofântica da ciência. A partir do significado da arte como declaração (Aussage) examina-se a questão da atualidade da arte tendo também como parâmetro um diálogo entre Gadamer e Hegel, considerando a tese do caráter passado da arte (Vergangenheitslehre). / This paper has the objective of investigating what justifies the paradigmatic character of the analysis on the questioning of truth for the elaboration of the philosophical hermeneutics by Hans-Georg Gadamer in his work Truth and Method (Continuum Impacts). The aesthetic and hermeneutic relationship not only submits the aesthetic phenomenon to an interpretive analysis but also does give the aesthetics the possibility of recovering the phenomenon of arts as an experience of truth. The autonomy of reflection upon the realm of aesthetics, and specifically on the phenomenon of arts is guaranteed by the purpose of a critical analysis on the methodological procedure of natural sciences. For Gadamer, the exclusive intention of demonstrating the truth based on the verification of certainties is insufficient for human sciences. The ontological-hermeneutic analysis on arts is examined as a condition to recover and claim it as the experience of truth. The character of aesthetic subjectivity is analyzed, by Kant\'s philosophy, as a fundamental requisite to recover the questioning of truth from arts. The hermeneutic task of criticism on the notion of aesthetic consciousness constitutes the initial opening to rethink the questioning of truth and its relationship with the arts. What makes it possible to have a hermeneutic reflection upon the arts is its ontological analysis from the new dimension of understanding by Heidegger and from the concept of experience from Hegel\'s dialectics. hermeneutic experience The of arts is thought as an ontological experience of ending, from the categories of games, symbols and festivities that on their own reveal their way of being. In the structure of the work Truth and Method (Continuum Impacts) an interchange between the realms of experience analyzed (arts, history and language) is identified, what makes the experiencing of arts be considered from the principle of history of effects (Wikungsgeschichte) and from the universal phenomenon of linguistics (Sprachlichkeit). The declarative character of arts bearing in mind its historic-temporal and interpretative character is highlighted as an element of analysis. The analysis upon the questioning of truth (aletheia) is articulated to the ontological explicitness on the universal character of the language (Sprach) and the critical intention of the apophantical certainty of science. From the meaning of arts as a declaration (Auslegung) the questioning of the present arts is examined from a dialogue between Gadamer and Hegel, considering the thesis of the past character of arts (Vergangenheittslehre).

Na epopéia homérica, a ágora, a assembléia do povo, constitui espaço privilegiado de interação social, servindo de cenário para a figuração de eventos importantes para a condução da trama, tanto da Ilíada quanto da Odisséia. No âmbito dos estudos homéricos, aqueles que se dedicam à análise histórica dos poemas têm feito largo uso desses episódios, na busca de chegar a explicações coerentes a respeito dos modos de operação da sociedade retratada na narrativa. Qual seria o papel das assembléias na sociedade homérica? Qual seria a constituição social do povo presente nessas reuniões? Seria ela conformada aos moldes de uma sociedade de caráter patriarcal ou refletiria as instituições das nascentes póleis arcaicas? Ou seria pura ficção, um amálgama de elementos contraditórios, não retratando uma sociedade que tivesse tido existência fora dos textos? O principal obstáculo para o encaminhamento dessas questões encontra-se na própria natureza dos textos homéricos. Elas são caras à nossa forma de perceber o mundo, mas não encontram eco no texto. Os poemas não apresentam registros que possibilitem respostas precisas para elas. Quando as questões que animam a interpretação buscam a clara delimitação das instâncias organizacionais da sociedade figurada na Ilíada e na Odisséia, a memória preservada, no registro épico da ágora homérica, apresenta-se para nós permeada de ambigüidade e indefinições, que, para serem rompidas, necessitam de esquemas de referências que possibilitem contextos a partir dos quais se possa empreender a análise. No presente trabalho, apresentam-se reflexão sobre a forma como a crítica especializada tem contornado tais problemas de interpretação e proposta de hermenêutica das cenas de assembléia na épica, tendo como fio condutor as questões da conformação da ágora como elemento definidor do estatuto da vida civilizada; da oposição entre assunto público e privado; e da natureza social do povo presente nas assembléias / In Homeric epic poems, the ágora, the assembly of the people, constitutes a privileged space of social interaction. It serves as stage set for portraying important events for plot conduction, both in the Iliad and the Odissey. In scope of Homeric studies, those engaged in historical analysis of the epic poems have made wide use of these episodes in search of coherent explanations, regarding the operational ways of the society portrayed throughout the narrative. Which would be the role of the assemblies in the Homeric society? Which would be the social constitution of the people present in these meetings? Would it be conformed to the moulds of a society of patriarchal character or would it reflect the institutions of the rising archaic pólis? Or would it be pure fiction, an amalgam of contradictory elements, not portraying a society that had had existence out of the texts? The main obstacle for the guiding of these questions meets in the proper nature of the Homeric texts. They are so dear to the way we perceive the world, but they don\'t find any echo in the text. The poems do not present registers that make possible accurate answers for the asked questions. When the questions that liven up the interpretation search the clear delimitation of the organizational instances of the society depicted in the Iliad and in the Odyssey, the memory preserved in the epic register of the Homeric ágora comes out pervaded by ambiguity and unclear settings, that, to be breached, need design of references that make possible contexts from which the analysis can be undertaken. This work presents a reflection on the form as the specialized critic has contoured such problems of interpretation and a proposal of hermeneutics of the assembly scenes in the epic, having as conducting wire the questions related to the conformation of the ágora as defining element of civilized life; the opposition between public and private subject; and the social nature of people present in the assemblies
