[pt] A coexistência de valores e interesses diversos nas sociedades atuais exige que o ordenamento jurídico não se deixe mover por normas unilateralmente fixadas ou valores absolutos. No Brasil, a Constituição que assegura o direito à intimidade, considerado pela doutrina e jurisprudência fundamento do sigilo bancário, estabelece ser facultado à administração tributária, especialmente para conferir efetividade ao princípio da capacidade econômica do contribuinte, identificar, respeitados os direitos individuais e nos termos da lei, o patrimônio, os rendimentos e as atividades econômicas dos contribuintes, sendo vedado atribuir tratamento desigual àqueles que se encontrem em situação equivalente. Além disso, é inegável o fato de que as instituições financeiras vêm sendo utilizadas com finalidade ilícita, servindo de meio para a realização de crimes como a lavagem de dinheiro e a evasão de divisas, cujo combate tem sido intensificado tanto no Brasil, quanto no cenário mundial. Neste processo, surge a tensão entre o interesse público na obtenção, pela autoridade fiscal, de dados que podem comprovar a realização de ilícitos e proporcionar a concretização dos princípios da isonomia e da capacidade contributiva, e a necessidade de proteção da esfera privada do indivíduo, objeto da presente dissertação. / [en] The coexistence of valuables and several interests in the current societies demand that the legal system will not make any movement on account of rules that have been established by one-sided only, or on account of values that are absolute. In Brazil, the Constitution that assures the right to intimacy (privacy s right), considered by the doctrine and by the jurisprudence as a ground of the bank secrecy, establishes that it is facilitated to the tax administration, specially to onfer effectiveness to the principle of the economic capacity of the taxpayers, to identify, respected the individual rights and the law terms, the assets, their incomes and their economic activities, being forbidden to attribute different treatment to those who are found under an equivalent situation. Moreover, the fact that the financial institutions are being used for illegal purposes is undeniable, serving as a way for the performance of crimes such as money laundering and foreing currency s evasion, which combat has been intensified as much as in Brazil as in the world scenery. In this process, the tension between the public interest raises, to obtain from the fiscal authority, the data that can prove the performance of illegal acts and that can provide the realization of the isonomy principles and of the tax- paying ability, as well as the protection needed of the individual private sphere, object of this present work.

Com isso, observou-se também um crescimento de usuários nas redes sociais, sites de relacionamentos e chats. Espaços estes que propiciaram que pessoas localizadas em diferentes regiões geográficas se conhecessem e desenvolvessem diferentes tipos de relacionamentos, inclusive amorosos. Reconhecendo os dados que revelam o crescente índice de relacionamentos amorosos que se desenvolvem exclusivamente pela internet, a presente dissertação objetiva comparar os relacionamentos amorosos mediados pela Internet com os relacionamentos amorosos não mediados pela Internet, no que diz respeito ao amor, à qualidade conjugal e às concepções de infidelidade. Esta pesquisa, de caráter quantitativo, foi realizada com 86 usuários de Internet, divididos em dois grupos (43 em relacionamentos amorosos mediados pela internet e 43 em relacionamentos amorosos não mediados pela Internet). O documento da dissertação está composto por três artigos. No primeiro, é exposto um perfil discriminante entre os relacionamentos amorosos mediados e não mediados pela internet. No segundo, apresenta-se a comparação dos grupos no que diz respeito à qualidade conjugal e aos três componentes do amor: intimidade, paixão e decisão/compromisso. Por fim, no terceiro artigo, são apresentadas as concepções dos usuários de Internet sobre questões relacionadas à infidelidade. Os resultados revelam que existe diferenças significativas entre os grupos, apontando uma melhor qualidade conjugal, comprometimento, intimidade e paixão nos relacionamentos amorosos presencias. Além de indicar maior tempo de uso para acesso a redes sociais, chats e demais atividades de lazer nos relacionamentos amorosos mediados pela Internet, apontou também índices mais altos de infidelidade e problemas conjugais. Neste sentido, sugere-se que a Internet é um meio para conhecer pessoas e iniciar um relacionamento, entretanto para desenvolver o relacionamento, com mais intimidade, paixão, decisão/compromisso e qualidade conjugal recomenda-se que ocorra em contexto presencial. / Technological advances makes the Internet a powerful tool, capable of overcoming great distances to enable communication between people from different locations in real time. With that, there was also a growth of users in social networs, social networking sites and chat rooms. These tools have led these people located in different geographic regions to know each other and develop different types of relationships, including loving ones. Recognizing that the current data show the increasing rate of loving relationships tha develop exclusively on the internet, this paper aims to compare the loving relationships mediated by the Internet with loving relationships that are not mediate by the Internet, with regard to love, marital quality and conception of infidelity. This research, with a quantitative design was conducted with 86 Internet users that were divided into two groups (43 in loving relationships mediated by the Internet and 43 in loving relationships unmediated by the Internet). The thesis document is composed of three articles. In the first one, is exposed a discriminant profile between loving relationships mediated and unmediated by the Internet. On the second, is presented the comparison of the groups with regard to marital quality and the three components of love: intimacy, passion and decision/commitment. Finally, in the third article, we present the concepts of Internet users os issues to infidelity. The results show that there are significant differences between the groups, indicating better marital quality, commitment, passion and intimacy in presencial loving relationships. Besides indicating longer access on social networks, chats and other leisure activities, the romantic relationship mediated by the Internet also showed higher rates of infidelity and marital problems. In this sense, it is suggested that the Internet is a way to meet people and start relationship, although the relationship to develop within more intimacy, passion, decision/commitment and marital quality is recommended that occur in presencial context.

The textuality of friendship : homosocial hermeneutic exchanges in early modern English drama

My thesis argues that textually embedded intimacy and exclusivity between men opens up ethical problems concerning the use of education and persuasive powers—the ability to reconfigure vice as virtue, to argue a case for transgressions, and to navigate political, economic, and social spheres for personal self-advancement. My argument is based first on the proposition that masculine elite friendship in the early modern period is situated in specific pedagogical practices, engagement with particular rhetorical manuals and classical texts, and manipulation of texts which determine the affectionate, ‘textual', nature of these relationships. From this, I propose, second, that a hermeneutic process of rhetorical and poetic composition and exclusionary understanding is embedded within these textual relationships. From these two propositions, I analyse the textual surface of homosocial relationships in order to ask questions about ethical dilemmas concerning the forms of power they represent. How can an enclosed system of affection be useful for political, social, or financial advancement by making a vice (self-interest) of a virtue (fidelity), a dubious idea in the early modern period? How are homosocial networks developed and depicted through an engagement with their own textuality? Are they shown as transgressive and dangerous in further marginalizing those who are not privy to the system of textual exchange between men? The creation of homosocial male friendships is predicated on the idea that there are shared texts and methodologies for internalizing ideas from classical sources (imitatio) and for using these as starting points for the creation of arguments (inventio) to suit social, political, and even domestic situations. I focus on fictitious relationships developed in early modern English drama—as playwrights represent masculine discourse, textual knowledge, and rhetorical techniques. The friendships and fellowships in these dramatic productions contain questions about the use of masculine networks in socio-political and economic navigation.

Currently, men’s responsibility is the focus of much of the public talk on gender equality in Sweden.This has given rise to a number of organisations carrying the overall ambition to include menin what has traditionally been regarded as a women´s issue. One of these initiatives is called #killmiddag,”dinner for guys”, and can be understood as a call out for men to get together and have intimateconversations with each other in order to free themselves from destructive masculinitynorms. In this thesis, the feminist equality initiative #killmiddag is scrutinized with the aim to findwhat possibilities and restraints the initiative might give rise to in regards to issues connected togender equality. The empirical material consists of the initiatives conversational guides and instructionsalong with a number of press articles published between the years of 2016-2018. In order toanalyze this material, specifically the role of conversations, experience and emotions this thesis usesresearch about therapeutic discourse and how this is linked to contemporary ideals about intimacy.This analysis focuses on how problems and solutions are articulated discursively, and how categorieslike ”gender equality” is filled with meaning. Using research concerning the effects of marketbasedforms of governing, my goal is to further contribute to a discussion about what happens with”gender equality” when market rationalities come to replace conflicting interests in politics. Assistedby a poststructuralist approach this thesis highlights some of the problems in using personalexperience as a source of objective knowledge, and how the use of emotions and intimacy, withtheir inbuilt epistemological fragility, might not necessarily be considered apt when striving for politicalchange.

"In our house we're not terribly sexual" : exploring the barriers to supporting intellectually disabled people in the area of sexuality and intimacy : a thesis presented in fulfilment of the requirement for the degree of Doctor of Philosophy, Sociology, Social Policy and Social Work, Massey University, Palmerston North, New Zealand

How support workers enable, regulate or constrain the sexual expression of intellectually disabled people who live in service agency group homes is the subject of this thesis. A general literature search of what intellectually disabled people currently experience in their lives, including their experiences in the area of sexuality and intimacy, begins this investigation. Secondly, an extensive literature review of the support role, incorporating an appraisal of past and current issues related to the support position in general and to the area of sexuality support in particular, was completed. What intellectually disabled people themselves would like in relation to sexuality and intimacy support was included in this section. Thirdly, a review of research studies focussing on the operation of the support position within service agency systems was undertaken. These explorations revealed a high degree of reluctance on the part of workers to provide assistance in the sexuality area, despite a proven necessity for support to be made available to the intellectually disabled people they worked with. Review research studies suggested a variety of causal factors in explanation of this reluctance. These suggestions link to two meta-reason positions. Failure to prove support either stemmed from individual worker’s inactions due to ignorance and/or incompetence, or from wider systemic failures on the part of agency services to positively value and support this key service role in this area. However, little if any analysis of the possible influence of the broader social, emotional and cultural contexts, in which the concepts ‘sexuality’ and ‘(intellectual) disability’ are located, could be found in the studies reviewed. Eleven in-depth interviews were conducted with front-line support workers about their sexuality support practice. Preliminary readings of the interview texts revealed a similar reluctance on the part of the workers concerned to assist those they worked with in this area. Interview texts were then subjected to a post-modernist inspired, interpretive discursive analysis. This analysis uncovered and tracked how key power/knowledge effects inherent in the terms ‘(intellectual) disability’, ‘sexuality’, ‘gender’ and ‘desire’ inhering in the concept of an ‘ideal (sexual) couple’ interweave to shape the ‘no support necessary’ practice responses held in worker’s interview talk. From this exploration it is suggested that research studies of workers’ practices as an aspect of the promotion of change in support outcomes in the sexuality support area need to go beyond the parameters of recommendations that stem from considerations of either individual or systemic limitation alone. It remains a convincing point to suggest that poorly performing workers need retraining in this area and the overall value of the support role within service organizations needs reshaping. However, future research recommendations also need to engage more directly and effectively with the effects of the wider social and emotional “ideal (sexual) couple” ambiguities that also influence worker’s lack of assistance in this complex and sensitive support area. The use of a post-modern perspective as a helpful conceptual tool in unpacking the power these ambiguities hold within the support position is offered as a productive way forward for future research and practice development.

Options for developing a new mid micron value proposition for consumers

The research for this thesis "Options for Developing a New Mid Micron Value Proposition for Consumers", is a part of a larger "New Mid Micron Products" project initiated by Mid Micron New Zealand Inc with the key goal of turning the Mid Micron Sector into a more vibrant and profitable one. The motivation for the project can be found in the dramatic fall in demand for New Zealand Mid Micron wool over the past decade. Two dominant causes for the fall in demand for Mid Micron wool were identified: the substandard skin comfort of final products made from Mid Micron wool, and a problem with the structure of the Mid Micron Sector. These problems are addressed in the "New Mid Micron Products" project that combines new product development and new marketing initiatives. Product development involved the use of new spinning technology to improve skin comfort quality and develop new products that are softer and prickle free. The aim is to extract more value for woolgrowers by having the wool converted into a higher value product. The new marketing initiatives, which were identified in this thesis research, Focusing On New Market Segments via E-Commerce and Reconfiguring The Value Chain, and concentrate on the operational issues of capturing the value from the newly developed Mid Micron products. Taking into account the nature of the overall Mid Micron Project and type of developed products, this research identified the Operational Excellence and Product Leadership models as alternative routes to develop a new Mid Micron Value Proposition for consumers. Operational Excellence, and the associated Cost Leadership strategy, is a low capital investment option, while Product Leadership and the associated Differentiation strategy is a high capital investment option. The models' principles and their elements, products, price and delivery to market, are evaluated in the context of the Mid Micron Business.

The borderland between care and self-care

<p>The aim of this thesis was to examine different approaches to support the self-care of persons with Type 2 diabetes, with special reference to practical, social, and sexual aspects of women's self-management. The methods to elucidate this comprised: evaluating a new model for diabetes patient education; designing a model to analyse the role of social networks in women's diabetes; conducting individual and focus group interviews for deeper understanding of the social and sexual aspects of diabetes; and collecting questionnaire data as a complement to the above.</p><p>The experience-based educational program led by pharmacists was found to improve participants' subjective control over diabetes and to provide important emotional support and encouragement to continue self-care. Metabolic control as measured by HbA<sub>1c</sub> temporarily improved. The social network model elucidated potential mechanism leading to conflict of disease and social demands in women's diabetes. Qualitative analysis of the focus group interviews pointed to the role of guilt, shame, and social taboo in connection with the women's diabetes and sexuality.</p><p>Borderland is the metaphor I have chosen to describe the space between the traditional health care system and the everyday self-care of people with chronic disease. Using Borderland as a framework, a future model for diabetes management, anchored in our own and other's findings, is outlined and the concept of "Disease Manager Role" is introduced. The vision of a self-care support center in Borderland addresses such issues as accessibility, continuity, equitable provider-user relations, shared care plans, and strengthening social support.</p>
