[pt] A presente dissertação diz respeito a um dos temas centrais da Teoria do Direito: o conceito de sanção. Muitos dos conceitos jurídicos básicos - inclusive o próprio conceito de Direito - encontram-se estritamente conectados com ele, de forma que um estudo cuidadoso sobre esse tema possibilitará que muitas outras questões fundamentais do Direito sejam, senão resolvidas, ao menos aclaradas. As inúmeras subdivisões que a complexidade do tema acarreta tornaram necessárias delimitações quanto ao objeto de estudo. Portanto, dentro da ampla esfera interessante ao pesquisador empenhado em deslindar o tema, optou-se por centrar a pesquisa em objetivos mais modestos: o de reconhecer e apresentar os principais problemas que encerram o conceito de sanção para a teoria do direito em três autores específicos - Jeremy Bentham, John Austin e Hans Kelsen - pertencentes a uma mesma tradição de pensamento jurídico, a Teoria Analítica do Direito (analytical jurisprudence). Tal escolha é facilmente justificável, em virtude da centralidade do conceito em suas concepções de Direito. / [en] The present work refers to one of the central subjects of the Legal Theory: the concept of sanction. Many of the basic legal concepts - and the concept of Law itself - are strictly connected with it, in such a way that a careful study on this subject will make possible that many other basic questions of the Law are, if not solved, at least clarified. Because of the innumerable subdivisions caused by that the complexity of the subject, it had become necessary to delimitate the studied object. Therefore, within the wide area of interest presented by the subject, the researcher has opted to focus his/her work on more modest objectives: to recognize and to present the main problems concerning the concept of sanction inside the work of three specific authors - Jeremy Bentham, John Austin and Hans Kelsen -, being them all part of the same legal thought tradition, the analytical school of jurisprudence. Such choice is justified by the unquestionable importance that the authors confer to the sanctions in their legal theories.

Este trabalho é sobre idéia de governo no pensamento político do filósofo moral e do direito, radical político e teórico constitucional inglês Jeremy Bentham (1748- 1832). Após uma breve exposição dos principais temas e questões exploradas, bem como, dos respectivos momentos da sua vida intelectual, argumento a favor de que é possível extrair da crítica política e jurídica de Bentham a Blackstone alguns elementos da sua concepção de governo e visão sobre a política. Argumenta-se a favor de certa convergência entre as posições de Bacon e de Bentham com relação aos projetos de reforma penal, concepção de governo, métodos de investigação e ontologia da política. Também, é explorada a sugestão de que tal convergência pode ser explicada em virtude dos princípios filosóficos similares adotados por ambos. A principal conclusão é a de que a linha de interpretação discutida pode fornecer uma melhor compreensão sobre as conexões entre a variedade de assuntos explorados nos escritos jurídicos-políticos de Bentham. / This work is about the idea of the government in the political thought of the English utilitarian moral and legal philosopher, political radical and constitutional theorist Jeremy Bentham (1748-1832). After a brief exposition of the main themes and questions explored by him and the respective moments of his intellectual life, give evidence it is possible to extract from Bentham´s political and juridical criticism to the Blackstone some elements of his government conception and vision about politics. It is argued in favor of some convergence between Bacon´s and Bentham´s positions concerning legal reform projects, government conception, investigation methods, and political ontology; also, the suggestion that it can be explained by their similar philosophical principles is explored. The main conclusion is that the line of the interpretation discussed can provide a better understanding about the connections among the variety of the issues concerning the government theme explored in the Bentham´s juridical-political works.

George Orwell’s Nineteen Eighty-Four, first published in 1949, is a vision of socialism gone wrong. The setting of Oceania is a world ruled over by an oligarchical collective, “The Party,” which wields absolute power through a formidable combination of surveillance technology and the operation of the principles of “panoptic control,” a concept drawn from Jeremy Bentham’s model prison design of the late 1700s and revived by Foucault in the mid 1970s. The combination of surveillance technology and panoptic control is central to the functioning of power in Orwell’s novel, a union which has created a self-sustaining form of totalitarianism dependent on the oppression of individual identity for its automatic perpetuation. This essay offers a reading of Nineteen Eighty-Four as an implicit critique of Bentham’s Panopticon which in many ways foreshadowed the later work of Michel Foucault on the functioning of power within this specific type of physical and social architecture. / George Orwells roman 1984, vilken publicerades första gången 1949, är en framtidsvision om socialism som gått fel. Romanen utspelas i Oceania, en värld som styrs av ett oligarkiskt kollektiv, “Partiet,” vilket utövar absolut makt genom en utstuderad kombination av övervakningsteknik och teorin om “panoptisk” kontroll, ett begrepp sprunget ur av Jeremy Benthams fängelsemodell från sent 1700-tal, vilket återskapades av Michel Foucault i mitten av 1970-talet. Political economy played a central role in the construction of the new Republic of Colombia through the influence of Ezequiel Rojas. In his pursuit of theoretical and practical guidance to organize a new society of free individuals pledged to happiness, Rojas looked to political economy for inspiration. However, the sources that Rojas drew on did not belong to the tradition of classical political economy; he based his own approach on other, less traditional sources; namely utilitarianism and ideology. In this text I aim to reconstruct this approach, showing its tensions and contradictions and the way in which Rojas tried to address them through religion. / La economía política jugó un papel importante en la construcción de la nueva República de Colombia en cabeza de Ezequiel Rojas. En busca de elementos teóricos y prácticos para organizar una nueva sociedad de individuos libres y destinados a la felicidad, Rojas buscó en la economía política inspiración. Sin embargo, no era la economía política clásica la que Rojas difundía en sus enseñanzas. Rojas construyó su propia propuesta a partir de tradiciones e influencias menos usuales: el utilitarismo y la ideología. En este texto pretendo reconstruir esa propuesta, mostrando sus tensiones y contradicciones y la manera como Rojas intentó conciliarse recurriendo a la religión.

Surveillance in Nineteen Eighty-Four : The Dismantling of Privacy in Oceania / Övervakning i 1984 : Nedmonteringen av privatliv i Oceania

The purpose of this essay is to analyze how certain elements of panopticism manage to dismantle the notion of privacy in George Orwell’s novel Nineteen Eighty-Four. By reading the text through a lens of panopticism, a theory introduced by Jeremy Bentham, I give examples on how the surveillance methods used by the Party share similarities with the system of surveillance within a Panoptic prison, but also in what ways that they differ. In the end, it is obvious that the society of Oceania cannot be considered to be a complete Panopticon, although several elements of panopticism are present within the text and that they dismantle the aspect of privacy in the novel.
