The present work has as an objective to study the environmental policy of the
State of Rio Grande de Sul, considering environmental legislation passed by the State s
Legislative Assembly (Assembléia Legislativa Gaúcha) and other actions made by
representatives of the main associations and political parties in the state. There was
made a bibliographic review of the contemporary environmental sociology theories with
the subsequent empirical approach in order to facilitate the understanding of possible
rationality of political actions, their motivations, definitionsand other issues present in
public discussion of state s Parliament (Parlamento Gaucho). / O presente estudo teve como objetivo estudar os aspectos políticos ambientais
do Estado do Rio Grande do Sul, considerando a ação empregada pelos agentes
políticos, representante das principais agremiações partidárias no Estado, na produção
da legislação ambiental aprovada pela Assembléia Legislativa Gaúcha. Para tanto foi
realizada a revisão bibliográfica acerca da Teoria Sociológica Ambiental
contemporânea, com a posterior aplicação da abordagem empírica do estudo, no intuito
de viabilizarmos o entendimento da possível racionalidade da ação realizada pelos
atores políticos, considerando as suas motivações e definições dos problemas
levantados na esfera pública de discussão do Parlamento Gaúcho.

This article discusses on the new theory of legislation. It is presented considering its antecedents, and its treatment from sociology of law to the current state of its development. It is make emphasis on the interdisciplinary nature of this theory for a better understanding of the legislative process, without failing to acknowledge the importance of its legal status. / El presente artículo nos introduce a la denominada “Nueva Teoría de la Legislación”. Se presenta sus antecedentes, así como su tratamiento desde la Sociología del Derecho al su estado actual de desarrollo. Por otra parte, se hace énfasis en la naturaleza interdisciplinaria de esta teoría para un mejor entendimiento del proceso de creación de leyes, sin dejar de reconocer la importancia de su situación jurídica.

[pt] Esta dissertação tem como objetivo a análise e exposição da teoria da legislação
de Jeremy Bentham, configurando-se como um recorte metodológico e uma análise
eminentemente autoral. Na primeira parte, examina-se a origem dos elementos materiais
de sua teoria, destacando seu debate com William Blackstone à luz do Princípio da
Utilidade. A segunda parte aborda a sua proposta relacionada aos aspectos formais e
estruturais das leis, apresentando a Nomografia de Bentham como uma consolidação de
regras para prevenir defeitos nos textos legislativos. A terceira parte abrange críticas feitas
por alguns autores à teoria de Bentham. A conclusão tentará demonstrar os pontos
positivos e negativos da teoria benthamiana, dando encerramento do trabalho. / [en] The present work has as its main purpose to analyze and expose Jeremy
Bentham s theory of legislation, constituting a methodological cut and an authorial
analysis. In the first part, the origin of the material elements of his theory is examined,
highlighting his debate with William Blackstone in the light of the principle of utility.
The second part addresses his proposal related to the formal and structural aspects of laws, presenting Bentham s Nomography as a consolidation of rules to prevent defects in
legislative texts. The third part encompasses criticisms made by some authors of
Bentham s theory. The conclusion will attempt to demonstrate the positive and negative
topics in Bentham s theory, providing closure to the research.

F. A. Hayek's Critique of LegislationHolm, Cyril January 2014 (has links)
The dissertation concerns F. A. Hayek’s (1899–1992) critique of legislation. The purpose of the investigation is to clarify and assess that critique. I argue that there is in Hayek’s work a critique of legislation that is distinct from his well-known critique of social planning. Further that the main claim of this critique is what I refer to as Hayek’s legislation tenet, namely that legislation that aims to achieve specific aggregate results in complex orders of society will decrease the welfare level. The legislation tenet gains support; (i) from the welfare claim – according to which there is a positive correlation between the utilization of knowledge and the welfare level in society; (ii) from the dispersal of knowledge thesis – according to which the total knowledge of society is dispersed and not available to any one agency; and (iii) from the cultural evolution thesis – according to which evolutionary rules are more favorable to the utilization of knowledge in social cooperation than are legislative rules. More specifically, I argue that these form two lines of argument in support of the legislation tenet. One line of argument is based on the conjunction of the welfare claim and the dispersal of knowledge thesis. I argue that this line of argument is true. The other line of argument is based on the conjunction of the welfare claim and the cultural evolution thesis. I argue that this line of argument is false, mainly because the empirical work of political scientist Elinor Ostrom refutes it. Because the two lines of argument support the legislation tenet independently of each other, I argue that Hayek’s critique of legislation is true. In this dissertation, I further develop a legislative policy tool as based on the welfare claim and Hayek’s conception of coercion. I also consider Hayek’s idea that rules and law are instrumental in forging rational individual action and rational social orders, and turn to review this idea in light of the work of experimental economist Vernon Smith and economic historian Avner Greif. I find that Smith and Greif support this idea of Hayek’s, and I conjecture that it contributes to our understanding of Adam Smith’s notion of the invisible hand: It is rules – not an invisible hand – that prompt subjects to align individual and aggregate rationality in social interaction. Finally, I argue that Hayek’s critique is essentially utilitarian, as it is concerned with the negative welfare consequences of certain forms of legislation. And although it may appear that the dispersal of knowledge thesis will undermine the possibility of carrying out the utilitarian calculus, due to the lack of knowledge of the consequences of one’s actions – and therefore undermine the legislation tenet itself – I argue that the distinction between utilitarianism conceived as a method of deliberation and utilitarianism conceived as a criterion of correctness may be used to save Hayek’s critique from this objection.
