Darbo objektas – Marijampolės savivaldybės greta ,,VIA Baltica“ kelio žemės paėmimas visuomenės poreikiams. Tyrimo tikslas – nustatyti žemės paėmimo visuomenės poreikiams projektų rengimo problemas. Tiriamasis darbas atliekamas analizuojant teisės aktus, teritorijų planavimo dokumentus ir statistinius duomenis. Tyrimui įgyvendinti iškelti uždaviniai: 1. Išnagrinėti teisės aktus, reglamentuojančius žemės paėmimą visuomenės poreikiams; 2. Nustatyti žemės paėmimo visuomenės poreikiams projektų rengimo problemas; 3. Išanalizuoti situacija susijusią su ,,VIA Baltica“ keliu; 4. Statistiškai išnagrinėti šalia ,,VIA Baltica“ kelio paimamus visuomenės poreikiams žemės sklypus. Tyrimo metodika: Siekiama išanalizuoti žemės paėmimo visuomenės poreikiams procesą, bei nustatyti problemas susijusias su žemės paėmimu visuomenės poreikiams projekto rengimu ir išnagrinėti žemės paėmimo visuomenės poreikiams atvejį Marijampolės savivaldybėje atlikta literatūros šaltinių analizė, dokumentų analizė, sisteminė analizė, panaudoti loginis-analitinis, lyginamasis ir kiti moksliniai metodai. The aim of the research is to define the plan preparation problems of land acquisition for public needs. Research work is conducted by analyzing legislation, territory planning documents and statistic data. The objectives for the implementation of the study are as follows: 1. To investigate the legislation governing land acquisition for public needs; 2. To identify the plan preparation problems of land acquisition for public needs; 3. To analyze the situation in relation to ”Via Baltica” road; 4. To analyze statistically the land acquisition for public needs near ”Via Baltica” road. The period of analysis, from 1850 to 1888, was chosen for being an important transition period in the country, marked, above all, by the Lei de Terras of 1850 and the abolition of slavery. It is also comprised within this time frame the early days of the transition of the production model in the region, away from the raising of animals and the production of foods destined for immediate necessities, to a model founded on coffee plantations, a model that already featuring capitalistic traits, modeled on a more disciplined and continuous work regime. The main documental scope that guides the research is a collection of civil lawsuits concerning land questions. Nonetheless, I combine the lawsuits with other sources, like land registries, censuses, Almanaques and journals. Despite sharing a semantic similarity, as well as a common etymological origin with the word “ownership”, “squatters” (“posseiros”) and “owners” (“possuidores”) will take on opposite meanings in the context of agrarian disputes of the 19th century: the former were stigmatized as poor invaders who did not have the means to make the land productive and to legalize it; the latter were the ones who, besides having ownership of the land, also possessed land titles. However, the construction of these categories is not as linear as it might seem at first sight. On many occasions, social and political prestige would supplant the necessity for proof of property titles. Small and medium-sized farmers had a hard time transforming their lands into legal property. Thus, I put forward the hypothesis that “posseiros” and “possuidores” are categories that, far from being fixed and having stable definitions, outline a historical process of conflict. In this way, I seek to comprehend the object of my research, in the light of the notions of primitive accumulation present in Marx, and most of all, in Thompson; and the notion of stigma, present in Goffman and Norbert Elias. I also intend to find out, with the chosen theoretical and empirical foundations, how a group of free laborers earned their place in the social dynamics of the region at the time. / Esta pesquisa tem como objetivo analisar os conflitos sociais durante o processo de estruturação fundiária da região que compõe o atual município de São Carlos-SP, durante a segunda metade do século XIX. A delimitação temporal – entre 1850 e 1888 - foi escolhida por se tratar de um privilegiado período de transições no país, marcadas, sobretudo, pela Lei de Terras de 1850 e pela abolição da escravidão. Também é dentro desse período que se inicia na região a transição de um modelo de produção voltado para a criação de animais e cultivo de gêneros de primeiras necessidades, para o empreendimento cafeeiro, modelo já com traços capitalistas, assentado em uma disciplina de trabalho mais rígida e contínua. O escopo documental primordial que rege a pesquisa é um conjunto de processos cíveis acerca de questões ligadas à terra. Entretanto, faço o cruzamento dos processos com outras fontes, como registros de terras, recenseamentos, Almanaques e jornais. Apesar de guardarem uma similaridade semântica e uma mesma origem etimológica em torno da palavra posse, posseiros e possuidores vão ganhar significados diametralmente opostos no bojo das disputas agrárias durante o século XIX: os primeiros ficaram estigmatizados como invasores pobres que não dispunham de recursos para deixar a terra produtiva e para legalizá-la; já os segundos são os que, além da posse, tinham o título de propriedade de seu território. Entretanto, a construção dessas categorias não é tão linear quanto aparenta. Muitas vezes o prestígio político e social suplantava a necessidade de comprovação dos títulos de propriedade. Já pequenos e médios lavradores por vezes sofriam para transformar sua posse em propriedade. Assim, parto da hipótese que posseiros e possuidores, são categorias que, longe de serem estanques e de terem definições seguras, demarcam um processo histórico de conflitos. Assim, procuro compreender meu objeto de pesquisa à luz dos conceitos de acumulação primitiva, presente em Marx e, sobretudo, Thompson, e de estigma, presente em Goffman e Norbert Elias. Pretendo também encontrar, com a mobilização empírica e teórica escolhida, como o grupo de trabalhadores nacionais livres conseguiu um lugar nas dinâmicas sociais da região à época.

De la propriété du sol en volume / Land property expressed as a volume

La propriété foncière du Code civil, unitaire par principe, s’accommode difficilement de l’ubiquité du droit de superficie, comme en attestent les incessants débats doctrinaux sur le sujet. Le volume immobilier moderne a répondu aux besoins de division du sol du corps social. Toutefois, en dématérialisant l’immeuble, le volume déstabilise fortement la théorie classique de la propriété. La présente thèse définit un concept de sol appropriable et divisible dans le sens de la hauteur, sans renier la propriété du code. Pour cela, le sol, incluant le dessous et le dessus, est perçu comme relevant du monde tangible. Ce bien est ensuite appréhendé en trois dimensions par un procédé de géométrisation. Le sol volumique correspond à une nouvelle phase plus abstraite de conceptualisation du sol. Cependant, la chose sensible signifiée par le concept, le sol ou fonds de terre selon les juristes demeure la même ; seule sa représentation a évolué. Dans cette perspective, le sol en volume devient individualisable et appropriable sur le modèle du sol parcellisé en deux dimensions, indispensable à une propriété individuelle et exclusive. Ainsi, la propriété du Code civil via ses dispositions actuelles, notamment les articles 552, 518 et 544, s’applique à un volume immobilier comme à une parcelle. Ce modèle de propriété passant de l’unité à la division, est complété par un droit de superficie simple, droit réel fondé sur les articles 553, 543 du Code civil et le droit de jouissance spéciale. Suivant la thèse moniste, la propriété du sol en volume, qui n’est autre que le concept de propriété du code appliqué à un sol tridimensionnel, concilie la théorie classique de la propriété et celle du doyen Savatier. / The concept of land property in the Civil Code, unitary by principle, has always been in difficulty when facing the ubiquitous “droit de superficie”, as evidenced by the never-ending doctrinal debates. The modern concept of property “volume” has responded to the social need for division of the land. However, with volume, real estate properties become incorporeal things and destabilize the classical theory of property, which is synonymous with corporeal things. This thesis defines a concept of land property appropriable and divisible relative to height, compatible with the Civil Code’s land law. For this, land, including the subjacent and superjacent domains, is perceived as part of the tangible world. This land is then comprehended in three dimensions via a geometrical approach. Land with three-dimensional significance corresponds to a new phase of conceptualization of the land that is more abstract. The physical part, however, which the concept refers to, ie the land, remains the same; only its representation has evolved. Applying this perspective, the land expressed as a volume becomes a unit appropriable on the model of land divided in two dimensions. Consequently, the concept of property in the Civil Code under its current wording, notably clause 552, but also 518 and 544, applies to land expressed as a volume as to a parcel. This property model able to divide the land vertically as well as horizontally is also capable to organize a land division comparable to a long lease. This complementary concept is based on clauses 553, 543 of the Civil Code. Developing the monistic thesis, the ownership of the land when seen as a volume reconciles the theory of the dean Savatier and the classical theory of property.

Property reallotment is a measure that is done in accordance with the FBL. Property reallotment may involve a change in the division of property. Esements can beformed, changed and canceled through property realloments and joint property units can be formed and changed. For example, a change in the division of property unitsmay apply to partition, subdivision and amalgamation of properties and entails a forming of the property in question. The measure can be implemented by agreement between the property owners and also with coercion. Such a measure entails a large encroachment of individualproperty rights and is therefore protected by a number of terms. Reallotment may only be enforced if it meets the terms that protect public and private interests. Theseare regulated in Chapters 3 and 5. FBL. This thesis focuses on the protection of the individual interests, which are mainly regulated in Chapter 5, 4–8, §§ FBL. In thecase of voluntary agreements, these terms may be agreed upon. The purpose of this thesis is to present and clarify how the improvement and advantage terms for property reallotment are applied in the courts. The thesis alsoexplains what legitimates coercive rules. A case review of about 20 cases has been made to find a pattern in how the courts interpret the requirements in theparagraphs. In order to find relevant cases that deal with the terms, all cases in the LMRR between 2009 and 2020 were reviewed. In addition to the cases, legislativehistory and doctrine have also been studied. The conclusion describes examples of occasions when the terms are usually considered to be fulfilled and the factors that are used in the assessments. What isclearly evident is that what is usually regarded as an improvement or advantage of a property regulation is of an economic nature.

Rights to property, rights to buy, and land law reform : applying Article 1 of the First Protocol to the European Convention on Human Rights

This dissertation examines the application and effect of Article 1 of the First Protocol to the ECHR in relation to Scots land law reform. Chapter one will reflect on why existing rights to property have come to be challenged. Chapter two sets out the human rights paradigm and scrutinises what rights and whose rights are engaged. Chapter three traces the development of A1P1. Chapter four applies the human rights paradigm to contemporary reforms. Chapter five considers the broader effect A1P1 has had on domestic property law. This dissertation submits that the problem to be overcome is that, in many instances, Scots land law reform has been reduced into a simplistic struggle. A1P1 has been held up as either a citadel protecting landowners or as an ineffective and unjustified right to be ignored. At the core of this debate are competing claims between liberal individualist rights to property and socially democratic, egalitarian goals. This dissertation argues that it is important to move beyond this binary debate. This is not about finding some mysterious "red card" or eureka moment that conclusively shows compatibility or incompatibility. Instead, compatibility will be determined by following a rule-based approach that values rational decision-making and the best available evidence, as well as the importance of democratic institutions. As such, it will be illustrated how future challenges are likely to focus not on the underlying purpose of land law reform but on the macro or micro granularity of Ministerial discretion. In coming to this conclusion, it will be argued that A1P1 has a pervasive influence on the entire workings of all public bodies and, like a dye, permeates the legislative process.

Syftet med detta arbete är att, dels ur ett fastighetsrättsligt perspektiv, dels ett folkrättsligt perspektiv, utreda om Sveriges urbefolkning samerna kan sägas ha förvärvat en äganderätt till marken i Lappland enligt svensk rätt, eller om detta enbart handlar om en bruksrätt inkluderande renskötsel, jakt och fiske. Vad gäller det fastighetsrättsliga perspektivet har samerna haft en mycket stark fastighetsrättslig ställning på 1600- och 1700-talet. Då behandlades samernas lappskatteland som sådan skattejord, som skattebönderna sedermera genom lagstiftning automatiskt förvärvade full äganderätt till. Så skedde dock inte för samernas del. I stället trängdes de undan från stora delar av sina ursprungliga marker på grund av bl.a. kolonisation, exploateringsintressen, samt nedvärdering av nomadkulturen. Från att ha varit i stor majoritet blev de en minoritet på sina gamla marker. Dessa marker har sedermera kommit att betraktas som kronojord i statens ägo, vilket innebär en stor förskjutning av samernas fastighetsrättliga ställning inom loppet av fyra sekler. Gällande rätt garanterar inte samer som är medlemmar av en sameby någon starkare rätt än en bruksrätt, som till vissa delar är svagare än vad som gäller för andra bruksrättsinnehavare i Sverige. The question is dealt with from a land law as well as an international law approach. Concerning the land law approach, the Sami people has had a very strong position close to ownership during the 17th and 18th centuries. At that time, the Samis paid tax for their lands, which meant that they were not considered to belong to the Crown, but were treated in the same way as the independent farmers’ lands. However, while the farmers through a declaration from the King in 1789 automatically achieved full ownership of their lands, the Sami people did not. Instead, the Samis were pressed back from large parts of their original territory because of colonisation, exploitation and depreciation of their nomadic way of living. Once a majority, they found themselves a minority in their own land and their territory had become the Crown’s property. Undoubtedly, there has been an extraordinary shifting of the Sami people’s land rights within four centuries. Current law does only guarantee the members of the Sami villages the right to use land for reindeer breeding, hunting and fishing, and this right is in some aspects even weaker than that of other Swedish citizens with similar rights. Still, case law does not exclude the possibility that reindeer breeding could have originated right of ownership, especially in Lapland. My findings on this area are that there is convincing evidence that the Sami people has acquired right of ownership on the lands which they traditionally occupy all year around. On the lands that they share with others, they have a strong right to use the land during the winter, probably stronger than the legislation provides for. What concerns the international law approach, Swedish legislation does fulfil the minimum demands according to the conventions the country has ratified. Still, Sweden has been criticized of not finding a balanced solution to and improving legal certainty on Sami land rights. Sweden has not ratified the ILO Convention no. 169 con-cerning indigenous and tribal peoples in independent countries. The reason for this is mainly the article which aims at strengthening the indigenous peoples’ land rights, which Sweden does not find compatible with national law. Still, one can hope that the ongoing international development on the area will show the way, and that Sweden will pay attention to it in future legislation.

On the lands that they share with others, they have a strong right to use the land during the winter, probably stronger than the legislation provides for.</p><p>What concerns the international law approach, Swedish legislation does fulfil the minimum demands according to the conventions the country has ratified. Still, Sweden has been criticized of not finding a balanced solution to and improving legal certainty on Sami land rights. Sweden has not ratified the ILO Convention no. 169 con-cerning indigenous and tribal peoples in independent countries. The reason for this is mainly the article which aims at strengthening the indigenous peoples’ land rights, which Sweden does not find compatible with national law. Still, one can hope that the ongoing international development on the area will show the way, and that Sweden will pay attention to it in future legislation.</p>

Die vorliegende Arbeit prüft unterschiedliche Einflussfaktoren und deren Auswirkung auf die Merkmale informeller Siedlungen. Hypothese ist, dass die Morphologie und weitere physischen Merkmale informeller Siedlungen trotz der Wirksamkeit lokaler und kulturspezifischer Rahmenbedingungen auf die Wirkung bestimmbarer Einflussfaktoren zurückgeführt werden können, die entsprechend erkennbarer und prognostizierbarer Gesetzmäßigkeiten wirken. Es werden die Gesetzmäßigkeiten geprüft, die mit informeller Stadtbildung in Verbindung stehen und sich in Morphologie und weiteren physischen Merkmalen von informellen Siedlungen äußern. Dabei werden konstante und variable Faktoren unterschieden, die bei der Ausbildung informeller Stadtstrukturen wirken. Die meisten Faktoren stellen sich als variabel heraus. Mit dem Verständnis über deren Bedeutung und Zusammenhänge kann daher die informelle Siedlungsbildung beeinflusst werden und Planungsempfehlungen können für schnell und informell wachsende Städte formuliert werden. Die Morphologie und bautypischen Merkmale informeller Siedlungen sind prognostizierbar und die Folgen bestimmter Entscheidungen einschätzbar. Die Beeinflussung der Einflussfaktoren ist insbesondere auf der Ebene von Politik und Gesetzgebung möglich. Fast alle Handlungs- und Planungsentscheidungen müssen das Bodenrechtssystem und die vorliegenden Verhältnisse des Bodeneigentums beachten. Als Fallstudien dienen fünf Städte in Afrika, die von einer Bandbreite an Rahmenbedingungen beeinflusst werden und die aktuell einem besonders rasanten, doch jungen Verstädterungsprozess ausgesetzt sind. In Afrika finden sich unterscheidbare Rechtssysteme, die zum Teil aus der Kolonialgeschichte hervorgehen. Die Wahl der Beispiele wurde während der Bearbeitung und Vertiefung des Themas getroffen. Vor allem fußt die Analyse auf Originalmaterial, das die Autorin durch eigene Aufenthalte zusammengetragen und erhoben hat. Spezielle Planunterlagen, Planungs- und Gesetzesinformationen waren im Allgemeinen nicht anders aufzufinden. Es gibt auch nur wenige vorangegangene, einzelne Analysen informeller Siedlungen aus architektonischer oder planerischer Sicht. Wie keine der wenigen vorhandenen Analysen beansprucht diese Arbeit nun das Erarbeiten der Zusammenhänge von Rahmenbedingungen und Siedlungscharakteristik unter Beleuchtung der Bandbreite informeller Siedlungsformen. Von Bedeutung ist daher die intensive Arbeit mit dem Kartenmaterial auf Siedlungs- und Bebauungsebene, dessen Betrachtung vor dem Hintergrund landesspezifischer Informationen und die Erkenntnisgewinnung aus dem Vergleich der ausgewählten Beispiele stattfinden. / This work examines the factors influencing the characteristics of informal settlements. Hypothetically, the morphology and other physical characteristics of informal settlements can be attributed to the effect determinable factors, which function with predictable regularities, despite a locally and culturally specific framework. Examined are those regularities, which are related to the formation of informal urban growth, and which are expressed in the morphology and further physical characteristics of informal settlements. Constant and variable factors are differentiated when examining their influence on informal urban morphologies. It is discovered that most factors can be influenced on the level of politics and legislation and therefore, the formation and the physical characteristics of informal settlements can be steered. Planning recommendations for fast, informally growing cities can be formulated and the consequences of planning and policy decisions can be predicted equally. Nearly all action and planning decisions must consider the local juridical system and specific conditions of land ownership. The research clearly shows that the physical form of informal urban development, i.e. morphology and townscape, is directly connected to the given land ownership system in a country in general, and to the land rights specifically for settled land. In other words, current as well as former land ownership conditions in a country influence the physical characteristics of the informal settlements. In principle, the land law determines type, extent and functioning of plot allocation and transfer processes; and indirectly, the type and degree of nonconformity to this legal defines the type, extent and functioning of the informal land market. The research is based on case studies in five African cities with varying legal, administrative, historic and cultural frameworks, and which are currently exposed to a rapid process of urbanization, which has started only recently. In Africa, there are distinguishable juridical systems, which partially result from colonial history. Above all, the analysis is based on original material, which was gathered by the author during field research. There are only few analyses of informal settlements, which take an architectural or planning perspective, and those are limited to individual settlements. This work now stresses the interrelation of different aspects in the framework with physical settlement characteristics, while analyzing the respective range of informal settlement forms for each case example.

In second half of 15th century, Bohemia was confronted with many social changes. One of the most important was the effort to codify land law which was finalized by the publishing of Vladislaus's land law. It's leading author was Albrecht Rendl of Ousava. Because of it Rendl became well known among his contemporaries and in general historical awareness. There are only few known facts about the rest of his life. He served as royal prosecutor for a long time, but he also obtained two of the highest land offices - the supreme land scribe and the prosecutor. Rendl represents a kind of person able to promote himself to the highest points of contemporary policy due to his formidable personal abilities.
