Land-Based Coral Nurseries: A Valuable Tool for Production and Transplantation of Acropora cervicornis

Coral nurseries have become a popular and successful method to produce coral fragments for reef-restocking and restoration projects worldwide. Numerous in-situ coral nurseries have been established and many studies have focused on the most effective way to produce coral fragments in offshore nurseries. In contrast, production of coral fragments in land-based nurseries is rarely studied despite a growing knowledge of coral husbandry and coral aquaculture. Little data exist on the success of tank-raised corals when transplanted back into reef environments. This thesis presents the results of a study designed to assess the use of land-based coral nurseries in production of fragments of the Atlantic staghorn coral Acropora cervicornis for the purposes of reef re-stocking and restoration. The first objective of the study was to assess if A. cervicornis fragments can be produced in aquarium conditions at comparable rates to offshore nurseries. Fragments from the same wild donor colonies were placed in an offshore nursery and a land-based nursery and monitored for survival, growth, branch production, and branch thickness for 16 months. Survival was lower in the land-based nursery, largely due to a mechanical failure. Linear extension was lower in the land-based nursery until nursery conditions were evaluated and optimized. The optimization process included changes to water quality, temperature control, and lighting. Post-optimization, linear extension in the land-based nursery exceeded the offshore nursery, with a maximum monthly growth rate of 16.0 ± 5.3 mm month-1. The maximum monthly rate in the offshore nursery was 10.6 ± 4.1 mm month-1. Branch number and thickness were also lower initially in the land-based nursery, however both metrics increased rapidly after optimization. This experiment shows that A. cervicornis can be successfully grown in a land-based nursery, and that linear extension and fragment production can be higher than in offshore nurseries if environmental conditions are maintained within optimum ranges. This experiment highlights some of the conditions that promoted high linear extension rates in this species. The second objective of this study was to examine the success of corals outplanted from land-based nurseries and to determine whether corals reared in a land-based nursery would show the same growth and survival after transplantation as those reared in a traditional offshore nursery. This was examined in two experiments. In the first experiment, small fragments were outplanted from colonies reared offshore and from colonies reared in a land-based system. In the second experiment, larger colonies reared in the two separate land-based systems were outplanted to the same location. All transplanted corals were monitored for survival, growth, branch number, and incidence of predation, breakage, and disease over one year. Two major storm events occurred during this portion of the study, so the potential for differences in breakage or storm damage were also assessed. There were no significant differences in survival or growth of fragments outplanted from a land-based nursery and an offshore nursery. Colony outplants from one land-based location had better survival and growth than colonies from a second land-based location. Tropical storm activity greatly increased the occurrence of breakage and tissue loss in all groups, resulting in decreases in colony volume and additional mortality. Survival ranged from 85% to 100% after six months, and survival ranged from 70% to 89% after one year and the passing of two tropical storms. Small (5 cm) transplants did not have significantly lower survivorship than large transplants. Overall, the transplant of fragments and colonies raised in land-based nurseries was successful, as measured by growth and survival rates that were comparable to or exceeded those observed for corals raised in offshore nurseries. Large colony transplants exhibited the best survivorship and extension rates, but were also highly prone to breakage.

Utilisation de l’habitat et pressions anthropiques sur une population de rorquals à bosse (Megaptera novaeangliae) de Guadeloupe par suivi terrestre

Le sanctuaire Agoa est une aire marine protégée dans la zone économique exclusive (ZEE) des Antilles françaises qui fut créée en 2010 pour la conservation des mammifères marins et de leurs habitats. Il est connu que le rorqual à bosse fréquente les eaux des Antilles de décembre à mai pour la reproduction et la mise bas. Par contre, peu d’information existe sur l’abondance, le comportement, la distribution et les pressions anthropiques sur cette espèce aux Antilles et encore moins dans le sanctuaire. Cette maîtrise s’intéresse principalement à connaître cette espèce dans un secteur précis de cette aire marine et les liens qu’elle entretient avec certains utilisateurs humains de son habitat. Le tout vise à informer les intervenants en place, autant institutionnels qu’utilisateurs, vers une mise en place de mesures de conservation adaptées. Un suivi terrestre hivernal de plus de 300 heures, en 2012 et 2013, a permis de déterminer l’utilisation de l’habitat et les pressions anthropiques sur une population de rorquals à bosse fréquentant le sud de la péninsule de la Pointe-des-Châteaux en Guadeloupe. Il s’agit du premier suivi terrestre de cette espèce aux Antilles françaises et un des premiers dans l'arc caribéen. La zone d’étude couvre environ 264 km2 et serait une des zones les plus fréquentées de l’archipel guadeloupéen par l’espèce. À l’aide d’un théodolite, la trajectoire de 107 groupes différents (137,8 heures, 699 remontées) a été décrite. Les résultats montrent que la zone d’étude est principalement fréquentée en mars et avril, avec une abondance maximale au début du mois d’avril. La forte présence de baleineaux, particulièrement au mois de mars, pousse à croire que cette zone est utilisée comme pouponnière. Le comportement n’est pas aléatoire dans la zone d’étude et les trajectoires convergent vers certaines zones ayant possiblement un lien avec la bathymétrie. De plus, la zone marine à proximité de la Pointe-des-Châteaux pourrait potentiellement être un lieu de convergence des groupes. Ceux-ci se déplacent à vitesse réduite en direction ENE en général, à l’exception des femelles accompagnées de baleineaux qui prennent une orientation tout autre, c’est-à-dire vers le ONO, et ce à plus grande vitesse. Bien que la pression d’observation soit considérée comme modérée, une forte proportion des remontées se trouve dans les corridors de navigation présents dans la zone d’étude. De plus, le corridor de navigation des navettes entre Saint-François et La Désirade comporte le plus grand risque relatif de collision mortelle. Une réduction de vitesse des embarcations fréquentant le corridor des navettes diminuerait significativement le risque de collision mortelle. Ces pistes de réflexion mèneront sans doute à d’autres études plus poussées afin de continuer à en apprendre sur l’écologie de cette espèce fascinante. / The Agoa sanctuary, a marine protected area (MPO) covering the exclusive economic zone (EEZ) in the French Caribbean, was created in 2010 to protect marine mammals and their habitats. It is known that the Caribbean islands are used from December to May by humpback whales (Megaptera novaeangliae) as a reproductive area. However, sparse information exists on the abundance, the behaviour, the distribution and the anthropogenic pressures on this species in the Caribbean and even less in the sanctuary. This thesis focuses on increasing scientific knowledge about this species’ use of a part of the Agoa Sanctuary and their interactions with human users of the MPO. Such knowledge may inform stakeholders’ (institutional and individual) decision-making towards implementation of appropriate conservation measures. A land-based survey of more than 300 hours, in 2012 and 2013, was carried out to determine the habitat use of, and anthropogenic pressures on, a population of humpback whales frequenting the surrounding water of the Pointe-des-Châteaux peninsula in Guadeloupe. This is the first land-based survey of this species in the French West Indies and one of the first in the Caribbean. The study area of approximately 264 square kilometres is one of the most visited areas by this species in the Guadeloupe archipelago. Using a theodolite, 107 trajectories (i.e. groups of whales) were recorded, representing 137.8 hours and 699 surfacings. Results show that the abundance was higher in March and April with a peak in the first week of April. The high proportion of calves in this population, mainly in March, suggest that the study zone is a nursing area. Overall movement patterns are not random and may possibly be dictated by the bathymetry. Furthermore, trajectories seem to converge close to the Pointe-des-Châteaux. The average movement is slow and oriented in the same direction as the dominant current to the west of the Pointe-des-Châteaux (i.e. ENE), except for mother and calf groups that swim faster in the opposite direction (i.e. WNW). Even if the anthropogenic pressure may be consided as moderate, a high proportion of surfacing is located in some of the main maritime traffic corridors. In addition, the shuttle corridor between Saint-Francois and Désirade island has the greatest relative risk of fatal collision. A reduced speed for the shuttle corridor would lower significantly the collision risk. These findings may lead to more extensive studies to better understand the ecology of this fascinating species.

Its associated services and products are substantially contributing to economic growth and sustainable development of the country. However, it is internationally and nationally recognised that land-based marine pollution (LBMP) is the most important single risk to the health and sustainability of coastal and marine waters and the associated ecosystems. The regulation of LBMP at the national level is still difficult and challenging. The issue of LBMP management has only recently been introduced in South Africa with the development of the National Programme of Action to Protect Marine Environment from Land-based Activities, 2008. South Africa is only starting to consider the question of LBMP regulation. This thesis aims to conduct a critical analysis of the South African regulatory framework pertaining to LBMP in comparison to international best practice and the French regulatory framework, in order to identify the key South African challenges in this regard and to make recommendations to address them. In order to do so, this research commences by providing an analysis of LBMP and the theoretical foundations associated with LBMP regulation, as promoted by international best practice. The study identifies and assesses the main regulatory features to be considered in the development, implementation and/or assessment of a regulatory framework pertaining to LBMP. These features will form the methodological framework to conduct the comparative legal assessment between the French and South African regulatory frameworks pertaining to LBMP. This thesis then provides a detailed and thorough legal analysis of the French and South African regulatory frameworks pertaining to LBMP using the methodological framework developed using guidance from international best practice. Towards the regulation of interactive gambling : an analysis of the gambling regulatory framework in South Africa

With the exception of horse racing, any form of gambling was criminalised in South Africa until the dawn of constitutional democracy in 1994. In the same year, the Lotteries and Gambling Board Act, 1993, came into force decriminalising, amongst others, casinos and gambling games within the Republic. This Act has since been repealed and gambling is governed by the National Gambling Act, 2004, as well as by provincial gambling laws. Interactive / online gambling is illegal pending authorisation by a national legislation. Such legislation, the National Gambling Amendment Act, 2008, seeking to regulate interactive gambling awaits proclamation of the date of its commencement by the President. The National Gambling Policy, 2016, dashes any hope of regulation of interactive gambling, however, as it seeks to embargo the introduction of (new) forms of gambling, including but not limited to interactive gambling. The scourge of problem gambling and the protection of traditional forms of gambling, that is, casinos, are the main reasons for advocating for the continued prohibition of interactive gambling. Problem gambling is not unique to interactive gambling, but affects all modes of gambling. South Africa is among countries with a high rate of problem gambling. It is feared that interactive gambling will exacerbate the scourge of problem gambling as gamblers with access to the internet will now have unlimited gambling opportunities around the clock. On the other hand, interactive gambling offers practical solutions to the implementation of harm minimisation strategies to deal with problem gambling such as limitations on gambling deposits, losses and time. Prohibition of interactive gambling is difficult to enforce and deprives the country of an opportunity to control, through licensing, this mode of gambling and possible benefit from taxation and licensing fees. It further exposes gamblers – who despite prohibition choose this mode of gambling – to unregulated and illegal gambling websites. This thesis attempts to provide safeguards for regulation of interactive gambling and to embrace the benefits of the technological development that makes interactive gambling a reality. The United Kingdom (UK) is a prime example of a country that has successfully legalised and licensed interactive gambling in its jurisdiction. / Criminal and Procedural Law / LL. D.

Land-Based Food Initiatives in Two Rural and Remote Indigenous Communities

The purpose of this thesis is to describe the harvesting and dietary practices of two rural and remote Indigenous communities. The ethnographic methods of participant observations and semi-structured interviews availed an abundance of rich and detailed data that allowed for a clear understanding of the barriers these two communities face when accessing food. This is an articled-based thesis containing three parts. Part one is composed of a literature review that describes the barriers that have contributed to food insecurity problems in Indigenous communities. It finishes with a chapter dedicated to defining the postcolonial theoretical perspective and describing how and why it was employed during this research process. The postcolonial perspective was chosen to best understand the historical forces that caused food insecurity in Indigenous communities and justify my position as a non-indigenous researcher in the field of Indigenous health. The second part of the thesis is made up of two articles. Article one will describe the current situation of food access challenges and responses in Canada, more specifically in two rural and remote First Nations communities. The article illustrates how both First Nations are experiencing challenges obtaining healthy food from the market and from the land. The article describes what is involved in acquiring food in both communities, and the responses each community is taking to increase food access. The article concludes by pointing out how these initiatives are building more than just food capacity and why they deserve greater external support. The second article is focused solely in the community of Wapekeka, and is entitled The Cost of Local Food Procurement in One Northern Rural and Remote Indigenous Community. The purpose of the article is to provide a specific example of building local food capacity as strategy to address food insecurity. It documents the costs associated with traditional food procurement and compares these costs against the price of food available in the store. The final component of the thesis is the overall conclusion, highlighting the belief that the findings presented in this thesis will promote and emphasize the importance of land-based food initiatives as a way to foster positive health outcomes for all Indigenous peoples.

Wasting our future by wasting the Sea : How to combat marine pollution from land-based sources on international and regional level

In the United Nations Convention on the Law of the Sea, the environmental protection of the marine environment was first addressed in a comprehensive manner on an international level. However, the Convention distinguishes between four different sorts of pollution depending on which source the pollution originates from. Still, one of these sources play a more crucial role in the protection of the marine environment than the other since that source is estimated to stand for 80 percent of all the marine pollution; namely marine pollution from land-based sources. As the throw-away culture has led to products being disposed of at a faster rate than ever before, in particular plastic products, the amount of land-based debris has also substantially increased over the last decades. This increased disposal rate of products in combination with poor waste treatment has consequently led to many kinds of wastes ending up in the ocean and causing severe harm, not only to the marine environment and its living species, but also to humans that eat the fish and use the many other ecosystem services of the Sea. In this thesis, some prominent international conventions on marine pollution from land-based sources are examined; namely the United Nations Convention on the Law of the Sea, the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and their Disposal, as well as the Stockholm Convention on Persistent Organic Pollutants. To achieve United Nations Sustainable Development Goal number 14.1 to significantly reduce marine pollution from land-based sources by 2025, this thesis claims that international laws addressing this sort of pollution need to be implemented. Moreover, this thesis rests on the belief that regional implementation is a crucial component in making states align with international law. However, while regional implementation has been ambitious in the European Union Law, many regions still lack enforceable frameworks that aim to reduce and prevent marine pollution from land-based sources.

Assessment of biochar potential as a land-based emission mitigation measure in Colombia

There is an urgent need to mitigate carbon emissions to the atmosphere to reduce the negative effects of climate change. Countries have pledged national strategies to reach their climate change mitigation goals in their Nationally Determined Contributions (NDC). In the case of Colombia, the country envisions becoming carbon neutral by 2050.  A pathway to reach this goal is emission reduction through nature-based solutions (NBS). Biochar is an NBS with the potential to be used as a land-based emission mitigation technology. Records indicate that it was first used by indigenous communities in the Amazon about a thousand years ago. Biochar can be obtained through thermochemical conversion by slow pyrolysis of residual biomass. The original organic carbon present in the biomass is sequestered in the biochar as it is pyrolyzed and thus, CO2 emissions are prevented. Biochar is not yet considered in Colombia´s carbon neutrality strategy. The aim of this thesis project is to investigate the potential of biochar production in Colombia as a land-based mitigation technology (LMT). Therefore, a comprehensive assessment is performed with the purpose of identifying the status of biochar in the country. The motivation behind the assessment is to gain an understanding of the variables involved in biochar production. Factors such as the production sectors involved, feedstocks, production technologies, project costs and emission mitigation are of interest. The study explores these factors by following five methodological steps. First, the current research on the technology is mapped to understand biochar’s status at a national level. Second, experts are interviewed to collect their views regarding biochar and a PESTEL (Political, Economic, Social, Technological, Environmental & Legal) analysis is employed based on their point of view on the technology. Third, the potential sources of residual biomass which could be used to produce biochar in the agricultural sector are quantified. The approach to biochar’s potential is enriched with a focused in-person case study of biochar production from oil palm residues. Fourth, these residual biomass sources are subsequently employed to estimate the emissions sequestered in their biochar production. Lastly, project feasibility implementation is evaluated through a techno-economic to identify the project’s main cost drivers. The results are then discussed using a SWOT (Strength, Weaknesses, and Opportunities & Threats) analysis. The existing studies and the local experts’ opinion indicate that biochar potential is in the agricultural sector and that it can be thought of for soil adaptation. Biochar’s emission mitigation is considered an added value. In 2021, the agricultural sector produced near 73 million tonnes of agricultural products. The residues from agriculture could be used for biochar production. If the residues from the most produced agricultural products are transformed into biochar, about 1 to 2,2 tonne of CO2 per tonne of biochar could be avoided. The published literature and the in-person study visit confirmed that the largest advance in biochar production and use in Colombia is in the oil palm sector. Palm kernel shell, fibre and empty fruit bunches are the oil palm residues that could be used to produce biochar. From 1 tonne of these three oil palm residues, about 60 kg of biochar can be obtained. The results show that currently there is no market for trading with biochar in Colombia. High investments, transport and feedstock costs are identified obstacles. An Advanced Technology pyrolizer cost can cost around 330.000 USD while a Basic Technology one can be around 100 USD. Taxes associated with revenue from the biochar trade can negatively impact a biochar project’s feasibility. In this study, a price for biochar is estimated using break-even analysis. Under the assumptions used, the biochar price per tonne is around 200 to 1.000 USD. Price variability is explained in the technologies used for production, feedstock biomass availability and variable revenues from biochar sales. / Koldioxidutsläppen till atmosfären behöver minskas för att undvika de negativa effekterna av klimatförändringar. Biokol är en NBS som kan användas som landbaserade åtgärder för att minska växthusgasutsläpp eller öka koldioxidupptag. Forskning har bevisat att biokol användes i Amazonas för ungefär tusen år sedan. Biokol framställs genom långsam pyrolys av restprodukter av biomass. Kolet i biomassan binds i biokolet genom pyrolysis, vilket förhindrar koldioxidens utsläppning till atmosfären. Biokol inkluderas ännu inte i Colombias strategi för koldioxidneutralitet. Syftet med detta projekt är att undersöka biokolets produktionspotential i Colombia son ett landbaserade åtgärder (LMT). En analys gjordes för att identifiera statusen av biokol runt om i landet. Faktorer såsom berörda produktionssektorer, råvaror, produktionstekniker, projektkostnader och koldioxidutsläppen var av intresse. Studien undersöker faktorerna ovan genom att tillämpa en femstegsmetod. Först identifierades den aktuella forskningen om biokol i Colombia. Sedan intervjuades experter för att samla in deras åsikter om biokol och en PESTEL analys (Political, Economic, Social, Technological, Environmental & Legal) användes. Nästa steg i metoden var att kvantifiera potentialen av restprodukter inom jordbrukssektorn. Detta steg kompletterades med en fallstudie som fokuserade på biokolproduktion från rester från oljepalmer och sedan beräknades utsläppen som binds i biokol. Till sist utvärderades projektets genomförbarhet genom en teknoekonomisk analys som identifierade viktigaste drivkrafterna bakom kostnaderna. Resultaten diskuterades med hjälp av en SWOT analys (Strength, Weaknesses, and Opportunities & Threats). Experter och forskningsresultat om biokol i Colombia anger att det finns stor potential nom jordbrukssektor där biokol skulle kunna användas för jordförbättring, medan utsläppsminskningar endast anses vara en ytterligare fördel. År 2021 Colombias jordbrukssektor producerade nästan 73 millioner tonne av jordbruksprodukter och restprodukter från jordbruket kan användas för produktion av biokol. För varje ton biokol som produceras undviks ungefär 1 till 2,2 tonne koldioxid. Litteraturen och studiebesöket bekräftade att största framsteget inom produktion och användning av biokol i Colombia händer inom oljepalmssektorn. Palmkärnor, fibrer och tomma fruktknippar är restprodukterna som kan användas för att producera biokol. En ton av dessa tre typer av oljepalmsrester ger cirka 60 kg biokol. Resultaten visar att det inte finns en marknad för biokol i Colombia. Höga investeringskostnader, transport-och råvarukostnader är främsta hindarna som identifierades. En pyrolysanläggning med avancerad teknik kostar cirka 330 000 US-dollar, medan en pyrolysanläggning med grundläggande teknik kostar cirka 100 US -dollar. Skatter på inkomster från biokolsförsäljning kan ha en negativ effekt på genomförbarhet. Studien uppskattas ett pris för biokol med hjälp av en break-even-analys och visar att cirka 200 till 1.000 USD per tonne biokol vore ett möjligt prisintervall. Prisvariationerna förklaras av tekniken som används för produktion, tillgång på biomassa som råvara och varierande intäkter från biokolförsäljning.

The aim of this thesis is to examine the relationship between the Royal Australian Air Force (RAAF) and the Royal Australian Navy (RAN) regarding the operation of aircraft from ships of the RAN and from RAAF shore bases. The effects of the separate intellectual development of maritime doctrine in the RAAF and RAN, and the efforts of the two Australian services to transfer theory into practice will be considered in the pre- (and post) World War II period, with due consideration of the experience of the services in both wars. The thesis will also discuss the problems that were faced by the RAAF and RAN to develop mutually acceptable operational procedures to enable the efficient use of aircraft in a maritime setting. The influence and effect on RAAF and RAN doctrine and equipment procurement, as a result of the special relationships that developed between the Air Force and Navy of Australia and Britain will be critically examined. A similar approach to the post war US/Australian relationship, and its effect on the Australian services, will also be critically examined. The thesis being propounded is that the development of a unique Australian maritime policy was retarded due to a combination of the relationship with Britain and the United States, lack of suitable equipment, lack of clear operational concepts in both the RAAF and RAN and the parochial attitude of the most senior commanders of both Services. The study has been based on Department of Navy, Department of Air and Department of Defence documents held in the National Archives of Australia in Canberra and Melbourne. In addition, relevant documents from the Admiralty and Air Ministry related to the development of naval aviation on RAN vessels during World War I, the attitude of the RAF toward the deployment of RAAF units to Singapore, and the negotiations that resulted in the procurement of HMA Ships Sydney and Melbourne, have been perused. Wartime operational records of the RAAF have been examined to obtain data to enable a critical study to be made of the RAAF anti-submarine campaign, torpedo bomber operations and the maritime campaign undertaken from bases in North Western Area during World War II. The influence of the commander of the United States 5th Air Force has also been incorporated in the discussion. The research uncovered procedural and operational variations between the two Services, the diversion of key elements from Australian command and the priority given to the American line of advance that resulted in Australian operations being given a secondary, supportive, status. A conclusion reached as a result of this research has been that the development of a unique Australian maritime aerial capability was restricted by the requirement of Britain to deploy flying units to Singapore in 1940. Similarly, the pressure exerted on the RAN by the Admiralty to purchase the Light Fleet Carriers in the late 1940s was more in the interests of the RN and British foreign policy than that of the RAN. Overall, the relationship with the Britain and the United States masked the real weakness in Australia???s maritime operations and retarded its development.

國際法上『海洋環境保護』之研究

In the Corfu Channel,the International Court of Justice said that〝every State's obligation not to allow knowingly its territory to be used for acts contrary to the rights of other States'〞. And in the Trail Smelter arbitration,the arbitral tribunal held that 〝no State has the right to use or permit the use of its territory in such a manner as to cause injury by fumes in or to the territory of another or the property or persons therein….〞. Article 2 of the High Seas Convention which state 〝with reasonable regard to the interests of other States must exercise the freedoms of the high seas". It could be argued that, taking the principles in Articel 2 of the High Seas and in the Corfu Channel case together and Trail Smelter case by 〝analogy〞,there is a gereral rule of customary international law that States must not permit their nationals to discharge into the sea matter that could cause harm to the national of other States. However,this rule appears to be too vague to be very effective. So, given these deficiencies of customary internatinal law,it is not surprising to find that the international law relating to marine pollution is contained almost wholly in treaties. There are total Six Chapter,According to The UN Convention on the Law of the sea 1982 (UNCLOS),described Pollution from vessels、Pollution by dumping、Pollution from land-based sources、Pollution from or through the atmosphere 、Pollution from sea-bed activities、Pollution from activities in the『 Area』 and Pollution from Ice-covered areas.
