This article considers the nature of interpretation as important question in constitutional interpretation from a theonomic epistemological perspective. Theonomic epistemology is summarily described. The modem language philosophy's view of the nature of interpretation is then investigated, after which a theonomic definition of interpretation and hermeneutics is suggested. Different approaches to interpretation commonly found in legal practice are evaluated on the basis of the suggested definition. The theonomic approach is then applied to another issue in constitutional interpretation, the nature of the judicial function, and broad guidelines are given for the practical application of theonomic epistemological considerations. / Hierdie artikel ondersoek die wese van interpretasie as belangrike vraagstuk by grondwetuitleg vanuit die perspektief van die teonome epistemologie. Die teonome epistemologie word oorsigtelik beskryf. Die modeme taalfilosofie se beskouing van interpretasie word dan behandel, waama 'n teonome definisie van interpretasie en hermeneutiek voorgestel word. Die verskillende uitlegbenaderings wat algemeen in die praktyk voorkom, word aan die hand van die voorgestelde definisie geevalueer. Enforcing respect : iberalism, perfectionism, and antidiscrimination law

Can contemporary liberalism justify antidiscrimination law? The question seems impertinent until we consider contemporary liberalism’s commitment to limited government. Once we do, we realize that contemporary liberals may not complacently assume that their theories justify antidiscrimination law simply because discrimination based on race or sex is so obviously wrongful. Rather, they must scrutinize antidiscrimination law just as they do other regulation of individual conduct. Providing such scrutiny, this thesis argues that three of the most prominent contemporary liberal doctrines of political legitimacy—John Rawls’s “political liberalism,” an antiperfectionist version of the “harm principle,” and Joseph Raz’s “liberal perfectionism”—all fail to justify core applications of antidiscrimination law, applications that we intuitively consider perfectly legitimate. In light of this failure, contemporary liberalism faces a dilemma: it must jettison either its commitment to comprehensive, uniform antidiscrimination regimes or its antiperfectionism and overriding commitment to personal autonomy. This thesis argues for the latter course by providing an account of the wrongfulness of discrimination based on race or sex that condemns all instances of the conduct. According to this account, discrimination is wrong because acting on discriminatory intentions is wrong. More specifically, by taking another person’s race or sex as a reason to treat her less favorably than one would treat people of other races or the other sex, one fails to respect her as a person, to regard her as a being of ultimate value. Unlike contemporary liberal accounts, this account is fully perfectionist, since it defines discrimination in terms of the intentions of discriminators, and the intentions of discriminators in terms of their attitudes, which partly constitute their moral characters. So long as we remain committed to antidiscrimination law in its current form, we must attend to discriminators’ characters. And to attend to discriminators’ characters, we must be willing to espouse perfectionism.

The right to be let alone has been developing throughout history to offset the seemingly relentless encroachments by government in efforts to regulate "morality," and by governmental and/or business uses of technological advancements to control the individuals privacy. Thus, the espoused constitutional right of privacy has come to be the way for individuals (and groups) to stave off society's attempts to control or divert the individual from his right to be let alone. This work examines both state and federal court cases in an attempt to show that privacy has come to be a basic, constitutional right to be used against society's intrusions in areas of personal and sexual privacy.

Diploma thesis "Development of Czech medical law in the context of health-related human rights" deals with Czech medical law and its development after the year 1989 in connection with the human rights. Also this thesis deals with the area of human rights with their relation to health, especially in the time of the current health reforms. The aim of the thesis is, based on the analysis of the current findings, to find out the deficits of the protection of human rights regarding the modernization of health law and to identify the reasons of the failure of the implementation of the norms and laws concerning the human rights and their connection to health in the Czech legal system.

Towards an ethical interpretation of equality

Although the current South African approach of "substantive" equality is better than mere "formal" equality, I fear that even substantive equality will again deny or reduce difference. An "ethical" interpretation of equality is a way of interpretation that radically acknowledges difference and otherness. I argue for an ethical interpretation of equality as an alternative to substantive and formal equality. The intersection between public space, equality and justice is essential to such an ethical interpretation. An ethical interpretation of equality requires that present South African visions of public space must be reconstructed and transformed continuously. This means that an ethical interpretation of equality rejects finality and closure in respect of public space. The visions of public space and perspectives of equality that I support are alert to difference and otherness. My understanding of justice is that it is never fully achieved in the present. Justice functions as a future orientated ideal. The "ethical" in an ethical interpretation of equality reflects an awareness of the limits of any present system to encompass equality and justice completely. Visions of public space, perspectives on equality and landscapes of justice (the features of the ethical intersection) form the main sections of the thesis. I discuss the South African Truth and Reconciliation Commission (TRC) as a manifestation of the ethical intersection between public space, equality and justice. The TRC was an outstanding example of reconstruction and transformation of public space. It was a public space where each and every individual was treated equally while concrete contexts, specific circumstances and difference were taken into account. The TRC as event was inspired by the ideal of justice. The value of the TRC as a manifestation of the ethical intersection is the profound effect it may have on our interpretation of equality by demonstrating the limits of the substantive approach. / Die doel van hierdie proefskrif is om ondersoek in te stel na 'n "etiese" interpretasie van gelykheid. Alhoewel die huidige Suid-Afrikaanse benadering van "substantiewe" gelykheid beter is as blote formele gelykheid, vrees ek dat selfs substantiewe gelykheid weereens verskil sal ontken of gering skat. 'n "Etiese" interpretasie van gelykheid is 'n manier van interpretasie wat radikaal kennis neem van verskil en andersheid. Ek argumenteer vir 'n etiese interpretasie van gelykheid as 'n alternatief tot substantiewe en formele gelykheid. Die interseksie tuseen publieke spasie, gelykheid en geregtigheid is noodsaaklik vir so 'n etiese interpretasie. <p>The aim of this study was to examine how the social services could investigate and support children of irregular immigrants within the boundaries of the law. More specifically it aimed to examine the legal possibilities and obstacles for the social services to support irregular immigrants, how the officials at the social services act considering the legal aspects, and how they reason morally and ethically when dealing with irregular immigrants. To answer the aim of the study the theory of positive law was used combined with qualitative interviews with two officials at the social services. Moreover a small quantitative telephone study with officials in the social services and with voluntary organizations was made. The study has used theories of sociology of law, law and ethics, and professional (civil) disobedience. The conclusions were that children of irregular immigrants are included by the Swedish law for social services, but are hindered from getting support by the legal obligation to inform the police authorities when the social services are dealing with foreigners who did not apply for a residence permit. There is a need for the officials to be extra committed in such cases and they break the obligation to inform to be able to support the children.</p>

A questão das sanções da Lei da improbidade administrativa : contribuições para procedimento e aplicação racional.

This is a Master´s Degree Dissertation that agrees with the premise that Law cannot be dissociated from Moral and with the conclusion that leads to the path to rationalize moral values in the juridical atmosphere. In that way, constitutional jurisdiction attempts its objectives and legitimates itself upon social medium by using juridical argumentation´s methods, which must be particularly respected, in Brazil, in the sphere of the analysis of administrative improbity´s acts. At the same time, Constitution is not only the main juridical text of a given State, endowed with normative power and imperative norms, but represents, fundamentally, the great variety of mankind knowledge´s lines, as well as it is guided by a truly axiological sense. Based in that post-positivist context, this Master´s Degree Dissertation comments about the Administrative Improbity Law (Brazilian Federal Law nº 8.429/1992) by offering, initially, a general panorama of the above-mentioned law; soon after, it specifies the object of study with its species and penalties. Finally, this work shows study about the necessity to establish a procedure tending to investigate the real occurrence of an improbity act and, in that way, it is put forward another contribution, intending to rationalize the fixation of Administrative Improbity Law s sanctions, together with the application of Proportionality. / Trata-se de Dissertação de Mestrado que concorda com a premissa de que o Direito não pode ser dissociado da Moral e com a conclusão que conduz ao caminho de racionalizar a inserção dos valores morais na atmosfera jurídica. A jurisdição constitucional, neste sentido, cumpre seu papel e se legitima perante o meio social quando utiliza métodos de argumentação jurídica, os quais devem ser particularmente respeitados, no Brasil, na esfera de análise de atos de improbidade administrativa. Paralelamente, a Constituição não é apenas o principal texto jurídico de um Estado, dotado de força normativa e normas imperativas, como também representa, fundamentalmente, as mais diversas linhas do conhecimento humano, além do que, é norteada por um verdadeiro sentido axiológico. Baseada em tal contexto póspositivista, esta dissertação discorre a respeito da Lei da Improbidade Administrativa (Lei nº 8.429/1992) oferecendo, inicialmente, um panorama geral do referido diploma normativo para, logo depois, especificar o objeto de estudo nas modalidades e nas sanções nela contidas. Finalmente, o presente trabalho mostra estudo a respeito da necessidade de ser estabelecido um procedimento tendente a apurar a efetiva ocorrência de atos ímprobos para que, passo seguinte, seja apresentada outra contribuição, no sentido de racionalizar a aplicação das penalidades da Lei da Improbidade Administrativa, com o necessário uso da Regra da Proporcionalidade.
