A presente dissertação tem por objetivo o estudo da aplicação do princípio da congruência no Processo Individual do Trabalho. Tal princípio caracteriza-se pelo caráter restritivo da atuação judicial, vinculando a prolação de sentença aos limites da lide. A problemática centra-se no entendimento do conceito de lide, ora entendido simplesmente como pedido, ora como a matéria fática e jurídica levada aos autos, permitindo-se ao magistrado conhecer de pedidos não formulados expressamente, desde que os fatos a eles pertinentes tenham sido discutidos nos autos. A partir da Teoria Instrumentalista do Processo, que admite este modo de resolução de conflitos como um meio para a efetividade do Direito Material, buscou-se identificar a possibilidade de flexibilização do princípio da congruência no Processo Individual do Trabalho, tendo em vista que o estudo deste princípio revelou que a doutrina e a jurisprudência civil e trabalhista já permitem sua relativização ou mitigação em determinados casos, em especial quando se trata da aplicação de norma de ordem pública, uma das características do Direito Material do Trabalho. Ademais, considerando as questões linguísticas implicadas na formulação da pretensão da parte e da sentença, foi feita pesquisa jurisprudencial no sítio eletrônico do Tribunal Superior do Trabalho, de modo a identificar as relações hermenêuticas estabelecidas entre o pedido e a decisão final neste tribunal. Para tanto, foram selecionadas 149 decisões em que se discute a existência ou não de julgamento além dos limites da lide, destacando-se os casos em que o tribunal considerou desnecessária a formulação de pedido expresso para a concessão de direito trabalhista / The purpose of this dissertation is to study the use of the Principle of Ne Ultra et Extra Petita in individual labor process. This principle is defined by the restrictive aspect of the acts of the judge, binding the sentence to the matters under dispute. The core discussion lies on the identification of such matters, which can be seen as simply the pleadings expressed by the parties or as all the matters in connection with the facts merely mentioned by them. The latter position would allow the judicial authority to pronounce a sentence addressing additional matters that were not expressly pleaded by the parties. Based on the idea that the due process of law is an instrument to achieve effectiveness of legal commands, on the already accepted exception of this principle when it comes to public order rules, and also on the assumption that labor law is of public order, this dissertation analyzed the possibility of disregarding the Principle of Ne Ultra et Extra Petita in individual labor process in order to enhance the legal award. In addition to the theoretical analysis, a wide research on the website of the superior labor court (Tribunal Superior do Trabalho) was carried out in order to verify the hermeneutical relations between the pleadings and the dispositions of the judicial decision. Bearing such an objective in mind, 149 decisions on the alleged violation of the Principle of Ne Ultra et Extra Petita were selected and analyzed, focusing on those awards in which the court considered irrelevant the existence of an express pleading in order to grant or deny a specific labor right.

Le dualisme juridictionnel français à l'épreuve de l'Europe / French juridictional dualism put to the test of EuropeDi Filippo, Alessandra 13 December 2014 (has links)
La perspective européenne a renouvelé l’intérêt de la question du maintien ou de la suppression du dualisme juridictionnel en France à travers deux approches : la résistance aux modèles concurrents d’organisation juridictionnelle d’une part, le crible des standards européens d’autre part. Considéré comme un modèle d’organisation juridictionnelle, le système français a inspiré la majorité des Etats européens. Le phénomène a néanmoins été temporaire. Désormais, la plupart des Etats européens ont un système d’organisation juridictionnelle qui se rattache à un autre modèle. Engager le système français dans une telle voie est juridiquement faisable mais peu opportun en pratique. Le système français en tant que modèle – quoique minoritaire – d’organisation juridictionnelle a donc vocation à perdurer. Sur un autre front, l’alignement du système français sur les standards européens a également fait émerger l’hypothèse de sa suppression. Les condamnations, réelles ou potentielles, de la juridiction administrative et du procès mené devant elle, ainsi que du Tribunal des conflits et de la procédure suivie devant lui, ont montré que les réformes étaient inévitables et imposé de revenir sur des pratiques séculaires bien établies. Elles ont également contribué à rapprocher la juridiction administrative de la juridiction judiciaire et le procès administratif du procès civil. « Sauvé » au prix de nombreuses transformations, le système n’en est pas moins parvenu à préserver ses caractéristiques essentielles, prouvant sa capacité d’adaptation. Un temps affaibli, le dualisme juridictionnel n’a, en définitive, pas été altéré. Mieux, son fondement technique, justification contemporaine du dualisme juridictionnel, en est sorti renforcé. / The European perspective has shed new light on the question of whether maintaining or ruling out jurisdictional dualism in France through two main approaches: on the one hand, the resilience of substitutable models and, on the other hand, the scrutiny of European standards. Considered as a model, the French system has inspired the majority of states in Europe. This wave of inspiration has nevertheless been short-lived. Indeed, most states in Europe have established a judicial system, which is different from the French model. Bringing the French system towards the one adopted by most states in Europe is juridically feasible but raises several issues in practice. As a result, the French system, albeit minor amongst the European states, is probably prone to live on. Furthermore, bringing the French system towards European standards raised the question of a likely end of it. In fact, the French system came under critics, whether effective or potential, of its administrative courts and legal proceedings, together with critics concerning its so-called “Tribunal des conflits” and the legal proceedings. These critics point to the fact that reforming the French system was inevitable. Such reforms led the French system back on some of its secular anchored practices. Eventually, reforms also contributed to bring closer both the administrative court and the administrative legal proceedings to both civil court and civil legal proceedings. Saved at the cost of numerous reforms, the French system nevertheless managed to preserve its basic structures. This in turn provides evidence that the French system is able to adapt itself to an evolving European environment. Finally, the technical founding principles of jurisdictional dualism have been reinforced.

Les principes directeurs du procès dans la jurisprudence du Conseil Constitutionnel / The Trial’s guiding principles in the jurisprudence of the Constitutional CouncilLestrade, Éric 21 November 2013 (has links)
Malgré le peu de fondements écrits consacrés à la justice dans le texte de la Constitution du 4 octobre 1958, le Conseil constitutionnel, en réalisant un travail d’actualisation à partir de la Déclaration des droits de l’homme et du citoyen, a permis l’émergence d’un droit constitutionnel processuel, construit autour de principes directeurs. Ceux-ci peuvent être répartis dans trois catégories : deux principales, selon que l’acteur du procès prioritairement concerné soit le juge ou les parties et une troisième, complémentaire, celle des garanties procédurales, permettant de favoriser les qualités essentielles du juge et de contrôler le respect des droits des parties. Une gradation des exigences du Conseil constitutionnel est discrètement perceptible entre les deux premières catégories de principes, plus facilement identifiable entre celles-ci et la dernière famille. Cette échelle décroissante de « densité » des principes directeurs du procès témoigne d’une véritable politique jurisprudentielle en matière de droit constitutionnel processuel, qui met l’accent sur l’accès au juge, doté des qualités indispensables à l’accomplissement de sa mission juridictionnelle. Toutefois, aussi satisfaisante que soit l’action du juge constitutionnel français à l’égard du droit du procès, celle-ci nécessiterait aujourd’hui le relais du constituant, afin de moderniser le statut constitutionnel de la justice. / In spite of a relatively low number of written dispositions dedicated to justice inside of the body of the Constitution of October 1958 4th, the constitutional Council, while updating this text through the Declaration of Human Rights, contributed to the development of a procedural constitutional law, which is structured around guiding principles. Those principles can be classified within three different categories : two major categories depend on the trial actor that is primarily concerned, either the judge or the parties; a third and additional category pertaining to procedural protections, fosters the essential qualities of the judge and secure the protection of the parties’ rights. A gradation of the requirements of the constitutional Council is discreetly perceptible between the first two categories of principles, and more easily identifiable between those first two categories and the last one. This decreasing scale of “density” yoked to the trial guiding principles highlights a genuine judicial policy when it comes to procedural constitutional law, emphasizing access to the judge, whom is given essential qualities in order to achieve its judicial duty. However, the action of the French constitutional judge, as satisfactory as it is towards the rights of the trial, would easily support the intervention of the constituent power in order to update Justice’s constitutional status.

La tesis se encarga de analizar, por un lado, la integración y el desarrollo de las nuevas tecnologías en la Administración de Justicia; y, por otro, los parámetros que constituyen la validez y eficacia del documento electrónico. La primera cuestión se centra en la configuración de los Sistemas de Información de la Oficina Judicial y del Ministerio Fiscal, así como de la informatización de los Registros Civiles, donde el art. 230 LOPJ es la pieza clave. Se estudian sus programas, aplicaciones, la videoconferencia, los ficheros judiciales y las redes de telecomunicaciones que poseen la cobertura de la firma electrónica reconocida, donde cobran gran relevancia los convenios de colaboración tecnológica. La digitalización de las vistas quizá sea una de las cuestiones con más trascendencia, teniendo en cuenta que el juicio es el acto que culmina el proceso. Aunque no todos los proyectos adoptados en el ámbito de la e.justicia se han desarrollado de forma integral, ni han llegado a la totalidad de los órganos judiciales. El objetivo final es lograr una Justicia más ágil y de calidad, a lo cual aspira el Plan Estratégico de Modernización de la Justicia 2009-2012 aprobado recientemente.En referencia a la segunda perspectiva, no cabe duda que el Ordenamiento jurídico y los tribunales, en el ámbito de la justicia material, otorgan plena validez y eficacia al documento electrónico. Nuestra línea de investigación se justifica porque cada vez son más los procesos que incorporan soportes electrónicos de todo tipo, ya sea al plantearse la acción o posteriormente como medio de prueba (art. 299.2 LEC). Entre otros temas examinamos el documento informático, la problemática que rodea al fax, los sistemas de videograbación y el contrato electrónico. / La tesi s'encarrega d'analitzar, per una part, la integració i el desenvolupament de les noves tecnologies dins l´Administració de Justícia; i, per l'altra, els paràmetres que constitueixen la validesa i l'eficàcia del document electrònic. La primera qüestió es centra en la configuració dels Sistemes d´Informació de l´Oficina Judicial i del Ministeri Fiscal, així com de la informatització dels Registres Civils, on l'art. 230 LOPJ es la peça clau. S'estudien els seus programes, aplicacions, la videoconferència, el fitxers judicials i les xarxes de telecomunicacions que tenen la cobertura de la firma electrònica reconeguda, on cobren gran rellevància els convenis de col·laboració tecnològica. La digitalització de les vistes tal vegada sigui una de les qüestions amb més transcendència, tenint amb compte que el judici es l'acte que culmina el procés. Però no tots el projectes adoptats en l'àmbit de la e.justicia s'han desenvolupat d'una manera integral ni han arribat a la totalitat dels òrgans judicials. L'objectiu final es assolir una Justícia més àgil i de qualitat, al que aspira el Pla Estratègic de Modernització de la Justícia 2009-2012 aprovat recentment. En referència a la segona perspectiva, no hi ha dubte que l´Ordenament jurídic i els tribunals, en l'àmbit de la justícia material, donen plena validesa i eficàcia al document electrònic. Entre altres temes examinem el document informàtic, la problemàtica que envolta al fax, els sistemes de videogravació i el contracte electrònic. / The thesis seeks to analyse, on the one hand, the integration and development of the new technologies in the Administration of Justice; and, on the other, the parameters which constitute the validity and efficiency of the electronic document.The first question centres on the configuration of the Information Systems of the Judicial Office and the Public Prosecutor, as well as the computerisation of the Civil Registers, where the art. 230 LOPJ it's the part key. Their programmes, applications, the Video Conferencing, the judicial registers and the telecommunication networks which are covered by the recognised electronic signatures, are studied, where the agreements on technological collaboration gain great relevance. The digitalisation of evidence might perhaps be one of the questions with most consequence, bearing in mind that the judgment is the act by which the process is culminated. Although not all the projects adopted within the compass of e.justice have developed completely nor have reached all the judicial organs. The final objective is to achieve an agile, quality Justice, to which the recently approved Strategic Plan for the Modernisation of Justice aspires.With reference to the second perspective, there is no doubt that the juridical Ordinance and the tribunals within the compass of material justice grant full validity and efficacy to the electronic document. Our line of investigation is justified because there are more and more processes which are sustained by electronic supports of all kinds, whether it be at the establishment of the action or later, as a proof of it (art. 299.2 LEC). Amongst other things, we examine the computerised document, the problems which surround the fax, the systems for video recording and the electronic contract.
