The implementation, monitoring and management of an effective legal deposit system for South Africa

The aim of this study is to explore the issues surrounding the implementation, monitoring and management of legal deposit in South Africa. Legal deposit is a statutory obligation which requires that a producer of any type of publication which is available to the public, be it a commercial, public or private organisation or an individual, deposit one or more copies of the publication with a recognised national institution. The Legal Deposit Act of 1997 governs the deposit of publications in South Africa. Section 8 of the Legal Deposit Act makes provision for the constitution of a Legal Deposit Committee to oversee the implementation of the Act. This Committee, which consists of a broad spectrum of role players, expressed a need for an investigation into the many issues and questions relating to the provision of publications subject to legal deposit as required by the Legal Deposit Act. Although the Legal Deposit Act, at the time of its promulgation in 1998, was one of the first in the world to make provision for the deposit of electronic publications, this study focuses mainly on the legal deposit of books as this was identified by the Committee as an area of immediate and critical concern. The study begins with a comprehensive literature study to obtain sufficient theoretical information on legal deposit and of the problems and issues surrounding the subject internationally and in South Africa. - An overview of elements and issues covered in legal deposit legislation provides the background against which the investigation into the state of legal deposit and its implementation is undertaken. With the aim of contextualising South African legislative issues, a comparative study of legislation in the United Kingdom, Australia, Malaysia and South Africa is also undertaken. -A discussion of the stages and activities involved in legal deposit, the need for monitoring and enforcement procedures and the external and internal factors that influence the way in which legal deposit is implemented in a country, provides an overall understanding of the legal deposit process -The implementation of legal deposit also depends on the committed participation of various role players. The individual roles and needs of these stakeholders in the legal deposit process are identified. The empirical investigation was conducted in two stages. The first phase of the study involved a survey to explore the attitudes, opinions and actions of publishers and legal deposit libraries, as the two main role players, to determine how these factors affect the successful implementation of legal deposit in South Africa. This forms the bulk of the study. The second phase of the study consisted of a feasibility study to determine the state of compliance with legal deposit in the country The outcomes of the empirical study were used to identify gaps and weaknesses in the current legal deposit system. This formed the basis to make recommendations for the improvement of procedures, methods and services. Areas critical to the successful implementation of a legal deposit system are highlighted. The study concludes with a view to the future. This Master’s thesis examines the discussions about the new Swedish legal deposit legislation for electronicdocuments, related to Jürgen Habermas’ theories around the public sphere. In 2009, a draft of the law proposal was sent out to various authorities and organizations who were asked tocontribute their views on this matter. This study looks at who has responded of those asked, and what commonviews are apparent within these responses. The responses from two different categories are focused on –universities and other authorities, examining if any similarities or differences can be noticed in the arguments inthe different categories’ responses to the proposed law change. This information has been first analyzed through content analysis, providing an overview to the respondentsof the draft, and the different views which have arisen. Argumentation analysis has then been used to examinehow specific respondents have argued their views, focusing on the National Library of Sweden and the NationalArchives of Sweden. The most common views and arguments revolve around the definitions suggested in the proposal, regardingwhich documents are to be collected and who is responsible for their delivery. Many respondents also mentionedtheir desire to be able to fulfill their legal deposit obligations by delivering documents through networks. Habermas’ theories on the public sphere, which he claims to exist in today’s society, are very similar to thetheories of the public sphere addressed within this study. The authorities and organizations which have beenasked to contribute opinions towards this proposal are the same one who will be directly involved with the legaldeposit itself; while the future users of these collected electronic documents, namely scholars and the public,have been excluded from this discussion. Some respondents remarked upon the importance of the documentsbeing available to those to which they will be of use. However, the discussion has primarily concentrated on howthe delivery of these documents can be affected in the easiest possible manner for those involved.

Preservation of, and access to, legal deposit materials in South Africa.

The study investigates the preservation of, and access to, legal deposit materials in South Africa. The rapid development of technology has led to an increase in electronic publications as well as no considerable decrease in the production of printed materials making legal deposit a multifaceted and dynamic area of research. The primary purpose of legal deposit collections is to provide access to materials, both those published recently and produced years ago; these materials are deposited and need to be properly preserved for future generations. The specific objectives of the study were to, examine the activities and strategies in place to preserve materials while being used as well as the accessibility of these documents to the South African population. This study builds on and extends the candidate's investigation carried out in her master‘s thesis in 2007, about how legal deposit materials are kept and preserved. The highlight of the study includes identifying systems that assist with the collection of print and electronic documents. The means and processes to help make both print and electronic documents accessible in the long run are also identified. In addition, the study examines the challenges faced by legal deposit staff including their skills and knowledge in preservation management. The National Library of South Africa (NLSA), Mangaung Library Services, Msunduzi Municipal Library, Constitutional Court Library, R J R Masiea Public Library (Phuthaditjhaba) and North West Provincial Library Services were the units of analysis in this study. The study population included members of the Legal Deposit Committee, the heads of the libraries and departmental heads of legal deposit sections of each library. The whole population was in each case studied. Methodological triangulation was used to look at the problem from different angles using different tools in order to get a more accurate result. The study used both quantitative and qualitative methods, using self-administered questionnaires and interview schedules to collect data. A response rate of 78.6% was achieved for the questionnaire and results were analysed using SPSS. The qualitative method of conceptual content analysis was used to analyse the open-ended questions for the interview schedule. Descriptive statistics were used to summarise data in graphs, tables and pie charts. The major research findings indicate that preservation is not carried out properly at present due to the combined lack of preservation policies, funding, staff training and expertise. Most of the legal deposit libraries do not have preservation policies to improve preservation conditions, develop conservation facilities or to train and recruit staff. Furthermore the study concludes that various critical issues surrounding and affecting all facets of legal deposit stem from a lack of policy. Recommendations based on the findings and conclusions are made and the study establishes that effective implementation, preservation and access of legal deposit are dependent largely on many factors. The study investigated preservation of, and access to, legal deposit materials at the Msunduzi Municipal Library. Constant access to legal deposit materials will depend on proper preservation methods from the time they are first produced. The focus was to identify how the different materials are preserved and stored, especially because every institution has unique needs, especially with regard to the climatic conditions of the area. The study also examined challenges faced by the depository, skills and knowledge of the depository staff about preventative preservation methods, resources for conservation and collection management strategies. The methods to help make materials accessible were established by examining the means and processes used. Methodological triangulation was used to look at the study in different ways and this included a questionnaire, interviews, observation and collection of graphic data. The units of analysis were the staff of the legal deposit department and the whole population was surveyed. In this study, quantitative and qualitative techniques were employed. The results of the self-administered question and observation schedule were analysed using SPSS. Data collected using the interview schedule was analysed qualitatively. The results of the study show that there are inadequate preservation activities and strategies for legal deposit materials at the Msunduzi Municipal Library. The legal deposit collection was at risk of being lost and inaccessible to present and future generations. This was mostly due to lack of preservation activities and strategies as a result of lack of knowledge in preservation, adequate funding, staff training, preservation policies, environmental control of stack rooms and the proper handling and storage of materials. / Thesis (M.I.S.)-University of KwaZulu-Natal, Pietermaritzburg, 2007.

Born Digital Legal Deposit Policies and Practices

In 2014, the authors surveyed the born digital content legal deposit policies and practices in 17 different countries and presented the results of the survey at the 2015 International News Media Conference hosted by the National Library of Sweden in Stockholm, Sweden, April 15-16, 2015.2 Three years later, the authors expanded their team and updated the survey in order to assess progress in creating or improving national policies and in implementing practices for preserving born digital content. The 2017 survey reach has been broadened to include countries that did not participate in the 2014 survey. To optimise survey design, and allow for comparability of results with previous surveys, the authors briefly review 17 efforts over the last 12 years to understand the state of digital legal deposit and broader digital preservation policies (a deeper analysis will be provided in a future paper), and then set out the logic behind the current survey.

It can be defined as the mechanism by which a thing, object of a potential right, is entrusted to a third party and assigned to the satisfaction of the person who shall eventually be recognized as the beneficiary of such thing. Problems and constraints experienced by publishers concerning legal deposit in KwaZulu-Natal.

Legal deposit and its sustainability is a major problem that cannot be ignored in South Africa. The value of preserving and making accessible information is of primary importance for legal deposit collections. The concept of legal deposit is evolving from decade to decade as many factors continue to influence it. Among the challenges facing legal deposit libraries is the problem of publishers failing to comply with legal deposit requirements. This study investigated the problems and constraints experienced by publishers in KwaZulu- Natal concerning legal deposit. Thirty five publishers were surveyed by means of a selfadministered questionnaire which utilized both open and closed questions. The results of the study reveal that while the vast majority of publishers in KwaZulu-Natal are compliant with legal deposit requirements, they do experience a number of problems while doing so. These problems include financial costs and time constraints while a lack of knowledge about certain aspects of legal deposit on the part of the publishers was evident. Recommendations, which would require participation from all the stakeholders, to address the problems identified were made. The aim of this two years master’s thesis in Archive, Library and Museum studies is to investigate how the National Library of Sweden collects, arranges and provides access to its collection of printed ephemera. As a comparison, the thesis also looks at how Lund University Library is working with the same tasks. The main sources of information in this thesis comes from participant observations and interviews conducted with informants within the two libraries mentioned above. Document studies of the library’s internal documents and the Swedish Legal Deposit Law has also been used to get additional information. The findings in this thesis has been analyzed with a model based on a practice theory and a knowledge organization theory. The starting point in the investigation was to look at how these two libraries receives printed ephemera through legal deposits, if there are any problems connected to the legal deposits and if that possibly has an influence on the printed ephemera collections. The next part of the investigation focuses on how these collections has been organized with various classification systems over the years. In addition to this the survey wanted to find out if- and in what way these different systems have had an effect on the availability of this material and what tools the libraries uses to make it easier to find specific material within the collections and make it available for users. The results of the investigation show that National Library of Sweden and Lund University Library resave a wide range of material throw legal deposits but not nearly as much as they should get. One big problem is that many producers print their material outside of Sweden and are not aware that they are obligated to give copies of this to the Swedish Legal Deposit Library’s. The survey also reached the conclusion that the way the material is arranged and stored has a big impact on how accessible it is. However, by using cataloguing and digitalization the libraries can make this material more visible, and thus also more accessible.

Les migrations de femmes et d’hommes depuis le Maghreb vers la France est un processus historique ancien, remontant pour les Algériens à la fin du XIXème siècle et à la première moitié du XXème siècle pour les Marocains et les Tunisiens. Ces individus forment aujourd’hui une composante importante de la population française. Néanmoins, malgré la patrimonialisation de l’immigration, ces mémoires peinent à s’inscrire dans le récit collectif national. Dans ce contexte, la démocratisation de l’internet grâce à l’essor du web à la fin des années 1990, constitue un nouveau terrain d’expression pour des mémoires perçues comme délaissées. Média et moyen de communication, le web apparaît ainsi comme une nouvelle source pour l’étude des médiations mémorielles et des usages du passé. L’étude de ces dispositifs mémoriels implique une analyse des acteurs et de leurs stratégies de valorisation de la mémoire en ligne, mais aussi dans le champ social. Ce travail entend donc proposer une première histoire des mémoires de l’immigration maghrébine sur le web français à partir des archives du dépôt légal du web gérées par la Bibliothèque Nationale de France (BNF) et l’Institut National de l’Audiovisuel (INA). Il montre la complexité du processus de reconfiguration de la mise en visibilité des mémoires de l’immigration maghrébine. L’internet apparaît comme un nouveau support proposant des modes scénographiques inédits. Vecteur et reflet de l’amplification mémorielle, le web participe à la présentification de l’histoire en articulant le passé avec les logiques commémoratives. / This thesis focuses on how the web is used as a privilege space to study how North African immigration memories. This is the first history PhD in France that primarily relies on French Web archives as a source. This one has not yet been integrated in the French collective memory in spite of recent institutional attempts to draw people’s attention back to this issue. This exclusion was and still is linked with many causes: the socio-economic situation of North African minorities in France, the taboo of the Algerian war as well as the unequal treatment by the media of the Maghreb population. Since the end of the 1990’s, in a context of competing memories, many websites have been recalling the immigration memories and have been asking for recognition from the French state. From a media history perspective, how can these memories be presented on the Internet? Moreover, how can the past be used to rectify and transform the present? In France, a historical approach to analyzing the web and its contents has started to develop: publishing strategies, temporalities, uses, internet history. This work would not have been possible without the existence in France, since 2006, of the Web legal deposit, which is shared by INA (Institut National de l’Audiovisuel) and the BNF (Bibliothèque Nationale de France). Thereby, along with traditional broadcast material, Web content can be considered for media history. The epistemological and methodological approaches remain to be devised. The composition and the scenario of some selected memory devices online are studying thanks to the French web archive from 1999 to 2014.
