It displays the theory of socials systems, by Niklas Luhmann, and its main principles, where the society is seeing by an autopoietic system, which itself produces and generates several social subsystems, such as political, economic and juridical. The juridical system has as main link mechanism with the other social systems the Federal Constitution, by which we select the juridical goods that deserve the protection of the Penal Economic Subsystem. The research identifies the systemic failures, because the working of the Penal System does not give the real protection to the Economical Order foreseen by the Constitution. Brazil, in the perspective of its political, economical and juridical systems, as a transitional system subject to external interferences, we analyze the main obstacles coming from its condition of system in development that blocks the necessary adjusts in the Penal Economical Law, searching to demystify the misunderstanding social thoughts, that the aggravation of the Penal measures or the edition of more criminal laws will block the growth of criminal actions. / Este estudo, eminentemente bibliográfico, tem por objetivo investigar as principais dificuldades para a correção das disfunções do sistema penal econômico no Brasil. Apresenta a teoria dos sistemas sociais, de Niklas Luhmann, e seus principais fundamentos, pelos quais se compreende a sociedade como um sistema autopoiético, que produz a si mesmo e gera diversos subsistemas sociais, como o político, o econômico e o jurídico. O sistema jurídico tem como principal mecanismo de conexão com os demais sistemas sociais a Constituição Federal, por meio da qual seleciona os bens jurídicos que merecem a proteção do subsistema penal econômico. A pesquisa identifica as falhas sistêmicas, em razão das quais o funcionamento do sistema penal econômico não confere a devida proteção à ordem econômica prevista na Constituição. Em seguida, concebendo o Brasil, sob a perspectiva de seus sistemas político, jurídico e econômico, como um sistema transicional, sujeito à interferências externas, analisa os principais obstáculos decorrentes de sua condição de sistema em desenvolvimento, que impedem os ajustes necessários no Direito Penal Econômico, buscando desmistificar o equivocado pensamento social de que o agravamento das medidas penais, ou a edição de mais leis criminalizadoras impedirá o crescimento da criminalidade.

CoordenaÃÃo de AperfeiÃoamento de Pessoal de NÃvel Superior / O objeto de estudo da tese à o subsistema penal militar. O trabalho està estruturado com base na linguagem sociolÃgica de Niklas Luhmann. Foram realizados os seguintes procedimentos metodolÃgicos: revisÃo de literatura da obra desse autor; levantamento histÃrico acerca do processo de institucionalizaÃÃo das organizaÃÃes da justiÃa penal militar; e, pesquisa jurisprudencial nos sites eletrÃnicos do Supremo Tribunal Federal (STF) e do Superior Tribunal de JustiÃa (STJ) sobre crime militar. Em sÃntese, pode-se dizer que sÃo trÃs os objetivos da pesquisa: reconstruir uma versÃo da sociologia do direito de Niklas Luhmann; observar, a partir dela, a diferenciaÃÃo do subsistema penal militar; e, compreender como esse subsistema processa informaÃÃes e redundÃncias, de modo a evidenciar suas contingÃncias. Os resultados da pesquisa indicam que, com o aparecimento e desaparecimento de diferentes organizaÃÃes, as comunicaÃÃes jurÃdicas foram se concentrando em torno de uma distinÃÃo especÃfica (crime militar/nÃo crime militar), com base na qual, diferenciou-se o subsistema. A partir das decisÃes coletadas, verificou-se que as instÃncias decisÃrias desse subsistema desenvolvem suas comunicaÃÃes atravÃs da organizaÃÃo de autorreferÃncias e heterorreferÃncias para produzir informaÃÃes e redundÃncias. Os resultados indicam que o subsistema penal militar à mais restritivo nas interpretaÃÃes dos direitos humanos de acusados ou condenados pela prÃtica de crime militar. Tais restriÃÃes decorrerem de um ponto de vista normativo que se formula no prÃprio subsistema e acarretam a negaÃÃo de benefÃcios penais aos processados ou condenados por crime militar e a nÃo aplicaÃÃo de princÃpios constitucionais para descriminalizaÃÃo de determinadas condutas.

Esta tese se divide em duas partes. Na primeira parte serão expostas as escolas e teorias mais importantes para o conceito de sentido. Na segunda parte será exposto o conceito de sentido espectral. A primeira seção é monográfica e trata de investigar o conceito de sentido em quatro diferentes campos das ciências humanas: a lógica, a linguagem, a fenomenologia e a teoria dos sistemas. A segunda traz a proposição teórica do conceito de sentido espectral e o discute em função de diagramas de comunicação e sentido. Com isso, a discussão da primeira parte deste trabalho deverá introduzir as dimensões do conceito de sentido que, por sua vez, serão relacionados com certo padrão de difusão e consumo da informação. Essa relação entre os modos de produção das matrizes de media e um determinado conceito de sentido é explorada ao longo de todo o trabalho. Espectral, com isso, é uma metáfora para a particular produção de sentido do ambiente digital. Esse campo do sentido eletrônico será descrito e delineado em contraposição às metáforas não-espaciais de difusão do ciberespaço, que sugerem um campo aberto de aceleração e expansão não comensurável. Desse modo, o conceito de sentido espectral apresentará dois blocos de elementos complementares cuja finalidade é vincular as metáforas não-espaciais, exteriores e difusas do ciberespaço, com uma descrição dos mecanismos interiores desse sentido digital. Esses mecanismos serão descritos teórica e graficamente por meio de cinco componentes: serialização, aglutinação, seleção, nódulos e disrupção. Essas operações, por sua vez, percorrem uma superfície cujos movimentos são simultaneamente concêntricos e arborescentes. A descrição desse movimento será feita por meio de três circuitos: círculos interiores, círculos exteriores e círculos crescentes. A superfície, por sua vez, será descrita com o conceito de anéis de cebola. A vinculação entre as camadas concêntricas e a superfície do ciberespaço conforma o próprio conceito de sentido espectral. / This thesis is divided in two parts. The first part discusses the most influential schools and theories regarding the concept of meaning. The second part presents the concept of spectral meaning. This first section is monographic and consists in an investigation into the concept of meaning within four different fields of human sciences: logics, language, phenomenology and social systems theory. The second section presents the theoretical thesis concerning the concept of spectral meaning and discusses it in the light of communication and meaning diagrams. Therefore, the first part of this work introduces the varied understandings of the concept of meaning which, in a second phase, will be related to specific patterns of information and communication. This relationship between modes of production across different media matrices and a given concept of meaning is continually explored throughout the thesis. Spectral is, therefore, a metaphor for the specific production of sense in the digital environment. This field of electronic meaning will be described and portrayed in opposition to the non-spatial metaphors of diffusion that haunt the cyberspace, regularly depicting it as an open and incommensurable field of acceleration and expansion. Accordingly, the concept of spectral meaning will present two sets of paired elements in order to connect the non-spatial, diffusive and exterior metaphors of the cyberspace with a representation of the electronic meaning and its internal mechanisms. These mechanisms will be described theoretically and graphically along five main components: serialization, netclustering, gatekeeping, nodes and breakthrough. These operations, on the other hand, go through a surface whose activity is both concentric and arborescent. The description of this movement will be target along three cycles: inner circles, outer circles and growing circles. The surface itself, conversely, will be described with the concept of onion rings. The connection between the concentric layers and the cyberspace surface comprehends the concept of spectral meaning itself.

A teoria da sociedade de Niklas Luhmann, construída como teoria de sistemas sociais, encontra freqüentes críticas voltadas contra seu pretendido distanciamento moral e político no diagnóstico da sociedade contemporânea. Pesa sobre a teoria de sistemas sociais a generalização de um juízo prematuro conforme o qual ela se reduziria a uma sociologia conservadora de tendência tecnocrata, uma herdeira radicalizada do positivismo. Contudo, e contrariamente a essa percepção geral, a teoria de sistemas sociais parece ter um potencial crítico ainda inexplorado em toda a sua extensão, e que pode ser ativado por uma leitura que permita expandir o alcance da teoria. Essa expansão pode ser promovida quando a teoria de sistemas sociais é mobilizada para fundamentar uma teoria da comunicação de matriz materialista (capítulo 1), capaz de permitir que sua categoria fundamental a autopoiese seja compreendida em estreita relação com a apresentação do capital por Karl Marx (capítulo 2) e confrontada com uma teoria do capitalismo (capítulo e 3). Na seqüência, a teoria de sistemas sociais é empregada para dar conta das múltiplas dimensões da desigualdade social (capítulo 4) e da dinâmica dos conflitos e das contradições da sociedade atual (capítulo 5). Esta tese propõe um primeiro passo na direção de uma recepção crítica da obra teórica de Niklas Luhmann. Trata-se de testar os limites e as possibilidades da teoria de sistemas sociais. / Niklas Luhmanns theory of society, built as theory of social systems, is usually met with criticisms pointed against its intended moral and political distance in diagnosing contemporary society. Weights upon the social systems theory the generalization of a premature judgement according to which, this theory would be reduced to a conservative sociology with technocratic tendencies, a radicalised heir to positivism. However, and against this usual perception, the theory of social systems seems to have a critical potential not yet developed in its full extension and which may be activated by an interpretation capable of expanding its range. This extension can be carried out when we handle social systems theory in order to ground a materialistic theory of communication (chapter 1), enabling a close connection between its main conceptual category autopoiesis and Karl Marxs presentation of the capital (chapter 2), as well as a confrontation with a theory of capitalism (chapter 3). Afterwards, social systems theory is used to explaining the manifoldness of social inequality (chapter 4) and the dynamics of contemporary conflicts and societal contradictions (chapter 5). This thesis proposes a first step in the direction of a critical reception of Niklas Luhmanns theoretical work. It is a matter of testing limits and possibilities of social systems theory

Die Arbeit macht sich auf die Suche nach den Umrissen eines normativ fundierten Autokratiebegriffs. Begründet ist dieses Unterfangen mit der Beobachtung eines immanenten demokratischen Imperativs in den aktuellen Herrschaftskonzeptionen und Regimetypologien. Als Denkraum dient Niklas Luhmanns Theorie-Architektur der soziologischen Systemtheorie. Die Annahme ist, dass sich mit einer solchen Perspektive der Blick auf die Grundelemente des politischen Systems öffnen, die dann zu einer funktionalen Vernunft-Quelle führen um Autokratie neu zu definieren. / Based on the observation of an immanent democratic imperative in contemporary regime typologies and concepts, this work is in search for contours of a normative definition of autocracy. Niklas Luhmann's theoretical foundations serves as epistemological means to explore functional sources of Vernunft and to overcome metaphysical or natural justifications of order. The assumption is that such a perspective exposes fundamental elements of political systems and their systemic functions for a reformulation of autocracy.

Die vorliegende Arbeit untersucht die Intelligent Design (ID) Bewegung auf Basis der Luhmannschen Systemtheorie. Innerhalb dieser theoretischen Rahmung werden eine Einordnung und Positionsbestimmung der Bewegung, die ihrer Selbstbeschreibung nach wissenschaftlich operiert, vorgenommen. Die Wurzeln der Bewegung finden sich in der historischen Ausgangslage protestantischer Konfessionen. Aufgrund ihres Glaubens verfolgt, emigrierten viele Christen aus Europa in die 'neue Welt'. Die evolutionstheoretischen Erkenntnisse des 19. Jahrhunderts, insbesondere von Charles Darwin, hatten auch für das theologische Selbstverständnis dieser christlichen Gruppierungen weitreichende Folgen. Diesen wird entlang der Positionierung zum Kreationismus bis hin zum modernen politischen Aktivismus der Evangelikalen nachgegangen. Der systemtheoretische Ansatz leitet die Betrachtung der komplexen Kopplungen der ID-Bewegung zwischen verschiedenen gesellschaftlichen Teilsystemen an. Insbesondere wird die Beziehung zur Wissenschaft behandelt, mit Fokus auf das organisationale Zentrum der Bewegung, das Discovery Institute. Neben der politischen Arbeit wird der nach US-Recht „steuerrechtlich gemeinnützigen“ Stellung der Organisation besondere Aufmerksamkeit geschenkt. Politisches Agieren und wirtschaftliche Aspekte lenken den Blick schließlich auf die Öffentlichkeitsarbeit der ID-Bewegung und deren massenmedialen Auftritt. Die vorgebliche Wissenschaftlichkeit der Bewegung endet im Versuch das gegenwärtige System der Wissenschaft durch religiös-normative Setzungen zu regulieren. Das Ziel wird dabei mit der Gegenrepräsentation in der Gesellschaft, als soziale Bewegung, verfolgt.

The concept of community is highly problematic in the German context. ‘Gemeinschaft’ plays only a minor role in post-1945 philosophical writing, arguably as a result of the abuse of the concept by the National Socialists (‘Volksgemeinschaft’). Two of the major contemporary social philosophies in the German language, those of Jürgen Habermas and Niklas Luhmann, are deeply critical of ‘community’. Habermas rejects ‘community’ that has not been purified by a rational filter (as opposed to what he conceives of as the ideal ‘Kommunikationsgemeinschaft’). Luhmann rejects the concept outright, arguing that it is simply ‘alteuropäisch’ (i.e. based on out-of-date philosophical assumptions), and that it has no place in the description of modern society. In contrast to these prominent dismissive positions, I argue that the concept of community is an underrated one. First, Habermas relies more heavily on the concept of community than his focus on the ‘Lebenswelt’ makes us believe. I characterise his conception as a ‘transformation’ of systems theory, because his social philosophy partly adopts systems theory, while complementing it with the aspect of ‘community’. Second, I argue that contemporary cultural theoreticians (for example, Peter Sloterdijk) take systems theory as a starting point for developing ultimately communitarian social philosophies. The concept of community proves crucial as supplementation and balancing of systems-theoretical elements in contemporary thinking. Once this transformative role is recognised, a purely historical treatment of the concept of community – one which, as in Luhmann’s systems theory, sees no place for it in present or future theory – begins to look premature.

Crown selected youth diversion has received little academic attention in Canada. As a process that channels offenders out of the formal legal system, diversion purports to achieve contradictory self-serving system and offender-based goals. Using 50 randomly selected prosecution files – half of which the Crown diverted and half of which the Crown prosecuted – a mixed method investigation of diversion assesses cases through quantitative content analysis and grounded theory method. Based on the quantitative analysis, it is argued that there is an emerging patterned nature of Crown selected diversion that is not completely benign. This patterned nature of diversion unearths a distinctive discourse of diversion/non-diversion. Qualitatively, it is argued that the cases are organized around three temporal moments that create an area for distinctions to be made in terms of threat, responsibility, (in)tolerableness and recourse. Seemingly, there is a persistent paradoxical existence of the diversion process that emerges from the case files.
