La presente ricerca ha l’obiettivo di studiare il potenziale istruttivo/sociologico istruttivo delle misure associate al perdono giudiziario. Partendo da considerazioni attorno alla Dottrina di Protezione Integrale, analizza il citato Istituto, il suo concetto, la natura giuridica, i criteri di applicazione, in accordo al sistema giuridico patrio, alla Costituzione Federale, ai principi costituzionali, al sistema accusatorio ed al Patto di San José da Costa Rica. Paragona le pratiche relazionate al perdono giudiziario coi concetti dell’epistemologia genetica di Jean Piaget e colle pratiche pedagogiche sostenute da Paulo Freire in La Pedagogia dell’Autonomia. I risultati empirici paragonati alle basi teoriche citate rilevano il basso potenziale istruttivo delle pratiche adottate nell’uso del perdono giudiziario. / A presente pesquisa tem o objetivo de averiguar o potencial educativo/socioeducativo das medidas associadas à remissão. A partir de considerações acerca da Doutrina da Proteção Integral analisa o referido instituto; seu conceito, natureza jurídica, critérios de aplicação; conformação ao sistema jurídico pátrio, à Constituição Federal, aos princípios constitucionais, ao sistema acusatório e ao Pacto de São José da Costa Rica. Coteja as práticas relacionadas à remissão com os conceitos da epistemologia genética de Jean Piaget e com as práticas pedagógicas defendidas por Paulo Freire em Pedagogia da Autonomia. Os resultados empíricos em cotejo com as bases teóricas mencionadas revelam o baixo potencial educativo das práticas adotadas no emprego da remissão.

For this, the ASSE is regarded as a key actor in the process for implementing this policy. Through a comparative study between the reality observed in the states of Minas Gerais and Rio Grande do Sul, supported on in-depth interviews with 22 actors (principals and agents), observation of the structure and dynamics of 6 inpatient units, and documentary survey of the institutional strategies involved in the practice of this policy. We identified that the multiplicity of assignments required in the professional practice of ASSEs is far from being achieved in the reality of the units, and it is more feasible to focus on the collective profile or the socioeducational security team profile. Based on the interviews and analyses conducted, we designed recommendations for improvement with regard to three aspects: institutional change, material change, and dissemination and transformation of values. / Este estudo problematiza e identifica aspectos que influenciam o perfil e a prática do agente de segurança socioeducativa (ASSE) a partir de sua relação com as diretrizes da política de atendimento socioeducativo. Para tanto, o ASSE é considerado um ator fundamental no processo de implementação dessa política. Por meio de um estudo comparado entre a realidade observada nos estados de Minas Gerais e do Rio Grande do Sul, apoiado em entrevistas em profundidade com 23 atores (diretores e agentes), observação da estrutura e dinâmica de 6 unidades de internação e pesquisa documental das estratégias institucionais envolvidas na prática dessa política. Identificamos que a multiplicidade de atribuições exigidas no exercício profissional dos ASSE encontra-se distante de ser alcançada na realidade das unidades, sendo mais exequível focar o perfil coletivo ou o perfil da equipe de segurança socioeducativa. Com base nas entrevistas e análises realizadas, elaboramos recomendações de melhoria em relação a três aspectos: mudança institucional, mudança material e disseminação e transformação de valores.

Além da evolução histórica, o trabalho analisa as rotinas do Complexo de Defesa da Cidadania localizado na cidade de Picos PI. Os parâmetros para análise consideram as proposições do Estatuto da Criança e do Adolescente e sua aplicação na esfera municipal. Os procedimentos metodológicos utilizados para estruturação e análise do trabalho compreendem as orientações e demandas de um estudo de caso. Os resultados revelam aspectos e detalhes do cotidiano de uma unidade de internação provisória, apontam contradições, alternativas e comportamentos que surgem ao longo da execução de seus programas, evidenciando o descompasso entre as políticas sociais e sua implementação. Esses fatores contribuem para uma melhor compreensão das estratégias utilizadas na aplicação das medidas socioeducativas, assim como, a abordagem de temas negligenciados por análises mais amplas e sugere a necessidade de se atentar para novas metodologias de trabalho nas unidades de aplicação das medidas socioeducativas. Os resultados despertam também para a necessidade de estudos complementares que permitam uma melhor compreensão das contradições entre os diversos níveis de gestão e um interesse maior no problema da percepção dos vários segmentos envolvidos nos programas de atendimento sob medidas socioeducativas

Orientador: Débora Cristina Fonseca / Resumo: A presente pesquisa discute a temática da adolescência/juventude em conflito com a lei utilizando-se de referencial teórico fundamentado na perspectiva sócio histórica, que compreende os conceitos de juventude e ato infracional a partir da relação dialética entre o sujeito e o seu meio. O principal objetivo da pesquisa consistiu em investigar como os jovens autores de ato infracional compreendem as medidas socioeducativas e (re)conhecem sua efetividade. Os demais objetivos foram identificar as atividades desenvolvidas pelos jovens durante o cumprimento de medida socioeducativa, relacionando tais atividades com as diretrizes do SINASE (BRASIL, 2006); e analisar e refletir a respeito das possibilidades de que a socioeducação se constitua enquanto um espaço social e educativo capaz de proporcionar alternativas para a formação humana, bem como de garantir os direitos dos jovens e de suas famílias. Para tanto, foram realizadas entrevistas semiestruturadas com sete jovens em cumprimento de medidas de Liberdade Assistida (LA) e/ou Prestação de Serviços à Comunidade (PSC). Os dados produzidos pelas entrevistas foram analisados e discutidos com base no materialismo histórico dialético, através de categorias e subcategorias. Os resultados obtidos por meio das falas dos participantes desvelam contradições presentes nas medidas socioeducativas em meio aberto. (Resumo completo, clicar acesso eletrônico abaixo) / Abstract: The present research discusses the theme of adolescence/youth in conflict with the law, using the theoretical reference based on socio-historic perspective, which understands the concepts of youth and infraction from dialectical relationship between the subject and his environment. The main objective of this research was to investigate how the young who committed the infraction understand the socio-educational measures and recognize their effectiveness. The other objectives were to identify the activities developed by them when obeying the socio-educational measures, relating these activities with SINASE guidelines (BRASIL, 2006); analyze and reflect about the possibilities the socio-education consists in a social and educational space, able to provide alternatives to human formation, as well as ensure the families' and young’s rights. Therefore, semistructured interviews were realized with seven young complying Assisted Freedom (AF) and/or Community Service (SC). The data produced by these interviews were analyzed and discussed based on dialectical historical materialism, through categories and sub-categories. The results obtained by participants’ speeches unveil contradictions present in the socio-educational measures in opened environment. Orientador: Silvio José Benelli / Banca: Maurício Gonçalves Saliba / Banca: Édio Raniere da Silva / Resumo: A presente intercessão-pesquisa tem como objetivo principal atuar, investigar e problematizar a prática do psicólogo, os saberes e os fazeres no cenário da imbricação entre a Política Nacional de Assistência Social e o Sistema Nacional do Atendimento Socioeducativo (SINASE), tendo como lócus privilegiado o atendimento socioeducativo em meio aberto, executado em um CREAS com atuação específica no acompanhamento de adolescentes em cumprimento de Medidas Socioeducativas de Liberdade Assistida e Prestação de Serviços à Comunidade. Buscamos contribuir na reflexão e na construção de possibilidades de atuação técnica do trabalhador psicólogo, o que fazemos, a princípio, contextualizando o SINASE a partir de sua formação histórico-política, interrogando a sua formação atual e as práticas do trabalho social apresentadas pela literatura acadêmica, bem como discutindo a tecnologia socioeducativa e os modelos que se desdobram dessas práticas. (Resumo completo, clicar acesso eletrônico abaixo) / Abstract: The present intercession-research aims to act, investigate and problematize the practice of the psychologist, the knowledge and the practice in the intermingling scenario between the Brazillian National Social Work System and the Brazilian Young Offenders Support System (SINASE), having the supervised socioeducation probation services as our privileged theme, performed in a CREAS that specificlly works in the accompanying off young offenders that are subject to the legal punishments of probation and Community Services. We intent contribute to the reflection and construction of possibilities of technical performance in the psychologist work. At first, we do a contextualization of the SINASE and his historical-political formation, questioning its current formation and the practices of social work presented by the academic literature, ant discussing the socio-educational technology and the models that unfold from these practices. Os Direitos Humanos são o tema da pesquisa. Tendo-os como referência política e para a reflexão, o objeto de estudo do presente trabalho é a educação na situação de internação imposta a adolescentes infratores, a ser cumprida em Unidades da Fundação Estadual para O Bem-Estar do Menor - Febem/SP. Apoiada teoricamente em Foucault e Bourdieu, particularmente nos conceitos de sujeição do sujeito e de habitus, respectivamente, a pesquisa teve como objetivo investigar processos educativos que se desenvolvem com e sobre os adolescentes em situação de privação de liberdade. Para realizá-lo, parte da definição conceitual dos Direitos Humanos e da Educação, tendo como termos fundamentais educação e internação. A estratégia metodológica para a busca de dados que permitissem a reflexão a partir da hipótese colocada se desenvolveu explorando diversos testemunhos escritos sobre o objeto, de fontes diversas: pesquisas acadêmicas, de órgãos de governo e de organismos internacionais; reportagens na mídia; documentos internos de uma Unidade e da Fundação; documentos nacionais e internacionais que legislam sobre educação e sobre adolescentes em privação de liberdade. Starting from their as politic reference and element of reflection, the subject of this work is education imposed to the youth at institutions of reeducation as at unities of State Foundation for Welfare of Youth Febem/ SP. This research is on Foucaults and Bourdieus theories, more specifically by ideas about subjection of subject and habitus, it had as goal to investigate educative process development with and on the youths without freedom. For to think about it, we use as star point the conceptual definition about Human and Education Rights base on education and internement. The method of strategy used for search data to allow a reflection was developed exploring several write testimony about subject and several research sources as academic research, unities of government and international institution, newspapers, documents from Febem/ SP; national and international documents that have been legislating about education and freedom less for youth. This work toward to hegemony of educative process on social relations and relations of powerful from prisons systems than values, attitude and skill that internationals an nationals documents set up as goal for education of all children as subjective and non transferable.

In the last decade, the theme has gained prominence in the academic field focusing on socio-educational measures of deprivation of liberty. Despite the majority in the socio-educational system, measures carried out in an open environment are almost non-existent in the social sciences. Aiming to make these experiences visible and based on the understanding that the preponderant discourse in the guidelines of the socio-educational system is to enable futures distanced from the infraction practice, this research aims to analyze the construction of future projects of young people of the socioeducation of open means, that anchor this construction. Methodologically, we opted for an ethnographic insertion, involving observations, interviews and systematization of informal conversations with young people of an open-medium execution unit, located in the municipality of Canoas (RS, Brazil), recognized by the reduction of violence rates from of a public security policy that reinforced preventive actions. Based on Gilberto Velho's concept of possibilities field, data analysis allowed us to identify a typology of young people in the construction of their future projects, composed of two types: one related to young people with punctual insertions in infractional practices, and another with a continuous infraction trajectory. The former are characterized by projects of an "idyllic" future, without a great concern of mediation with the concrete possibilities, giving scope for a voluntaristic analysis of the process of construction of future projects. The others, characterized by recidivism and infractional practices as main forms of sociability, present projects of continuity of criminality, claiming to be the "only possibility", demonstrating a limited space for desire, contributing to a deterministic view of this process. In addition, it was possible to identify elements such as consumption and masculinity in the future projects of young people of both types and that these elements were accentuated by the experience of a temporality centered in the present, by a phenomenon of presentification. / A pesquisa insere-se no contexto de intersec??o das tem?ticas juventudes, viol?ncias e temporalidades, em especial, na figura dos adolescentes em conflito com a lei. Na ?ltima d?cada, o tema ganhou destaque no ?mbito acad?mico focalizando as medidas socioeducativas de priva??o de liberdade. Apesar de maioria no sistema socioeducativo, as medidas executadas em meio aberto s?o tema quase inexistente nas ci?ncias sociais. Visando visibilizar essas experi?ncias e partindo do entendimento de que o discurso preponderante nas diretrizes do sistema socioeducativo ? o de possibilitar futuros distanciados da pr?tica infracional, essa pesquisa objetiva analisar a constru??o de projetos de futuro de jovens da socioeduca??o de meio aberto, compreendendo quais os elementos que ancoram essa constru??o. Metodologicamente, optou-se por uma inser??o etnogr?fica, envolvendo observa??es, entrevistas e sistematiza??o de conversas informais com jovens de uma unidade de execu??o de meio aberto, situada no munic?pio de Canoas (RS, Brasil), reconhecido pela redu??o dos ?ndices de viol?ncia a partir de uma pol?tica de seguran?a p?blica que potencializou a??es preventivas. Partindo do conceito de campo de possibilidades de Gilberto Velho, a an?lise dos dados permitiu identificar uma tipologia de jovens, no tocante ? constru??o de seus projetos de futuro, composta por dois tipos: um ligado aos jovens com inser??es pontuais em pr?ticas infracionais, e outro com uma trajet?ria infracional cont?nua. Os primeiros caracterizam-se por projetos de um futuro ?id?lico?, sem uma grande preocupa??o de media??o com as possibilidades concretas, dando margem para uma an?lise voluntarista do processo de constru??o de projetos de futuro. The theoretical analysis was based on Lev Vygotsky and his followers‟ assumptions as well as from other theorists. The goal was to comprehend the relation of educational procedures and learnings, and this comprehension is built around the human capacity in noticing and recognizing ones mistakes and accomplishments such as the recognition of time and space and the individual's experience with the surrounding reality. Therefore, in this way, when analyzing the school learning process from Juveniles on Probation this paper aimed to comprehend how occur the socialization and absorption of school. This paper‟s theoretical structure also focused on the aspects of legal context and the actions from the Public System on the preservation of the guarantee from basic rights. The quantitative research had as study subjects a total of 19 Juveniles interviewed. There were eight (08) juveniles OP, who are enrolled at municipal and state public schools in Palmas, interviewed as well as eleven (11) juveniles interviewed at the Secretary of Social Development – SEDES from the city of Palmas. The data‟s analysis proved that there is a concerning social abyss between the school and the social environment, that the school‟s and the teachers‟ actions do not contribute to the development and maturation process of juveniles and that the Public Power needs to contribute to improve the social and educational care system on the Brazilian Federal State Tocantins. A preventive measure is not to be seen, yet, a punitive one. The system concentrates itself on the offense and only after that a social and educational measure is applied, but, the control and preventive actions cannot be seen. It would be necessary that the schools and the Public Justice Agencies formed an alliance and together would demand support policies to the Nacional Social Educational System – SINASE – and the National Council of Children and Adolescents‟ Rights – CONANDA, since this alliance is not accordingly structured. There is a need to promote policies of unification between the Social and Educational System in the city of Palmas and the Brazilian Federal State Tocantins. / O presente trabalho aborda os processos de aprendizado e desenvolvimento escolar de adolescentes que estão cumprindo medidas socioeducativas na cidade de Palmas, capital do estado do Tocantins. A análise teórica centrou-se nos pressupostos de Lev Vygotsky e seus/as seguidores/as, bem como, de outros/as teóricos/as. Buscou-se a compreensão das relações dos processos educacionais de aprendizagem e desenvolvimento, compreensão que se estrutura na capacidade da pessoa humana em perceber e reconhecer os próprios erros e acertos, em ter noção de tempo espaço e de sua vivência. Assim, mediante análise do aprendizado escolar de adolescentes que cumprem medidas socioeducativas em Liberdade Assistida – LA –, este trabalho objetivou compreender como ocorrem seus processos de socialização e aquisição dos conteúdos escolares. A estruturação teórica concentrou-se nos aspectos dos contextos legais e das ações do Poder Público na preservação da garantia dos direitos. A pesquisa qualitativa teve como sujeitos um total de dezenove (19) adolescentes entrevistados/as: oito (08) matriculados/as em escolas municipais e estaduais e onze (11) adolescentes foram entrevistados/as na Secretaria de Desenvolvimento Social – SEDES – desse município. A análise dos dados demonstrou que há um abismo social entre a escola e o ambiente social, que as ações da escola e de seus/as professores/as não contribuem no processo de desenvolvimento e amadurecimento dos/as adolescentes que estão em LA e que o Poder Público precisa contribuir para melhorar o sistema de atendimento socioeducativo no estado do Tocantins. O caráter preventivo não é visto, e sim o punitivo. Observa-se apenas o ato infracional e posteriormente a medida socioeducativa a ser aplicada, mas as ações de controle e prevenção social não são vistas. Seria necessário que as escolas e os Órgãos de Justiça do Poder Público pudessem se integrar para que juntos, demandassem políticas de sustentação do Sistema Nacional Socioeducativo – SINASE – e do Conselho Nacional dos Direitos da Criança e do Adolescente – CONANDA –, uma vez que, esta interligação não se estrutura adequadamente. Há necessidade de que sejam promovidas políticas de unidade do Sistema Socioeducativo na cidade de Palmas e no estado do Tocantins.

Foram identificados 70 estudos nas bases de dados ADOLEC (Literatura sobre adolescência) e SciELO, utilizando descritores associados ao tema e os critérios definidos de inclusão e exclusão. Após selecionados, foram analisados segundo a metodologia de análise de conteúdo temática. Verificou-se que a produção tem aumentado nos últimos anos e que questões emergentes são apontadas tanto no âmbito do sistema socioeducativo, em seu processo de socioeducação, como no âmbito da assistência à saúde. Tendo como temática transversal a esses dois eixos a tendência de psiquiatrização e patologização da adolescência, como fenômenos contemporâneos a serem discutidos e enfrentados na efetivação de um sistema implicado eticamente na atenção integral à saúde de adolescentes que praticaram atos infracionais.

It is an analysis ex-post-facto about the realized RAP and poetry workshops in the years 2007 to 2010 with teenagers that were in fulfillment of measurable social-educational internment Center of Adolescent Treatment (Cead) Centro de Atendimento ao Adolescente in Portuguese. This is one of the units that execute the social-educational measure of internment to male teenagers at Belo Horizonte/MG. For the realization of this study, was of big importance the analysis of all registers that were made in the period of 2007 to 2010, and it was: footages, photos, production of RAP lyrics and poetry lyrics of the teenagers, reports, records, annotations in the field diary, etc. Were also interviewed a teenager and two young adults that, when teenagers, participated in the workshops; two professionals that accompanied this practice of work with the teenagers and one DJ for being one of the oldest references of the Hip Hop Culture at Minas Gerais state. The realized interviews with a teenager and two young adults aimed to apprehend the resulting of the workshops in the perspective of their subjects. The realized interviews with the professionals have had as objective the apprehension of the meanings that they attributed to its realization. And, the interview with the DJ, was in reason of him subsidize the historical apprehension of the influence of the Hip Hop at the city and in your relation with the teenager. The realized analytical course demonstrated that the RAP and the poetry workshops can propitiate the apprehension and the tract of objective and subjective questions of the teenagers, related to your lives and to the measurable social-educational of internment that they are experiencing, with bigger approximation to their reality / Esta dissertação teve por finalidade apreender a relação do adolescente em cumprimento de medida socioeducativa de internação com as oficinas de RAP e de poesia, tendo em vista o uso dessas artes como instrumento socioeducativo e como caminho para possibilitar a comunicação, a reflexão e a efetivação dos objetivos da medida. Trata-se de uma análise expost- facto sobre as oficinas de RAP e de poesia realizadas nos anos de 2007 a 2010 com adolescentes que estavam em cumprimento de medida socioeducativa de internação, no Centro de Atendimento ao Adolescente (Cead), uma das unidades que executa a medida a adolescentes do sexo masculino, em Belo Horizonte/MG. Para a realização deste estudo foi de suma importância a análise de todos os registros feitos no período de 2007 a 2010, como filmagens, fotos, produção de letras de RAP e de poesias dos adolescentes, relatórios, prontuários, anotações do diário de campo, etc. Foram entrevistados: um adolescente e dois jovens adultos que participaram das oficinas quando adolescentes, com o objetivo de apreender os resultados das oficinas, na perspectiva dos seus sujeitos; dois profissionais que acompanharam essa prática de trabalho com os adolescentes; e um DJ, por ser uma das referências mais antigas da cultura Hip Hop no estado de Minas Gerais. As entrevistas realizadas com os profissionais tiveram por objetivo a apreensão dos significados que os mesmos atribuíram à sua realização. E, a entrevista com o DJ, deu-se em razão dele poder subsidiar a apreensão histórica da influência do Hip Hop na cidade e em sua relação com o adolescente. O percurso analítico realizado demonstrou que as oficinas de RAP e de poesia podem propiciar a apreensão e o trato de questões objetivas e subjetivas dos adolescentes, relacionadas à sua vida e à medida socioeducativa de internação que estão vivenciando, com maior aproximação de suas realidades
