Obstacles to shared decision-making in psychiatric practice : findings from three observational studies

This thesis aims to make contributions at substantive, methodological and theoretical levels. First, the findings from three observational studies are combined to identify obstacles to the use of shared decision-making in modern psychiatric practice. Particular attention is paid to how patients' choices about their treatment are facilitated or constrained by the actions of mental health professionals. A typology of pressure is constructed, based on detailed analyses of how pressure is applied and resisted in routine encounters (outpatient consultations) and "crisis' situations (assessments for compulsory admission to hospital, and ward rounds in acute inpatient care). Findings from two ethnographies and one conversation analysis (CA) study are presented. 'Meaning' is central to the write-up of each set of findings, however while the analytic focus of the ethnographies is 'insider' knowledge and meanings, in the CA study it is gn the activities that make those meanings possible in the first place. The methodological contribution of the thesis stems from its demonstration of how to produce a coherent, unified research account from two very different versions of qualitative inquiry. Despite the potential for analytic inconsistency, the thesis arguably has far greater force and persuasiveness as a result of the attempt to combine, compare and contrast findings from three studies. It is contended that a sound theoretical base for sociological research may be created by combining Goffman's micro-sociology with Foucault's analyses of disciplinary power/knowledge in one of a number of ways. A Goffmanian 'home base' is adopted for this thesis, with Foucauldian thinking applied to add a historical, 'macro' dimension to the analysis that Goffman's work so conspicuously lacks. Foucault's work also provides the conceptual tools for examining the more subtle form of control through expertise that would be missed in a purely Goffmanian study.

A veiled space - Ideological Images of Society in Swedish Compulsory School Civics Lars Sandin  This study deals with the ideological dimension of education in the Swedish compulsory school [grundskolan]. By focusing on the images of the social world which are configured in the content of education, the study pays attention to the reproduction of an ideological dimension which is latent in our social imaginary. The theoretical problem was formulated as a question about if, and in what form, critical knowledge content is offered as part of the reproduction of the social imaginary that takes place in education. The empirical aim was to interpret the images of society configured in policy documents and teaching practice in compulsory school civics [samhällskunskap] with regard to how the differentiation of social space appears in these images. A hermeneutic approach was used. In the first of the two parts of the study, a number of policy documents – curricula and syllabi – were interpreted. In these documents, the differentiation of social space was found to be made visible selectively. The gender dimension and the dimension termed “cultural diversity” were highlighted, while the link between social differences and the uneven distribution of resources could only be glimpsed sporadically. A clear pattern of individuality could also be interpreted. The second of the two parts of the study was designed as a multiple case study. In this, the teaching of two teaching contents in civics, politics and economics, were studied as two separate cases. Three different images of society could be interpreted: a rationalist, a functionalist and a socio-political image. Of these, only the socio-political image offered a transparent view into the differentiated social space. However, the socio-political image was given a weak and unclear legitimacy in the teaching. The dominance of the rationalist and functionalist images were related to traditions that embed the teaching of civics. In the discussion the results from the two parts of the study were taken together and related to the problem. Among other things, the results were interpreted as an example of a conflict between contemporary reproduction and historical reproduction in education.

Statistik från Socialstyrelsen visar att den 1 november 2016 tvångsvårdades 384 personer med missbruksproblematik i Sverige. Mellan år 2000–2009 dokumenterades 150 graviditeter och åtta förmodade graviditeter som resulterade i 94 barn som föddes av kvinnor som fick vård enligt LVM. Dessa barn föddes i högre andel prematurt jämfört med resten av befolkningen samt hade lägre födelsevikt. I Sverige finns det idag inget lagstöd för att vårda en gravid kvinna med missbruksproblematik till skydd för det ofödda barnet. Det beräknas att det föds 1,6 barn per 1000 med den svåraste formen av skador till följd av moderns alkoholintag, fetalt alkoholsyndrom. Studiens syfte är därför att med en kvalitativ metod undersöka hur åtta yrkesverksamma socialarbetare i Sverige upplever arbetet med gravida kvinnor med missbruksproblematik samt hur de uppfattar skyddet för ett ofött barn. Studien har sedan analyserats utifrån de teoretiska begreppen makt och handlingsutrymme samt svenska lagar, riktlinjer och konventionen om barns rättigheter. Resultatet visar att samtliga informanter känner frustration över att inte kunna ta hänsyn till barnets välbefinnande förrän efter det fötts och att de anser att det hade varit till fördel för både barnen och till viss del de gravida om lagen ändrades. / Statistics from the National Board of Health and Welfare declares that on November 1, 2016, 384 people with drug addiction were receiving compulsory treatment in Sweden. Between the years of 2000 and 2009, 150 pregnancies and 8 presumed pregnancies which resulted in 94 children born of women receiving care under the LVM were documented. These children were born prematurely and had lower weight at birth compared to the rest of the population. In Sweden, there is no legal ways to grant a pregnant woman with substance abuse compulsory treatment for the protection of the unborn child. It is estimated that 1.6 children out of 1,000 are born with the most severe form of injuries due to the mother's alcohol intake, which is fetal alcohol syndrome. The purpose of this study is to by a qualitative approach examine how eight working social workers in Sweden experience their work with pregnant women with substance abuse and how they perceive the protection of an unborn child. The answers has then been analyzed on the basis of the theoretical concepts of power and scope, as well as Swedish laws, guidelines and the convention on the rights of the child. The result shows that all informants feel frustrated by not being able to take into account the child's wellbeing until after birth and that they think a change in Swedish law would have been beneficial for both the children and the pregnant women.

Povinnosti pacientů a zdravotnických zařízení v ochraně veřejného zdraví / Obligations of Patients and Medical Facilities in Public Health Protection

Personality rights are fundamental human rights which are the subject of much attention also during the provision of health care. A patient has right, above all, to data protection in his medical documentation, medical facilities have an obligation to maintain confidentiality on matters relating to the patient?s state of health. All therapeutic actions can be carried out only with the consent of a patient. However, the personality rights can be limited in order to protect public health. Legislation can impose a whole range of obligations and duties to patients and medical facilities in order to protect public health. The thesis summarizes fundamental legislation and regulations of the above mentioned issue. It describes a possibility to break the confidentiality in order to protect public health, a regulation of imposition of compulsory medical treatment and anti-epidemiological measures. The thesis briefly informs about company preventive care and related limited choice of a physician and a medical facility. The objective of the thesis was to find out the views of general public of limitations of personality rights in order to protect public health. For the practical part the method of quantitative research was chosen, the technique of a questionnaire. The research was conducted from January 2011 to March 2011 in the region of České Budějovice. The research group included 460 respondents, 405 respondents filled in the questionnaires properly and these were included in the research. To achieve the research objectives, three hypotheses were set. Hypotheses 1 and 3 were proven on the basis of obtained and statistically evaluated data. Hypothesis 2 was not proven. The research results demonstrated especially differences in respondents´ views of a possibility to refuse obligatory vaccinations.

Esta dissertação tem por objetivo compreender de que maneira os estudantes de graduação em Educação Física relatam suas experiências com a clausura durante o estágio em saúde mental no Hospital Psiquiátrico São Pedro (HPSP). Fundamentase nos aportes teóricos produzidos a partir do movimento em prol da da Luta Antimanicomial e da Reforma Psiquiátrica, bem como busca inspiração analítica nos princípios da desinstitucionalização da loucura. A pesquisa é de corte qualitativo com metodologia centrada na análise documental proposta por André Cellard (2008; 2012) e incrementada pelo relato da experiência da própria pesquisadora in loco. A operacionalização da investigação contou com duas etapas desenvolvidas entre os meses de outubro de 2015 e abril de 2016. A primeira, refere-se à experiência de dois meses ininterruptos da pesquisadora no estágio de familiarização dentro dos serviços de saúde mental oferecidos pelo Hospital Psiquiátrico São Pedro. A segunda, emerge da análise documental sobre os relatórios de estágio em saúde mental dos estudantes de Educação Física que realizaram seus estágios nesta mesma instituição. A partir da análise dos relatos, foi possível notar que o estágio em saúde mental foi tratado mais na perspectiva de cumprimento de uma demanda de familiarização com o HPSP do que de um movimento de estranhamento à manutenção do controle e confinamento dos sujeitos nos dias de hoje. Pelo que pude perceber nas entrelinhas dos relatos, os estagiários veem a Educação Física mais como uma ferramenta de contenção, presa às demandas orgânicas do cuidado, do que um espaço para reflexões sobre os serviços substitutivos e a aposta na reinserção social do sujeito. Em conclusão, penso que para aprofundar os efeitos da Reforma Psiquiátrica é preciso também pôr em marcha um movimento "antiestágio- manicomial". / This research aims to understand how the graduate students in Physical Education report their experiences with the patients’ confinement during the internship in mental health at São Pedro Psychiatric Hospital (HPSP). The study is based on the theoretical contributions made from the movement for the Anti-Asylum and the Psychiatric Reform, and search analytical inspiration in the principles of deinstitutionalization.The research was based on qualitative cutting with its methodology centered on document analysis proposed by André Cellard (2008; 2012), and also, improved by the experience of the researcher on the spot. The investigation had two stages developed between the months of October 2015 and April 2016. The first refers to two months of continuous experience researcher had at the familiarization stage within the mental health services offered by the Psychiatric Hospital St. Pedro. The second emerges from the documentary analysis of internship reports on mental health of Physical Education students who conducted their internships at the same institution.From the analysis of the reports, it was noticeable that the internship in mental health has been treated more from the perspective of demand compliance to the familiarization with HPSP than a movement of estrangement to control maintenance and confinement of patients in these days. In these demands the internship in Physical Education also appeared as a containment tool, trapped in a care organic logic. It is possible to tell that the internship ends incorporating asylum features, leaving little space for reflection on the substitutive services and its commitment to social reintegration of the patients. In conclusion, I believe that stop deepen the effects of psychiatric reform is necessary to set also in motion a movement "anti-asylum-internship".

O trabalho do apenado e a (des)marginalização do direito laboral : a possibilidade do liame empregatício do trabalho extramuros em prol da iniciativa privada

Apesar da sistemática constitucional advinda em 1988, na qual é vedada a pena de trabalhos forçados, o sistema de execução penal vigente no ordenamento jurídico brasileiro prevê a obrigatoriedade do trabalho do apenado à pena privativa de liberdade em caráter definitivo como forma de ressocialização da pessoa e para evitar o ócio carcerário, dentre outros fins. Tal trabalho sofre a não incidência dos direitos trabalhistas previstos na CLT, possuindo, o apenado, resguardo apenas a alguns benefícios previstos na legislação penal, além da remição da pena em razão do trabalho prestado. Todavia, esse não deveria ser o tratamento conferido ao preso ao trabalhar externamente para a iniciativa privada, pois nessa situação o apenado poderá possuir todos os elementos essenciais configuradores da relação de emprego. Porém, o mesmo tratamento marginalizado continua a ser conferido para essas relações. O Estado, ao possuir a custódia do condenado, deverá devolvê-lo para a sociedade como um cidadão capaz de coexistir em condições de convivência pacífica com os demais. Contudo, a conjuntura carcerária brasileira está calcando o caminho contrário, pois há o desrespeito à dignidade da pessoa humana, condição primordial para o tratamento de reabilitação. / Despite the constitutional systematic arising in 1988, in which the forced labor penalty is prohibited, the system of criminal enforcement force in Brazilian law provides for compulsory labor of the convict to the closed regime as a form of rehabilitation of the person and to avoid idleness prison. Such work does not suffer the impact of labor rights provided for in the Labor Code, possessing, the convict, just a few benefits guard provided for in criminal law, beyond redemption penalty by reason of the work provided. But, this should not be the treatment given to the prisoner, because the convict to work externally to the private sector may have all configurators essential elements of the employment relationship. However, it remains marginalized treatment given to these relations. Brazil bans the death penalty, therefore, the State has custody of the convict, it must return to society as a citizen able to coexist in conditions of peaceful coexistence with others. However, the Brazilian prison situation is to occur the other way, as there is a lack of respect for human dignity, precondition for rehabilitation treatment.
