Dessa forma, concebe-se este trabalho enquanto uma avaliaÃÃo de processo, utilizando-se da metodologia qualitativa, baseada no mÃtodo do estudo de caso. Por meio dela, podem-se compreender as percepÃÃes e significados do atendimento socioeducativo, na concepÃÃo dos seus mais legÃtimos destinatÃrios: os socioeducandos e seus familiares. Os instrumentos utilizados para a coleta de dados constituÃram-se de: pesquisa documental, observaÃÃes da rotina, entrevistas semiestruturadas, registros em prontuÃrios e Planos Individuais de Atendimento. Les femmes qui agressent sexuellement en compagnie de leur conjoint : trajectoire de vie et passage à l’acteDesfachelles, Marion 08 1900 (has links)
Si au cours des dernières décennies les connaissances relatives aux délinquantes sexuelles se sont accrues, celles relatives aux co-délinquantes sont encore rares, alors que ces femmes représentent une part importante du total des délinquantes sexuelles. Le but de la présente étude était de mettre en lumière les trajectoires de vie des femmes qui agressent en compagnie de leur conjoint et de dresser un modèle descriptif du processus de leur passage à l’acte. Sur la base de 17 entretiens non directifs avec des femmes incarcérées en France pour des faits de co-délinquance sexuelle, notre recherche suggère que les co-délinquantes présentent majoritairement un historique de vie abusif et des difficultés émotionnelles, relationnelles, économiques et éducatives importantes. Ces facteurs de vulnérabilité ont été acquis au cours de leur enfance et par leurs expériences sentimentales négatives et abusives. Un modèle descriptif de leur passage à l’acte en trois phases a été établi. Il est apparu que la délinquance sexuelle des co-délinquantes se modifiait au fil des agressions, tant dans leur implication dans les abus qu’au niveau de leur coercition. Les données ont aussi révélé un nombre non négligeable de femmes qui agressent ensuite par elles-mêmes. Ces constatations nous ont amenés à une classification en trois catégories des femmes qui agressent sexuellement : les femmes asservies, les femmes impliquées et les femmes diversifiées. / Although knowledge about female sexual offenders has become more extensive in recent years, our knowledge of co-offenders, who account for an important part of all female sexual offenders, is still sparse. The aim of the present study was to better understand the life course history of female sexual co-offenders and to develop a descriptive model of their offending process. Systematic qualitative analyses of 17 interviews with female sexual co-offenders incarcerated for sexual offenses in France were conducted. Results show that the majority of female sexual co-offenders had problematic life-course histories that include emotional, relational, financial and educational difficulties. Many of these difficulties emerged during childhood and grew more important as a result of abusive and negative experiences that set the stage for the co-offending relationships. The analysis of the co-offending process showed that the coercive basis for female sexual co-offending changes over time. Results also revealed the presence of three sub-groups of female co-offenders with different roles and motivations, indicating the need for differential assessment and intervention strategies with female co- offenders.

An implementation of what is currently one of the most commonly used tools for high- risk assessment of offenders, HCR-20, the 3rd version - HCR (V3) to the Czech Republic is the main goal of the submitted thesis. Specifically, a theoretical background of this tool, an illustration of the administration and data evaluation within two different case studies, an assessment of inter-rater reliability, a comparison of three versions of HCR-20 with emphasis on the second and the third vision and advantages and disadvantages of HCR (V3) are introduced. This project underlines an importance of taking part in training for a high-risk assessment tool, which is very often underestimated in the Czech Republic, and the importance of gained experiences in high-risk assessment of offenders and the unification of assessors. Moreover, the study supports the implementation of standardised high-risk assessment method. The high-risk assessment of offenders ad hoc should be replaced in our country by clinical assessment supported by results gained via standardised high-risk assessment tool as it is applied abroad. Further research is needed to gain this goal. Empirical results in the thesis are supported by theoretical background. Si la question de l'inclusion des actes de terrorisme dans la notion de crime contre l'humanité avait déjà été abordée à plusieurs reprises dans certains travaux, c'est au lendemain des attentats terroristes du 11 septembre 2001 perpétrés aux États-Unis d'Amérique qu'elle s'est posée avec acuité. Cette étude est née de la volonté de savoir si le terrorisme pourrait être considéré comme un crime contre l'humanité. Celle-ci se veut une analyse des points de ressemblance et de dissemblance entre l'incrimination et la criminalité terroristes d'une part et celles liées au crime contre l'humanité d'autre part. Si à certains égards, le terrorisme se rapproche du crime contre l'humanité, par la violence et le contexte idéologique qui les caractérisent, il n'en demeure pas moins qu'il s'agit de deux criminalités essentiellement différentes. Étant donné que traiter du crime contre l'humanité et du terrorisme, c'est aborder des sujets où se trouvent étroitement imbriqués le droit, l'histoire, la politique et la sociologie politique, l'étude ne se limite pas au seul droit pénal. / If the matter of including terrorist acts in the notion of crime against humanity had already been approached repeatedly in certain research works, since the terrorist attacks of September 11th 2001, committed in the United States of America, it raised intensively. This study grew from the will to know if terrorism could be considered as a crime against humanity. This one aims to be an analysis of similarities and disparities between terrorist incrimination and criminality on the one hand and those linked with crime against humanity on the other hand. If in certain respects, terrorism gets closer to the crime against humanity, by violence and ideological context which characterize them, the fact remains that they are essentially two different forms of criminalities. Given that dealing with crime against humanity and terrorism, will raise subjects in which are closely interconnected law, history, politics and political sociology, thus the study is not restricted to the plain criminal law.

Previous issue date: 2016-02-22 / The present work has the scope to examine the new paradigms in human relationship with the environment, so that the right can respond effectively to the many emerging demands, without losing sight of the essential component of human dignity. Scientific analysis had as reference the doctrine study, native and foreign country, of the legislation and judicial behavior in face of the subject discussed. From this perspective, to analyze the current predisposition of the law, one seeks to understand how environmental laws can be related to fundamental rights and personality of the individual. By examining this dynamic, being the right to healthy and ecologically balanced environment a fundamental right, this right can perfectly merge with the general right of personality, forming a fundamental right of personality to the environment where humans can fully develop their qualities and essential attributes. The connection of environmental law with the fundamental right and the right to personality is supported on the theory of complexity of Edgar Morin, where it is possible to extend the legal nature of the right to the environment. In addition, the study faces the problem of how damage caused to the environment can affect the human being. For this purpose, the present study turns the attention to the theoretical aspects that allow the configuration of moral damage subject to compensation to the human being compared to the environmental damage. Thus, one can conclude that the ecological damage is not the only damage to the balance of the environment (pure environmental damage), affecting also other fundamental values, such as the right of personality and human dignity (environmental damage reflection or rebound) / O presente trabalho tem o escopo de analisar os novos paradigmas na relação do ser humano com o meio ambiente, a fim de que o Direito possa responder com efetividade às múltiplas demandas emergentes, sem perder de vista o componente essencial da dignidade humana. A análise científica teve como referenciais o estudo de doutrina, pátria e estrangeira, da legislação e do comportamento jurisprudencial que envolve o tema abordado. Sob essa perspectiva, ao analisar a atual predisposição do Direito, busca-se compreender como o direito ambiental pode ser relacionado aos direitos fundamental e de personalidade do indivíduo. Ao se examinar essa dinâmica, sendo o direito ao meio ambiente sadio e ecologicamente equilibrado um direito fundamental, ele pode, perfeitamente, fundir-se ao direito geral de personalidade, formando um direito fundamental de personalidade ao meio ambiente, pelo qual o ser humano poderá desenvolver plenamente suas qualidades e atributos essenciais. A conexão do direito ambiental com o direito fundamental e o direito de personalidade encontra amparo na teoria da complexidade de Edgar Morin, que entende ser possível ampliar a natureza jurídica do direito ao meio ambiente. Além disso, o estudo enfrenta o problema de como os danos causados ao meio ambiente podem afetar a pessoa humana. Com esse propósito, a pesquisa enfatiza os aspectos teóricos que possibilitam configurar dano moral indenizável à pessoa humana quando houver lesão ambiental. Assim, conclui-se que o dano ecológico não consiste apenas e tão-somente na lesão ao equilíbrio do meio ambiente (dano ambiental puro), mas afeta, igualmente, outros valores precípuos fundamentais, como o direito de personalidade e a dignidade humana (dano ambiental reflexo ou ricochete)

En observant l’activité disciplinaire de l’administration, nous remarquons qu’il y beaucoup de cas où on a transgressé clairement les exigences et les garanties données par le législateur en faveur du fonctionnaire durant la procédure disciplinaire. En effet, l’importance de cette étude et ses objectifs sont les suivants :- Les garanties disciplinaires occupent une place importante dans la fonction publique, car ce sont elles qui protègent les droits du fonctionnaire qui fait l’objet d’une enquête disciplinaire et qui limitent l’arbitraire et l’extrémisme de l’administration vis-à-vis à ses employés, afin de réaliser une enquête disciplinaire juste. Etudier et démontrer la valeur juridique des garanties disciplinaires destinées à assurer la protection du fonctionnaire, notamment à notre époque où le nombre de fonctionnaires, en Libye, a dépassé, selon les dernières statistiques, le seuil de million de fonctionnaires ; ce qui fait d’eux la plus grande catégorie socioprofessionnelle. L’intervention de l’Etat pour satisfaire les besoins de ses citoyens se fait à travers les services publics dont l’efficacité repose sur celle du fonctionnaire. Et étant donné que le principe de l’efficacité exige l’octroi à l’administration d’un certain pouvoir disciplinaire pour sanctionner le fonctionnaire fautif, sécuriser l’emploi et rassurer l’employé sont également nécessaires, afin de stimuler ses ambitions et améliorer ses performances. C’est pourquoi l’existence du principe de la garantie et le fait de trouver l’équilibre entre ce principe et celui de l’efficacité est nécessaire. Cette étude a visé, également, à informer les fonctionnaires qu’il existe beaucoup de garanties pour lesquelles ils doivent être informés afin de pouvoir protéger leurs droits au cas où ils font l’objet des sanctions disciplinaires, alors qu’une grande majorité d’eux n’a aucune autre source financière à part leurs salaires. Car ils peuvent perdre leur traitement, cela est prévu par la loi en cas de suspension pendant la procédure disciplinaire ou pour toujours en cas de révocation. Enfin, l’intérêt de cette étude consiste, aussi, dans le fait qu’elle compare deux systèmes disciplinaires, à savoir le système libyen et le système français, tout en faisant référence à d’autres systèmes, afin d’identifier ses lacunes et proposer des solutions appropriées. Et cela éclaire, sans doute, le chemin devant les personnes chargées de faire évoluer les législations libyennes concernant la fonction publique. / In observing the disciplinary activity of the administration, we note that there are many cases where the requirements and guarantees given by the legislator in favor of the civil servant during the disciplinary procedure have been clearly violated.Indeed, the importance of this study and its objectives are as follows:Disciplinary safeguards play an important role in the public service, as they protect the rights of the civil servant who is the subject of a disciplinary investigation and limit the arbitrary and extremism of the administration vis-à-vis its employees, in order to conduct a fair disciplinary investigation.To study and demonstrate the legal value of the disciplinary guarantees intended to ensure the protection of the civil servant, especially in our time when the number of civil servants in Libya exceeded, according to the latest statistics, the threshold of millions of civil servants; This makes them the largest socio-professional category.The intervention of the State to satisfy the needs of its citizens is done through the public services whose efficiency depends on that of the official. And since the principle of efficiency requires the administration of a certain disciplinary power to sanction the offending official, secure the job and reassure the employee are also necessary, in order to stimulate his ambitions and improve his performance. That is why the existence of the principle of guarantee and the balancing of this principle with that of effectiveness is necessary.The study also aimed to inform public servants that there are many guarantees for which they must be informed in order to protect their rights in case they are subject to disciplinary sanctions, when a large majority of them have no other financial source besides their salaries. Because they may lose their treatment, this is provided by law in case of suspension during disciplinary proceedings or for always in case of revocation.In the fact that it compares two disciplinary systems, namely the Libyan and French systems, while making reference to other systems, in order to identify its shortcomings and propose appropriate solutions. And this undoubtedly illuminates the way for those responsible for the evolution of Libyan legislation concerning the public service.

La situation environnementale actuelle et les prévisions y afférentes des experts,obligent à questionner l’appréhension du dommage à l’environnement par la responsabilitécivile et plus largement, des atteintes et risques d’atteintes à celui-ci.Cette réflexion porte ainsi sur les outils et mécanismes de ladite responsabilité, afin devérifier leur adaptation à ce dommage. Il s’agit d’identifier les carences du régime, et deformuler des propositions théoriques, techniques, ou pratiques, car d’importants efforts restentà fournir, tous domaines confondus, pour un droit effectif et efficace.Se trouvant à la croisée des problèmes et enjeux abordés, le secteur agroalimentairefait office de secteur-témoin, comme il en va de la responsabilité relative singulièrement à lasanté humaine, sans préjudice d’impacts autres des pollutions.Ces dommages étant majoritairement très difficiles à constater avec rigueur et àévaluer, en plus d’être onéreux à réparer –lorsqu’ils ne sont pas irréversibles–, leraisonnement suivi consiste à démontrer l’urgence de mieux adapter la responsabilité civile àceux-ci, par l’analyse de ses différents éléments, en tenant compte de la dualité qui lacaractérise. The following thesis considers the shortcomings and adequacy of tort law’stools and mechanisms for addressing these environmental concerns. Indeed, it is particularlydifficult to even ascertain most environmental offenses and estimate their cost, particularlywith regard to irreversible harms. Thus, the reasoning demonstrates the emergency of a betteradaptation of both corresponding liability and responsibility, through their different elements,including the duality that characterizes them. Here, we then offer theoretical, technical orpractical considerations, which may be of use in navigating this route.In considering these issues, the food proceeding industry serves as a particularly usefulmodel sector for the demonstration, as it has grappled with many of the same problems andstakes, including liability for human health, without prejudice to other pollutions’ impacts.Furthermore, we aim at rethinking the ill-adapted law to consider liability andresponsibility; this requires that we learn lessons from the results of the reasoning, andmanage with the particularities of interests and actors that intervene, or the larger room thatmust be devoted to the environment in social choices. Specifically, the goal of theanthropocentric approach is to enable to overcome skepticism towards environmentalconcerns, and to underline the fact that these offenses are fundamentally borderless.

Annotation The diploma thesis deals with the description and analysis of tax and administrative management in terms of deadlines. The aim of the thesis is to find a practical basis when applying an inconsistent setting of deadlines in the tax and administrative procedures. It was important to determine whether the concept of deadlines in the legislation is different, how the concept of time is regulated in the legislation and how this issue can actually affect us. The analysis of individual management was based on actual data. I was provided the data related to the tax procedure by a particular tax subject. The data related to the administrative procedure were requested from a specific administrative authority. The practical part of the thesis deals with a detailed analysis of individual management in terms of deadlines. The tax procedure was about determining the preclusion of the deadline for a tax assessment and the identification of the factors which had an impact on the course of this period. In the case of administrative proceeding, the time limits which are necessary for discussion of the minor offense and the administrative offense were analyzed. The thesis contains tables with data for better clarity within individual management.

Previous issue date: 2014 / With the Constitution of the Federative Republic of Brazil (1988), the Statute of Children and Adolescents - ECA - (1990) and the National System of Socio-Educational Services - SINASE - (2012) provides is sufficient legislation for a guided socio action respect for human rights, from the perspective of inclusion and citizenship. The SINASE regulates the execution of educational measures, establishing the principles and guidelines that should norteá them. The expected socio-educational measures in the ECA, in its art. 120, refers to Socioeducativa Measure Free range. While measure restricting freedom, it has been carried out by the Centre Free range Martyr Francisca, unit constructed in accordance with the SINASE guideline regarding the architectural design and educational proposal. This study presents what is sought to understand how these principles and guidelines are being implemented in educationally childcare service in Free range Martyr Francisca Center. So problematized is the hybrid character of socio-educational measures, raising questions about their sanctioning and educational content as well as the subjective and microsocial forms of everyday life involving adolescents in compliance with socio-educational measures of semi-liberty in Fortaleza. Thus, this work is conceived as a process of evaluation, using the qualitative methodology, based on the case study method. Through it, one can understand the perceptions and meanings of social and educational services in the design of its most legitimate recipients: the socioeducandos and their families. The instruments used for data collection is consisted of: desk research, routine observations, semi-structured interviews, medical records and records in Individual Care Plans. This study will establish a pedagogical relationship mediated by means other than punitive, composing a new look at the socioeducandos, and them about themselves; It points out the need and the difficulty does not have an Alumni Program; and demonstrates the need for a greater involvement of the state executive power, in achieving the goals established in the State Plan for Socio-Educational Services. / Com a Constituição da República Federativa do Brasil (1988), o Estatuto da Criança e do Adolescente — ECA — (1990) e o Sistema Nacional de Atendimento Socioeducativo — SINASE — (2012), dispõe-se de legislações suficientes para uma ação socioeducativa pautada no respeito aos Direitos Humanos, numa perspectiva de inclusão e cidadania. O SINASE regulamenta a execução das medidas socioeducativas, estabelecendo os princípios e diretrizes que devem norteá-las. A medida socioeducativa prevista no ECA, em seu art. 120, refere-se à Medida Socioeducativa de Semiliberdade. Enquanto medida restritiva de liberdade, tem sido efetivada pelo Centro de Semiliberdade Mártir Francisca, unidade construída em conformidade com a diretriz do SINASE referente ao projeto arquitetônico e à proposta pedagógica. O presente estudo apresenta o que se busca compreender sobre como esses princípios e diretrizes estão sendo pedagogicamente implementados no atendimento socioeducativo no Centro de Semiliberdade Mártir Francisca. Assim, problematizou-se o caráter híbrido da medida socioeducativa, levantando questões sobre seu conteúdo sancionatório e pedagógico, bem como as formas subjetivas e microssociais do cotidiano que envolve os adolescentes em cumprimento de medida socioeducativa de semiliberdade em Fortaleza-CE. Dessa forma, concebe-se este trabalho enquanto uma avaliação de processo, utilizando-se da metodologia qualitativa, baseada no método do estudo de caso. Por meio dela, podem-se compreender as percepções e significados do atendimento socioeducativo, na concepção dos seus mais legítimos destinatários: os socioeducandos e seus familiares. Os instrumentos utilizados para a coleta de dados constituíram-se de: pesquisa documental, observações da rotina, entrevistas semiestruturadas, registros em prontuários e Planos Individuais de Atendimento. O estudo evidencia o estabelecimento de uma relação pedagógica mediada por outros meios que não os punitivos, compondo um novo olhar sobre os socioeducandos, e deles sobre si mesmos; aponta a necessidade e as dificuldades em não se dispor de um Programa de Egressos; e demonstra a necessidade de um envolvimento maior do poder executivo estadual, no cumprimento das metas estabelecidas no Plano Estadual de Atendimento Socioeducativo.

É preciso conhecer os problemas enfrentados pelo Poder Judiciário para buscar soluções satisfatórias e não paliativos. Esta pesquisa está fundamentada na efetivação do princípio constitucional da duração razoável do processo à luz da satisfação do jurisdicionado, sendo o fundo de garantia das
execuções trabalhistas um instrumento capaz de concretizar os direitos sonegados aos trabalhadores na Justiça do trabalho, apresentando possíveis soluções para a morosidade na prestação jurisdicional, garantindo uma tutela justa, útil e adequada. Com o passar do tempo vem aumentando o número de demandas no judiciário e com o advento da Emenda de n 45, que atribuiu novas competências à Justiça do Trabalho, observou-se a dificuldade processual de concretização deste princípio na Justiça do trabalho. Assim, pela falta de institutos capazes de fornecer subsídios que efetivem a prestação
jurisdicional com a satisfação do jurisdicionado cria-se com a Emenda Constitucional de n 45 em seu artigo 3 o fundo de garantia das execuções trabalhistas que pretende garantir os créditos sonegados aos empregados pela força de trabalho. Vale destacar que no direito alienígena a discussão sobre este
princípio é de suma importância para uma prestação jurisdicional, apesar de já estar bastante avançada tendo até alguns países, como a exemplo da Itália que já colacionaram ao seu ordenamento jurídico uma sanção pelo desrespeito a este princípio. Contudo, o enfoque referente às possíveis soluções fundamenta-se no Fundo de Garantia das Execuções Trabalhistas. Ao longo desta pesquisa, pretende-se explorar a forma qualitativa, visando produzir conhecimentos para aplicação prática dirigida à solução dos problemas. Espera-se com o aprofundamento deste trabalho, garantir e propor à
