O objetivo deste trabalho é fazer a análise do conceito de salvamento de embarcações no Transporte Marítimo, através de um contrato de salvamento Lloyd’s Open Form (LOF) com a cláusula SCOPIC (Special Conpensation P&I Clause) incorporada ao contrato. Uma vez que há um acidente que envolva um salvamento no mar, há todo um processo a ser seguido, o que envolve a retirada de declarações, a avaliação dos perigos, quer para nomear peritos, escolhendo testemunhas, cálculo dos valores do salvado, prêmio de salvamento, os valores do SCOPIC, desembolsos imediatos, a escolha do SCR (Shipowner Casualty Representative), nomeação dos advogados que representam os salvadores, seguradores de casco e máquinas, P&I e de carga, assim como, a utilização dos conceitos da Convenção Internacional de Salvamento no Mar (CISM 1989), em especial os Artigos 13 e 14. A opção metodológica adotada consistiu numa pesquisa qualitativa por instrumento de questionário eletrônico e levantamento exploratório. Como resultado da aplicação, foi possível verificar que os envolvidos em uma aventura marítima consideram o contrato de salvamento LOF, com a cláusula SCOPIC incorporada, importantíssimo para a atividade comercial de transporte marítimo. Dessa forma o trabalho contribui cientificamente para análises futuras dos valores envolvidos em um prêmio de salvamento, o problema da terceirização dos serviços de salvamento, o dilema do crescente gigantismo dos navios mercantes e suas cargas e uma possível avaliação equivocada das condições do navio na ocasião do salvamento. / This work highlights the main technical aspects related to the study and analysis of the LOF salvage contract with the SCOPIC clause. The objective of this work is to analyze the concept of salvage vessels in maritime transport through a salvage agreement Lloyd's Open Form (LOF) with SCOPIC clause (Special Conpensation P&I Clause) incorporated into the contract. Since there is an accident involving one salvage at sea, there is a whole process to be followed, which involves statements, the hazards assessment, in order to appoint the surveyors and experts, choosing witnesses, calculation of the saved values, salvage award, SCOPIC of values, out of pockets, the choice of SCR (Shipowner Casualty Representatives), appointment of lawyers representing the salvors, H&M insurers (Hull and machinery), P&I Clubs and cargo, as well as the use of the International Convention’s Salvage at Sea (CISM 1989), in highlight the Articles 13 and 14. The method adopted. The methodological option adopted consisted of a search for "survey" and exploratory survey. As a result of the application, it found that those involved in a maritime adventure consider the LOF salvage contract with SCOPIC clause incorporated important to the shipping industry. The aim of this Diploma thesis is calculating the parameters of the heat balance diagram as well as creating balance sheet for winter and summer operation. In one of the first parts, the reader is acquainted with two P&I diagrams containing main accessories, which are also used in the heat scheme, KKS marking system is used to name the acces-sories. The main part of the thesis consists of a detailed calculation of the heat transfer surface of the condenser with design of the tube bundle including the main dimensions of the condenser. Last but not least, the calculations of the hydraulic losses of condenser are included in the thesis.

Le transport maritime qui est une des modalités du commerce .international, a pu se développer grâce à l'assurance maritime. Compte tenu de la technicité et de son caractère international, les litiges en matière d'assurance maritime ont été souvent réglés par voie d'arbitrage. Le recours à l'arbitrage en assurance maritime peut être à l'occasion d'un litige entre assureur/assuré assureur subrogé/tiers responsable, assureur/réassureur etc. Cette étude porte sur ces différents litiges tel que soumis à l'arbitrage el leurs spécificités, il conviendra d'étudier ce sujet dans un cadre comparatif entre le droit français, marocain et anglais. Par ailleurs, l'approche du sujet par la méthode comparative nous permet1ra de découvrir les solutions concrètes finalement retenues dans les trois systèmes juridiques en question tout en rapprochant cela au débat doctrinal et jurisprudentiel relatif à cette question. / Maritime transport, which is an inherent part of international trade, has been able to develop due mainly to marine insurance. Marine insurance disputes, given their technical nature and their international character, have been often settled by arbitration. The use of arbitration in marine insurance may be in the course of litigation between insurer and insured, subrogated insurer and a responsible third party, insurer and reinsurer, etc. This study deals with aspects peculiar to maritime law and various disputes submitted to arbitration. This thesis delves into the comparison of French. Moroccan and English laws. Moreover, the comparative approach to the subject will allow us, while bringing it closer to the doctrinal and jurisprudential debate, to discover the concrete settlements reached in the three legal systems in question.

Analyse économique du système international CLC/FIPOL comme instrument de prévention des marées noires

L'objet de cette thèse est d'évaluer l'efficacité du régime international de responsabilité et d'indemnisation CLC/FIPOL en matière de prévention des marées noires. La méthodologie proposée s'inspire principalement de l'analyse économique des règles de responsabilité, tout en explorant à la fin l'analyse économique des accords environnementaux internationaux. L'exercice de recherche proposé combine à la fois analyse institutionnelle, travail empirique et modélisation théorique.<br />Les deux premiers chapitres établissent l'intérêt potentiel du régime international comme instrument de prévention des marées noires, l'un sur le plan théorique, l'autre sur le plan empirique. L'analyse de l'efficacité préventive du régime international consiste, d'une part, à apprécier la capacité du régime international à indemniser l'intégralité du coût social des marées noires (chapitre 3) et, d'autre part, à étudier les incitations fournies aux propriétaires de navires et aux compagnies pétrolières pour qu'ils adoptent des pratiques suffisamment sûres en matière gestion des risques pétroliers (chapitre 4 et 5). Le sixième chapitre ouvre le cadre d'analyse de l'efficacité préventive du régime CLC/FIPOL en étudiant les conséquences de l'élaboration collective du régime international sur sa fonction préventive.<br />Les résultats obtenus permettent d'identifier différents mécanismes par lesquels le pouvoir incitatif du régime international pourrait être accru. Cependant, les analyses conduites indiquent également que la fonction préventive du régime international est limitée par différents facteurs qui peuvent difficilement être corrigés au moyen d'une modification des conventions CLC et FIPOL.

十九世紀英國經濟活動、社會結構及工藝技術發生重大變革,船舶所有人從事海上運送活動所面臨之責任風險,種類繁多且金額甚鉅,非其能獨自承擔而有轉嫁風險之必要,船舶所有人防護及補償保險遂應運而生,迄今已有一百五十餘年之歷史。 船舶所有人防護及補償保險,乃由船舶所有人組成非營利性之防護及補償協會,以相互保險之方式承保船舶所有人之責任風險,其承保範圍廣泛,包括船員及旅客傷病死亡責任、人命救助之費用及報酬、貨物責任、船舶碰撞責任、污染責任、船舶拖帶責任、船骸移除責任、共同海損分攤額、檢疫費用、罰金、損害防阻及法律費用等等。 船舶所有人透過船舶所有人防護及補償保險之安排,轉嫁龐大之責任風險,使海上運送活動得以存續,船舶所有人防護及補償保險之貢獻重大,已成為海上保險不可或缺之一環,其重要性並不亞於船體保險及貨物保險。惟目前我國學界關於船舶所有人防護及補償保險之文獻極為有限,且多數文獻因論著年代較為久遠,部分內容已與現況有所差異。 鑒於船舶所有人防護及補償保險之重要性,本文乃以英國不列顛防護及補償協會之2007年協會規則為主要研究對象,並以相關國際公約、英國法及我國法為研究範圍,自法律層面分析探討船舶所有人防護及補償保險之意義、功能、歷史沿革、法律架構、契約之成立與效力及其承保範圍,建立船舶所有人防護及補償保險之概念與體系論述,以期能達成協助船舶所有人瞭解並維護其關於船舶所有人防護及補償保險之各項權益、引起國內學界對船舶所有人防護及補償保險之重視與研究興趣、俾利國內航運保險相關主管機關對航運業轉嫁責任風險之行政監理及對我國船舶所有人組成防護及補償協會可行性之評估等研究目的。
