Project documentation addresses the construction of the building Pension for seniors in Chomýž. The plot is close to the village center. It is a detached new build. The building is used for senior housing in a very quiet area. There is one part of a building apartments 1 bedroom and 2 bedroom apartments. In the second part of the building, which serves not only seniors, but also close to the public, is dining with dispensaries, further a patisserie, general practitioner, pedicure and hairdressing. The building and access roads designed for the disabled. The aim of the project documentation is to increase the comfort of the service in the village Chomýž.

Les champs du droit d'auteur et de la culture semblent a priori guidés par des logiques diamétralement opposées : logique personnaliste pour l'un, logique publique culturelle, pour l'autre. Notre étude se donne cependant pour objectif de dépasser ce postulat en démontrant la manière dont les logiques personnaliste et publique culturelle s'entrecroisent. L'immatériel constitue aujourd'hui un levier incontournable de l'action publique. Réciproquement, en droit d'auteur, le législateur instaure un véritable dialogue entre logique réservataire et intérêt général. Si la dimension sociale de la propriété littéraire et artistique est présente dès les origines du dispositif de protection, l'environnement numérique a néanmoins contribué à questionner de manière inédite la légitimité et les vertus du droit d'auteur. Sous l'effet de l'incursion réciproque d'une logique d'intérêt général en droit d'auteur et d'une logique personnaliste dans l'action publique culturelle, l'œuvre de l'esprit se trouve à la croisée des champs normatifs. Or, les impératifs publics qui s'expriment au sein de la sphère publique culturelle sont porteurs de changements pour le droit d'auteur. Plutôt que d'aborder la question de l'affirmation d'une logique publique culturelle en droit d'auteur sous le seul angle des tensions susceptibles de naître de la rencontre de ces champs normatifs, nos travaux s'attacheront à démontrer la construction d'une nouvelle figure du droit d'auteur. Au contact de ces impératifs publics, un espace singulier se construit au sein même du droit d'auteur tenant pour partie du droit privé, et pour partie du droit public. / The fields of copyright and culture seem to be guided by different logics. French copyright law is known to be author-oriented whereas the cultural field is guided by public interest. The aim of our study however is to prove this assumption wrong by demonstrating that both of these logics tend to intertwine. The intangible resources are nowadays a major lever of public action. Reciprocally, in the copyright law system, there is an important dialogue between public interest and author-centered philosophy. The common interest dimension goes way back to the very creation of copyright law. The digital environment contributes, nevertheless, to the raising of new questions about the virtues of copyright law. Those structural movements have a major impact on copyright law. Rather than address the matter of the assertion of a cultural public logic in copyright through the conflicts that can be raised by the meeting of these normative fields, we want to demonstrate the appearance of a new copyright figure. The encounter between the public imperatives and the copyright law creates a new space within the copyright system itself. This hybrid space is composed of both private and public law.

Coupled Pedagogy: A Study of Sustainability Education and Community-Based Learning in the Senior Capstone Program at Portland State University

Sustainability has emerged in mainstream higher education over the last few years, and the fields of community-based learning and sustainability education are closely linked through their emphases on active, experiential learning in place-based contexts. In order to create ecologically literate citizens to more adequately address environmental problems, there is a logical connection between teaching about sustainability and engaging students in the community, which can serve as a relevant forum to address sustainability issues. However, there is a problem in that educational programs and courses dealing directly with sustainability topics across the higher education landscape often do not emphasize or include experiential, community-based elements. Understanding this relationship is crucial to advance the field of sustainability with meaningful community engagement. This research investigated the pedagogical strategies and frameworks that are foundational in undergraduate capstone courses that include sustainability education and community-based learning. A sample of five community-based, interdisciplinary senior capstone courses at Portland State University was examined through semi-structured interviews with course instructors and syllabi review. Three broad themes emerged as common values among the instructors: connectedness and relationships, community and place, and diversity and inclusiveness. Reflection was a tool utilized universally by instructors to personalize the learning process, cultivate understanding of connectedness and relationships, and incorporate feelings into the learning process. Competencies and skills related to sustainability and those related to civic engagement were very similar; engagement in community is a sustainable practice. This study provides cogent support for the notion that achieving meaningful, transformative sustainability learning requires community-based learning.

Územně promítnutelné indikátory udržitelného rozvoje / Indicators of Spatial Sustainable Development

The aim of the thesis was to analyse indicators and data sets used in the field of sustainable spatial plannig. On the base of the analyses there were spatial indicators of the sustainable development designed. The basic condition to design new indicators it was the accessibility to the elementary datas. The other condition was to design very simply methodology that could be use also for measuring in very small location. The thesis designed idnicators in three main areas of the spatial planning: • landuse, • accessibility of the services, • inner city/town/village traffic. One of the demands for the new indicators set was it´s efficiency for all kinds of the cities in the Czech Republic. This demand was fullfilled by the 3 level methodolgy – the main indicator was measurable for all kinds of settlemets – small villages, small and middle towns and also for cities. The basic methodology (for small villages) was very simple. Indicators were computed from very easy accesible data sets. And this methodology could also be used for larger settlements without any problems. The second level – for small and middle towns – sometimes needs special surveys or special hardware and software. The top of the pyramid is the methodology for cities. In this level there are used detailed analyses and computing methods. The thesis designes the methodology and also checks the practical application up.

The author focuses on the fact that at the present stage the information support of the population is becoming one of the most important tasks of state authorities and social protection, in particular. The main priority of the social protection authorities in this area is that citizens receive the necessary information as quickly as possible, regardless of their location and reduction in the number of citizens who need social support, but do not receive it due to the lack of information about their rights. The paper reveals the theoretical, regulatory, and practical foundations for organizing public information on social support measures, and gives recommendations for its improvement. / Автор акцентирует внимание на том, что на современном этапе информационное обеспечение населения становится одной из важнейших задач органов государственной власти и социальной защиты, в частности. Основным приоритетом органов социальной защиты в данной области является как можно более быстрое получение гражданами необходимой информации, независимо от места их нахождения и снижение количества граждан, которые нуждаются в оказании социальной поддержки, но не получают ее из-за отсутствия информации о своих правах. В работе раскрываются теоретические, нормативно-правовые и практические основы деятельности по организации информирования населения о мерах социальной поддержки, даются рекомендации по ее совершенствованию.

Цель исследования – разработка эффективной модели управления качеством государственных услуг в сфере социальной политики. В ходе исследования были рассмотрены сущность и значение системы управления качеством государственных услуг в сфере социальной политики, понятие и сущность государственной услуги, выделены отличия государственной услуги от социальной услуги, рассмотрены вопросы правового регулирования процесса предоставления государственных услуг в сфере социальной политики, рассмотрено понятие и сущность оценки качества предоставления государственных услуг в сфере социальной политики, исследовано отношение потребителей государственных услуг к качеству их предоставления. Магистерская диссертация также содержит проект по повышению качества государственных услуг управления социальной политики и практические рекомендации по совершенствованию системы управления качеством государственных услуг управления социальной политики. / The thesis is devoted to the quality management in the field of public services in the social sector. In the course of the study the author reflected on the notion and meaning of the quality management system in the public sector, specified the notion and essence of public services, distinguished public services from social services, elaborated on the legal framework of the quality management in this area. Also the work contains the notion of features of the quality assessment system an research of the customers’ attitude to public services in the social sphere. The thesis includes the project aimed at improvement of the public services’ quality in the social sector and recommendations for the perfection of the quality management of public services.

The history and the development of Kimberly Africana Library and its relationship with the Kimberly Public Library

The study investigates the establishment and development of the Kimberley Africana Library and its mother institution, the Kimberley Public Library within the broader social, economical and political environment in which they took place. The history of these institutions is inextricable until 1984 when the public and Africana sections of the Library were separated and the Kimberley Africana Library was opened to the public in 1986. It was the exceptional collections of Africana and rare books which distinguished the Kimberley Public Library and the main factor which bound the history of these two institutions. The Kimberley Public Library and its progeny the Kimberley Africana Library are the products of a new industrialised era which came about after the discovery of diamonds in South Africa. They emanated from an environment which produced the new wealth of the country, an almost uncharted region which was relatively new to the established British colonies. In order to place the origins of and motivation for the establishment of the Kimberley Public Library and the Kimberley Africana Library in perspective, it is necessary in this study also to include an overview of the development of the diamond mining industry in Kimberley. This development, peculiar as it was to Kimberley, gave rise to the type of social and cultural milieu in which the Public Library was founded by the immigrants to this area. Also included in the study is a brief survey of the development of the library movement in South Africa and the role played by the Kimberley Public Library in the growth of this movement and in the expansion of public library services to the people of the country. The history of the Kimberley Public/Africana Library which covers a period of more than a century is divided into three distinct periods, namely that which deals with the institution as a Subscription Library from 1882 until 1960 and, from 1961 as a free library under the jurisdiction of the Kimberley Municipality and affiliated to the Cape Provincial Library Service. The third period concerns the dichotomisation of the Kimberley Public Library and the establishment of the Kimberley Africana Library in 1986 to house the Library’s renowned collection of Africana and rare books. This section also deals with the period after 1994 when the Kimberley Libraries functioned under the new political dispensation in South Africa. Emphasis is laid on the formation, nature and scope of the Africana Collection which was the raison d’etre for the establishment of the Kimberley Africana Library and the most significant of the items in the collection are broadly described. The study concludes with an assessment of the challenges the Kimberley Africana Library faces and suggests ways and means of resolving these. An Appendix entitled The Founders and the Builders is added in order to elaborate on the exceptional contributions of several prominent Committee members and Librarians who controlled and managed these institutions from their inception in 1882 until 2008. / Information Science / M. Depuis le début des années 2000, la Commission européenne suivie par la Cour de Justice de l'Union européenne (CJUE), ont déterminé les exigences du droit de l'Union dans de nombreux domaines concernant l'organisation et le fonctionnement de l'action administrative en matière de services publics. L'interprétation des règles dictées par le Traité sur le fonctionnement de l'Union européenne, fixe les modalités de la gestion publique, qu'il s'agisse de la création des services d'utilité publique ; de leurs formes de gestion quelles soient structurelles ou conventionnelles ; des droits particuliers accompagnant leur bon fonctionnement ; ou encore de l'encadrement des aides publiques nécessaires à leur financement. Ces progressions qui devraient être normalisées par l'adoption d'une future directive, ont largement influencé la manière de concevoir, en France, la gestion des services publics autant que la participation publique dans l'économie. La recherche de l'optimisation du fonctionnement des services et de l'efficacité économique de l'opération, motive désormais le recours au procédé de la gestion déléguée. Source d'inspiration, le droit de l'Union et particulièrement le travail de la CJUE, contribuent à la réflexion sur l'enrichissement des mécanismes de gestion des services publics, qui disposent en outre, d'un cadre privilégié à l'échelon local. Pour autant, cette influence est réciproque. Renouvelée au travers du concept de « partenariat public- privé », la concession est envisagée comme un outil clef pour la relance économique de l'Europe, et demeure une référence en matière de montages contractuels complexes. / Since the beginning of 2000, The European Commission and the European Court of Justice of the European Union (CJEU), have determined the requirements of European Union Law in various areas relating to the organization and the functioning of the administrative action on public services matters. The interpretation of rules dictated by the Treaty on the functioning of the European Union is setting out the terms of the public management whether the creation of public utility, their forms of management , structural or contractual, special rights accompanying their proper functioning, or even the framework of public aid to finance it. These progressions which should be normalized by the adoption of a future directive have greatly influenced the way to perceive in France, the management of public services as much as the participation in the economy. The search for optimizing the functioning of the services and the economic efficiency of the operation is urging from now on to use the delegated management process. The European Union Law, source of inspiration, and more particularly the work of the CJEU, are contributing to a reflection on the enrichment of the mechanisms of the management of public services, which have furthermore a privileged frame locally. However, this influence is reciprocal. Renewed through the concept of “public-private partnership”, the concession is envisaged as a key tool for the recovery of the European Economy, and remains a reference on complex contractual arrangements.

Participatory Governance, accountability, and responsiveness

Die Dissertation untersucht ob partizipative Governance ein effektives Mittel ist um lokale Regierungen in Guatemala dazu zu bewegen ihren Wählern gegenüber verstärkt Rechenschaft abzulegen und den Haushalt mehr an den Bedürfnissen der Armen auszu-richten. Das erste Papier bereitet die wissenschaftlichen Erkenntnisse zur Wirkung von und den Bedingungen für effektive partizipative Governance auf. Das zweite Papier stellt ein neues Verfahren zur Kalibrierung qualitativer Interviewdaten für fuzzy-set Qualitative Comparative Analysis (fsQCA) vor. In einer qualitativ-vergleichenden Ana-lyse von zehn ländlichen Gemeinden untersucht das dritte Papier wie sich effektive par-tizipative Governance, politischer Wettbewerb und Zugang zu lokalen Medien auf die Haushaltsgestaltung einer Lokalregierung auswirken. Das vierte Papier analysiert mit derselben Methode die Bedingungen für effektive partizipative Governance. Das fünfte Papier präsentiert eine Fallstudie zweier Gemeinden und diskutiert Politikoptionen für die Implementierung von partizipativer Governance in Guatemala. Die Ergebnisse der Papiere zeigen, dass effektive partizipative Governance in Kombination mit starkem politischem Wettbewerb zu einer armutsorientierteren Ausrichtung öffentlicher Ausga-ben in den zehn Gemeinden führt, da Wähler besser informiert sind. Jedoch deuten die Ergebnisse auch darauf hin, dass partizipative Governance wegen des geringen Grades zivilgesellschaftlicher Organisation, des niedrigen Bildungsniveaus und hoher Armut in Guatemala nicht effektiv implementiert wird. Partizipative Governance kann also lokale Regierungen dazu bewegen Rechenschaft abzulegen und den Haushalt armutsorientier-ter zu gestalten. Ihre effektive Implementierung wird jedoch in Guatemala lange dauern und einen hohen Ressourceneinsatz erfordern. Daher sollten politische Entscheidungs-träger und Geber auch die Stärkung anderer Informations- und Rechenschaftslegungs-mechanismen, wie der Gemeinderäte, in Betracht ziehen. / This thesis analyses whether participatory governance is an effective means for increas-ing local government accountability and for making local government spending more responsive to the needs of the poor in rural Guatemala. The first paper evaluates the scientific evidence on the impact of and the conditions for effective participatory gov-ernance. The second paper presents a new technique for calibrating qualitative interview data for fuzzy-set Qualitative Comparative Analysis (fsQCA). In a qualitative compara-tive analysis of ten rural Guatemalan municipalities the third paper examines how effec-tive participatory governance, competitive elections, and access to local media influence the allocation of local government spending. The fourth paper analyses the conditions for effective participatory governance with the same empirical method. The fifth paper presents a comparative case study of two municipalities and discusses policy options for implementing participatory governance in Guatemala. Overall, the papers’ findings show that effective participatory governance is sufficient for local government responsiveness in the study area when it is combined with competitive elections, because it increases voter information about local government performance. Yet, the findings also suggest that it will be difficult to implement participatory governance effectively in Guatemala due to the low degree of civil society organization, the low level of education of the population and the high level of poverty. The conclusion drawn from these findings is that effective participatory governance arrangements can make local governments more accountable and responsive, but that it will require much time and resources to implement them. Policy makers and donors should therefore also consider strengthening other information mechanisms, as well as existing accountability mechanisms, such as elected Municipal Councils.
