De la relation entre service public et fonction publique. Etude comparée des droits français et chinois / The relationship between public services and civil service. Comparative study of french and chinese laws

En France, depuis les années 1990, la polarité traditionnelle service public / fonction publique est mise en cause par des mesures de privatisation et d'externalisation des services publics d'une part, et par la contractualisation et la « managérialisation » de la fonction publique d'autre part. Ces tendances s'observent également en Chine dans la construction d'un système de services publics à partir des années 1990, et dans l'instauration d'une fonction publique décidée à la fin des années 1980 et entérinée par la loi du 27 avril 2005 « sur les agents publics ». Malgré les divergencespolitiques et culturelles entre les deux pays, on constate non seulement un même mouvement de recul de l'administration publique dans la gestion des services publics, mais aussi l'influence croissante du droit privé sur le droit de la fonction publique. Le droit public, en tant qu'il régit traditionnellement le service public et la fonction publique, est dès lors mis en question tant au niveau de son périmètre qu'au niveau de sa substance. À mesure que la relation entre service publicet fonction publique se distend, la corrélation entre les finalités de l'État et les structures administratives devient moins évidente. Dans ce contexte, la comparaison des droits français et chinois éclaire les transformations en cours du droit public. / In France, since the 1990s, the traditional polarity public service / civil service is questioned by privatization and public services outsourcing on the one hand, and by contracting and "managerialization" of civil service on the other hand. These trends are also observed in China in the construction of a public services system from 1990s, and in the establishment of a civil service decided in the late 1980s and endorsed by the Law of 27 April 2005 on Public Servants. In spite of the political and cultural differences between the two countries, there is a converging movement : the public administration steps back from the public services management, while the private law grows its influence on the civil service law. Public law, as it traditionally governs the public service and the civil service, is therefore challenged both in its scope and in its substance. As the relationship between public services and civil service distends, the correlation between the purposes of state and the administrative structures is less obvious. In this context, the comparison of French and Chinese laws illuminates the ongoing transformations of public law.

This thesis solves the design of multifunctional building. The building is situated on the outskirts of Mikulov in the cadastral area Mikulov in Moravia. Plot number is the 5087th. Multifunctional house will be used for housing of 26 people and providing commercial services. There are considered groceries and hairdressing salon. The building is designed without a basement, four-storey, with a gabled roof. It is based on the footings of plain concrete. The structural system consists of wall formwork system from VELOX.

An exploration of the success and failures of developmental local government on service delivery: a case of Tshwane Metropolitan Municipality

Developmental local government is regarded as a remedy for the deep-rooted structural socio-economic challenges in South Africa. Many of these challenges are a legacy of apartheid and colonialism, so the ascent to power of a democratic government after the 1994 democratic elections was seen as a watershed for the development of policies and programmes to ameliorate poverty, unemployment and gross inequality. The Constitution of the Republic of South Africa Act, 108 of 1996, positions South Africa as a developmental state (defining developmentalism as a capable state with strong economic growth and professionalized public institutions). The White Paper on Local Government, 1998, was also introduced to mitigate poverty and unemployment. The adoption of a democratic developmental state model that empowers local government, as the coalface of service delivery, was seen as the solution. The developmental trajectory posited by the national government was thus predicated on the efficacy of municipalities. This study therefore explores the success and failure of developmentalism in South Africa, using the Tshwane Metropolitan Municipality as a case study. Analysis and comparison regarding the best model for South Africa was done on the basis of a literature review of international and local studies and official documents and legislation. The review shows that the now defunct developmentalist Reconstruction and Development Programme (RDP) was adopted in 1994 to address the socio-economic ills associated with colonialism and apartheid, but it was replaced by the neoliberal Growth Employment and Redistribution policy. Most developing countries use East Asia as a template to replicate developmental models. Developmentalism thrived in Asia because these countries are not democratic. However, South Africa is a constitutional democracy, which means that the public and public participation must be taken into consideration in policy-making and decision-making, especially for local government to address local socio-economic problems, particularly those affecting the poor. This was not found to be the case in the Tshwane Metropolitan Municipality, where developmentalism is overshadowed by endemic problems around leadership, patronage and a lack of consultation with the people, leaving their needs largely unmet. Neo-liberal policies, clearly not aligned with developmentalism, have been espoused, so a developmental local government model has not been implemented systematically in the Metro. Recommendations to prioritize truly developmental local economic growth and socio-economic development include extensive training and higher appointment criteria. / Development Studies / M.A. (Development Studies)

The subject of this diploma thesis is elaborating specific parts of detailed deisgn for building kindergarten in Hustopeče according to Annex No. 13 to Decree No. 499/2006 Coll. The thesis deals with a object of public services - a kindergarten. This kindergarten will consist of a total of 4 classrooms, each of which has its own sanitary and storage facilities. The building also includes its own kitchen with a dining room, which will be used for the preparation of meals on the premises. The building is designed for a total of 80 children, 8 teachers and 3 chefs. The whole design concept takes into consideration, among other things, the economy, whether in its layout, material solution or technical equipment of the building. The layout is based primarily on the size, orientation, and slope of the building plot. The land has a significant longitudinal as well as transverse slope and the distribution of the building's masses corresponds to this. The plot is a relatively narrow rectangle, and its much longer side is parallel to the street line.

Title: Sport as a Public Service: Equity and Efficiency of Local Sport Facilities In the Czech Republic, clubs traditionally played a key role in providing sport facilities. In recent years, the role of local authorities in sport has strengthened. Hence, there have been changes in the management of sport facilities in the context of new trends in public administration and sport participation. The thesis analyzes and evaluates current modes of provision of public sport facilities as the consequence of these changes. The examined issue is narrowed down to the two theoretical concepts - sport equity and efficiency of sport facilities. These are perceived as a part of the performance of sport facilities (see Liu et al., 2009 or Kung and Taylor, 2010). The first part of the thesis aims to test the effect of different forms of management of sports facilities on the sport equity score in the framework of institutional analysis (Houlihan, 2005). On the basis of the original instrument for measuring of sport equity, the survey is carried out. The research sample (N = 193) is made up by the municipalities with extended powers, except for regional cities and Prague. The second part of the thesis has the character of an action research. Community service nurses' experiences regarding health care services at Tshwane district public hospital

This qualitative study followed an Interpretative Phenomenological Analysis (IPA) approach to explore the community services nurses’ experiences of health care services at Tshwane district public hospital. Data were collected from 11 purposively selected community service nurses using a semi-structured interview format. Data was analysed using Interpretative Phenomenological Analysis framework for data analysis. Four super-ordinates emerged from data analysis: (1) Resources, (2) Work environmental relations, (3) Supervision and support and, (4) Impact of community service experiences. The study revealed that the health care services rendered at the hospital studied are substandard. Community service nurses reported several challenges experienced during their placement in the hospital under study. Lack of human and material resources, supervision and support contributed to hindrance of smooth acquisition of their clinical skills and experience. These challenges resulted in the psychological and emotional drain of the participants. Uncovering the well-springs of migrant womens' agency: connecting with Australian public infrastructure

The study sought to uncover the constitution of migrant women's agency as they rebuild their lives in Australia, and to explore how contact with any publicly funded services might influence the capacity to be self determining subjects. The thesis used a framework of lifeworld theories (Bourdieu, Schutz, Giddens), materialist, trans-national feminist and post colonial writings, and a methodological approach based on critical hermeneutics (Ricoeur), feminist standpoint and decolonising theories. Thirty in depth interviews were carried out with 6 women migrating from each of 5 regions: Vietnam, Lebanon, the Horn of Africa, the former Soviet Union and the Philippines. Australian based immigration literature constituted the third corner of triangulation. The interviews were carried out through an exploration of themes format, eliciting data about the different ontological and epistemological assumptions of the cultures of origin. The findings revealed not only the women's remarkable tenacity and resilience as creative agents, but also the indispensability of Australia's publicly funded infrastructure or welfare state. The women were mostly privileged in terms of class, education and affirming relationships with males. Nevertheless, their self determination depended on contact with universal public policies, programs and with local community services. The welfare state seems to be modernity's means for re-establishing human connectedness that is the crux of the human condition. Connecting with fellow Australians in friendships and neighbourliness was also important in resettlement. Conclusions include a policy discussion in agreement with Australian and international scholars proposing that there is no alternative but for governments to invest in a welfare state for the civil societies and knowledge based economies of the 21st Century.
