Previous issue date: 2015-03-20 / This study aims to identify how the regulatory state intervention in public services can serve as an instrument for the realization of human rights and therefore of human dignity, considering the constitutional system of the protection of human rights in Brazil. Thus, in this research, by means of specific literature analyzes, it is possible to identify the regulation of economic activity as one of the most important tools to achieve economic efficiency and to improve the conditions for development. In this context, the substantial approach of public interest‟s legal theory of regulation focuses on the rights and values that should be sought and protected by regulation. These rights and values are already protected by economic order and by the Federal Constitution and international treaties, especially the right of isonomic access to quality public services that dignify the human being. According to this theory, the social function of public services requires that private providers of those suit their economic interest to the collective interest, being the end of regulation the promotion of means for a human dignified existence, according to the dictates of social justice, which means the inclusion of all. Therefore, this will take to human development, from the perspective of humanistic capitalism to govern economic activity and we also point to the precepts of governance and the right to good administration, inherent in the so-called "regulatory state" / Considerando o sistema constitucional de proteção dos direitos humanos no Brasil, o presente trabalho tem como proposta demonstrar como a intervenção regulatória do Estado nos serviços públicos pode servir de instrumento para a concretização dos direitos humanos e consequentemente da dignidade humana. Assim, nesta pesquisa, por meio de análises de bibliografia específica, é possível identificar a regulação da atividade econômica como um dos mais importantes instrumentos para a obtenção da eficiência econômica e para a melhoria das condições de desenvolvimento. Nesse contexto, a abordagem substancial da teoria jurídica do interesse público da regulação foca nos direitos e valores que devem ser buscados e protegidos pela regulação. Esses direitos e valores estão já protegidos pela ordem econômica e também pelas demais normas constitucionais e tratados internacionais, destacando-se o direito de acesso isonômico a serviços públicos de qualidade, que dignificam o ser humano. Assim, segundo tal teoria, a função social dos serviços públicos deve imporaos agentes privados, prestadores de tais serviços que adequem o seu interesse econômico ao interesse coletivo, sendo o fim da regulação a promoçãodos meios para uma existência humana digna, conforme os ditames da justiça social, ou seja, com a inclusão de todos. Isso levará, por conseguinte, ao desenvolvimento humano, segundo a ótica do capitalismo humanistaa reger a atividade econômica, com destaque ainda aos preceitos da governança e do direito à boa administração pública, inerentes ao chamado Estado regulatório

Il lavoro indaga lo sviluppo del principio di autonomia nella teoria e nelle prassi del regionalismo italiano, con lo scopo di dimostrare come oggi risulta piuttosto difficile individuare un modello preciso per l’Italia. Il regionalismo, infatti, è sempre stato considerato come fattore strumentale a perseguire obiettivi estranei all’autonomia, senza però trovare un adeguato riscontro nel concreto assetto dei rapporti tra centro e periferia.
Come lo studio ha cercato di dimostrare, le motivazioni di tale difficoltà, di natura storica e, soprattutto, politica, si possono rintracciare ripercorrendo le tappe del movimento regionalista: dal periodo risorgimentale di formazione dello Stato italiano alla Costituente; dalla lunga fase di inattuazione delle Regioni alle riforme costituzionali del 1999 e del 2001.
Dal quadro attuale emerge un diritto regionale “confuso”, immagine sbiadita (e stravolta) del disegno realizzato a grandi linee – e frettolosamente – con la modifica del Titolo V della Costituzione.
La realtà dimostra che, per valorizzare il principio di autonomia regionale, occorrerebbe un cambiamento culturale nella classe dirigente italiana. Se ciò non dovesse accadere, il regionalismo (o, come confusamente viene oggi chiamato, il federalismo) rimarrebbe ancora a lungo privo di un modello. / The study investigates the development of the autonomy principle in the theory and praxis of the Italian regionalism. It aims at demonstrating the difficulty in finding an adequate model to Italy nowadays. In fact, regionalism has always been considered as an instrument to reach goals that are extrinsic to autonomy. Nevertheless, it is not to be found in the concrete structure of the relationship between State and regions.
As the study intend to focus on, the historical and mainly political reasons can be found by following the different steps of the regionalist movement: from the Risorgimento, when the Italian state was born, to the Costituente; from the long period of failure in the realization of the regions to the constitutional reforms in 1999 and 2001.
The current situation shows a “confused” regional law, a faded and upset image of the project hastily outlined by modifying the Titolo V of the Constitution.
It is a matter of fact that a cultural change in the Italian ruling-class should be necessary in order to evaluate the principle of regional autonomy. Otherwise, regionalism (or federalism, as it is confusedly called today) would remain without a model for a long time.

La décentralisation est l'innovation institutionnelle majeure que connaissent les pays africains depuis les années 1990. Si elle est irréversible, il n'en demeure pas moins que la capacité des collectivités territoriales à fournir des services publics locaux aux populations locales et à impulser le développement économique et social est contrainte par l'étroitesse des moyens juridique, financier, humain et matériel. Cette thèse de droit public porte sur le financement des collectivités territoriales en Côte d'Ivoire. L'objectif général de cette étude est de démontrer d'une part, les différentes politiques publiques locales financées par les institutions locales, et d'autre part, les moyens mis en œuvre pour les financer. Au bout d'une enquête qui aura utilisé plusieurs types de données (documents, entretiens, observations directes, etc.) il apparaît que les atouts de financement des collectivités territoriales en Côte d'Ivoire sont avérés, et peuvent faire état d'une réussite en matière de réalisation d'investissement local. Toutefois, les outils et dispositifs législatifs existants consacrés au développement local durable soulèvent des difficultés qui incitent à s'interroger sur l'efficacité même du système de financement de ces entités décentralisées. C'est dire que des dysfonctionnements existent à ce sujet, et entravent les initiatives des élus locaux. En s'appuyant sur une série d'études de cas africains et sur un grand nombre d'exemples dans d'autres parties du monde, cette thèse propose des pistes concrètes pour moderniser le système de financement des collectivités territoriales ivoiriennes. L'évolution du développement économique et social à l'échelle de la Côte d'Ivoire dépend largement de cette réforme juridique, institutionnelle et sociologique. / Decentralization is the major institutional innovation that African countries since the 1990s. If it is irreversible, the fact remains that the ability of local authorities to provide local public services to local people and to boost development economic and social development is constrained by the narrow legal means, financial, human and material. This thesis public law concerns the financing of local authorities in Côte d'Ivoire. The overall objective of this study is to demonstrate one band, the different local public policies financed by local institutions, and secondly, the means used to finance them. After an investigation that has used many types of data (documents, interviews, direct observations, etc.) it appears that the local authorities financing assets in Côte d'Ivoire have proven and can point to a success material for making local investment. However, the existing legislative tools and devices on sustainable local development raise difficulties raise questions about the very effectiveness of the financial system in these decentralized entities. This means that malfunctions exist on this subject and impede the initiatives of local elected officials. Based on a series of African case studies and numerous examples in other parts of the world, this thesis proposes concrete ways to modernize the Ivorian local government finance system. The evolution of the economic and social development across Côte d'Ivoire depends largely 011 this legal reform, institutional and sociological.

In addition, the author offers a new perspective about the authorities that are able to perform the process mentioned before, to finally show us the probability to reform the used methodology of the expiration dates of concessions based on certain principles,and bestow a modification proposal. / El presente artículo trata sobre una revisión crítica del régimen de renovación de concesiones en materia de servicios públicos de Telecomunicaciones en la normativa peruana. Para ello, el autor se centrará en analizar las formas de renovación existente en la legislación peruana, así como los principios que rigen el proceso de renovación de las concesiones en Telecomunicaciones. Además, el autor nos brinda una visión sobre las autoridades competentes para realizar el mencionado proceso, para, finalmente, mostrarnos una probabilidad de reforma en la metodología de renovación de plazos de concesión basada en determinados principios, así como una otorgarnos una propuesta de modificación.

Previous issue date: 2007 / The objective of this study is to diagnose the regulation of public services in Ceará. The thesis started with a historic presentation of the origin and evolution of regulatory agencies in the United States, It compared North American and European regulatory patterns represented by the French and the British experiences and discussed the concept of regulation in public services, detailed pretexts, objectives and fundamental aspects that should characterize regulatory agencies. By examining how regulatory agencies emerged in Brazil at the federal as well as at the state level in the context of state reform during the Fernando Henrique Cardoso administration, it described the principal characteristic of Brazilian federal regulatory agencies furthermore it exposed the scenario and the conditions of ARCE´s creation. From this point on, the thesis described the agency´s actions by analyzing its institutional profile, standardization methods, supervision, conflict intermediation and process analysis. It also tackled the role of the agency in formulating public policies and its patterns of negotiations of services rates with civil society through its institutional social control mechanisms. Throughout the thesis, ARCE´s regulation difficulties were discussed having as a reference international standards while in the conclusion were presented numerous suggestions and propositions to improve regulation of public services in the state of Ceará. / O presente estudo tem por objetivo um diagnóstico acerca da regulação de serviços públicos no Estado do Ceará. Como instrumental de pesquisa, parte de uma revisão histórica abordando a origem e a evolução das agências reguladoras nos Estados Unidos, comparando os padrões norte-americano e europeu de regulação, representado pelas experiências britânica e francesa. Discutindo o conceito da regulação de serviços públicos, detalha os pressupostos, objetivos e aspectos fundamentais que devem caracterizar as agências reguladoras. Examina como surgiram as agências reguladoras no Brasil, tanto no nível federal, quanto no nível estadual, em um contexto de reforma do Estado empreendido no Governo Fernando Henrique Cardoso, descrevendo as principais características das agências reguladoras federais brasileiras, bem como detalha o cenário e as condições em que foi criada a ARCE – Agência Reguladora de Serviços Públicos Delegados do Estado do Ceará. A partir daí, a pesquisa discorre sobre a atuação da ARCE, analisando o seu perfil institucional, bem como as competências de normatização, fiscalização, mediação de conflitos, e análises tarifárias realizadas pela Agência. Aborda ainda aspectos relacionados com o papel da Agência na formulação de políticas públicas, e o controle social da instituição e dos serviços regulados por meio da interlocução com a sociedade. Ao longo do texto discute as principais dificuldades encontradas pela ARCE, à luz dos conceitos de regulação e da experiência internacional, concluindo com análises e proposições objetivando a consolidação da regulação de serviços públicos no Estado do Ceará.

The main goal of this theses is to evaluate the public transportation service in České Budějovice. The theoretical part of this thesis offers the reader, basic information about services, their characteristics, features, but also information about pricing and types of services. Reader will be also acquainted with information about transportation services. Analytical part of the thesis describes actual status of public transportation in České Budějovice. The various routes, means of transport and conditions for transportation are described in detail. The financial development of public transport provider, Dopravní podnik města České Budějovice, is also evaluated. In order to achieve the main goal of thesis, the questionnaire with the focus on customer needs, was created. Thanks to the responses of the passengers, it was possible to determine which are the most important positives and negatives of public transportation in České Budějovice. Subsequently, the SWOT analysis was made. The SWOT analysis determined, what strategy the company should select in the future. Based on the results from performed analysis, it was then possible to suggest some proposals, that would in the future lead to improvement of public transportation service of České Budějovice.

Previous issue date: 2010-11-12 / Value creation for society and gains in efficiency, efficacy and effectiveness has been reason of concerning in public sector. Based on a broad literature about service operations management, service value and public service value, this thesis has taken for granted that to know the value which a service must deliver to its main stakeholders is prior to organize it. According to literature, value might be created since designing public institutions until managing them. To integrate the different perspectives, it was used an approach that evaluates service value creation from the consequences on to its customers and the necessary resources to deliver them. These consequences were analyzed under four dimensions: utility, justice, solidarity, and aesthetic. Recourses analyzed were competences and technology. Thus, this thesis s purpose was to define the value of Forensic Science Service (FSS) to its main stakeholders. The specific objectives, which generated propositions, were: to find out the role played by FSS in its interorganizational network, to find out the main FSS characteristics, to identify critical factors for value delivery, and to propose some guides to design FSS. To achieve these objectives, a five-year qualitative, longitudinal and exploratory case study was carried out in a FSS federation unity. Subsidiary information was collected in six other FSS. Data also were collected from FSS stakeholders, using multiple methods. Results were analyzed and criticized based on theory. The findings showed that FSS takes part in a Public Safety and Criminal Justice interorganizational network and provide it with a service: the production of forensic evidence. FSS operations present exams variety, process variability, layout by fixed position in front office, and stakeholders diversity. FSS association with science highlights its intangibility. FSS utility dimension is to link the suspect to crime scene (or innocent someone wrongly accused) using science and technology, that is, it helps to build a narrative, in which defendants behaviors are trialed according to the law. There are obstacles on delivering this value dimension, like miscoordination among network members on crime scene preservation, for instance. The justice dimension assumes that every citizen must have access to FSS, independent of any pre-existing condition. Although, FSS hasn t been universalized yet. The solidarity dimension has a deeply conexion with Human Rights, both in avoiding constraining suspects during criminal investigations, and contributing to fair trials, in the sense that either prosecution or defense have access to the service in equal terms. However, FSS subordination to the Police jeopardizes its impartiality. The aesthetic dimension consists on helping Police solve crimes without constraining suspects. Besides the technical competence, FSS personnel need a communicational competence to a full client s knowledge. The technological resources are part of production process and critical for value delivery. Concluding, FSS should be redesigned as an independent agency in order to increase Criminal Justice impartiality. Finally, the study encourages reflections about the difficulties of applying service operations management concepts to a public organization that is changing, and it´s characterized by the diversity of stakeholders and by its fluid and poorly defined, although important value. / A criação de valor para a sociedade e ganhos em eficiência, eficácia e efetividade são motivos de preocupação no setor público. Baseada em uma ampla literatura sobre gestão de operações de serviços e valor de serviço, incluindo serviços públicos, esta tese partiu do pressuposto de que saber o valor de um serviço para os seus principais stakeholders é prioritário para organizá-lo. Segundo a literatura, valor pode ser criado desde o desenho até a gestão de instituições. Para integrar as perspectivas, abordou-se a criação de valor a partir das consequências para os destinatários do serviço e dos recursos necessários para produzi-las. Estas consequências são analisadas sob quatro dimensões: utilidade, justiça, solidariedade e estética. E os recursos analisados foram competências e tecnologias. Assim, o propósito dessa tese foi definir o valor do serviço de perícia criminal para os seus principais stakeholders. Os objetivos específicos, que geraram proposições, foram: investigar o papel desempenhado pelo serviço em sua rede interorganizacional; abordar suas principais características; identificar fatores críticos para a entrega de valor e propor algumas diretrizes a fim de projetar o serviço. Com o propósito de atingir esses objetivos, um estudo de caso qualitativo, exploratório e longitudinal de cinco anos foi realizado em um órgão pericial. Subsidiariamente, coletaram-se informações em seis outros órgãos periciais. Foram coletados, também, dados de stakeholders do serviço, utilizando-se múltiplos métodos. Os resultados foram analisados e discutidos com base na teoria. Esses resultados mostraram que a perícia criminal integra uma rede interorganizacional de segurança pública e justiça criminal e produz um serviço: a prova pericial. O serviço apresenta variedade de exames, variabilidade de processos, arranjo posicional na linha de frente e diversidade de stakeholders. A associação entre o serviço e a ciência realça sua intangibilidade. A dimensão de utilidade do serviço é vincular o suspeito ao local do crime (ou inocentar alguém erroneamente acusado), utilizando a ciência e a tecnologia, ou seja, auxiliar a construção de uma narrativa, para que as condutas dos réus sejam julgadas de acordo com a lei. Há obstáculos na entrega desta dimensão, como, por exemplo, as dificuldades de coordenação entre os atores da rede na preservação do local de crime. A dimensão de justiça presume que todo cidadão tenha acesso ao serviço, independente de qualquer condição pré-existente. Entretanto, este acesso ainda não foi universalizado. A dimensão de solidariedade tem relação profunda com os Direitos Humanos, tanto para evitar que suspeitos sofram constrangimentos durante investigações criminais, quanto contribuindo para julgamentos justos, de forma que acusação e defesa tenham igual acesso ao serviço. Porém, a subordinação do serviço a Polícia compromete sua imparcialidade. A dimensão estética consiste em auxiliar a Polícia a desvendar crimes sem constranger suspeitos. Além da competência técnica, os peritos precisam ter competências comunicativas, para conhecerem os clientes. Os recursos tecnológicos são parte do processo de produção do serviço e críticos para a entrega de valor. Concluindo, o serviço de perícia criminal deveria ser redesenhado institucionalmente como um órgão independente, para incrementar a imparcialidade da Justiça. Finalmente, o estudo encoraja reflexões sobre as dificuldades em aplicar os conceitos de gestão de operações a um serviço público em mudança, que é caracterizado pela diversidade de stakeholders e por seu valor fluido e pouco definido, porém relevante.
