Before dully exploring the main object herein, foreign law is asserted in order to base the study on the institute inserted in the Brazilian legal system with the arrival of the New Civil Procedure Code. After having dealt with the stabilization of the phenomenon that falls on interim protection, an introductory study is performed to its sorts, procedures and requirements that shall be present for us to pass on to the analysis of the object of stabilization. Later, we move on to the study of the stabilization itself. We have chosen to develop the current paper considering the innovation from the 2015 legislator that established discussions and debates in the legal system, without having up to now proof of its practical application. Thus, stabilization on interim protection does not bear resemblance with the institutes from existing procedural law in the Brazilian legal system that translates the challenge experienced in the empirical and academic area. We have attempted to approach more emblematic issues already arising from the doctrine, always in light of the Federal Constitution and the new Brazilian Civil Procedure Code / O estudo em apreço tem por objetivo a investigação da estabilização da tutela antecipada. Antes de adentrar propriamente ao objeto principal desse breve ensaio, é perquirido o direito estrangeiro, a fim de balizar o estudo do instituto inserido no sistema positivo brasileiro com a chegada do novo Código de Processo Civil. Tratando-se a estabilização de fenômeno que recai sobre a tutela provisória, é realizado um estudo introdutório às suas espécies, procedimento e requisitos que devem estar presentes para que se passe à análise do objeto da estabilização. Posteriormente, passa-se ao estudo do instituto da estabilização propriamente dito. Optamos por desenvolver o presente trabalho considerando a inovação do legislador de 2015, que ensejou discussões e debates na seara jurídica, não havendo, até esse momento, indícios de sua aplicação prática. Com efeito, a estabilização da tutela provisória não guarda similitude com institutos do direito processual até então existentes no ordenamento jurídico brasileiro, o que traduz o desafio vivenciado na área empírica e acadêmica. Procuramos abordar as questões mais emblemáticas já suscitadas pela doutrina, sempre à luz da Constituição Federal e do novo Código de Processo Civil brasileiro

Restrições à antecipação da tutela / Preliminary injunctive relief restrictions

O tema proposto para o presente estudo refere-se à análise, dentro do contexto das tutelas antecipadas, dos seus pressupostos positivos e negativos, de algumas das restrições impostas pela legislação vigente a hipóteses de concessão, bem como à viabilidade da sua aplicação na situação atual da sua interpretação pela doutrina e pela jurisprudência. Procurou-se demonstrar a aplicação dessas normas restritivas, bem como a justificativa para a sua aceitação dentro do conceito da segurança jurídica e do contexto fático em que cada um dos casos analisados está inserido. Ademais, foi desenvolvido estudo crítico sobre as hipóteses em que se admite a relativização dessas restrições, as razões que levam a tal resultado e as consequências daí advindas para o cenário jurídico brasileiro. Todos os pontos mencionados foram baseados principalmente na análise do direito das partes a uma tutela jurisdicional efetiva e tempestiva, sempre com enfoque no direito processual constitucional, destacando-se a importância do respeito ao devido processo legal nesses casos e a importância de se garantir à parte um processo célere e de duração razoável. / The theme of this study is the analysis, within the context of preliminary injunctive relief mechanisms and their positive and negative prerequisites, some of the restrictions imposed by current legislation on the cases where such relief can be granted, as well as the feasibility of their application in the current situation of their interpretation by the doctrine developed by legal scholars and the jurisprudence from the courts. An effort is made to demonstrate the application of these rules and the justification for their acceptance within the concept of legal security and the factual context of each of the cases analyzed. Additionally, there is critical analysis of the situations where these restrictions can be relativized, the reasons for that result and the consequences for the Brazilian legal scenario. All these points are based mainly on analysis of the right of parties to obtain effective and timely protection from the courts, always with focus on constitutional procedural law, highlighting the importance of respect for due legal process as well as the importance of assuring speedy administration of justice.

Análise Preliminar de Perigos(APP) em projetos de arquitetura: aplicação e teste de viabilidade da ferramenta de análise de risco / Preliminary Hazard Analysis (PHA) applied to architecture design level: application and test of risk analysis tools

O objetivo foi testar a viabilidade de aplicação da ferramenta da Análise Preliminar de Perigo (APP) em projeto de arquitetura. As bases conceituais foram extraídas da análise de risco de processos industriais e segurança no ambiente de trabalho. A estrutura de encaminhamento da análise foi referenciada na norma internacional ISO 6.241 (International Organization for Standardization Performance standards in building Principles for their preparation and factors to be considered), a qual orienta a avaliação de desempenho do edifício, seus elementos e instalações, quando submetidos a condições normais de exposição e uso. Os referenciais utilizados como requisitos foram: segurança ao fogo e segurança ao uso; este último, com ênfase na acessibilidade. Os critérios aplicados foram norteados pelo Decreto do Estado de São Paulo, n. 46.076, de 31 de agosto de 2001, e pela norma da ABNT NBR 9.050, 2004. A adequação da APP ao uso em projeto de arquitetura envolveu a estruturação das categorias de análise, adequação da estrutura de composição da APP, a sistematização e codificação de listas de verificações, uso do aplicativo Excel e formatação de questionários com validação dos níveis de importância por especialistas. A ferramenta foi testada em dois edifícios do campus USP/Leste. Constatou-se que o uso dos macros facilitou a priorização dos pontos de interesse no processo de tomada de decisão, tanto para o projetista (matriz de risco por meio do nível de ação), indicando as situações relevantes para a melhoria contínua do projeto, como para o gerente de projetos (significância), trazendo informações representativas para sua atuação. Nos projetos analisados as falhas recaíram sobre as especificações de materiais, consideradas para o projetista como substancial ficando a distribuição espacial versus funcionalidade com um grau de importância moderado em situações de emergência. No atual estágio de desenvolvimento da ferramenta, o analista precisa ter habilidades como: senso crítico na comparação entre o prescritivo (leis, normas e regulamentos) e o real (proposição projetual) e capacidade de reconhecer os caminhos críticos entre os vários elementos dos subsistemas que contribuem para a geração de conflitos, desvios e falhas na proposição projetual. Este estudo confirma a viabilidade da aplicação da APP em projeto de arquitetura; entretanto, há necessidade do uso de um aplicativo que integre sistemicamente um banco de dados prescritivo e gráfico, permitindo uma associação entre os subsistemas e suas interfaces com desempenho, além da facilidade de manuseio. / This MASTER thesis aims at testing the viability of the Preliminary Hazard Analysis Tool (PHA) on architecture design level. The conceptual bases come from risk analysis industrial processes and security on labor ambient. The architecture design analysis was based on international standard ISO6241 (International organization for standardization Performance standards in building Principles for their preparation and factors to be considered) which establishes the performance evaluation of buildings, their elements and facilities when they are under use and external exposure conditions. The following performance requirements were adopted: fire safety and use safety, the last one with emphasis in universal accessibility. The performance criteria were oriented by São Paulo State Law n° 46.076 august 31, 2001 and national standard ABNT NBR9.050: 2004. The adaptation of PHA for application to architecture design level implies the structure of analysis categories, structure of PHA, systematization and codification of checklists, use of Excel application, formulation of questionnaires and validation of importance levels based on declared preference technique. The PHA tool was tested on two building projects of Campus USP/ Leste of University of São Paulo. The employment of programming scripts (excel macros) has demonstrated their potential for facilitating prioritization of actions during the design process. The designer could be able to improve the technical solutions by mean of the action level pointed by risk matrix and the manager could be able to take the most suitable decision by mean of the degree of significance. The main faults detected in the analyzed projects are related to: lack and inadequacy of materials specification and poor spaces functionality. The PHA tool user is supposed to have prior abilities such as: common sense in order to compare the prescription (laws, standards) to the real situation (design) as well as has the capacity of finding the critical path between many elements of the subsystems that contribute to the generation of conflicts and failures on the project. This study confirms the viability of PHA application in architecture design level, however, it is necessary the use of an application which integrates systemically a prescriptive and graphic database, allows an association between the subsystems and their interfaces with constructive performance and is easy of utilization.

In addition to this, there is to consider that most of the proposed curriculum of our schools as regards the organization and selection of content even if based on a formalistic approach to the curriculum which is based on the fragmentation of knowledge ignoring the uniqueness the exchange experiences and social and cultural experiences of learners. From this context, this research aims to investigate the perception of teachers and students on the value of prior knowledge of the students of the Youth and Adult Education Program (PROEJA) in teaching practices at the Food Technical Course at the Federal Institute of Education Science and technology of Amap? Macap? IFAP- Campus.. The researchers were 57 students of 4th, 5th and 7th semester and 14 teachers of the Technical Course in Food in PROEJA carried ou at IFAP. We used as data collection instruments the application of questionnaires documentary analysis of the Pedagogical Course Project (PPP), as well as the Institutional Development Plan (IDP) lesson plans and teaching plans in order to observe the prioritized knowledge in the common core curriculum and core technical and identify the knowledge valued in pedagogical practice PROEJA teacher. At the end of this investigation, we came to the understanding that the prior knowledge of students of the Technical Course of Food are considered by some teachers in the classroom but not given due importance. The valued knowledge are: knowledge curriculum; the disciplinary knowledge and the knowledge of teachers, that is, the teacher of scientific knowledge overlaps the daily knowledge of students. / A Educa??o de Jovens e Adultos (EJA) ? uma modalidade da Educa??o B?sica, que vem passando por mudan?as significativas, visando atender ?s novas exig?ncias da sociedade, principalmente com rela??o ?s pr?ticas pedag?gicas desenvolvidas no ambiente escolar, esse fator requer cada vez mais dos professores a aquisi??o de novos saberes que considerem o contexto de vida dos educandos, seus saberes e experi?ncias. Statistical Properties of Preliminary Test Estimators

<p>This thesis investigates the statistical properties of preliminary test estimators of linear models with normally distributed errors. Specifically, we derive exact expressions for the mean, variance and quadratic risk (i.e. the Mean Square Error) of estimators whose form are determined by the outcome of a statistical test. In the process, some new results on the moments of truncated linear or quadratic forms in normal vectors are established.</p><p>In the first paper (Paper I), we consider the estimation of the vector of regression coefficients under a model selection procedure where it is assumed that the analyst chooses between two nested linear models by some of the standard model selection criteria. This is shown to be equivalent to estimation under a preliminary test of some linear restrictions on the vector of regression coefficients. The main contribution of Paper I compared to earlier research is the generality of the form of the test statistic; we only assume it to be a quadratic form in the (translated) observation vector. Paper II paper deals with the estimation of the regression coefficients under a preliminary test for homoscedasticity of the error variances. In Paper III, we investigate the statistical properties of estimators, truncated at zero, of variance components in linear models with random effects. Paper IV establishes some new results on the moments of truncated linear and/or quadratic forms in normally distributed vectors. These results are used in Papers I-III. In Paper V we study some algebraic properties of matrices that occur in the comparison of two nested models. Specifically we derive an expression for the inertia (the number of positive, negative and zero eigenvalues) of this type of matrices.</p>

Zukünftige Hyperschalltransportsysteme unterliegen umfangreichen technischen, physikalischen, ökonomischen und ökologischen Anforderungen. Im Detail sind diese Anforderungen stark untereinander verknüpft und somit ist eine multidisziplinäre Behandlung bei einem Entwurf von Hyperschall-Konfigurationen notwendig. Mit Hilfe höherwertiger numerischer Verfahren, wie CFD und FEM, sowie wachsender parallelisierter Rechensysteme lässt sich der Hyperschall-Entwurfsprozess in einen multidisziplinären Optimierungsprozess (MDO-Prozess) überführen. In der vorliegenden Arbeit wird daher ein neu entwickeltes Optimierungswerkzeug für den Vorentwurf von Hyperschall-Flugzeugen vorgestellt, welches die wichtigsten Aspekte der Aerodynamik, der Strukturmechanik, der Flugmechanik, der Antriebsintegration und der Missionsanalyse in einer multidisziplinären Analyse vereint. Alle Teilprozesse werden vollständig automatisiert und in den Analyseprozess integriert. Nach geometrischen Änderungen am Konfigurationsdesign erfolgt eine Aktualisierung des gesamten Entwurfs mit abschließender Leistungsbewertung. Die Funktionalität und Kapazität dieses MDO-Prozesses wird erfolgreich an einem existierenden Hyperschallentwurf, der HYCAT-1A, demonstriert. / Future hypersonic transport systems are characterized by extensive and strongly coupled technical, physical, economic and environmental requirements. Hence a multidisciplinary approach for preliminary design studies is necessary. Using high-fidelity numerical tools, e.g. CFD and FEM, on large-scale computer systems the hypersonic design process can be transformed into a multidisciplinary optimization process (MDO process). Thus in the present work a newly developed optimization tool is presented considering aerodynamic, structural, engine and mission characteristics. All sub-processes are integrated in a fully automated analysis environment. During the optimization the outer geometry is changed and all sub-processes are updated accordingly to evaluate the design performance. The functionality and possibilities of the developed MDO process are successfully shown on an existing hypersonic design, the HYCAT-1A configuration.

Preliminary Investigation of the Relationship Between Emotion Processing Variables and Difficulties in Affect Regulation With the Use of Affect Regulation Strategies

A preliminary measure of affect regulation strategies was developed from Parkinson and Totterdell’s (1999) provisional classification of deliberate strategies for improving negative affect. Four broad categories of strategies including Cognitive Engagement, Cognitive Diversion, Behavioural Engagement, and Behavioural Diversion were represented by the measure. Using this measure, relationships between self-reported use of affect regulation strategies and difficulties in emotion regulation and emotion processing variables were investigated. Participants included 186 adults. Participants completed a 20 minute online survey consisting of the measure of affect regulation strategies, the Difficulties in Emotion Regulation Scale (DERS), the Subjective Experience of Emotions Scale (SEE), and a demographic information questionnaire. Weak correlations were found for the majority of the difficulties in emotion regulation and emotion processing subscales and individuals’ self-reported use of affect regulation categories.
