[pt] A presente dissertação propõe-se ao estudo da necessidade de aplicação do conceito de adaptação razoável, limitada a um ônus indevido, pela Administração Pública às pessoas com deficiência, como mecanismo de concretização do reconhecimento social. Para tanto, apresenta-se a teoria do reconhecimento intersubjetivo, na visão proposta por Axel Honneth, segundo o qual são identificadas três esferas de reconhecimento que, quando completas, propiciam autorrealização social dos indivíduos. Assim, os conflitos sociais refletiriam relações de reconhecimento incompletas, sendo que a luta por inclusão social
corresponderia, na realidade, a uma luta por reconhecimento. Dentro dessa perspectiva, identificou-se ainda que as pessoas com deficiência permanecem em constante luta por sua inclusão social, sendo que a reserva legal de vagas em concursos públicos, prevista no art. 37, VIII da Constituição Federal, contribui
como importante mecanismo inclusivo e fomentador de um reconhecimento social por garantir o acesso ao trabalho. Não obstante, a reserva por si só seria inócua, caso não se buscasse efetivação desse acesso ao trabalho, por meio da adaptação razoável da Administração Pública, conceito inovador, introduzido com a
Convenção sobre os Direitos das Pessoas com Deficiência da Organização das Nações Unidas, da qual o Brasil é signatário e que se encontra inserida no bloco de constitucionalidade nacional. Por intermédio da adaptação razoável, limitada pelo ônus indevido, promovem-se ajustes ou medidas indispensáveis ao efetivo exercício de direitos humanos. As transformações operadas contribuem para a inclusão social das pessoas com deficiência bem como ampliam o horizonte normativo de uma comunidade. / [en] The present dissertation aims to study the necessity to apply the concept of reasonable accommodation, limited to an undue burden by public administration for disabled people as a mechanism to achieve social recognition. For such, the theory of intersubjective recognition is presented through the perspective of Axel
Honneth. According to that, there are 3 spheres of recognition which, when complete, provide the individual s social self-realization. Thus, the social conflicts would reflect incomplete recognition relationships and the social inclusion struggle would then correspond in fact to a struggle for recognition. From this point of view it was possible to identify that people with disabilities are constantly struggling for their social inclusion. And the legal reservation of job posts in public competitions, predicted in the article 37, VIII of the Federal constitution, represents an important inclusive mechanism as well as promotes social recognition since it guarantees access to work. Nevertheless, the reservation itself would be innocuous if there wasn t a search for the implementation of this access to work through reasonable accommodation. This is an innovative concept, introduced by the Convention on the rights of people with disabilities of the United Nations Organization of which Brazil is signatory and which is inserted in the block of national constitutionality. Through reasonable accommodation and limited by the undue burden, measures are taken or adjustments are made, which are indispensable to the effective exercise of human rights. Such transformations contribute to the social inclusion of disabled people as well as broaden the normative horizons of a community.

The Employment Equity Act, No 55 of 1998 forms part of the transformation legislation aimed at promoting equity and eliminating discriminatory and unfair treatment in the workplace. This Act was promulgated more than ten years ago, and its positive impact has to be measured in terms of its contribution to the conduciveness of the work environment. The aim of this study is to enhance measures for effective implementation of an Employment Equity Programme (EEP) in the Public Service, with specific reference to the Department of Justice and Constitutional Development. The ultimate aim is to identify Employment Equity (EE) measures that will benefit management and employees in enhancing individual performance and productivity. The study focuses on perceptions of employees on how they perceive EEP. As the study progressed it became equally important to determine the alignment and contribution of EEP on Departmental strategic objectives. Approximately every tenth citizen in the Czech Republic suffers from a disability. Persons with disabilities form a vulnerable group in the labour market, which is caused mainly by a lower level of their education. Therefore, it is important that legislation protects the disabled persons and encourages employers to their employment. Employing of disabled people is in the interest of entire society and also has an integrative dimension. The main objective of this thesis is to assess comprehensively the legal regulation of the employment of persons with disabilities in the Czech Republic, to reflect recent amendments to applicable legislation and simultaneously to verify the premise that these regulations are satisfactory and feasible in practice. The thesis consists of four parts. The first part focuses on the basic definitions and states in which aspects some similar terms are identical or different. Special attention is paid to the definition of a "disabled person" in all its major forms. The second part deals with international and European regulation, by which the Czech Republic is bound and with which the national legislation must be in accordance. L’objectif de la recherche est de comprendre l’héritage du rapport de la Commission de consultations sur les pratiques d'accommodement reliées aux différences culturelles (Commission Bouchard-Taylor). Nous présenterons une analyse des mesures adoptées par divers gouvernements québécois, qui ont voté des lois en chambre parlementaire afin de promouvoir la laïcité de l’État. Plusieurs éléments socioculturels retiennent une attention particulière en ce qui concerne les recommandations émises par les experts, puis appropriées par les politiciens lors de projets de loi. Notre recherche de terrain se focalise sur les pratiques religieuses des catholiques pratiquants, ce qui représente une approche distincte par rapport aux autres recherches qui se sont principalement penchées sur les communautés religieuses minoritaires telles que les musulmans ou les juifs, dont les pratiques religieuses sont plus visibles et directement affectées par les lois sur la laïcité. Par le fait d’étudier des membres de la religion catholique dans cette étude, nous pourrons également mieux comprendre la perception de ces pratiquants dans une société qui, depuis de nombreuses années, a véhiculé des préjugés marqués à leur égard dans les médias et l'imaginaire collectif. / The aim of this research is to understand the legacy of the report by the Commission de consultations sur les pratiques d'accommodement reliées aux différences culturelles (Bouchard-Taylor Commission). I first analyze the measures adopted by various Quebec governments, that promote the secular nature of the State. Several issues come to the fore in the way recommendations issued by expert are conceived and then appropriated by politicians when bills are drafted. My research focuses on the religious behavior of practising Catholics, which represents a distinct approach from other research that has focused mainly on minority religious communities such as Muslims or Jews, whose religious practices are more visible and directly affected by secularization laws. By looking at members of the Catholic religion in this study, we will also be able to better understand the perception of these practitioners in a society which, for many years, has conveyed marked prejudices towards them in the media and the collective memory.

近年來在我國,有關就業歧視所引起的爭議,已經因各弱勢團體權利意識之覺醒,而有逐漸受到社會的重視,除了一般較為熟知之性別歧視外,尚有其他有關宗教信仰、族群、黨派、身心障礙、語言、年齡及容貌等因素所造成的工作機會或待遇的不平等之現象,也曾引起廣泛的討論,究竟這些現象在我國之嚴重程度如何?我國現行法規制度是否能夠有效因應?有沒必要參酌其他先進國家法制,作禁止歧視之統一性立法?都是值得進一步探討的課題。
因此,本論文針對禁止身心障礙就業歧視制度發展最完備的美國作為探討的對象,首先討論美國禁止身心障礙就業歧視制度之早期發展沿革,包括了禁止身心障礙之概念與理論之簡介以及一九六四年所通過之民權法第七章(Title VII of the Civil Right Act of 1964)、一九七三年通過之復健法(Rehabilitation Act of 1973)之重要規定及對於禁止身心障礙就業歧視問題之影響。其次,則針對一九九0年所通過之美國身心障礙人士法(Americans with Disabilities Act of 1990)作討論。而美國身心障礙人士法乃是禁止身心障礙就業歧視制度之核心規範,因此,本文除了討論該法之立法背景外,同時更針對該法之重要條款規定以及平等就業機會委員會(Equal Employment Opportunity Commission: EEOC)對於該法所頒佈之相關指導原則作一個綜合之分析討論。進而,更針對該法在美國所引發之重大爭議中,選取美國最高法院在最近所作出之最具代表性之六個判決,也對判決作一個綜合之評析,以明瞭其利弊得失之所在及我國可資借鏡參考之處。
再其次,則討論我國目前建構禁止身心障礙就業歧視制度之現狀及所遭遇之困境,主要是對於身心障礙者之就業困境及遭受就業歧視之情形、禁止身心障礙就業歧視之相關規範與制度、身心障礙之就業歧視評議制度運作情形及處理禁止身心障礙就業歧視所引發之爭議等幾個議題作分析,以期能夠對於我國目前建構禁止身心障礙就業歧視制度之現狀及其所遭遇之困境有所瞭解。最後,則以美國處理禁止身心障礙就業歧視問題之經驗,希望能對於我國建立一個正確之禁止身心障礙就業歧視制度之建構方向,以及關於目前我國在處理禁止身心障礙就業歧視問題之一些具體建議。 / Disputes resulted from the employment discrimination have been gradually noticed by Taiwan society due to the awakening consciousness of each disadvantaged minority in these years. In addition to the commonly known of sexual discrimination, other factors of unequal employment and treatment are also widely discussed, such as religion, race, party, disability, language, age and appearance. However, how serious are these phenomena in our country after all? Do existing laws and regulations could solve them effectively? Is it necessary to refer to other modern countries’ legal systems to legislate against discrimination? All of the above are worthy of further discussion.
Therefore, America, the country with the most complete legislation system to protect a disability from employment discrimination, is the object for discussion in this article. First to discuss is its early development history, including the introduction of concept and theory, the important regulations of Title VII of the Civil Right Act of 1964 and Rehabilitation Act of 1973 and their influences. Second to discuss is the Americans with Disabilities Act of 1990, which is the core regulation of the legislation system to protect a disability from the employment discrimination; Therefore, in addition to discussing its legislation background, this article also discusses comprehensively of its important regulations and the regulations to implement the equal employment provisions of the Americans with Disabilities Act on it at the same time. Then selects 6 most representative decrees made by Supreme Court of the United State with regard to the important disputes, and also analyze those decrees comprehensively to realize their advantages and disadvantages to find some experiences that could learned in Taiwan.
Moreover, is to discuss that the situation and the difficulty in the establishment of the legislation system to protect a disability from employment discrimination, which mainly focus on the analysis of the employment difficulties and discrimination faced by the people with physical and mental disabilities, relevant regulations and legislation system against employment discrimination, operation of committee on employment discrimination, and disputes arose from employment discrimination. Finally, it is expected to establish a correct direction for the establishment of legislation system to protect a disability from employment discrimination and to seek out specific suggestions relevant to problems we have in the management of the employment discrimination faced by the people with physical and mental disabilities through America’s experiences.

Les conséquences juridiques de la coexistence de l’obligation d’accommodement raisonnable et du régime public de réparation des lésions professionnellesParent, Sébastien 11 1900 (has links)
Une bourse d'études du Conseil de recherches en sciences humaines (CRSH) a été accordée à l'auteur pour la réalisation de ce projet de recherche. / Suite à l’étude de la genèse de deux régimes occupant une place fondamentale en droit du travail québécois, soit le régime public de réparation des lésions professionnelles institué par la Loi sur les accidents du travail et les maladies professionnelles, et l’obligation d’accommodement raisonnable, issue du droit à l’égalité consacré à l’article 10 de la Charte québécoise, ce mémoire s’intéresse au déploiement du conflit normatif et du conflit juridictionnel découlant de l’évolution en parallèle de ces deux sources d’obligations pour les employeurs, dont l’objet est la réintégration et le maintien du lien d’emploi du salarié atteint d’un handicap. Cette étude propose ensuite d’explorer les conséquences juridiques de la solution retenue par la Cour d’appel du Québec, dans l’arrêt Caron rendu en juin 2015, laquelle décide de juxtaposer une obligation d’accommodement raisonnable au régime public de réparation des lésions professionnelles. Ainsi, ce mémoire met en évidence les conséquences en droit constitutionnel canadien et quasi constitutionnel québécois de la démarche utilisée dans l’arrêt Caron et des résultats auxquels elle a conduit, en recentrant la place du droit à l’égalité en droit public et en discutant de ses impacts sur la séparation des pouvoirs. En outre, ce revirement jurisprudentiel engendre maintes difficultés au regard de la particularité du droit administratif, plus spécifiquement quant au rôle et aux pouvoirs limités de la C.N.E.S.S.T. et du T.A.T.-D.S.S.T. Enfin, cette analyse fait ressortir que la solution retenue par la Cour d’appel porte atteinte à l’équilibre que s’efforce de maintenir ce régime public reposant sur un important compromis social. / Following the review of the genesis of two fundamental regimes in Quebec labour law, the public system that provides repairs to injured workers, established by the Act respecting industrial accidents and occupational diseases, and the duty to provide reasonable accommodation arising from the right to equality under section 10 of the Quebec Charter, this thesis focuses on the development of the normative conflict and the jurisdictional conflict stemming from the parallel evolution of these two sources of obligations for employers. Both of these are based on the reinstatement of disabled workers and the continuation of their employment relationship. This study proposes to explore the legal consequences of the solution adopted by the Quebec Court of Appeal in Caron’s case, dated June 2015, in which the Court decided to overlay the employer’s duty to accommodate onto the Workers’ Compensation public system. Thus, emphasizing on the role that the right to equality plays in public law and discussing its impact on the separation of powers, this thesis shows the consequences from the approach used in the Caron judgment and its particular results through Canadian constitutional and Quebec quasi-constitutional principles. Furthermore, this significant change gives rise to many difficulties regarding the particularities of administrative law, and more specifically, the role and the limited powers of C.N.E.S.S.T. and T.A.T.-D.S.S.T. Finally, this analysis highlights that the solution held by the Court of Appeal infringes on the balance attempted by the public system based on an important social compromise.

La non-discrimination est une notion en constante évolution. Elle se doit d’être réceptive aux nouvelles formes discriminatoires vécues par les travailleurs afin de garantir un niveau de protection juridique conforme aux exigences internationales et nationales. En ce sens, les discriminations multiples sont un parfait exemple. Il s’agit de situations dans lesquelles interviennent et interagissent plusieurs motifs prohibés. Or, le concept de discriminations multiples, issu des sciences sociales, n’est théorisé en droit que depuis les années 1980. Si elles sont inconnues du droit positif, la doctrine et la pratique tendent à souligner la nécessité de leur reconnaissance juridique. Saisies par le droit du travail, elles posent de nombreuses questions quant à leur définition et leur mise en oeuvre. Leur étude va permettre de délivrer une approche différente de l’exigence de non-discrimination en droit du travail mais également des objectifs de diversité en entreprise. / Anti-discrimination law is always evolving. It must be receptive to new types of discrimination against workers to guarantee a level of legal protection consistent with international and national standards. In that sense, multiple discriminations are a perfect example. They take place when several protected characteristics occur and interact with each other. The concept of multiple discriminations arises from social sciences but has only been legally theorized since the 80s. If French law does not consider them, jurisprudence and practice tends to underline the necessity of a legal acknowledgment. Seized by employment law, multiple discriminations pose many questions with regard to their definition and implementation. Nonetheless, studying them offers a different approach to the duty to not discriminate at work, and to insuring diversity in the workplace.

En 2007, le Premier ministre du Québec, monsieur Jean Charest, a établi la Commission de consultation sur les pratiques d’accommodement reliées aux différences culturelles afin de donner suite aux conflits émanant des différences ethniques et culturelles. La commission a pour mandat de dresser le bilan des pratiques d’accommodement au Québec, d’analyser la problématique, de consulter la population et de formuler des recommandations au gouvernement afin d’assurer la conformité des pratiques d’accommodement avec les valeurs de la société québécoise. En premier lieu, ce mémoire démontrera que deux facteurs, dont l’évolution de l’identité de la majorité francophone et l’évolution des pays d’origine des immigrants, ont contribué à un malaise de gestion de la diversité et, par conséquent, ont rendu l’établissement de la commission pertinent. En deuxième lieu, m’appuyant sur une revue de la méthodologie, des conclusions et des recommandations de la commission, ainsi que la réplique du Ministère de l’Immigration et des Communautés culturelles, je vais illustrer que, malgré un mandat pertinent et achevé, la réponse gouvernementale fut inadéquate. Finalement, je démontrerai que les modèles de gestion de diversité soutenus par le rapport de la Commission, la laïcité inclusive et l’interculturalisme, sont des aspects nécessaires de la gestion de la diversité. Cependant, ils en découlent des philosophies politiques de neutralisme et pluralisme dont la force et le compromis en sont les buts. Je crois que le Québec peut être meilleur gestionnaire de sa diversité et peut obtenir de vraies réconciliations en prônant la conversation; une approche patriotique de la gestion de diversité. / In 2007 and in response to conflicts stemming from ethnic and religious difference, Quebec Premier Jean Charest established the Consultation Commission on Accommodation Practices Related to Cultural Differences. The Commission’s mandate was to take stock of accommodation practices in Quebec, analyse the issues, consult the population and formulate recommendations to the government to ensure accommodation practices’ congruence with the values of Quebec society. This mémoire will first argue that two factors, namely the evolution of the francophone majority population’s identity and changes to immigrants’ origins, contributed to Quebec’s malaise with diversity management and thus made the establishment of the Commission relevant. Second, through a review of the Commission’s methods, findings, recommendations and the Ministry of Immigration and Cultural communities’ response to the recommendations, it will be argued that while the Commission’s mandate was both pertinent and fulfilled, the government’s response was inadequate. Finally, it will be argued that while open secularism and interculturalism, diversity management methods proffered by the Commission’s report, are necessary components of diversity management, they espouse the political philosophies of neutralism and pluralism which respectively result in force and compromise. I will argue that Quebec can manage difference more effectively and achieve true reconciliation by embracing conversation, a patriotic approach to diversity management.
