新勞動合同法對台商影響以及台商因應之道

2008年元月實施的《中華人民共和國勞動合同法》,是中國大陸政府當局宣告擺脫過往提供低廉人力資源的新興國家形象,挑選更願意肩付企業社會責任的企業,轉型成為真正大國。這部勞動合同法在更全面保障勞工權益時,被資方及部分學者視為一部親勞方遠資方的法令,執行後衝擊許多外商,其中包括台商。 2008年元月實施的《中華人民共和國勞動合同法》,是中國大陸政府當局宣告擺脫過往提供低廉人力資源的新興國家形象,挑選更願意肩付企業社會責任的企業,轉型成為真正大國。這部勞動合同法在更全面保障勞工權益時,被資方及部分學者視為一部親勞方遠資方的法令,執行後衝擊許多外商,其中包括台商。 本論文針對勞動合同法對台商造成的影響進行探討,不同產業的台商受到影響的差別性,並研討台商因應之道,例如作出內部制度改革及遷徙廠房等,遷徙路線是本文探討焦點。 本論文透過與台商的深度訪談獲得相關資訊,歸納出台商在勞動合同法實施後,決定西移入中國大陸內地、南移向東南亞國家、或是向東返回台灣投資的三個遷徙路線,與作出這個決定的背後考量。 2008年台灣總統大選後再次政黨輪替,馬政府團隊重新開啟與對岸的交流,台灣當局也利用這個台商思動和兩岸融冰的時機,提供優惠政策吸引台商返台投資。勞動合同法的頒布也牽動台商在兩岸的移轉和經營的變革。 / Law of The People’s Republic of China on Employment Contracts is executed to get rid of the image of offering cheap human resource, Mainland China’s stereotype for investors in majority. After practicing the Law, the government expects to attract enterprises with more willing of taking social responsibilities to transform as the modern country. The Law protects labors’rights more completely, but is regarded a bias against investors. The consequence of practicing the Law impacts many foreign investors, including Taiwanese businessmen. This thesis discusses how the Law impacts Taiwanese businessmen, various effects to different businesses, and the responses from Taiwanese investors, such as the innovation of internal system and removal of business. Where do those Taiwanese businessmen remove their investment is the key point of this thesis. The conclusion of this thesis is based on one-by-one interview with selected Taiwanese businessmen among various businesses. If they decided to remove the investment, three routes are mostly considered: east to interior land of Mainland China, south to East Asia countries, and east to Taiwan. This thesis also indicates why they do such considerations. 2008 Taiwan Presidential Election rotated ruling party. KMT Ma government restarts the interaction with Mainland China and takes advantage of ice-breaking timing to offer favorable policies to attract Taiwanese businessmen to return to Taiwan. The execution of Law of The People’s Republic of China on Employment Contracts also affects the move of Taiwanese businessmen and the mode of business operation.

中美日汽車品牌權益決定因素之研究 / The Study on The Determinant of Brand Equity for Taiwanese, American and Japanese cars

1992年台灣正式成為GATT的觀察員,而工業局在1994年表示為因應加入GATT,小汽車的關稅要降低5%,另外要增加對包括日本等14國的汽車配額。面臨更多汽車品牌進入台灣市場,國內的汽車廠商面對更劇烈的競爭應如何提升本身的品牌權益?本研究主要是以消費者觀點來探討三種品牌車主認為那些決定因素對品牌權益有顯著的影響,以提供廠商做為提升品牌權益的參考依據。   經過品牌權益、來源國效果、以及汽車品牌相關文獻的回顧,接著進行國內五大車廠之銷售人員或經理的訪談,然後進行二場焦點團體,建立理論架構並以問卷調查的方式,收集到台灣四個縣市(台北縣、基隆市、宜蘭縣、花蓮縣)的豐田車主44份問卷、克萊斯勒車主47份問卷、以及裕隆車主36份問卷的資料,試圖了解產品品質、服務品質、來源國效果、知覺風險、必及品牌忠誠度等五個決定因素,是否對汽車品牌權益有顯著的影響。另外,也探討人口統計變數的車主是否會造成對不同品牌有不同品牌權益。   本研究之重要結論有以下幾點:   1. 消費者觀點的決定因素對品牌權益的影響力和解釋力,為產品品質最高、其餘依次為服務品質、知覺風險、品牌忠誠度、而以來源國效果最低。   2. 豐田汽車與克萊斯勒汽車的品牌權益並無顯著差異,但豐田汽車和克萊斯勒汽車均高於裕隆汽車的品牌權益。   3. 行銷學者在提出品牌權益的觀念架構都沒提到知覺風險,但經過汽車品牌相關文獻的探討、汽車銷售人員訪談、以及焦點團體發現知覺風險可能對品牌權益有所影響。而經由研究發現知覺風險確實是汽車品牌權益的決定因素之一,例如:豐田汽車與克萊斯勒汽車均比裕隆汽車有較低的社會風險。   4. 某一汽車品牌的廠商可針對特定汽車品牌,進行某項決定因素的訴求或改善,以增加本身的品牌權益。例如,豐田汽車的行銷策略可以針對克萊斯勒汽車,可訴求豐田汽車在產品品質的低故障性和耐用性優於克萊斯勒汽車,而增加豐田對克萊斯勒的品牌權益。   5. 不同的人口統計變數會造成不同的品牌權益,但只存在特定品牌車主針對某一品牌的汽車。例如,婚姻狀態會造成不同的品牌權益,只有發生在裕隆車主對豐田汽車,未婚的裕隆車主認為豐田汽車和裕隆汽車的品牌權益差異較大;已婚的裕隆車主認為豐田汽車和裕隆汽車的品牌權益差異較小,彼此的看法有顯著的差異。

合作策略的興起為許多台灣廠商帶來新的啟發,因為構成台灣經主體的中小企業可以透過適當的合作策略運用,達成以往不易達成的企業目標,尤其是在面對變化快速、競爭日益激烈的企業經營環境,合作策略更能突顯其優點。然而在合作策略於企業界盛行以來,績效不佳的情形往往多於成功的案例(Harrigan 1986; Kanter 1990),因此縱然標榜「一加一大於二」的合作聯盟似是非常吸引人,但卻好像並不怎麼好用。於是,廠商在企圖利用這種新興的策略方式來獲取合作利益,並進而達成因應環境趨動因素的要求及滿足企業內部趨動因素的目標時,對影響合作聯盟績效因素的研究就顯得格外重要了。因此,本研究企圖透過對個案的深入訪查了解合作績效的影響因素,及其相關議題,以下即本研究之結論。   1、若適當地利用合作行銷策略,將可以有效地達到下列三項企業目標:利用互補性的優勢快速地進入新市場區隔或強化既有區隔的優勢地位、取得關鍵性資源、降低企業投資風險。   2、合作動機對合作方式的選擇及管理機制設計有重大的影響。   3、在進行合作夥伴的選擇時,對夥伴的評估準則會影響合作方式的選擇及管理機制的設計。   4、廠商的合作動機、合作方式、及管理機制必須能相互配合,才會有較佳的合作績效。

從體驗行銷觀點看台灣背包客異國旅行經驗 / A study on the outbound experiences of Taiwanese backpackers —from the perspective of experiential marketing

無 / Backpacker is an emerging new market niche in current International tourism market. It’s important to understand backpackers’ touring experiences with specific national identity to benefit global destination experience providers. Therefore, metaphors concerning backpacking experiences are projected first. Second, from the perspective of experiential marketing, this study is attempted to analyze Taiwanese backpackers’ outbound traveling experience elements which engage sense, feel, think, act, and relate experiences for creating unique and lasting memories, by examining direct influential factors. Then, according to their satisfaction statements, their perspectives about overall on-tour experiences are concluded. This study adopts quasi-netnography methodology, alone with event-based narrative inquiry technique, to analyze 37 Taiwanese backpackers’ online narratives on backpackers.com.tw. The metaphors, direct influential factors (personnel, other tourist, product/souvenir, and physical environment) on five experience modules (sense, feel, act, think, and relate), and satisfaction (overall evaluation, recommendation, and willing of revisit) are examined. And, the reliability check achieves significance level. The results show that five metaphors can be seen as bases for designing unforgettable backpacking experiences. And, aside from direct influences, there are also other three indirect influences (media, cultural status, and resource constraint). Further, “people” and “environment” factors influence Taiwanese backpackers’ on-tour experiences most. Next, their experiences encompass multi-sensory experiences, engaged/involved emotions, personal cognitive development, social relationship building, and personal fulfillment. Finally, the finding regarding satisfaction can be used as a management tool to enhance the overall experience. Thus, this study sheds light on offering practical insights to International tourism industry.

台灣銀行業投資大陸的發展策略 / The investment strategies of Tiwanese banks in China

隨著兩岸金融政策的開放,國內銀行將會面臨新的局勢。中國大陸經濟崛起是台灣銀行業者的發展契機,同時因為兩岸在經濟與金融發展脈絡上的不同,亦會造成雙邊交流的阻礙,在機會與困境的新局中,國內銀行要如何找出因應之道將會格外重要。 本文透過文獻回顧、SWOT與個案分析的方式描繪出,未來可能出現的交流新貌。首先在文獻回顧上,台灣目前面臨銀行家數過多的問題,雖然歷經多次改革但是成效仍舊相對有限,未來銀行在中國大陸拓展事業版圖後,有機會改善國內的金融環境。 其次在SWOT分析中,台灣銀行產業發展得較早,所以培養出不少優秀的人才,而且銀行也擁有成熟的金融技術,此為國內銀行交流的優勢,不過國內銀行面對大陸銀行的競爭,規模與營業據點不足卻是發展上的劣勢。 最後在個案分析中,外資金融機構赴大陸發展,其業務經營方向越來越偏向當地市場,不僅各國逐漸轉型為獨資外資銀行,而且也開始經營本地業務,未來國內銀行也應該把目光從台商轉到大陸市場。 兩岸金融談判持續進行,期盼雙方可以透過了解降低雙邊交流可能造成的摩擦,更希望兩岸在互信互利的基礎下,共同創造出繁榮的大中華經濟圈。 / Open cross-strait financial policy has led to domestic banks are facing a new situation. China market is an opportunity for banks in Taiwan,but different financial environment will result in communication barriers. In this situation, how to find the solution is an important issue. We have gone through ‘Literature Review’,’ SWOT analysis’,’ Case Studies’ and reached conclusion. In the literature review, Taiwan faces overbanking problems in recent years. Although domestic reform several times but the effect is relatively limited. Banks enter the Chinese mainland market, overbanking will be improved. In the SWOT analysis. talent and technology is the development advantages.Industry of bank started early, so the country has many excellent financial professionals. Taiwan has also been leading in the financial technology. It’s the bank's strength. However, domestic banks face competition from mainland banks, lack of scale and business units are the disadvantages of the development. In the case studies, foreign financial institutions enter the Chinese market, more and more close to the local business direction. Foreign Capital Bank not only transformed into wholly foreign funded commercial bank, but also operating a local business. Domestic banks should also target customers from Taiwan enterprises into local enterprises in the future. In the ECFA framework, the Government will continue to conduct financial negotiations. Abstract The Mainland China has been the global newest economic body, having the fastest growth in economy. It is now being developed and built by way of internationalization. It further combines itself with the entire development of the great East Asia economic circle and tries to become the next international economic center all over the world. Its economy fast grows at a speed of almost annual two-digit. It will become the third economic body in the whole world in scale. Because it nears Taiwan, so reasonably turns into one of the favorite destinations which Taiwanese enterprises prefer moving out overseas in recent years. However, the investment risk in Mainland China is very high. When it comes to finance, it is not easy to ask for the loan of bank. When human matter is concerned, it is closing of information and the difficulty about management. As for marketing, you have to face the obstacle with regard to market opening and collecting market information. Concerning about production, the insufficiency of traffic facility and the restraint of electric power supply exist. As to law, the inconsistency about the explanation of rule among the responsible officials and the unpredictable changes in policy often occur. When it comes to general operation management, not only does the administrative efficiency lower, but extra social fees and concoct expenses flood. According to the statistical data of the communication foundation between straits, the number of dispute cases having been received by the foundation is 127 in 1998, almost twice, 70 in 1997. To sum up, the problems happening among Taiwanese merchant about investing in Mainland China are full of all kinds. Therefore, it is sure to raise the rate of success in business only by way of finding out the key success factor¡]KSF¡^about investing and operating. A Study of Liu Chia-mo and His Poetry of Realism

Liu Chia-mo (1814-1853), a native of Houguan in Fujian, once served as an educational instructor at Ningde and a school counselor in Taiwan Prefecture during the Daoguang and Hsienfeng reigns of the Ching Dynasty. Owing to a lack of relevant literature and access to his poetry, academics have not come up with any comprehensive study concerning Liu Chia-mo, his works and his social life. Therefore, this research was intended to construct the life story of Liu Chia-mo from the first-hand historical documents including Liu Chia-mo¡¦s works¡X First Draft by Waidingmoa Bridge Recluse, Dungyang Little Grass, Sword Poetry, Wandering Ambition in Crane Pen, Guanhai Chi, Haiyin Shi, Hsieh Chang-ting¡¦s Gambling Chess Villa Collection (Shi, Wen, Tsu, Tsu Words, Notebook), and the recently discovered Gambling Chess Villa Draft, Chang Chi-liang¡¦s Chang Heng-fu Collection, Si-Po-Tzu Hall Poetry, Huang Tsung-yi¡¦s Po-Suo Poetry, and Wei Hsiu-jen¡¦s Hai-Nan-Shan Hall Poetry. This dissertation takes realism in the poetry by Liu Chia-mo as its subject. It will demonstrate his patriotism, concern over the livelihood of civilians and responsibilities and expectations for the world mainly through the textual study of First Draft by Waidingmoa Bridge Recluse, Dungyang Little Grass, Guanhai Chi and Haiyin Shi. The Introduction section consists of a literature review of Liu Chia-mo and the characteristics of his poetry of realism. Chapter One briefly describes Liu Chia-mo¡¦s historical background in the spirit of knowing the person from the world. Chapter Two explores the life of Liu Chia-mo, his publication of poetry and literature, and his literary creativity with aside from his poetry. Chapter Three deals chiefly with First Draft by Waidingmoa Bridge Recluse to study his poetry on the Sino-British Opium War. Chapter Four examines Dungyang Little Grass together with Wandering Ambition in Crane Pen to study the poetry composed during his service as an educational instructor at Ningde. Chapter Five focuses on the discussion of Guanhai Chi and Haiyin Shi, two poetic texts composed by Liu Chia-mo during his service as a school counselor in Taiwan Prefecture that address social issues in the Chinese-dominated Taiwan society during the Daoguang and Hsienfeng reigns as an effort to cure social illness and improve public morality from a perspective of observing customs. An estimated total of 1,100 poems were composed by Liu Chia-mo, whose contents range from the Opium War, Taiwanese social traditions and customs, expressions of praise for matters in painting, landscape description, and family relationships and friendship. Characterized by detailed quotations, occasional dialectal usages and transformation of vulgarity into gracefulness, they are all works that express a love of native land. In its concluding section the paper briefly considers the contents of Liu¡¦s poetry as an effort to deepen the study of Liu Chiao-mo and Taiwanese literature.

The societal culture dimension within the human resource practices of Taiwanese management in the UK

This thesis examines approaches to international human resource management by Taiwanese MNCs located in the UK. A range of international human resource management models are discussed, from the universalist paradigm originating in the US to more contextual models, particularly those emphasising the impact of culture. The key elements of Chinese culture and their application to management are reviewed Interview and questionnaire data is drawn from 32 Taiwanese companies operating in the UK in the manufacturing and financial services sectors, and is analysed using SPSS and NVivo packages. Key findings include that the cultural origin of Taiwanese managers remains crucial in the way they manage UK subsidiaries. The small size of the Taiwanese companies also influences their internationalisation and international human resource strategy. In addition, there is a sectoral difference in the different HR practices being adopted. Japanese MNCs have been the only non-western MNCs to have been studied in depth. Although the Japanese and Chinese have been said to share a similar culture, they are shown in this thesis to adopt different techniques to achieve their HRM goals. It is concluded that many goals similar to those of western models of HRM can be found in Taiwanese MNCs, but achieved through different HR practices, for example, group reward rather than individual reward for commitment. It is suggested that conventional HRM frameworks fail to readily explain companies of non-western origin and the thesis tries to develop an IHRM model suitable for Chinese MNCs. Following strong economic development in China, research on Taiwanese MNCs can contribute to future perspectives on Chinese internationalisation and management transfer.

Survey of Selected Contemporary Taiwanese Female Composers of Music for Solo Piano

abstract: The purpose of this project was to examine the lives and solo piano works of four members of the early generation of female composers in Taiwan. These four women were born between 1950 and 1960, began to appear on the Taiwanese musical scene after 1980, and were still active as composers at the time of this study. They include Fan-Ling Su (b. 1955), Hwei-Lee Chang (b. 1956), Shyh-Ji Pan-Chew (b. 1957), and Kwang-I Ying (b. 1960). Detailed biographical information on the four composers is presented and discussed. In addition, the musical form and features of all solo piano works at all levels by the four composers are analyzed, and the musical characteristics of each composer's work are discussed. The biography of a fifth composer, Wei-Ho Dai (b. 1950), is also discussed but is placed in the Appendices because her piano music could not be located. This research paper is presented in six chapters: (1) Prologue; the life and music of (2) Fan-Ling Su, (3) Hwei-Lee Chang, (4) Shyh-Ji Pan-Chew, and (5) Kwang-I Ying; and (6) Conclusion. The Prologue provides an overview of the development of Western classical music in Taiwan, a review of extant literature on the selected composers and their music, and the development of piano music in Taiwan. The Conclusion is comprised of comparisons of the four composers' music, including their personal interests and preferences as exhibited in their music. For example, all of the composers have used atonality in their music. Two of the composers, Fan-Ling Su and Kwang-I Ying, openly apply Chinese elements in their piano works, while Hwei-Lee Chang tries to avoid direct use of the Chinese pentatonic scale. The piano works of Hwei-Lee Chang and Shyh-Ji Pan-Chew are chromatic and atonal, and show an economical usage of material.
