Utgifter för vissa ändringsarbeten på näringsfastigheter medför direktavdrag då de genom det så kallade utvidgade reparationsbegreppet i 19 kap. 2 § 2 st. Inkomstskattelagen klassificeras som reparation och underhåll. För att falla in under det utvidgade reparationsbegreppet får åtgärderna inte medföra en väsentlig förändring av fastigheten. Högsta förvaltningsdomstolen har i mål 2012 ref. 15 avgjort det enda målet i högsta instans rörande det utvidgade reparationsbegreppet sedan begreppet ändrades genom en lagändring 2000. Utmärkande för målet är att ett fastighetsförvaltande bolag vidtog ett stort antal åtgärder på fastigheten vid ett och samma tillfälle. Högsta förvaltningsdomstolen ansåg att omfattningen av åtgärderna gjorde att de inte föll in under det utvidgade reparationsbegreppet. Fastighetsägare kan av olika skäl välja att vidta ett flertal åtgärder på sin fastighet vid ett och samma tillfälle. Eftersom åtgärderna då kan förefalla att vara väsentliga på grund av dess omfattning, finns en risk att ändringar som egentligen är en anhopning av ändringsarbeten som faller in under det utvidgade reparationsbegreppet istället anses innebära en väsentlig förändring av byggnaden. I denna uppsats har författaren med utgångspunkt i HFD 2012 ref. 15 och underinstanspraxis undersökt huruvida ett fastighetsförvaltande bolag som vidtar ett flertal åtgärder på en fastighet vid ett och samma tillfälle försätts i en skattemässigt sämre situation än en fastighetsägare som väljer att sprida ut åtgärderna över tiden. Författaren anser att slutsatsen torde kunna dras att ett fastighetsförvaltande bolag som väljer att vidta ett flertal åtgärder på en fastighet vid ett och samma tillfälle försätts i en skattemässigt sämre situation än en fastighetsägare som väljer att sprida ut åtgärderna över tiden. / Expenses for certain alterations of commercial real estate qualify for direct tax deduction, as they are seen as repairs and maintenance through the extended concept of repairs in ch. 19 sec. 2 para. 2 of the Swedish Income Tax Act. To fall within the concept, the alterations must not result in a substantial change of the property. The Swedish Supreme Administrative Court has in the case HFD 2012 ref. 15 given the only ruling in the highest instance regarding the extended concept of repairs since the concept was changed through an amendment of the law in 2000. Distinguishing for the case is that it concerned a real estate management company that made several alterations on its estate at one time. The Supreme Administrative Court ruled that the width of the alterations did that they fell outside of the extended concept of repairs. Commercial real estate owners can for different reasons want to make several alterations at one time. Since the alterations in such cases can be seen as substantial, there is a risk that alterations which on its own fall within the extended concept of repairs are deemed to fall outside of the concept. In this thesis the author has investigated whether a real estate management company that makes several alterations at one time on a property is set in a disadvantageous tax position compared to a estate owner that choose to spread the alterations over time. The starting point of this investigation has been the Supreme Administrative Court’s ruling in HFD 2012 ref. 15 and rulings from the lower courts. The author establish that the conclusion can be drawn that a real estate management company that makes several alterations at one time on a property is set in a disadvantageous tax position compared to an estate owner that choose to spread the alterations over time.

Share-based payments have become a popular form of employee remuneration, largely for its potential to address the agency problem and are especially effective when made to senior employees. Accounting standards require companies to report share-based payments made to employees as expenses in their financial statements, but extant South African tax legislation does not permit a deduction where shares are awarded to serve as incentives for senior employees. This is due to the fact that the courts do not view the issue of a company‟s own shares as “expenditure”. South African tax legislation presently contains a special tax deduction for shares awarded to employees, but this provision‟s low monetary limit and restrictive requirements are considered to be inadequate, where the intention is to provide adequate incentives to senior employees in order to address the agency problem.
The objective of this study is to evaluate whether sufficient grounds exist, based on the principles of sound tax policy, for the legislature to enact a special tax deduction for share-based payments, which would serve as an adequate incentive to senior employees. Diploma thesis deals with subject of income tax allowances in European Union countries and its development since the nineties of 20th century. The main aim is to analyse trend in tax allowances transition from tax deductions to the systems, where tax credits prevail. The thesis also analyses the impact of standard tax allowances to the tax liability of average taxpayer. The impact of tax allowances is influenced by economic advancement, economic crisis and mainly by the way, how the tax system and system of social care is set. Most often the comprehensive income tax system with progressive tax rate schedule and flat tax system are being compared. In conclusion, the thesis is going to confirm or refute the persistence of the trend in prevailing tax credits in systems of tax allowances.

Companies use different forms of representation to promote business negotiations. The regulations for the right to deduction for the cost of representation are stated in Chapter 16 section 2 of the Swedish Income Tax Act (IL). According to the law there must be an im-mediate connection between the expenditure and the business practice and the claimed de-duction must be reasonable. The Swedish tax authority publishes general recommendations regarding representation which are used as guidelines for the tax payer to follow. The gen-eral provision about tax deduction can be found in Chapter 16 section 1 of the Swedish In-come Tax Act (IL), stating that expenses to acquire or retain income shall be deductible. Expenses that have an immediate connection with incomes count as tax deductible ex-penses in the business practice. The provision about deductible representation is in this manner more restrictive than the general principle in Chapter 16 section 1 of the Swedish Income Tax Act (IL). Taxation law is complicated and it may demand interpretation of the regulations. When gaps are present in regulations, certain interpretation methods and pro-cedures can be applied in order to increase the foreseeability for the tax payer. The Swedish tax authority’s general recommendation contributes to an increased foreseeability and con-formity since their instructions play a significant role regarding deduction for representa-tion. Personal living costs are not deductible according to Chapter 9 section 2 of the Swedish Income Tax Act (IL). The circumstances that need to be considered are differences between companies, type of movement, the form of representation and at how many occasions representation has occurred. Representation can adopt the form of bribes or other improper rewards as it lies in the na-ture of representation to function as an economic lubricant. According to Chapter 9 sec-tion 10 of the Swedish Income Tax Act (IL), expenses for bribes or other improper re-wards are not deductible. The meaning of improper is not further defined in the taxation regulations. Case law emanating from the criminal regulations in Chapter 17 section 7 and Chapter 20 section 2 of the Swedish Penal Code (BrB) may instead be used to clarify this conception. The aim of this thesis was to study elderly people’s experiences of and approach to their usage of home care services with tax deduction. The aim was also to describe how elderly people reason about their underlying motives of using home care service with tax deduction. The study is based on six qualitative interviews with people between the ages of 65 and 80, living in Nacka, Sweden. This thesis is a collaboration with Stiftelsen Stockholms läns Äldrecentrum/ Stockholm Gerontology Center and part of their follow up study concerning simplified administration for elderly people applying for home care services in Nacka. The theory of rational choice was used in the analysis of the results. The primary results showed that elderly people’s usage of home care services with tax deduction was limited though regular and consist mainly of basic domestic work. The overall experiences of using home care services with tax deduction were positive and described in terms of satisfaction and as a possibility of independence and influence regarding their needs of services and how they were executed. The results indicate that the usage of home care services with tax deduction is partly based on elderly people’s lack of confidence in publicly-financed elderly care. Due to the distrust in elderly care and the self-determing factors home care services with tax deduction generated, their choice of using home care services with tax deduction seemed more appealing than publicly-financed home care services.
