Abtract The main aim of this diploma thesis is to analyze the evaluation of tenders in public procurement according to their economic advantageousness and at the same time to compare the current stage of the ability of contracting authorities to evaluate this economic advantageousness compared to the stage of effect of the previous legal regulation. The background information for the topic of this diploma thesis were obtained from the legal regulation of the Czech Republic and the European Union, professional literature (legal commentaries), professional articles of periodical publications dealing with public procurement, internet sources and the case law of the Office for the Protection of Competition, administrative courts of the Czech Republic and the Court of Justice of the European Union. The analytical approach, linguistic, teleological and comparative method of legal interpretation were used. This diploma thesis consists of six main chapters. The introductory chapter discusses the purpose and aim of the legal regulation of public procurement and in the following chapter the part of the tender procedure and the basic principles of public procurement, crucial for the whole process of public procurement. Sveriges befolkning fortsätter att öka och en majoritet av Sveriges kommuner anger att deupplever en bostadsbrist. För att bemöta behovet av fler bostäder finns därför ett behov avfortsatt exploatering av kommunal mark där kommunernas process för tilldelning av mark tillbyggherrar benämns markanvisning. Fram tills 2015 har detta dock varit oreglerat vilket ocksåhar lett till stora variationer i anvisningsprocessen mellan kommunerna och få studier hargenomförts inom området.Syftet med denna studie är att beskriva markanvisningsprocessen i olika kommuner med fokuspå transparensen i utvärderingen av anbud samt vilken logik som styr detta. Målet är attdiskutera olika tillvägagångssätt inklusive dess förutsägbarhet och transparens med avstamp itidigare studier samt teorier för den rationella beslutsprocessen. Det empiriska materialetsamlades primärt in via intervjuer med respondenter från utvalda kommuner i kombinationmed information från offentliga styrdokument.Studiens resultat bekräftar de variationer mellan kommunerna som tidigare identifierats menger en ny inblick i hur utvärderingsprocesserna genomförs i praktiken. I studien föreslås enalternativ kategorisering av anvisningsmetoder samtidigt som resultaten visar på en generellotydlighet och brist på standardiserade utvärderingsprocesser. Avsaknaden av generellariktlinjer försämrar transparensen mot aktörer på marknaden och en trend att övergå till meriterativa beslutsprocesser minskar även förutsägbarheten. För att förbättra dessa aspekterinom markanvisningsprocessen krävs ytterligare forskning som studerar de kommunalaförutsättningarna, ökad kunskapsspridning och erfarenhetsutbyte tillsammans med endiskussion kring lämpliga metoder för att uppnå den största samhällsekonomiska nyttan. / The population in Sweden continues to increase and a majority of the municipalities state thatthey are experiencing a housing shortage. To meet the need for more housing, there isconsequently a need for continued exploitation of municipal land, where the municipalities'process for allocating land to builders is called land allocation. However, until 2015 this hasbeen unregulated, which has also led to large variations in the allocation process between themunicipalities and few studies have been carried out in the field.The purpose of this study is to describe the land allocation process in different municipalitieswith a focus on transparency in the tender evaluation and the logic that governs this. The aimis to discuss different approaches including its predictability and transparency with regard toprevious studies and theories for the rational decision-making process. The empirical materialwas collected primarily through interviews with respondents from selected municipalities incombination with information from public control documents.The results of the study confirm the variations between the municipalities, which werepreviously identified, but give a new insight into how the evaluation processes are implementedin practice. The study proposes an alternative categorization of allocation methods, while theresults show a general lack of clarity and standardized evaluation processes. The lack of generalguidelines reduces transparency towards market actors and a trend towards more iterativedecision-making processes also reduces predictability. In order to improve these aspects withinthe land allocation process, further research is needed which studies the municipal conditions,increased knowledge dissemination and exchange of experience together with a discussionabout suitable methods for achieving the highest socio-economic benefit.

Beställarens syn på offentlig upphandling av byggentreprenader / Purchasers’ perspective on procurement of public works

Syfte: Lagen om offentlig upphandling tillämpas av alla myndigheter som upphandlar varor, tjänster och byggentreprenader med skattepengar. Syftet med denna studie är att få insikt över hur offentliga beställare tänker när de genomför upphandlingar av byggnader. Målet är att lista de faktorer som påverkar beslutfattandet angående kort och långsiktiga aspekter när en offentlig myndighet skall handla upp byggentreprenader samt att få förståelse för vilka egenskaper krävs av beställare för att kunna utföra enupphandling. Metod: Genom litteraturstudier undersöks hur lagen om offentlig upphandling är utformad, och vilka arbetsuppgifter en beställare har. Vidare studeras hur det kan bli fel och vilka konsekvenser som kan förekomma ifall beställaren upphandlar olagligt. I intervjuerna framkommer praktisk erfarenhet som beställare och fastighetsförvaltare har av LOU, hur de arbetar för att få fram den produkt de vill ha och vad som anses vara besvärligt med lagen. Resultat: Studien visar att beställarens arbete är omfattande och risken är stor att göra fel i upphandlingen. Egenskaper som påverkar beställarens arbete inkluderar erfarenhet, kompetens, branschkunskap. I litteraturstudien framkommer att ett anbud kan vinnas med lägsta pris, eller med ekonomiskt mest fördelaktiga anbud. Det sistnämnda beslutas genom att analysera mjuka parametrar, exempelvis driftkostnader, anbudsgivares organisation, genomförandetider m.m. Faktorer som påverkar beställarens valmöjligheter angående kort- och långsiktiga aspekter beror på branschkunskap, LOU:s utformning, organisationens struktur, politiska policys, miljöcertifieringar, entreprenadformer och byggnadens användningsområde. Mjuka parametrar kan vara svåra att kontrollera och kan leda till överklagan. De som ofta analyseras i dagsläget utöver pris är entreprenörens organisation. Pris är alltid en parameter som beställare analyserar och ofta den enda parameter som granskas. Konsekvenser: LOU finns för att gynna konkurrensen i landet och i EU. Vissa delar av lagen hämmar beställarens valmöjligheter och kan göra deras arbete krångligt att genomföra. Det är bra för alla som arbetar med LOU att förstå hur en beställare resonerar kring kvalitéer för en byggnad och hur de arbetar med anbudsutvärderingen. Begränsningar: Studien är begränsad till offentliga beställare som arbetar i kommuner med ca 100 000 invånare i storlek. Intervjuerna är begränsade till beställare och förvaltare. Studien undersöker beställares resonemang som arbetar med byggentreprenadupphandlingar. / Purpose: The law of public procurement is used by all governments who procure products, services and public works using tax funds. The purpose of this study is to acquire an overview of how public purchasers’ reason regarding procurement of public works. The aim of this study is to list factors that affect decision-making regarding short and long-term aspects when a public government is to purchase public works, and to acquire an understanding of what personal qualities are needed to undergo a procurement. Method: Literature studies examine how the law of public procurement is designed,and what tasks a procurer has. Further studies are made on how things can go wrong and what the consequences can be if the purchaser undergoes an unlawful procurement. The interviews illustrate practical experience that procurers and property managershave on the law of public procurement, how they go about acquiring their wanted product and their views on what is problematic about this law. Findings: This study shows us that the procurers work is comprehensive and that there is a big risk of doing something wrong in the procurement. Qualities that affect aprocurer’s work include experience, competence and knowledge of the industry. The literature studies show that a bid can be won by the lowest cost, or by the most economically advantageous tender. The latter is determined through analysing soft parameters, such as operating costs, the bidders’ organisation, production times and more. Factors that affect the procurers options regarding short and long-term aspects depends on industry knowledge, configuration of the public procurement law, structure of the organisation, political policies, environmental certifications, type of contracting and the usage of the building. Soft parameters can be difficult to control and can lead to a judicial appeal. What is currently analysed other than price is usually is the organisation of the contractor. Price is always a parameter that procurers analyse and often the only one. Implications: The public procurement law exists to favour competition in the nationand in EU. Some parts of law inhibits procures’ options and can make their work difficult to carry out. How procurers’ reason on choice of qualities of buildings and how they work with evaluating bids are good things to know for anyone involved with the public procurement law. Limitations: This study is limited to public procurers working in municipalities of about 100 000 inhabitants. The interviews are restricted to procurers and property managers. The study investigates how buyers working with procurement of public works reason.

Den svenska upphandlingsprocessen och Trafikverket / The Swedish Public Procuration Process and the Transport Administration

The Swedish public procurement system is well regulated and developed and can also be very hard to understand. The public sector annually carries out public procurements to a large amount of money, and thus constitutes a large part of Sweden’s total GDP. The value of the purchases covered by the procurement acts was estimated at approximately SEK 782 billion in 2018. The purpose of public procurement is to guarantee competition on equal terms, contribute to the efficient use of society's resources and taxpayers' money, while promoting innovative solutions, and have environmental considerations in mind. The purpose of this paper is to examine what the procurement process looks like at one of Sweden's largest authorities, the Swedish Transport Administration (Trafikverket) and if improvements should be made. Questions about how tenders are received and evaluated, about what the market looks like, about what improvements that are desired and about what is good about the procurement process. These questions linked to a trust-based governing will be answered and discussed. The main conclusion that are made in this paper is that the Swedish procurement process require some improvements, but the hard thing is to decide what should be improved. My conclusion is that tender evaluation and the review process are areas that needs the most improvement from the empirical data that I have collected, but other areas came to discussion as well. A discussion regarding the trust-based governing is also included in the conclusion.

This thesis focuses on the issues related to the requirements of the contracting authority contained in the tender documents of public works contracts. In the first part, the basic concepts of public procurement are explained, where most attention is devoted to particular tender documents. The second part deals with the situation of public procurement in the Czech Republic, during the years following the opinion of the newly released energy efficient buildings. A case study is used to determine whether the use of economic net present value (NPV), as the evaluation criteria for the selected public order.
