Etnisk diskriminering- från arbetslivet till Arbetsdomstolen? : En granskning av Arbetsdomstolens praxis gällande etnisk diskriminering

The right to non-discrimination is a fundamental part of human rights. Sweden has enacted legislation which prohibits employers from discriminating or harassing employees and job seekers. Swedish authorities also receive a substantial amount of complaints concerning ethnic discrimination in the workplace every year and there are volumes of research showing structural injustices related to discrimination. Despite these facts few employers have so far been found guilty of discrimination on ethnic grounds in Swedish courts. This thesis aims to shed lights on and analyse how the Swedish anti-discrimination legislation is utilised in the Swedish Labour Court regarding discrimination and harassment on ethnic grounds. On the basis that very few lawsuits brought on behalf of employees/job seekers have been successful it is hypothesized that there are problems either with the form of the legislation or the assessment of the court. Firstly the shape of statutes, their legislative history and preparatory works are illustrated to create an understanding for the legal pre-conditions, thereafter the judgements of the Labour Court are analysed within the theoretical framework of the thesis – composed of Critical Race Theory and Sociology of Law. The study has shown problems concerning both the legislation and the assessment of the Labour Court. The legislation does not seem to embody the awareness of discriminating structures shown by the works of the preparatory committees. Further the assessments of the Court suggest a lack of understanding of the interaction between different pre-conditions and how these create a disadvantage for people of a minority standing which affects them both in the workplace and in the judgments of the Court.

The following article analyses the progressive process of deregulation of labour and social relations through the withdrawal of the State and public authorities, as well as public administration, control and direction of the relations of this type, both individual and collective. The comparison is made between the Spanish and Peruvian model, but especially between the regulation of the European Union and several Latin American countries. Stands in the article between “public” intervention – regulation legislative or Government– of “administrative” intervention, control by the administration of the employment relationship, especially in this case through the labour inspection bodies. / El artículo analiza el progresivo proceso de desregulación de las relaciones laborales y sociales a través de la retirada del Estado y de los poderes públicos, así como de la Administración Pública, en el control y dirección de las relaciones de este tipo, tanto individuales como colectivas. La comparativa se efectúa entre el modelo español y peruano, pero muy especialmente entre la regulación de la Unión Europea y de diversos países de América Latina. Se distingue en el artículo entre la intervención “pública” –regulación legislativa o gubernamental– de la intervención “administrativa”, control por parte de la Administración de las relaciones laborales, especialmente en este supuesto a través de los órganos de la inspección de trabajo.

Summaries in English and Afrikkans / The aim of this thesis is to investigate the labour law position of South African farm workers. For three and a half centuries farm workers constituted the most neglected group in the South African labour force. Consequently, an understanding of their present position can only be obtained by investigating their labour history. As in other parts of the world, farm workers in South Africa held a subordinate position to agricultural employers. Discrimination against black persons added to the inferior socio-economic and political position of South African farm workers. White farmers occupied a strong political position during most of the time under investigation, which enabled them to institute and apply discriminatory legislation and informal methods to overcome labour shortages. The freedom of movement of black people and their access to land were restricted to create a cheap immobile labour force. During the 20th century farmers prevented the inclusion of farm workers in labour legislation by exercising their political influence. Pressure by industrial trade unions and encouragement by the International Labour Organisation (ILO) resulted in the adoption of the Agricultural Labour Act which made labour legislation applicable to farm workers, but precluded them from striking and made allowance for longer working hours than for industrial workers. The new political dispensation facilitated the inclusion of farm workers in general labour legislation without any discriminatory exceptions and land reform legislation now protects farm workers against arbitrary evictions. A bill of rights furthermore guarantees the rights of farm workers which were previously violated. It would superficially seem that farm workers' problems are something of the past. Farm workers, however, remain handicapped in exercising their new rights by historical factors and circumstances peculiar to the agricultural sector. Legal comparison with Ontario and California confirms that legislation alone is insufficient to empower farm workers. It is recommended that the government amend existing legislation to accommodate the special needs of farm workers and that relevant ILO conventions, especially Convention 141 of 1975, be ratified to aid the development of unions for farm workers. Searching for Equality : Sex Discrimination, Parental Leave and the Swedish Model With Comparisons to EU, UK and US Law

Achieving economic equality between men and women is a challenge to every country. The approach taken politically and legally in Sweden is to encourage a greater economic independence of women from the family through paid work, as well encouraging men to assume a greater share of unpaid work, particularly parental leave, resulting in a lessening of the double burden of work for women. These efforts have made within the context of the parameters of the Swedish model with respect to labor, in which the preferred mechanism of resolution is agreement between the social partners and not legislation. To this end, the Swedish collective agreements have been analyzed specifically with respect to taking parental leave. The other parameters in the area of sex equality applicable to the Swedish system are those as defined by Community law, specifically the equal treatment and equal pay directives, against which the Swedish regulations as well as case law applying such are assessed. This work takes the Swedish approach to the problem of economic equality and compares it to the approaches as found in EU, UK and US law. In the UK, there has been a recent emphasis on a family friendly workplace, which is to be achieved at least in part through flexible working. The American approach has focused on discriminatory behavior as a societal phenomena. Comparisons to these two national systems are interesting also from an industrial relations aspect, as Sweden is the most unionized at 80 %, followed by the UK and then by the US at only 15 %. The findings of this thesis suggest that Sweden may need to reassess its approach to equality between the sexes, as well as issues of discrimination in general, incorporating aspects of access to justice into the legal system, as well as reassessing the role of the labor unions, and the Swedish model, with respect to such questions in general...

It seeks to identify models of procedures used in the labor lawsuit, mainly at procedure accelerated and its efficiency within the organizational structure of the labour court. It also shows the necessity of compliance with law number 9.957/2000 as a feasible tool for effective adjudication of the labour Court in cases with amount estimated is below forty salaries. In order to achieve these aim, we approached initially background´s law aspects to reach at justice, constitutional principles of reasonable timing of proceeding and legal certainty, so the comprehension and union of labour laws. Another aspect of this research shows the search for revolutionary changes in the organization structure of the labour court for a hole applicability of the procedure accelerated, due to overload of cases in progress at court. We attempt to analyze the labour court employee’s point of view about the accelerated procedure, activy as an effective tool in seeking a quickly adjucation and finally efficient. Finally the proposal is the creation of special courts to trial of labor cases in progress before the accelerated procedure, as a tool to speed up the law activity and decrease the time of the labor case. / Através desta pesquisa, analisa-se a lei 9.957/2000, que instituiu o procedimento sumaríssimo no processo do trabalho. Procura-se identificar os modelos de procedimentos utilizados na tramitação do processo trabalhista, notadamente o procedimento sumaríssimo e sua eficácia, dentro da estrutura organizacional da Justiça do Trabalho. Busca-se demonstrar a necessidade do cumprimento da lei n. 9.957/2000, como instrumento viável para uma efetiva prestação jurisdicional da Justiça do Trabalho, nas ações de valor abaixo de quarenta salários mínimos. Para atingir tais propósitos, abordam-se, inicialmente, aspectos teóricos fundamentais relacionados ao acesso à justiça, aos princípios constitucionais da duração razoável do processo e da segurança jurídica e, ainda, a interpretação e integração da legislação trabalhista. Em um segundo momento, demonstra-se a necessidade de reforma na estrutura organizacional da Justiça do Trabalho para uma integral aplicabilidade do procedimento sumaríssimo, em face da sobrecarga de processos em tramitação nas varas do trabalho. Analisa-se, também, a visão dos operadores do Direito do Trabalho, jurisdicionados e serventuários da Justiça do Trabalho sobre o procedimento sumaríssimo, na qualidade de instrumento eficaz na busca de uma prestação jurisdicional célere e, por isso, efetiva. Por fim, expõe-se a proposta de criação de varas do trabalho específicas para julgamento de processos tramitados pelo procedimento sumaríssimo, como instrumento de celeridade da atividade jurisdicional e de redução do tempo de duração do processo trabalhista.

The jurisdictional conflict between labour and civil courts in labour matters : a critical discussion on the prevention of forum shopping

The Labour Relations Act 66 of 1995 provides an elaborate dispute resolution system which seeks to resolve disputes in a speedy and cost-effective manner. However, this system is faced with a number of challenges. The application of common law and administrative law causes tension between the Labour Court and civil courts. It creates uncertainty in the development of our labour law jurisprudence and also leads to the problem of forum shopping. These problems in effect undermine the objectives of the Act. This dissertation analyzes problems in the LRA and other legislations leading to forum shopping. It also analyses the view of the courts on this problem and further expounds a number of possible solutions. The analysis revolves mainly around an observation of South African literature and case law. / Mercantile Law / LL.M.
