A tese trata do princípio da diferença na teoria da justiça de John Rawls, confrontando-o com a alegada raiz kantiana desta teoria, e sustentando que ambos – o princípio da diferença e a interpretação kantiana de Rawls – seriam incompatíveis, em razão do caráter conseqüencialista do princípio. Como resultado, nos escritos tardios de Rawls, o princípio da diferença passa a ocupar um espaço secundário na teoria da justiça, assim como a própria interpretação kantiana. / The thesis deals with the principle of difference in John Rawls’s theory of justice, facing it with the Kantian interpretation, and holds that both – the principle of difference and Rawls’s Kantian interpretation – are incompatible, due to the consequentialist character of the principle of difference. As a result, in Rawls’ later writings, the principle of difference abandoned, as well as the Kantian interpretation.

A tese analisa a produção jurisprudencial dos direitos humanos no Supremo Tribunal Federal (STF), defendendo o argumento de que, no quadro brasileiro, o STF ao interpretar a normativa vigente atua na construção desses direitos. Reconstruindo o cenário de afirmação dos direitos humanos a partir da Carta da ONU (1945) e da Declaração Universal dos Direitos Humanos (1948), o estudo questiona o consenso em torno dos direitos humanos propondo uma leitura ampliada que os vincula aos debates sobre justiça. São objetivos do trabalho, que faz uso de pesquisa bibliográfica e documental (i) aferir qual enquadramento os direitos humanos recebem no STF, o que envolve investigar, no recorte selecionado entre 1988 e 2012, como tem sido construída a categoria jurídica direitos humanos no tratamento jurisprudencial desse Tribunal e (ii) investigar com base em quais fundamentos esse enquadramento se apresenta. O marco teórico da Teoria Integrada da Justiça de Nancy Fraser é utilizado para problematizar a concepção contemporânea de Direitos Humanos, bem como o desenho institucional do STF. A análise dos acórdãos coletados é feita com tratamento quantitativo e o adensamento do material é feito por meio de uma tipologia de casos, que orienta a abordagem qualitativa. O trabalho é concluído apontando a existência de concepções de direitos humanos que não condizem com a conjuntura de aceitação na qual esses direitos estariam assentados. / This thesis analyzes the jurisprudential production on human rights in the Federal Supreme Court (STF), defending the argument that, in the Brazilian context, when interpreting the current legislation, the Court acts towards the construction of these rights. Reconstructing the scenario of human rights extracted from the UN Charter (1945) and the Universal Declaration of Human Rights (1948), the study criticizes the consensus on human rights proposing an extended reading that relates to the debates about justice. Making use of bibliographical and documentary research, the objectives of the work are: (i) assessing what is the framing that human rights receive in the Federal Supreme Court during the period between 1988 and 2012, investigating how the category \"human rights\" has been built in the judicial treatment of this court and (ii) determining on what grounds such framing is based on. The theoretical framework of \"Integrated Theory of Justice\" by Nancy Fraser is used to discuss the contemporary conception of human rights as well as the institutional scheme of STF. The analysis of the collected trials is based on a quantitative treatment and the deepening of the material is made by means of a typology of cases that guides the qualitative approach. The conclusion of the work emphasizes the existence of notions of Human Rights that are not consistent with the environment of acceptance of the situation upon which these rights would be established.

Diploma thesis "Paradigma of Democracy in 20th. century" dissert upon modern theory of democracy. Thesis try to point differences in interpretation of the democracy conception on the basis of four modern theory democracy, which were interpreted in 20th century. Diploma thesis describe these doctrines: theory of competition democracy by J. A. Schumpeter; theory of pluralistic democracy and theory of polyarchy by R. A. Dahl; theory of justice by J. Rawls. At the close of thesis is short comparative analysis based on the main ideas these four democratic theory. Comparative analysis try to demonstrate main differences in the interpretation of democracy idea. It is necessary to understand, that "democracy" ins't exactly single valued definition, but democracy is wide spectrum of various doctrines. Transitioning towards renewable energy sources is crucial in mitigating climate change and reducing greenhouse gas emissions. Global energy consumption is expected to increase 50 % by 2050, meaning one of today’s main challenges is complying with those demands without tampering with the uncertainties of global climate change. To address climate change renewable energy sources are essential and wind power plays a great role in the energy matrix. Brazil is one of the front runners in the energy transition, where wind power has expanded since the early 2000’s. The state of Bahia, in Northeastern Brazil, is currently the region where wind energy is expanding the most. However, conflicts related to territoriality and justice aspects are increasing in the state due to the fast-expanding wind energy sector. This study applies document and content analysis to explore the multiple narratives regarding the wind energy expansion in the state of Bahia, Brazil. Framing theory and theories addressing power struggles and conflicts in relation to the energy transition will guide the analysis of the 27 documents included in the material.  Based on the analysis of the Bahian case, this study shows that different actors frame the matter of wind energy expansion differently depending on their positionings. Civil society and local perspectives are not present in policies and decision-making processes, including the planning and installation of wind energy parks in the studied case. The results suggest that inclusion and participation of local actors, stakeholders and the civil society is essential to ensure a just and sustainable transition to clean energy sources.

Ondřej Lánský The Examination of One Form of the Atlantic Modernization's Moral Background Abstract This thesis deals with critique of fundamental moral pattern of the Atlantic social space, that shapes some important features of social, political, and human action in the global era and endorses legitimacy of the reigning social order. The main task of this thesis is to show pathological moments of the contemporary development of global society through comparison of some constitutive features of Atlantic and Latin-American societies. The most important theoretical basis for this thesis is Axel Honneth's theory of recognition. As articulations of constitutive features of social normativity (ergo as expressions of shared social imaginaries of social configuration) are used chosen social philosophical concepts: John Rawls' liberalism and Enrique Dussel's philosophy of liberation. The thesis contains therefore four steps in three main chapters. Firstly the author sociologically analyzes the concept of social esteem in the context of theory of recognition. Secondly he examines John Rawls' normative theory of justice. Thirdly the author points some aspects of Rawls' theory, which allow certain interpretation and critique of the social esteem and of the liberal definition of moral legitimacy of the Atlantic...

Problems With the Veil of Ignorance, And How We Might Solve Them

Ever since Rawls published The Theory of Justice (1971/2009), the theory itself, along with many of its components, have been subject to intense debate. Both the "original position" and the "veil of ignorance" have been argued to be too unrealistic since the restriction on information makes it impossible to apply in the real world. Furthermore, it is argued that this restriction is too extensive, in that it excludes information that is necessary for making a just decision, and thus, that it contravenes fundamental egalitarian principles, making it less just than it should be. However, there still seems to be something appealing about the concept of the veil of ignorance and results from various experiments that have used it have shown results that indicate it has an effect, which implies that the concept might have some use after all. In this paper, I will argue for a modified version of Rawls' veil of ignorance that, while limited in its available applications, might both serve a practical use in society to increase justice and have a low risk of obtaining inegalitarian results. I will do this by first summarizing Rawls' theory of justice with a focus on his veil of ignorance. Second, I will present and discuss the critiques from various philosophers. Third, I will discuss the implications of several experiments that make use of the veil of ignorance, including the issue that these experiments are 'one-shot', or single iteration, experiments. Finally, I will detail my version of the veil of ignorance and explain why it both meets the critiques of the original veil of ignorance and could potentially serve a practical use in society.

Rawls’s distributional justice in Swedish healthcare / Distributionsrätt enligt Rawls i svensk sjukvård

Everyone will probably be given healthcare at some point in life, and might ask themselves how and why the healthcare is distributed the way it is in Swedish society. I also believe this is a matter where one would like the distribution of healthcare to be just. When I have read about different distribution theories, I have noticed similarities between the healthcare in Sweden and Rawls theory of justice, and the aim of this paper is to compare the Swedish ethical consideration on healthcare distribution with Rawls’s ideas. I find the three ethical principles stated by the Swedish Health Care and Medical Priorities Commission conform quite well with Rawls’s two principles of justice. They agree on equal healthcare distribution of resources on a population scale and that the ones in most need should be prioritised. Although, Rawls and Norman Daniels believe that only the equal opportunity to healthcare in order to strive for one’s life plans is valued, while the ethical principle of Swedish healthcare also adds an egalitarian adjustment of resources to people not living healthy. Normans’ interpretation of Rawls ideas argues to elevate individuals’ health to what is thought of as normal biological functioning, while my interpretation of Swedish ethical principles do not forbid elevating beyond the normal functioning. It might be impossible to make an ideal distribution of healthcare completely just, but I believe the Swedish healthcare distribution would be more just if it adheres more to Rawls’s principle of justice.
