O texto discute o atendimento de crianças livres no período de 1871 a 1888 na província de São Paulo. O tema é relevante em pesquisas do campo da historiografia educacional e da história da infância brasileira, no sentido que visa contribuir com o número, ainda escassos de pesquisas sobre a temática da história da criança negra na província de São Paulo. Ao longo do texto utilizamos o termo escravizado em vez de escravo em conformidade os estudos de Munanga (2004), que não consideram que os negros tenham nascido nessa condição nem tampouco tenham propensões biológicas para a vida em cativeiro. Procuramos, na parte inicial da pesquisa, apresentar um levantamento sobre dissertações, teses e artigos cujos temas conjugassem com os objetivos desta dissertação. Esses estudos relatam o processo de escolarização da população negra e também descrevem a situação da infância escravizada e da infância livre em periodização próxima ou semelhante à deste estudo. No processo metodológico, recorremos a 5 tipos diferentes de fontes documentais: relatórios do Ministério da Agricultura, anais dos Congressos Agrícola do Recife e do Rio de Janeiro, ambos realizados no ano de 1878, registros de batismo de crianças negras livres, exemplares do jornal A Redempção e o 1º Recenseamento Nacional do Império Brasileiro de 1872. As fontes são analisadas de maneira conjugada, dialogando entre si de forma a auxiliar na composição do cenário do atendimento público das crianças negras livres na província de São Paulo. O recurso metodológico utilizado na análise do corpus documental varia conforme a natureza de cada fonte, sendo empreendidos, sobretudo, recursos quantitativos e qualitativos. A pesquisa revela a ausência de dados sobre as crianças negras livres, assim como a inexistência, na província de São Paulo, de instituições voltadas para o seu atendimento, como localizamos em outras províncias do Império brasileiro. Com base nas fontes analisadas, é possível verificar que as crianças negras livres em São Paulo não foram entregues ao Estado. / The text discusses the care of children free for the period 1871 to 1879 in the province of São Paulo. The theme is relevant to research in the field of educational historiography and the history of Brazilian children in order to understand the care initiatives proposed by the province of Sao Paulo to the sons and daughters of enslaved families. Throughout the text we use the term \"enslaved\" instead of slave in accordance Munanga studies (2004), which do not consider that blacks were born in this condition have neither biological propensities to life in captivity. Sought, in the early part of the research, presenting a survey of dissertations, theses and articles whose topics conjugate with the objectives of this dissertation. These studies report the education process of the black population and also describe the situation of children and childhood in bondage free periodization close or similar to this study. For this study, we used five different types of documentary sources: reports from the Ministry of Agriculture, Agricultural annals of Congress in Recife and Rio de Janeiro, both held in 1878, records of naive, copies of the newspaper The Redemption and the actual text of the Free Womb Law, the 1st national census of the Brazilian Empire in 1872 .The sources are analyzed so together, talking among themselves in order to assist in the composition of the scene of public service free of black children in the province of Sao Paulo. The methodological approach used in the Corpus analysis varies depending on the nature of each source, being undertaken, especially, quantitative and qualitative features. The research reveals the absence of data on free black children, as well as the absence, in the province of Sao Paulo, the institutions for their care, and was located in other provinces of the Empire of Brazil. Investiga a Instrução Pública Primária na Província da Bahia, e a legislação educacional que dava sustentação. Discute a iniciativa de professores de criarem escolas para instruírem os ingênuos. Considera que a Lei de 1871 possibilitou experiências educacionais aos filhos de mulher escrava, nascidos após a data da lei. Os relatórios dos Presidentes de Província e dos Diretores Gerais de Instrução Pública da Bahia, ofícios, correspondência de professores, presidentes de comissão literárias e jornais foram importantes para esta pesquisa. O trabalho fundamenta-se na historiografia da escravidão influenciada pelas teorias de E. P. Thompson, que trabalha legislação e direito relacionados a experiências de sujeitos comuns. Esta historiografia elegeu a legislação abolicionista enquanto estratégia política utilizada pelos sujeitos sociais envolvidos no processo de emancipação e abolição da escravidão no Brasil nas três últimas décadas do século XIX. / ABSTRACT This dissertation examines the debate on Education naive , free children born to enslaved women , under the law 2,040 of September 28, 1871 , known as Law of the Free Womb or Rio Branco law , Bahia 1871-1889 . Investigates the Primary Public Education in the Province of Bahia , and educational legislation that gave support . Discusses the initiative to set up schools for teachers to instruct naive . Considers that the 1871 law allowed educational experiences to the children of slave women born after the date of the law . Reports from the Presidents of the Province and the General Managers of Public Instruction Bahia , crafts , matching teachers , and committee chairmen of literary journals were important for this research . The work is based on the historiography of slavery influenced by the theories of E. P. Thompson working legislation and related rights experiences of ordinary subjects . This historiography that elected the abolitionist legislation as a political strategy used by social actors involved in the abolition of slavery and emancipation process in Brazil in the last three decades of the nineteenth century.

L’ectogestation : quels impacts sur les statuts moral et légal de l’entité en utérus artificiel ?

La recherche visant à développer des prototypes d’utérus artificiels (UA) est motivée par le besoin d’améliorer la prise en charge de grands prématurés humains. Plusieurs sont d’avis que les UA finiront par soutenir le développement de fœtus – que nous appelons « entités en UA » – à un stade de plus en plus tôt dans la gestation, soulevant ainsi plusieurs questions éthiques. À l’aide d’une revue narrative systématisée, ce mémoire analyse les impacts possibles de l’ectogestation sur les aspects moraux ayant une incidence sur le statut légal de l’entité en UA au Canada. Il amorce également une réflexion à savoir quel peut être son statut moral et/ou légal et par extension, quelles sont les implications éthiques et juridiques liées à son traitement. Pour ce faire, différentes écoles de pensée concernant la nature de l’embryon/fœtus et de la personne sont présentées. Ensuite, certains aspects pertinents au statut légal de l’entité en UA sont analysés dont ceux de la naissance et de la viabilité. Finalement, les aspects potentiellement problématiques de ces deux concepts en contexte d’ectogestation sont expliqués, notamment par rapport au droit à l’avortement que nous reformulons comme étant l’« arrêt de l’existence de l’entité en UA » lorsqu’il est question d’ectogestation. Considérant que la valeur morale accordée au produit humain de la conception diffère largement selon les écoles de pensée, et que le droit comporte certaines lacunes pour appréhender les questions relatives au statut légal de l’entité en UA, une analyse bioéthique est nécessaire pour bien encadrer et mener cette réflexion. / The research surrounding the development of artificial womb (AW) prototypes is motivated by the need to improve the treatment for extremely premature infants. Many believe that AW will play a role in supporting the development of the fetus, which we refer to as an “entity in an artificial womb” throughout this thesis, at increasingly earlier stages of gestation, which raises many ethical and legal issues. Using a systematised narrative review, the present master’s thesis analyzes the possible impacts of ectogestation on the moral aspects affecting the legal status of entity in AW in Canada. It also addresses its possible moral and/or legal status and, by extension, the ethical and legal implications related to the treatment of such entities. To do so, it presents different schools of thought concerning the nature of embryos/fetuses and persons, and analyzes relevant aspects concerning the legal status of the entities in AW, especially those relating to birth and viability. It explains how these two concepts might be problematic in the context of ectogestation, especially with respect to abortion rights – in the context ectogestation, we refer to abortion as “termination of the entity in an artificial womb”. Considering that the moral value attached to the result of conception differs substantially from one school of thought to another, and that shortcomings in the law may hinder the understanding of issues related to the legal status of the entity in an AW, a bioethical analysis is necessary to guide and carry out this reflection.

Tänkandet som ett välvande sker genom att ord revolverar [revolvere]. Detta leder till upptäckten av att vara involverad [involvere] i världen. Eftersom man är involverad vill man försöka evolvera [evolvere] det i vilket man är involverad: strukturen är volvere–revolvere–involvere–evolvere. Detta hänger samman med varats utgjutning [diffusio] som ingjuts [infusio] i människorna, varför människan ur förskingring vill fusionera [fusio] sin verklighet. Ur detta uppstår confusio. Hos Augustinus bestäms människan av ett tredelat confusio: kosmologiskt som upphov, biologiskt som skam och kognitivt som förvirring. / The following thesis takes as its point of departure the implicit Augustinian view of thinking. Besides his own definition of thinking as a ”collecting” in the Confessions (and his view of thinking in On the Trinity), Augustine also suggests thinking as volving [volvere]. This kind of thinking is structured by words revolving [revolvere] in the mind. This, is suggested, by necessity leads to an involvement [involvere] in the world. The fact of being involved in the world also means striving to evolve [evolvere] that in which you are involved: the structure is volvere–revolvere–involvere–evolvere. The aim of this thesis is to envelope and place what for Augustine is predominantly a negative notion of confusio in the right manner as a generative and dynamic notion, structured in a threefold manner: cosmologically as origin, biologically as shame, cognitively as confusion. These being three aspects defining the ego.
