EU-ACP economic agreements and WTO/GATT compatibility : options for ACP countries under Cotonou Agreement

The member states of European Union (EU) and a group of African, Caribbean and Pacific (ACP) states are currently negotiating for new trading agreements compatible with World Trade Organization‘s (WTO) rules. Whereas both the EU and the ACP states are in agreement that the new trading arrangements must be WTO compatible, there is no consensus on the format of the new trading agreements. The EU has insisted that the new trading arrangements should be in the form of free trade agreements, established under Article XXIV of General Agreement on Tariffs and Trade (GATT). Unlike the previous EU – ACP trade agreements which were non – reciprocal, Article XXIV requires that the new trading agreements should be reciprocal. Consequently the EU has gone ahead to negotiate for reciprocal Economic Partnership Agreements (EPAs) with some of the ACP states. Some ACP countries which are opposed to reciprocity have proposed that the new trading arrangements should be established under the provisions of Enabling Clause. Others have suggested that EU should attempt to apply for a WTO waiver. The Cotonou Agreement, under which the new trading agreements are being negotiated, provides that in case of those countries which are not ready to negotiate for EPAs, the EU should examine alternative possibilities, in order to provide these countries with a new framework for trade which is equivalent to their existing situation and in conformity with WTO rules. So far no alternative trading arrangements have been proposed. Although some ACP countries have agreed to negotiate for Economic Partnership Agreements under article XXIV of GAAT, there is no consensus on the interpretation of key provisions of Article XXIV. Under Article XXIV, the parties are required to remove substantially all trade barriers between themselves within reasonable time. The meaning of the phrases 'substantially all' and 'reasonable time‘ has remained controversial with each party giving an interpretation that favours its interests. Lack of consensus on the meaning of these phrases has hindered the conclusion of negotiations for EPAs. In a nutshell, the question of WTO compatibility presents the biggest hurdle to the conclusion of the new trading arrangements between the EU and the ACP group. This paper is an evaluation of the options available to the ACP countries to conclude WTO compatible trading arrangements with the EU. Chapter one of this paper is an introductory chapter which offers an overview of the entire paper. Chapter two sets out in details the historical background of the economic relationship between the EU and the ACP states. This chapter illustrates the historical background from which the new trading agreements have evolved to help the reader understand certain key features of the current economic partnership agreements. Chapter three looks at the GATT/WTO provisions relevant to the establishment of WTO compatible trading arrangements between EU and ACP countries. Particular emphasis is placed on Article XXIV, the Enabling Clause and the WTO waiver. Chapter four is the main chapter in which the paper explores the possibilities of concluding WTO compatible trading agreements under Article XXIV, Enabling clause and the WTO waiver. O orgão de solução de controvérsias da OMC e sua eficácia: análise sob a perspectiva do adensamento de juridicidade / WTO dispute settlement body and its effectiveness: a thickening of legality perspective

O presente trabalho analisa o tema da eficácia das decisões e recomendações do Órgão de Solução de controvérsias da OMC em face de seu adensamento de juridicidade recente. A expressão cunhada pelo Professor Titular Celso Lafer busca demonstrar a transformação pela qual passou a solução de controvérsias no sistema multilateral de comércio com a transição do GATT para a OMC. Nesse sentido, a dissertação analisa a eficácia das retaliações e sanções comerciais previstas na OMC, especialmente as contramedidas (Artigo 4.10, do ASMC) e a suspensão de concessões ou outras obrigações (Artigo 22, do ESC), determinando o objetivo esperado pelos membros da OMC na adoção de tais remédios jurisdicionais. Esta análise é feita a partir da eficácia entendida como um comportamento, uma resposta em relação a uma norma, em que é possível uma norma ter uma sanção prevista e, mesmo assim, não ser cumprida. O corte metodológico da pesquisa se concentrou na perspectiva da discrepância de poder econômico entre os membros da OMC, opondo os países desenvolvidos aos países em desenvolvimento e de menor desenvolvimento relativo, em uma abordagem sobre a aplicação desses remédios para os dois últimos. Nesta etapa, verificou-se um nível de eficácia diminuto em que não se consegue alcançar o objetivo das retaliações previsto nos acordos e na jurisprudência: a indução ao cumprimento. A verificação dos casos levou à conclusão de uma eficácia parcial dos remédios jurisdicionais previstos na OMC, de tal sorte que os países em desenvolvimento e de menor desenvolvimento relativo enfrentam dificuldades adicionais para obter a resposta adequada aos casos por eles apresentados ao Órgão de Solução de Controvérsias. Dessa forma, são analisadas as propostas no âmbito da Rodada Doha para elevar o nível de eficácia dessas medidas para o grupo de países aqui especificado, adotando-se uma combinação de possibilidades para o bom funcionamento do sistema, dentro de seus propósitos, dentre as quais podem ser mencionadas a retaliação coletiva, a retaliação cruzada, a compensação monetária retroativa, além dos problemas de qualificação técnica, de especialistas em comércio internacional e dos elevados gastos para levar adiante uma disputa na OMC enfrentados pelos países em desenvolvimento e de menor desenvolvimento relativo. / This paper examines the effectiveness of the decisions and recommendations of WTO Dispute Settlement Body by the perspective of its recent \'thickening of legality\'. The expression coined by Full Professor Celso Lafer seeks to demonstrate the transformation undergone by dispute settlement in the multilateral trading system due to the transition from ATT to WTO. The diplomatic negotiation permeated by the political component - which shows the differences between developed and developing countries in the GATT - was not fully eradicated in the DSU and, in this research, it is understood that this is an intrinsic feature to the system, which it could not do without. In this sense, the dissertation examines the effectiveness of the retaliations and the trade sanctions envisaged in the WTO, especially countermeasures (Article 4.10 of the SCM) and the suspension of concessions or other obligations (Article 22 of the DSU), determining the expected goal by WTO members in adopting such legal remedies. This analysis is done from the perspective of the effectiveness understood as a behavior, a response in relation to a rule, in which is possible for a rule to provide for a sanction and still not be enforced. The methodological approach of the research has focused on the prospect of economic power discrepancy between WTO members, opposing developed countries to developing countries and least developed countries, aiming to analyze the implementation of the remedies for the last two. At this stage, it was verified a short level of effectiveness in which it was not possible to achieve the objective set out for the retaliations in the agreements and in the jurisprudence: \"to induce compliance.\" The verification of the cases led to the conclusion of a partially effectiveness of the legal remedies predicted in the WTO, in such a way that the developing countries and least developed countries face additional difficulties in order to receive the appropriate response to the cases submitted by them to the Dispute Settlement Body. Thus, the proposals in the Doha Round to raise the level of effectiveness of these measures for the group of countries here specified are analyzed, adopting a combination of possibilities for the proper functioning of the system within its purposes, among which may be mentioned collective retaliation, cross-retaliation, retroactive monetary compensation, beyond technical qualification problems, international trade specialists and the high expenses to carry out a dispute in the WTO faced by developing countries and least developed countries.

No. of bitstreams: 1 Fernanda Vieira Kotzias.pdf: 3471482 bytes, checksum: 67b61f757300f836852265e45b5ff0a5 (MD5) Previous issue date: 2018-11-05 / The Trade Facilitation Agreement (TFA) represents an important step for Members of the World Trade Organization (WTO) towards the reduction of bureaucracy and transactional costs, as well to the increase in the transparency of foreign trade operations, in particular where Customs are concerned. The inclusion of this topic in WTO negotiations’ agenda was due to the perception that, as trade has become more liberalized, a new international regulatory architecture emerged, shifting the focus of policymakers from tariff barriers to other impediments to the cross-border movement of goods, particularly to those of an administrative and logistical nature. After almost twenty years of negotiations on its structure and content, the TFA was signed in 2013 during the Bali Conference and became effective in February 2017. Even though Brazil has only ratified the agreement in 2018 by means of Decree n. 9.326/2018, the Brazilian Government submitted its notification to WTO in 2016 designating 95.8% of the TFA commitments to be implemented immediately. The remaining 4.2% were scheduled to be implemented until December 2019. This was a bold position and has generated great expectations for operators and other interested parties in international trade. Nevertheless, Brazil remains poorly evaluated by national and international indicators that measure transaction costs, as most of the measures under the TFA continue to be totally or partially disregarded in practice, which is a major complain from the Brazilian private sector. In this context, the research problem addressed in this thesis is to identify the bottlenecks to the greater efficiency of the management of foreign trade in Brazil and evaluate the necessity of political, institutional and normative reforms and adjustments in order to foster the effective implementation of WTO trade facilitation obligations and increase Brazil’s integration into international trade. The proposed analysis is based on extensive bibliographical and documentary research, exploring doctrinal sources, national jurisprudence and WTO precedents to discuss the implications of the commitments signed within the scope of the WTO in the Brazilian legal system. From this, an attempt was made to inductively analyze the barriers to trade facilitation and legal uncertainty faced by trade operators. Finally, the research problem is addressed based on the study of foreign models and recommendations of international organizations. This thesis was structured in four chapters, in order to first present important concepts and delimitations in terms of trade facilitation and the way in which international obligations are internalized into the national legal order and discuss the Brazilian political-institutional structure regarding the regulation of foreign trade matters. Finally, based on the understandings and clarifications presented, recommendations are proposed for the implementation of trade facilitation in Brazil. Additionally, possible actions and reforms are directed to each of the main powers and articulators of Brazilian foreign trade individually, which are the Legislative Branch, the Executive Branch, the Judiciary Branch and the private sector / O Acordo sobre a Facilitação do Comércio (AFC) representa um passo importante dos Membros da Organização Mundial do Comércio (OMC) quanto à desburocratização, redução dos custos de transação e aumento da transparência nas operações de comércio internacional, sobretudo na atuação das Aduanas. A inclusão do tema na pauta de negociações da OMC deve-se à percepção dos Estados de que, à medida que o comércio se tornou mais liberalizado, houve uma mudança na arquitetura regulatória internacional, que direcionou parte do foco de contenção e eliminação de barreiras tarifárias para outros impedimentos ao movimento transfronteiriço de mercadorias, particularmente àqueles de natureza administrativa e logística. Após quase vinte anos de negociações sobre a estrutura normativa e o conteúdo do acordo, o AFC foi assinado em 2013 durante a Conferência de Bali, entrando em vigor em fevereiro de 2017. O Brasil ratificou o AFC apenas em abril de 2018, por meio do Decreto 9.326/2018, ainda que o governo brasileiro tenha notificado formalmente a OMC em 2016 sobre o seu compromisso de implementar imediatamente 95,8% do conteúdo do acordo, deixando apenas os 4,2% das obrigações restantes para implementação posterior, marcada para ocorrer até dezembro de 2019. Trata-se de posição arrojada e que despertou grande expectativa dos operadores e demais interessados no comércio internacional. Ocorre que o Brasil continua mal avaliado pelos indicadores nacionais e internacionais que medem custos de transação e grande parte das medidas contidas no acordo seguem sendo descumpridas total ou parcialmente na prática, sendo este um grande ponto de descontentamento do setor privado brasileiro. Nesse contexto, o problema de pesquisa que se pretende endereçar na presente tese volta-se à identificação dos gargalos à maior eficiência da gestão do comércio exterior brasileiro e à avaliação de reformas e ajustes necessários, em termos políticos, institucionais e normativos, para que o Brasil efetivamente implemente suas obrigações relativas à facilitação no âmbito da OMC e aumente sua integração ao comércio internacional. A análise proposta foi realizada a partir de ampla pesquisa bibliográfica e documental, explorando fontes doutrinárias e precedentes jurisprudenciais da OMC para discussão das implicações dos compromissos firmados no âmbito da OMC no ordenamento jurídico brasileiro. A partir disso, buscou-se, de modo indutivo, analisar os entraves existentes à facilitação do comércio e a insegurança jurídica causada aos operadores. Por fim, buscou-se responder o problema de pesquisa com base no estudo de modelos estrangeiros e recomendações de organismos internacionais. O trabalho foi estruturado em quatro capítulos, de forma a, primeiramente, apresentar conceitos e delimitações importantes em termos de facilitação do comércio e da forma como as obrigações internacionais são internalizadas no ordenamento jurídico nacional para, a partir disso, discutir a estrutura político-institucional e normativa do Brasil em matéria de comércio exterior. Por fim, a partir dos entendimentos e esclarecimentos apresentados, propõem-se recomendações para a efetivação da facilitação do comércio no Brasil, apresentando, de forma específica, ações e reformas direcionadas a cada um dos principais poderes e articuladores do comércio exterior brasileiro: o Poder Legislativo, o Poder Executivo, o Poder Judiciário e o setor privado

Relação entre normalização técnica e propriedade intelectual no ordenamento jurídico do comércio internacional / Relationship between technical standards and intelectual property in international trade law

Nas últimas décadas, a importância da normalização técnica para comércio internacional aumentou consideravelmente. Segundo dados da OCDE, estima-se que um total de 80% do comércio global na atualidade seja afetado por normas e regulamentos técnicos. Esse cenário justifica a preocupação dos Membros da OMC em incentivar o estabelecimento de padrões tecnológicos comuns nos diversos países, como um instrumento para evitar o incremento das barreiras técnicas e promover a facilitação do fluxo internacional de bens, serviços, investimentos e tecnologias. Contudo, o crescente envolvimento de direitos de propriedade intelectual nas normas técnicas internacionais tem preocupado algumas nações, principalmente em decorrência dos elevados custos, tensões e conflitos que resultam dessa situação, impactando de forma negativa o comércio. Sob a perspectiva do ordenamento jurídico do comércio internacional, o conflito revela-se no conjunto de obrigações que os Membros assumem no âmbito da OMC. Se os países devem obrigatoriamente utilizar como base as normas técnicas internacionais para estabelecer suas normas e regulamentos domésticos, e aquelas se encontram revestidas de direitos exclusivos privados, sua efetiva aplicação no plano doméstico depende da licença dos titulares desses direitos, nos termos e condições por eles impostos. No entanto, uma vez que eles não estejam dispostos a conceder licenças em termos razoáveis e não discriminatórios, ou se recusem a conferir a autorização, os países encontram dificuldades ou, ainda, ficam impossibilitados de implementar de forma plena as obrigações assumidas na OMC. A partir dessa hipótese, o presente estudo tem como objetivo analisar como se encontra regulada a relação entre a normalização técnica e a propriedade intelectual no ordenamento jurídico do comércio internacional. Esta tese confirma que as tensões inerentes à relação entre propriedade intelectual e normalização técnica alimentam um conflito sob a perspectiva do ordenamento jurídico do comércio internacional, que não possui regras específicas para regular a questão. Este conflito se traduz na dificuldade que os países têm na implementação plena das obrigações assumidas na OMC. Para a mitigação dos problemas que emergem desse conflito, observa-se que se destacam duas tendências seguidas pelos Membros da Organização. Uma delas consiste em incrementar as flexibilidades do Acordo TRIPS, como se verifica nos Estados Unidos, União Europeia e Índia. Outra opção observada é o afastamento das normas técnicas internacionais em prol da adoção de normas e regulamentos técnicos domésticos baseados em tecnologias nacionais ou não proprietárias com fundamento nas flexibilidades dos acordos TBT, SPS e GATS. Casos nesse sentido são identificados em países como China. Em certas circunstâncias, a preferência pelo estabelecimento de normas e regulamentos técnicos baseados essencialmente em tecnologias nacionais protegidas por direitos de propriedade intelectual pode robustecer as barreiras técnicas ao comércio. Diante disso, com o propósito de assegurar a efetividade dos acordos multilaterais de comércio e garantir segurança jurídica, entende-se necessário a adoção de medidas claras e adequadas, que busquem eliminar ou reduzir as tensões e conflito, e garantir a previsibilidade do Sistema Multilateral de Comércio. Importa, ainda, que tais medidas sejam estabelecidas de forma a facilitar o comércio internacional e promover a concorrência leal, a inovação, a transferência da tecnologia e o desenvolvimento das nações. / In recents decades, the importance of technical standards for international trade has increased substantially. According to OECD data, it is estimated that around 80% of global trade is affected by standards and technical regulations. This scenario justifies the concerns of WTO Members to encourage the settlement of common technological standards in different countries, as a tool to prevent the rise of technical barriers and promote the facilitation of the international flow of goods, services, investment and technology. However, the increasing involvement of intellectual property rights in international standards has concerned some nations, mainly due to high costs, tensions and conflicts that result from this situation, adversely impacting trade. From the perspective of international trade law, the conflict is revealed in the set of obligations that States assumed in the WTO. If countries must use international standards as a basis to establish technical regulations and norms, and those are covered by private exclusive rights, its effective implementation at the domestic level depends on the approval of rights holders, according the terms and conditions imposed by them. However, since the rights holders are not willing to grant licenses on reasonable and non-discriminatory conditions, or refuse to grant the licenses, countries may find difficult or even remain unable to fully implement their obligations in the WTO. From this hypothesis, this study aims to analyze as it is regulated the relationship between technical standards and intellectual property in international trade law. This thesis confirms that the tensions inherent in the relationship between intellectual property and technical standardization feed a conflict from the perspective of international trade law, which has no specific rules to regulate this question. This conflict is reflected in the difficulty countries have in the full implementation of the obligations assumed in WTO. In order to mitigate the problems that emerge from this conflict, it is observed that there are two trends followed by the Members of the Organization. One is to enhance the flexibilities of the TRIPS Agreement, as is the case in the United States, European Union and India. Another option is the deviation of international standards in favor of domestic standards and technical regulations based on national or non proprietary technologies founded on the flexibilities of TBT, SPS and GATS. Such cases are identified in countries like China. In some circumstances, the preference for the creation of standards and technical regulations based mainly on national technologies protected by intellectual property rights can strengthen the technical barriers to trade. Therefore, in order to ensure the effectiveness of multilateral trade agreements, it is necessary to establish clear and appropriate measures, which seek to eliminate or reduce tensions and conflict, and ensure the predictability of the multilateral trading system. It is also important that such measures are established to facilitate international trade and promote fair competition, innovation, technology transfer and development of nations.

With the surge of different private standards, usually created by industries, banks, NGOs, producers, supermarkets, academy and including, in some cases, WTO Members, the developing countries and least developed countries raise concerns about possible trade barriers, which is becoming a common agenda for the Committee on Technical Barriers to Trade, the Committee on Sanitary and Phytosanitary Measures and the Committee on Trade and Environment. Assess whether the WTO regulates the private standards, or how it contemplates the discussions around reducing greenhouse gas emissions, biodiversity conservation and water use, becomes essential considering that the environmental agenda gains strength and entails the adoption of measures that may affect international trade. This research considers the evolution of environmental issues in the GATT-WTO system as a way to set parameters of the multilateral trading rules related to those issues. In addition, it will detail the different models of private standards and organizations that encourage standardization as a means to achieve environmental objectives or related food safety goals. Finally, the case law of the GATT-WTO will be considered, in order to assess if the WTO has jurisdiction or not over private standards. Hence, the main objective of the thesis is to question the WTO's ability to regulate the adoption of private standards and, in addition, discuss how this debate can evolve under the TBT and the SPS Agreements, or even in the Committee on Trade and Environment / O objeto da presente pesquisa é analisar se a Organização Mundial do Comércio regula a criação, adoção e efeitos de padrões privados ao comércio que visam atingir fins ambientais, sanitários e fitossanitários, ou se essa agenda é exclusivamente privada e fica fora das regras do comércio internacional. Com o surgimento de inúmeros modelos de padrões privados, normalmente criados por indústrias, bancos, ONGs, produtores, redes de supermercados, academia, incluindo, em certos casos, Membros da OMC, a preocupação de países em desenvolvimento e países de menor desenvolvimento relativo quanto ao surgimento de barreiras ao comércio se torna marcante no âmbito do Committee on Technical Barriers to Trade, do Committee on Sanitary and Phytosanitary Measures e do Committee on Trade and Environment. Avaliar se a OMC regula esses padrões, ou de que maneira contempla a discussão de temas como redução de emissões de gases de efeito estufa, conservação da biodiversidade e uso da água torna-se essencial na medida em que a agenda ambiental ganha força e enseja a adoção de medidas que podem afetar o comércio internacional. A pesquisa considera a evolução dos temas ambientais no sistema GATT-OMC, como forma de estabelecer os parâmetros da regulamentação do comércio multilateral no tocante a questões ambientais. Além disso, detalha os diferentes modelos de padrões privados e organizações que incentivam a padronização como meio para se atingir objetivos ambientais ou relacionados a segurança dos alimentos. Por fim, a jurisprudência do GATT-OMC será analisada como forma de comprovar ou não que a OMC regula os padrões privados. O maior objetivo da tese é questionar a capacidade da OMC de regular a adoção dos padrões privados e, paralelamente, debater de que forma essa discussão pode evoluir no âmbito dos Acordos TBT e SPS, ou mesmo no Committee on Trade and Environment

A aplicação de medidas antidumping para neutralizar os efeitos da prática desleal protege a concorrência em benefício dos empresários do país importador, entretanto, se essas medidas forem aplicadas com finalidade protecionista, prejudicam a livre concorrência, impedindo a entrada de produtos estrangeiros em condições de concorrência com os produtos nacionais. As análises realizadas demonstraram que a legislação brasileira antidumping, de forma genérica, encontra-se em consonância com as normas da Organização Mundial do Comércio (OMC), que direcionam a aplicação de medidas antidumping no âmbito mundial. Apesar da evolução verificada na Rodada Uruguai, o estudo demonstrou a necessidade de algumas alterações na legislação antidumping da OMC para impedir a possibilidade de diferentes interpretações às normas antidumping pelos Países-Membros. As alterações devem proporcionar maior precisão a alguns conceitos presentes na legislação, como os referentes ao valor normal e à comprovação de dano, devendo também impor a aplicação de direitos antidumping em valores suficientes apenas para neutralizar os efeitos da prática desleal. A revisão da legislação antidumping mostra-se fundamental para a consolidação das normas antidumping no âmbito mundial e, sobretudo, para assegurar sua finalidade de proteger a concorrência em benefício dos empresários locais, sem causar prejuízos à concorrência internacional. / Abstract: The globalization process increased commercial relations among the countries at the end of the twentieth century, making more frequent disloyal enterprise practice like dumping and the respective utilization of apt legislation towards countries of the international trade. The aplication of antidumping measurement to neutralize the effects of disloyal practice protects the competition in the businessmenþs benefit of importer country, howerver, if these measures were applied with protecting goals they would damage the free competition, holding back the entry of foreign products in terms of competition, holding back the entry of foreign products in terms of competition with the national products. The analysis made, show that antidumping brazilian legislation, in general, is along with the rules of the World Trade Organization (WTO), that take control of the aplication of antidumping measures in the world. In spite of the evolution checked in the Uruguay Round, the study showed the necessity of some alteration in the antidumping legislation of the WTO to avoid the possibility of different interpretations at antidumping rules from member countries. The alterations have to bring bigger precision in some concepts that are present in the legislation, like the referent to the normal value and the damage checking that must impose the application of antidumping dues in enough values only to neutralise the disloyal practice effects. The review of antidumping legislation shows itself essential to the antidumping rules consolidation in the world and, above all, to assure its purpose to protect the competition into the benefit of local businessmen, without causing impairments to the international competition. / Mestre

隨著WTO爭端解決機構近年來的實踐,許多制度性問題紛紛浮現,特別是WTO爭端解決小組或上訴機構在反傾銷爭端中審查基準實踐上所引發之爭議。批評者主要認為上訴機構於反傾銷規範之法律解釋上不當適用解釋規則,並未遵循反傾銷協定第17.6(ii)條之規範。另外,上訴機構實質上近乎重新審理被訴會員之法律見解,似乎違反第17.6(ii)條之規範意旨。本文嘗試整理相關經由WTO上訴機構裁決之反傾銷爭端,觀察及彙整第17.6(ii)條於現行運作中之實踐情形,並檢視上述兩項爭議之正反意見。經分析後發現,上述兩項爭議皆涉及不同之政策考量與WTO組織間的互動。易言之,除爭端解決機構對於協定條文之法律解釋外,偏重與選擇不同之政策考量做為正當性基礎,將決定著審查基準之面貌。在進一步分析並檢討在反傾銷制度下可能影響審查基準之政策價值後,本文認為WTO爭端解決機制為維繫其準司法機關之正當性與確保經由多邊架構所帶來之合作利益,有統一法律解釋與重新審理被控訴會員之法律解釋之必要。另外,反傾銷協定第17.6(ii)條審查基準之解釋上,不宜採取其立法來源—美國法Chevron doctrine—之規範內涵。同時,為避免反傾銷制度遭濫用成為貿易保護政策之工具,應賦予WTO爭端解決機構於審理反傾銷爭端時較為自主之法律解釋權力。然而,基於適度尊重WTO會員主權之考量與司法自制之要求,本文建議,WTO爭端解決機構在審理反傾銷案件時,除須正確地援引並靈活運用國際法上習慣解釋規則外,更需適度參照第17.6(ii)條之立法目的,藉由嚴格適用WTO協定,以充實其所採取審查基準之正當性基礎。 / With practices of WTO Dispute Settlement Body (DSB), the institutional issues on Standards of Review have emerged, especially on WTO Anti-dumping disputes. Contestations are focus on whether Appellate Body has mal-applied rules of interpretations on Anti-Dumping Agreement (ADA) as to go beyond Article 17.6(ii). Moreover, Critics query whether Appellate Body De Novo reviewed member’s legal interpretations as to disregard purpose of Article 17.6(ii). By examining relevant anti-dumping penal and appellate body reports, current modes of practices on ADA Article 17.6(ii) are concluded, and probed to its different critiques. Further, issues of such are result from policy considerations of Standards of Review under Anti-Dumping System. In other words, apart from penal and appellate body’s interpretations on ADA, different policy ends will influence current practices of Standards of Review. Consequently, the article checks on and assays on relevant policy justifications of deferential standards of review under anti-dumping system. Concluded, for retaining its institution justifications and ensuring the cooperation gains under multilateral approach, WTO dispute settlement institutes have the necessities in de novo review and leveling legal interpretations. Moreover, due to the different characters, the Chevron mode interpretations on standards of review is without analogy to ADA article 17.6(ii); meanwhile, for preventing distorting antidumping measures as trade protection tools, WTO dispute settlement institutes should have much room on discretion of reviewing members’ ADA legal interpretations. However, in respecting WTO Member’s sovereignty and the requiring of judicial restraint, when taking the standards of review on examining anti-dumping disputes, WTO dispute settlement institutes would strictly and nimbly retain customary rules of interpretation of public international law with considering purposes of ADA article 17.6(ii).

Particularly, the inclusion of new issues within the WTO rules, within the multilateral trading system is fundamental to the pursuit of well-being of people take a central role in the discussions, and sustainable development is achieved from the respect and balance between human beings and the market. The paper attempted to analyze the TRIPS Agreement and its relationship with the right to access to medicines, assessing the possibility that the relaxation of its rules be considered a demonstration of the relevance of human rights in international trade. To achieve this objective, the first analysis of the evolution of the system of protection of intellectual property was critical to understanding the formation of the international IP regime that culminated in the TRIPS Agreement. In sequence, the problem of access to medicines was presented from the considerations about the social responsibility of the pharmaceutical industry and the implications caused by the TRIPS Agreement, regarding the need to be envisioned an international policy aimed at ensuring universal access to products the pharmaceutical industry, thus revealing the existence of a relationship between the work of international organizations, including the World Trade Organization and Human Rights. Finally, from the point of view of modern cosmopolitanism from the demonstration that the internationalization of human rights can be understood as a reassertion of humanism found that to change the paradigms of intellectual property and particularly patent pharmaceutical, it is essential to define the social role of the pharmaceutical industry, understanding the conditions of access to drugs is regarded as a matter subject to humanitarian protection. / As transformações globais ocorridas na modernidade têm provocado o surgimento de novos desafios e a necessidade de busca por novas perspectivas na participação dos atores no sistema internacional. Particularmente, a inclusão de novos temas no âmbito das regras da OMC, dentro do sistema multilateral de comércio, é fundamental para que a busca pelo bem-estar do homem tome papel central nas discussões, e o desenvolvimento sustentável seja alcançado a partir do respeito e do equilíbrio entre ser humano e mercado. A dissertação se propôs a analisar o Acordo TRIPS e sua relação com o direito ao acesso a medicamentos, avaliando a possibilidade de que a flexibilização de suas normas ser considerada uma demonstração da relevância dos Direitos Humanos no âmbito do comércio internacional. Visando tal objetivo, inicialmente a análise da evolução do sistema de proteção da Propriedade Intelectual foi fundamental para compreender formação do regime internacional de PI que culminou com o Acordo TRIPS. Em sequência, a problemática do acesso a medicamentos foi apresentada a partir das considerações acerca da responsabilidade social da indústria farmacêutica e das implicações provocadas pelo Acordo TRIPS, no que tange à necessidade de ser vislumbrada uma política internacional que vise a garantia do acesso universal aos produtos da indústria farmacêutica, evidenciando assim a existência de uma relação entre a atuação de organismos internacionais, entre os quais a Organização Mundial do Comércio e os Direitos Humanos. Por fim, sob o ponto de vista do cosmopolitismo moderno, a partir da demonstração de que a internacionalização dos Direitos Humanos pode ser compreendida como a reafirmação do Humanismo constatou-se que para a mudança dos paradigmas relativos à propriedade intelectual e, particularmente, à patente farmacêutica, é imprescindível a definição do papel social da indústria farmacêutica, a compreensão de que as condições de acesso a medicamentos sejam consideradas matéria sujeita à proteção humanitária.
