In the first part of this essay, the author describes the regulatory regime governing the issuance of opinions by the Supervising Agency of the Government Procurement (OSCE) in Peru. In the second, there is a series of interpretative elements of the binding nature of opinions of OSCE that were provided by the legislature and that institution. The third is a review of the doctrinarian characteristics that defined the institution of the Administrative Advisory Service. And finally, in the fourth part, the author proposes an interpretation of the meaning and scope of the binding nature of opinions of OSCE, with focus on their application across the various stages of government procurement in Peru. / En la primera parte de este artículo se describe el régimen normativo que regula la emisión de opiniones por parte del Organismo Supervisor de las Contrataciones del Estado en el Perú. En la segunda, se recogen una serie de elementos interpretativos del carácter vinculante que el legislador nacional le ha dado a esas opiniones. La tercera hace una revisión de las características con que la doctrina define a la Función Administrativa Consultiva. Y en la cuarta, finalmente, se propone una interpretación del sentido y alcance del carácter vinculante de las opiniones, con especial énfasis en su aplicación durante las diversas etapasde la contratación pública en el Perú.

Surrounded by an environment increasingly complex and dynamic, organizations need to turn to the information contained on that to develop strategies and actions aligned with the environmental demands. In this context, the information scanning emerges as a way to instrument alignment, since it deals with the systematization of information flow in the external environment started and finished in decision making that state the actions to be pursued by corporations. This study aimed to examine as occur the process of information scanning from the external environment in managing government contracts Eletrosul. The literature review included the issues of external environment of organizations, the monitoring information from the external environment and management of contracts. Given the objective of this research, we chose to use a qualitative approach to complement the quantitative approach, orchestrated by the method of single case study. The unit of analysis involved in the process of contract management, and all participants in the research managers. Data were collected from three sources of evidence - documents, interviews and questionnaires - providing triangulation with the presence of qualitative and quantitative data. The results showed the existence of two modes of concurrent scanning - so conditioned view and formal research. About the scanning process, it was noted that all steps are performed by contract managers, away from fruition peculiar to an administrative process of public character. The longed to proposals to strengthen and standardize each step of the monitoring process, defining information needs, expanding the sources of information, further conditions for the active collecting, centralizing the storage, strengthening and streamlining the dissemination and easing skill levels for faster decision making. The findings point to achieve the objective of proposed research, which included the analysis of the scanning process in a public organization, as well as to the scope of theoretical and practical contributions that justified the development of the study as widening the scope of analysis and approach in studies of scanning. Moreover, the work gave the ELETROSUL know the current reality of contract management and scanning carried out and this has enabled the creation of actions for improvement of both processes / Atualmente a informação é fundamental para que as organizações alcancem níveis superiores de desempenho que lhes garantam o sucesso e a sobrevivência. Circundadas por um ambiente cada vez mais complexo e dinâmico, as organizações necessitam voltarem-se para as informações contidas naquele para desenvolverem estratégias e ações alinhadas com as demandas ambientais. Nesse contexto o monitoramento de informações surge como uma forma de instrumentalizar este alinhamento, porquanto contempla a sistematização do fluxo informacional iniciado no ambiente externo e finalizado na tomada de decisão que indicará as ações a serem perseguidas pelas corporações. O presente estudo teve por objetivo analisar como ocorre o processo de monitoramento de informações do ambiente externo no gerenciamento de contratos administrativos da Eletrosul. A revisão teórica contemplou os temas de ambiente externo das organizações, o monitoramento de informações do ambiente externo e a gestão de contratos administrativos. Considerando o objetivo da pesquisa, optou-se pela utilização da abordagem qualitativa com a complementação da abordagem quantitativa, instrumentalizada por meio do método de estudo de caso único. A unidade de análise consistiu no processo de gestão de contratos, sendo todos os participantes da pesquisa gestores. Os dados foram coletados a partir de três fontes de evidência documentos, entrevistas e questionários propiciando triangulação com a presença dos dados qualitativos e quantitativos. Os resultados apontaram para a existência de dois modos de monitoramento concomitantes - modo visão condicionada e o modo pesquisa formal. Sobre o processo de monitoramento, percebeu-se que todas as etapas são executadas pelos gestores de contratos, embora concretizadas a partir das particularidades inerentes a um processo administrativo de caráter público. As propostas apresentadas almejaram fortalecer e padronizar cada uma das etapas do processo de monitoramento, definindo as necessidades informacionais, ampliando as fontes de informação, dando maiores condições para a coleta ativa, centralizando a armazenagem, fortalecendo e agilizando a disseminação e flexibilizando os níveis de competência para a tomada de decisão mais rápida. As conclusões apontaram para o cumprimento do objetivo de pesquisa proposto, que contemplou a análise do processo de monitoramento em uma organização pública, bem como para o alcance das contribuições teóricas e práticas que justificaram o desenvolvimento do estudo, como a ampliação do escopo de análise e da abordagem nos estudos sobre monitoramento. Além disso, o trabalho propiciou à ELETROSUL conhecer a realidade atual do gerenciamento de contratos e do monitoramento realizado neste e viabilizou a criação de ações de aperfeiçoamento de ambos os processos

The work begin with the historical and the political analysis of the laws seeking for property rights and indians' rights. The realized the definition and characterization of each of these topics. Presents legislative, doctrine, jurisprudence and procedural researches , as well as empirical data, aiming to show that the demarcation of Indians lands in the State of MatoGrosso disregarding Constitutional principles analysed through the research, mainly those established at article 5º, XXII and article 231, § 1º of The Federal Constitution of 1988. Demonstrate that infringement to the constitutional principles by demarcation process accomplished by FUNAI culminates with the increase in judicial disputes and quarrel over land in MatoGrosso. This investees of demarcation held in absentia of the indigenous communities themselves, which actually fighting for public policy assistance on the reservations already delimited, and not, for more land. / O tema coteja o direito de propriedade e os direitos originários dos índios sobre as terras que tradicionalmente ocupam. Busca-se uma análise histórica e interpretativa de cada um deles, de forma a se entender a real intenção do legislador e as atuais disposições constitucionais e infraconstitucionais a respeito desses temas. O trabalho parte da análise da história e da política das legislações que contemplam o direito de propriedade e os direitos dos índios. É realizada a definição e a caracterização de cada um desses direitos. São apresentados resultados de pesquisa legislativa, doutrinária, jurisprudencial e processual e dados empíricos, com vistas a demonstrar que as demarcações das terras indígenas no estado de Mato Grosso desrespeitam os ditames constitucionais e infraconstitucionais analisados, em especial aqueles estabelecidos no art. 5º, XXII e no art. 231, § 1º da Constituição Federal de 1988. É demonstrado que a infringência aos ditames constitucionais pelos processos demarcatórios realizados pela FUNAI culmina com o aumento de litígios judiciais e de disputas por terras mato-grossenses.Tais investidas demarcatórias são realizadas à revelia das próprias comunidades indígenas, as quais, na realidade, lutam por políticas públicas de assistência nas reservas já demarcadas, e não, por mais terras.

As últimas décadas têm sido caracterizadas por um intenso desenvolvimento da informática e da telemática. Na Administração Pública, a utilização dessas novas tecnologias provo-cou o aparecimento de um novo modo de atuação, designado pela expressão governo ele-trônico. O governo eletrônico constitui uma realidade a ser explorada também sob uma perspectiva jurídica. As bases constitucionais e legais pertinentes permitem verificar que ele está sujeito a um enquadramento sistemático, sendo regido por princípios como a equi-valência de suportes, a eficiência administrativa, a equivalência de garantias e a interope-rabilidade entre os sistemas informáticos. O uso das novas tecnologias traz importantes reflexos sobre institutos clássicos do direito administrativo, tais como o ato e o processo administrativo, que precisam ser reavaliados de acordo com o novo contexto. O ato admi-nistrativo, antes formalizado somente em papel e com a intervenção direta do homem, é passível de ser expedido em forma eletrônica ou pela atuação automatizada de um sistema informático. O processo administrativo, visto como um mecanismo de troca e produção da informação, pode valer-se do suporte digital, abrindo a oportunidade para o relacionamento telemático e para a automatização de tarefas, com relevantes consequências sobre a estru-tura do procedimento e sobre os atos processuais. / The last decades have been characterized by an intense development of information tech-nology and telematics. In public administration, the use of these new technologies pro-duced a new way of operating, designated e-government. E-government must be explored also under a legal perspective. The applicable constitutional and legal bases allow one to verify that electronic government is submitted to a systematic framework, governed by principles such as media neutrality, administrative efficiency, equivalence of guarantees and interoperability between computer systems. The use of new technologies has important effects on traditional elements of administrative law, such as administrative act and admin-istrative procedure, which must be revisited according to this new context. The administra-tive act, which previously was only paper-based and had a direct involvement of an indi-vidual, may now be issued in electronic form or by an automated computer system. The administrative procedure, seen as a mechanism of information exchange and production, can make use of digital media, creating the opportunity for telematic interaction and auto-mation of tasks, with important consequences for the structure of the procedure and procedural acts.

Le pouvoir de décision unilatérale de l’administration entretient avec la démocratie administrative des rapports ambivalents. Appréhendée comme l’ensemble des règles qui tendent à la participation des administrés à l’élaboration des décisions administratives, la démocratie administrative est de prime abord contradictoire avec la dimension de contrainte et de commandement que l’unilatéralité manifeste. Faisant figure d’oxymore, elle s’est pourtant imposée à un pouvoir dont la légitimité semblait remise en cause. Le principe d’une participation des administrés irrigue désormais, à travers des procédés multiples et utilisant les nouvelles technologies, la relation entre le « public » et l’administration : la démocratie administrative a saisi le pouvoir de décision unilatérale.Pourtant, loin de remettre en cause ce pouvoir, la démocratie administrative vient en réalité le conforter. En se limitant à une ouverture du processus d’élaboration de certaines décisions administratives, le droit actuel de la participation des administrés n’atteint pas les caractères mêmes de l’unilatéralité. Les participants n’accèdent que très exceptionnellement au rang de coauteurs et leur influence sur le contenu de la décision est limitée. La sollicitation du public s’avère être un instrument de légitimation du volontarisme de la puissance publique. Avec le renfort du juge administratif, la participation des administrés demeure un simple moment procédural. La démocratie administrative se révèle être en définitive une notion malléable, dont l’administration tire profit dans l’exercice de son pouvoir de décision unilatérale. / The unilateral decision-making power of the administration maintains an ambivalent relationship with the administrative democracy. Understood as the set of rules which tend to the governed participation in the development of administrative decisions, administrative democracy is prima facie contradictory to the dimensions of constraint and command that are part of unilaterality. Standing as an oxymoron, it has yet imposed on a power which legitimacy seemed compromised. The principle of participation of the governed irrigates now, across multiple processes and through the use of new technologies, the relationship between the "public" and the administration: the administrative democracy has seized the power of unilateral decision.Yet far from questioning this power, the administrative democracy has actually strengthened it. Limiting itself to opening up the process of drafting of certain administrative decisions, the current right of participation of the governed does not reach the characters of unilateralism. Participants only access exceptionally to the rank of co-authors and their influence on the content of the decision remains limited. Public solicitation proves to be a legitimizing instrument of the voluntarism of the public authority. With the reinforcement of the administrative judge, citizen’s participation remains a simple procedural time. The administrative democracy ultimately proves to be a malleable concept, of which the administration benefits in exercising its power of unilateral decision.

Le principe de l'absence d'effet suspensif des recours contentieux en droit administratif / The non-suspensive effect principle of dispute actions in french administravive law

Dans le cadre de la procédure administrative contentieuse, les recours ne sont pas pourvus d’un effet suspensif. Par conséquent, les autorités administratives ont la possibilité d’exécuter les décisions contestées jusqu’à la décision juridictionnelle. Cette situation, constitutive d’un principe, est le produit d’une philosophie contentieuse marquée par un déséquilibre à l’avantage de l’administration. Le principe de l’absence d’effet suspensif en est une des formes d’expression les plus directes tant il est susceptible de grever la protection des droits des requérants. Son étude permet indirectement de questionner la pertinence contemporaine des fondements idéologiques du droit et du contentieux administratif. Sa déconstruction fait apparaitre son caractère désuet au regard des évolutions en cours. Celles-ci, qu’elles soient propres au phénomène juridique ou qu’elles le dépassent, servent à déterminer les caractéristiques attendues des recours contentieux. La recherche d’une solution équilibrée, à mi-chemin entre efficacité administrative et protection des requérants, devient un impératif. Celui-ci sera atteint à partir d’une reconstruction de cet aspect épineux de la procédure administrative contentieuse en s’appuyant sur une analyse matérielle de la situation litigieuse. / In contentious administrative disputes, appeal actions do not trigger any suspensive effect on the case. As a consequence, the administrative authorities can enforce the appealed decisions until the court gives its final decision. This position constitutes a principle and is due to a highly unbalanced dispute philosophy, as it tends to be favourable to the administration. The non-suspensive effect principle is one of the most direct expressions of this phenomenon as it is most likely to encumber the protection of the plaintiff rights. Studying this principle allows to question the relevance, nowadays, of the ideological basis on which law and administrative disputes are built. A deconstructive analysis shows that, due to several evolutions, this principle seems to be “outdated”. These developments, whether they are part of the legal dimension or part of something bigger, help shaping the expected features of the dispute actions. Finding a balanced solution, between administrative effectiveness and protection of plaintiffs, has become an essential requirement. And this may be reached through rebuilding this rather thorny aspect of the administrative proceedings from a legal analysis of the position in controversy.

The experiences and perceptions of social workers on the provision of family preservation services in the Ekurhuleni Metropolitan, Gauteng Province

Many South African families are beset by social, psychological and economic challenges placing children at risk. Family preservation services, capitalising on families’ strengths to resolve their problems, are crucial to avoid the removal of children from their homes. Using a qualitative approach, this study reveals the experiences and perceptions of twelve social workers providing family preservation services in the Ekurhuleni Metropolitan of Gauteng Province. These social workers articulate their understanding of and experiences with the Children’s Act (Act No. 38) of 2005. They are generally optimistic that family preservation services can offer a helping process with the potential to improve family functioning. Nevertheless, there are stumbling blocks to effective service delivery, such as the kinds of social problems experienced by families, lack of funding, high caseloads, lack of resources and little co-operation from other disciplines and agencies. Based on these findings, recommendations are made for practice, policy and further research. / Social Work / MA (Social Work)

The subject of my master thesis is the EU directive 2004/35 on environmental responsibility, prevention and damage redress, its implementation into the legal order of the Czech Republic and the potential impact of undue transposition of the directive. The first part of my thesis deals with the harmonization need in this area and with the directive itself. Following a brief introduction of the directive, I'm presenting an overview of its basic institutes and their legal form. I'm also making an effort at identifying possible shortcomings of the directive. The basic institutes of the directive include: key principles, the environmental damage itself, operational activity, responsibility mechanisms, financial safeguards and the administrative procedure to impose a preventive or a remedial provisions. The second part of my thesis deals with the theoretical aspects of appropriate implementation, such as the interpretation of the directive, a timely adoption of the transposition provisions, proper projection of the content of the directive, due form of the transposition provisions, the application of EU norms, the equivalence and effectiveness imperative and the internal Czech rules for the implementation of EU norms that have been laid down by the governmental provision Nr. 1304 (methodological directions).
