Private Employment Agencies and Agency Employment Abstract The main topic of this thesis is the effect of private employment agencies on the Czech labor market and legal regulation of their activities, especially of the agency employment. This thesis also focuses on the problems associated with the agency employment. The labour law is variable depending on social and economical changes not only in our country but also worldwide. It is related to the employment which should reflect the actual situation mostly on the labor market. In this situation there are a lot of people who can not find work and who must search for some alternative options. One of opportunities which are offered is the agency employment. This is the point of accent on quality legislation to minimize the risk of abuse and discrimination of the agency employees. The author analyzes the present legislation and outlines possible solutions of problems. This thesis is divided into eight main chapters. The Chapter One consists of the main concepts definitions which are used in this thesis. Intresset för och inhyrning av bemanningskonsulter har ökat som en del av företags försök att bli flexiblare med arbetsstyrkan. Dock är bemanningsbranschen ung och forskning kring konsultyrket utifrån konsultens perspektiv anser vi vara begränsad. Studiens syfte var att bidra till ökad kunskap om konsultyrket genom en empirisk undersökning där intervjuer med bemanningskonsulter utförts. Forskningsfrågan var: Hur upplever konsulter från bemanningsföretag sin arbetssituation hos kundföretag? Studien har inspirerats av ett kvalitativt förhållningssätt och empiri samlades in genom semistrukturerade intervjuer med sex respondenter som har erfarenheter från konsultyrket. Ansatsen i studien bedrevs deduktivt eftersom vi läst in oss kring ämnesområdet innan empirisk data samlades in. Utifrån tidigare forskning antog vi att konsultens upplevda arbetssituation påverkades antingen positivt eller negativt utifrån tre faktorer: Vilka förväntningar som finns på dem samt hur de behandlas av kundföretaget och kollegorna, vilka är anledningarna till att konsultyrket väljs samt deras arbetstillfredsställelse utifrån känslan av kontroll över arbetssituationen och relationerna inom kundföretaget. För att tolka det empiriska materialet användes tolkningsmodellen från den teoretiska referensramen. Meningar och ord i det transkriberade materialet markerades för att sedan jämföras med tidigare forskning och på så sätt finna samband och motsägelser. Vår slutsats var att konsulterna upplever sin arbetssituation antingen positivt eller negativt först och främst beroende på vilka förväntningar de har på yrket och uppdraget de anlitas för. Dessa förväntningar påverkas sedan av andra faktorer, som kundföretagets avsikt med att använda konsulten, hur mycket de involveras och hur väl de behandlas av både ledning, chefer samt kollegor. Beroende på vilka förväntningar konsulten har, får de andra faktorerna mer eller mindre påverkan på den upplevda arbetssituationen. / The interest for and hiring of consultants from temporary working agencies have increased as a part of companies' attempts to become more flexible with the workforce. The temporary staffing industry is yet young and we consider the research around the consultant profession limited, based on the consultants perspective. The purpose of this study was to increase knowledge about the consultant profession through an empirical research based on interviews with temporary agency workers. The research question was: How do consultants from temporary work agencies experience their work situation at client companies? This was a qualitative study and empirical data was collected through semi-structured interviews with six respondents who has experience from the consultant profession. The study had a deductive approach as we had read about the subject area before the collection of data. From previous research we assumed that the experienced work situation by the consultants was affected either positive or negative by three factors: Which expectations and how they are treated by the client company and by their colleagues, which are the reasons to choose the consultant profession, and their job satisfaction based on the impression of control over the work situation and the relations within the client company. To translate the empirical material the analysis model from the theoretical framework was used. Sentences and words from the transcribed material were marked and then compared with previous research and thus find connections and contradictions. Our conclusions were that the consultants experience their work situation either positive or negative primarily depending on which expectations they have on the profession and the assignment they are hired for. These expectations then affect the other factors, as the client company’s intention to use the consultant, how involved they are and how well they are treated by executives, managers and colleagues. Depending on which expectations the consultant has, the other factors have more or less impact on the experienced work situation.

The main purpose of this thesis is to introduce the concept of temporary agency work and assess the implementation of theoretical and practical knowledge. The main part is focused on analyzing the issues of legal regulation of temporary agency work. Then the triangular relationship between the private employment agency, user firms and agency workers is described and elaborated on. The analysis followed the implementation of recruitment agency workers, including financial analysis of costs and revenue that are spent on the project in Idea Agency Ltd. The final chapter outlines the advantages and disadvantages of temporary agency work for all parties involved, i.e. agency workers, users firms and private employment agencies. The conclusion summarizes the findings and proposed recommendations for improving the use of forms of agency work.

The aim of this diploma thesis is to offer a complete overview of the institute of temporary agency work. Temporary agency work is an institute that brings to the user undertakings the possibility to quickly adapt to the increase or decrease in demand for their products by changing the number of employees. The first part of the diploma thesis presents a brief excursion into the history of temporary agency work with focus on the most important historic moments and includes the explanation of its impacts. This chapter emphasises Czech history of temporary agency work, but it takes a quick glance at the history of temporary agency work in other states. The institute of temporary agency work was introduced to the Czech legal system as late as 2004. This point is very important to understand the uneasy position of agency employment on our labour market. The main part of this diploma thesis concerns current legal status of temporary agency work. It analyses obligations of the Czech Republic arising from the C181 and directive 2008/104/ES. The thesis continues to the Czech legal system and it analyses the positions of a private employment agency, user undertaking and an agency employee. In this chapter, the author draws on a historical case study of the Australian wine industry to explore variations in collective agency. The inductively derived process model illustrates the emergence of a new profession of scientific win- emaking, which unfolds in three phases. Each phase is characterized by a dis- tinct form of agency: distributed agency during the earliest phase, coordinated agency during later phases, and orchestrated agency during consolidation. In addition to exploring the temporal shifts in agency, the study includes a detailed analysis of the early stages of distributed agency, examining how col- lective agency is achieved in the absence of shared intentions.

À travers l’étude de trois espaces de mobilisation politique, professionnel et religieux, notre thèse de doctorat analyse l’agency de femmes musulmanes françaises. Dans une perspective sayadienne, nous décrivons l’assignation à l’altérité radicale dont héritent ces femmes d’ascendance maghrébine en dépit de leur naissance et leur socialisation en France. Nous apportons une attention particulière aux conditions sociales d’existence de classe ouvrière qui influent la manière d’être au monde et qui renforcent le poids de la dévalorisation sociale. Ces femmes revendiquent le droit à l’égalité de traitement et à la justice sociale par le biais d’engagements divers. La valorisation de l’identité stigmatisée ainsi que la prise du voile s’inscrivent dans une dynamique de retournement du stigmate dans sa forme la plus symbolique qui illustre l’affirmation à la légitimité à exister nationalement comme telles. Dans une perspective honnethienne, nous analysons les luttes pour la reconnaissance investies par ces femmes. Nous montrons les conditions et les effets de ces engagements sur leurs parcours biographiques. Les mobilisations politiques, professionnelles ou religieuses trouvent dans les collectifs le socle du déploiement d’une puissance d’agir qui transforme les subjectivités de ces femmes et implique le questionnement des normes politiques et religieuses et les engagent dans une critique des rapports de domination. Ces transformations par l’engagement collectif constituent les bases de chemins d’émancipation que nous analysons dans cette thèse. / Through the study of three different spaces of political, professional and religious mobilisations, my PhD thesis analyses the agency of French Muslim women. From a Sayadian perspective, it describes their labelling as a radical “other” that those women of North African descent experience, despite their birth and socialisation in France. It sheds a particular light on their working-class social condition, which influence their ways of being in the world, and which reinforce the weight of social depreciation. Through their various engagements, those women claim the rights to equality and social justice. The promotion of the stigmatised identity as well as the veiling have to be understood following a dynamic of reversing the stigma in its most symbolic form : this illustrates their affirmation to legitimacy of existing nationally as they are. From a honnethienne perspective, the thesis analyses the struggles for recognition of those women. It shows the conditions and the effects of those engagements on their biographical trajectories. The organisation of political, professional or religious mobilisations within a collective framework allows them to get empowered. It transforms the women’s subjectivities, it leads to a questioning of political and religious norms and it allows them to challenge power relations. This thesis analyses how those transformations thanks to collective engagement form the basis of emancipation.

Le projet de recherche s'est concentré sur les rôles des associations féminines en Tunisie depuis l’indépendance du pays au lendemain de la révolution de janvier 2011. Sur le plan conceptuel, je reprends la notion de « agency » en tant que cadre d’analyse pour étudier l’engagement et les moyens de mobilisation des individus qui militent dans les associations féminines. Dans la mesure où ce concept de « agency » indique un engagement dans la société, cette notion se prête parfaitement aux démarches épistémologiques dans mes enquêtes auprès des personnalités des associations féminines. Cette notion de « agency » me donne un cadre pour penser à la fois les actions des femmes et des hommes qui agissent au sein des associations étudiées mais aussi au niveau de l’influence qu’elles/ils laissent dans la société de par leurs actions. J’ai cherché à comprendre si l’agency, en tant que capacité individuelle de s’imposer dans des domaines de la vie sociale, politique ou économique pour apporter des innovations et modifications, pourrait s’appliquer à un groupe et donc pourrait être utile pour comprendre un pouvoir collectif. En analysant les entretiens que j’ai conduits avec les membres des associations féminines, j'ai cherché à suivre l’histoire de ces organisations et leur impact dans la société tunisienne durant le dernier demi-siècle depuis l’indépendance de la Tunisie à nos jours, et cela dans les domaines économique, social, politique et légal afin de répondre à ma question principale : quel est le rôle des associations féminines en Tunisie postcoloniale, notamment avant et après la révolution de 2011, surtout à l’égard du processus de la démocratisation dans le pays ? / The research project focused on the rôle of the feminist associations since the indipendence of Tunisia until the revolution of 2011, analyzing the context of the creation and the process, putting the accent on different women's associations which engaged themselves in order to ensure that the gained women's rights are respected and diffused in all country with the intention to improve women to became « fully citizens ».Every time I went to Tunisia, I had some interviews with the members of the organisations during the years before and after the revolution, in order to observe the evolution of their involvement in the association and in the society.The objective of this thesis is to contextualize the socio-political rôle occupied from the four associations in the history of the country, since their creation until the present day.On the conceptual plan, I included the « agency » notion, in order to analyse the involvement and the ressources of mobilisation of the people who participate in the work of the feminist associations.I tried to understand if « agency », as individual ability to impose on the domaines of the social, political and economic life to change something, it could be a collective ability, then a collective power. Analyzing the interviews with members of the associations, I attempted to track the history of the feminist tunisian organisations and their impact on the social life of the country, to answer to a final question : which is the rôle of the feminist associations in the postcolonial Tunisia, especially before an dafter the revolution of january 2011, mainly in relation to the democratic process of the country ?

Moral Professional Agency: A Framework for Exploring Teachers’ Constructions of Professionalism Within a Democratic Space

Despite long-standing debates about the nature of professions and professionalism related to teaching, little consensus has been reached due in large part to an ever-changing political climate and a number of competing ideologies and interests (Bair, 2014; Hargreaves & Goodson, 1996). This lack of consensus fosters variable expectations of teachers, creating opportunities for the generation and implementation of initiatives that ultimately control and undermine teachers’ work (Ingersoll, 2003). While the quality of our nation’s education system depends on teachers' capacity to have professional input regarding their work, concepts of teacher agency and professionalism remain ill-defined, and few studies explore teachers’ experiences in spaces where they are asked for such input. This constructivist study examined teacher agency and professionalism, given the ideal of democracy and the reality of neoliberalism. Utilizing agency theory and participatory democratic theory, this study sought to explore teachers’ perceptions of their professionalism and agency by co-constructing knowledge with 18 members of the Richmond Mayoral Teacher Advisory Council (MTAC). This study took place over seven months and included seven focus group interview sessions, two MTAC meeting debrief sessions, and multiple writing prompts focused on teachers’ narratives of their professional experiences. The study revealed several themes related to teachers’ professionalism, particularly teachers’ focus on student-centered, morally-grounded views of their work. This study’s iterative inquiry process culminated in the development of a Moral Professional Agency framework that may serve useful in future constructivist work with teachers regarding their professional work.
