In order to answer the question, we investigated the possibility of producing evidence in appeals. The research was developed under a theoretical-doctrinal bias, analyzing four distinct aspects of the procedural phenomenon: the parties, the judge, the appeals and the evidence. It was analyzed when the parties can produce evidence in a court seat, the legal action of the trial for the production of evidence, which features involve the production of evidence and which evidence be produced after the typical investigation phase. This dissertation traces the beacons so that evidence can be produced after the time provided for procedural instruction. It was concluded that it is possible to produce evidence in a court seat, but this is not a rule, but an exception to the system and clarifies and complements the factual-evidential framework of the case or allows the decision to reflect the current state of the litigious object, with the insertion of facts and evidence supervenientes in the process / A presente dissertação teve como objetivo responder à questão se existe apenas um momento único e excludente de qualquer outro para a produção da prova no processo. Para responder à questão investigou-se a possibilidade de serem produzidas provas em sede de recursos. A pesquisa foi desenvolvida sob um viés teórico-doutrinário, analisando quatro aspectos distintos do fenômeno processual: as partes, o juiz, os recursos e as provas. Analisou-se quando as partes podem produzir provas em sede recursal, a atuação de ofício do juízo para a produção das provas, quais recursos comportam a produção de provas e quais provas comportam serem produzidas posteriormente à fase instrutória típica. O trabalho traça as balizas para que a prova possa ser produzida após o momento previsto para a instrução processual. Concluiu-se ser possível a produção de prova em sede recursal, todavia esta não é regra, mas exceção do sistema e se volta a aclarar e complementar o quadro fático-probatório do processo ou possibilitar que a decisão reflita o estado atual do objeto litigioso, com a inserção de fatos e provas supervenientes no processo

O processo civil brasileiro tem sofrido contínuas alterações, sempre com vistas à busca de maior celeridade e efetividade jurisdicional. O aumento dos poderes do relator no julgamento dos recursos cíveis foi uma das formas encontradas para se acelerar a prestação jurisdicional e desobstruir a pauta dos Tribunais, hoje assolados por uma enorme quantidade de recursos. No entanto, as modificações da legislação que ampliaram os poderes do relator não escaparam às críticas da doutrina, seja por conta das deficiências da redação do dispositivo, seja do alcance prático do julgamento monocrático, chegando até mesmo a ter sua constitucionalidade questionada. O trabalho aborda essas questões trazendo um olhar contemporâneo e reflexivo sobre o tema. / The Brazilian civil procedure has undergone continuous changes, always seeking celerity and effectiveness. The increase of the powers of the rapporteur in the trial of civil appeals was one of the resources used to accelerate the judiciary relief and unclog the Courts agenda, currently plagued by a huge amount of appeals. However, changes in the law that expanded the powers of the rapporteur did not escape the doctrines criticism, whether on account of the wording deficiencies or on the practical effect of the judgment, having even its constitutionality questioned. This paper addresses these issues under a contemporary and reflexive right.

Repercussão geral das questões constitucionais / General repercussion on constitucional subjects

No início do presente trabalho, foi elaborado um histórico do Supremo Tribunal Federal e do recurso extraordinário, além de se traçar alguns aspectos sobre o papel da Corte na atualidade, resultado das mudanças sociais aspiradas pela Constituição de 1988 e de recentes reformas legislativas. Se, por um lado, o constituinte originário pretendeu ampliar o acesso à Justiça, não menos verdade é que a realidade acabou por demonstrar a insuficiência do modelo então vigente para dar respostas adequadas e céleres aos jurisdicionados. O Poder Judiciário brasileiro carece de importantes reformas procedimentais, com o objetivo de atribuir maior eficácia às decisões dos Tribunais Superiores, e, assim, desestimular a interposição de recursos a respeito de questões já sedimentadas. Neste contexto foi que se introduziram os institutos da súmula vinculante e da repercussão geral das questões constitucionais, este último como requisito de admissibilidade do recurso extraordinário. Ao longo do segundo capítulo, houve a apresentação dos institutos antecedentes da repercussão geral (introduzida pela Emenda Constitucional nº 45/2004), como a arguição de relevância vigente sob a Constituição de 1967, a transcendência do direito trabalhista (artigo 896-A da CLT), o certiorari do direito norte-americano e a ofensa federal relevante do direito argentino, além de outras experiências do direito estrangeiro. Detendo-se acerca da repercussão geral, no terceiro capítulo foram identificados alguns critérios adotados pelo Supremo Tribunal Federal nos julgamentos até o momento realizados, além de esclarecidas algumas noções fundamentais, como a natureza do provimento jurisdicional dele decorrente. No quarto e quinto capítulos foram apresentadas as principais questões procedimentais a respeito do exame da repercussão geral. Relativamente ao julgamento de recursos múltiplos previsto no artigo 543-B, §§ 3º e 4º, do CPC, também se estudou em que medida estará o Tribunal de origem vinculado à decisão a ser proferida pelo STF. Por fim, verificou-se se tais normas estão em harmonia com o sistema processual vigente, notadamente em relação aos princípios e garantias processuais presentes na Constituição da República de 1988. / The beginning of this work presents a background of the Brazilian Supreme Federal Court and the extraordinary appeal. It also presents an outline of the Court\'s current role, which is a result of the social changes aimed by the 1988 Brazilian Constitution and by recent legislative reforms. The original constituent primarily intended to expand the access to justice, but reality revealed that the operative model at the time was insufficient to respond swiftly and adequately to those under it jurisdiction. Brazilian Judiciary needs important procedural reforms in order to bring effectiveness to the decisions of the Supreme Courts and consequently discourage appeals against settled questions. The binding precedent and the general repercussion on constitutional subjects the latter being the admissibility requirement of the extraordinary appeal were introduced in this context. Through the second chapter, there is the presentation of the institutes previous to the general repercussion (introduced by the Constitutional Amendment 45/2004), such as the allegation of relevance operative on the 1967 Constitution, the labor law transcendence (article 896-A of the Brazilian Labor Code), the certiorari from the North-American Law system and the relevant federal offense from the Argentinian Law system, among other experiences from foreign Law systems. With regard to the general repercussion, the third chapter identifies some criteria adopted by the Brazilian Supreme Federal Court on its trials up to the present and sets forth some fundamental notions, such as the nature of the jurisdictional provision. The fourth and fifth chapters present the main procedural issues regarding the analysis of the general repercussion. They also study to what extent the court of origin is bound by the decision delivered by the Federal Supreme Court regarding multiple appeal judgments, as established by article 543-B, sections 3rd and 4th of the Brazilian Code of Civil Procedure. Finally, this work verifies whether such norms are in harmony with the current procedural system, notably regarding procedural principles and safeguards from the 1988 Brazilian Constitution.

Para tanto, por meio de pesquisa bibliográfica em fonte primárias relativas a tradição da common law busca evidenciar os principais pontos relativos a sua formação, bem como algumas peculiaridades existentes no Reino Unido e nos Estados Unidos da América quanto aos precedentes. O principal ponto de averiguação consiste na formação de precedentes, overruling e distinguish dos mesmos, o que implica em uma busca pela origem, definição e operação, tanto na vinculação hierárquica vertical e como na horizontal. Assim, para além das diferenças entre as tradições, a constituição dos quadros jurídicos (magistratura e advocacia) desvenda muito sobre a operação e construção do direito. Quanto ao Brasil delineiam-se alguns aspectos relevantes de sua história que contribuem para a compreensão do presente momento de crise no/do Poder Judiciário. Faz-se esse percurso para entender o porquê da existência dos recursos extraordinários e a problemática formação da federação brasileira e a concentração das competências legislativas materiais e processuais a cargo da União. Nesse cenário é importante a análise de como as modificações introduzidas pelo constituinte reformador têm a capacidade de solucionar os gargalos enfrentados pelo Poder Judiciário e em que medida a ideia de vinculação aqui implementadas refletem a experiência da common law ou tem mais similitude à tradição portuguesa dos assentos. Propõe-se, por fim, uma ideia de vinculação diferente da existente (súmulas vinculantes e de condensação de jurisprudência) a ser adotada no Brasil, que mais se aproxime a existente na common law, em que se valoriza o caso decidido e se parte para a vinculação aos motivos determinantes da decisão, ideia que tem semelhança a ratio decidendi, mas não é o mesmo que ela, em razão da forma como são realizados os julgamentos. A tentativa é de ver aquilo que pode ser útil, sem exaltação de uma tradição como melhor do que a outra, mas sim na compreensão das peculiaridades que a experiência dos precedentes na common law podem ajudar para uma vinculação que venha contribuir para uma melhor prestação jurisdicional, com uma racionalização no acesso ao Poder Judiciário, juntamente com uma otimização dos julgamentos dos tribunais de superposição para que seja viável a existência de vinculação e expansão erga omnes dos motivos determinantes das decisões. / The present study shows some conceptual differences between the two biggest families of law existing in the western - common law and civil law . The research is done through bibliographic search in primary sources of the common law tradition seeking to highlight the key points about the background as well as some peculiarities existing in the United Kingdom and the United States of America about binding precedents. The main point of investigation is the shaping of precedents, overruling and distinguish of them, which implies a search for the origin, definition and operation in its vertical and horizontal binding power. Thus, in addition to the differences between the traditions, the establishment of the judicial careers (judges and lawyers) reveals much about the operation and construction of law. About Brazil the study tries to outline some relevant aspects of its history that contributes to understand the present crisis in / of the Judiciary. In this journey tries to understand the reason for the existence of extraordinary appeal and the problematic organization of the Brazilian federation that concentrates the substantive and procedural legislative powers in charge of the federal government. In this scenario it is important to analyze how the changes introduced by the legislative power are able to solve the problems faced by the judiciary and how the idea of binding implemented here reflect the experience of the common law or has more similarity to the Portuguese tradition. By the end it is proposed a idea of stare decisis that is different from the one that exists here nowadays (binding precedents and jurisprudence condensation), which is closest to the common law tradition, where the ratio decidendi of the decided case provides to further cases the determinants reasons to the decision. The attempt is to see what can be useful, without exaltation of one tradition as better than the other, but rather in understanding the peculiarities that the experience of precedent in common law can help to provide a stare decisis that contributes to a better judicial adjudication with rationalization of access to the judiciary, together with an optimization of the judgments of the courts of superposition to be feasible to have binding judgments – erga omnes – and expansion of the determining reasons of the decisions.

The Application for an appeal review in civil court proceedings is an exceptional remedy, which may brought against final decisions of the Court of appeal. Through the application for an appeal review the Supreme Court of the Czech Republic not only corrects the defects of legal decisions of courts of appeal, but at the same time it keeps an eye on the unification of the decision-making practice of the courts of appeal. The legal regulation of the application for an appeal review is contained in particular in the Code of civil procedure, as amended, and its minor styling techniques can be found also in the Act on the special legal proceedings, and in the Act on courts and judges. Due to quite complicated legislation and high procedural demands that are placed on the application for an appeal review, is this extraordinary legal remedy a frequent subject of the decisions of the Supreme and the Constitutional Court, whose conclusions are in many decisions fundamentally distinguishing. These contradictions in such conclusions often makes legal regulation of an application for an appeal review even less transparent. Play to promote development and learning in children infected with Human Immune Virus (HIV): Case studies of three children

<p>The aim of this study was to explore the use of play with toddlers who are HIV positive to facilitate play, playfulness and sensory-motor development. The objectives were to explore how the therapist facilitated play, to explore how the child responded to the intervention, to explore how playfulness manifested as a facilitatory strategy and to explore how playfulness manifested as a response. A qualitative approach framed the case study research method with three participants between the ages of twelve months and three years. The main source of data was a record of the play-based intervention with the three participants. Additional data was obtained from participant observation of the children&rsquo / s responses to the play-based intervention, and hospital and occupational therapy record notes. A theory analytical strategy was used by coding data using theoretic propositions inductively. Each case was first analyzed individually, and then an analysis was made across the cases. Qualitative analysis of the data was done manually by coding, seeking categories and eliciting emergent themes by using an analytical strategy of theoretical propositions and an analytical technique of explanation building. Coding was done inductively, using theoretical constructs from the occupation by design, namely the elements of appeal, intactness and accuracy. Signs of playfulness were coded according to evidence of the elements of playfulness, namely perception of control, intrinsic motivation, suspension of reality or framing were evident in the data. Findings of the study were reported under two themes: Playful enablement &ndash / the therapist and Engaging, playing and developing &ndash / the child.</p>

A Study of Consumer's Cognition on Peer-to-Peer Recommendation Appeal and Tie Strength - A Case of Online Group-Buying

Online group-buying is one of the popular online business models recently. Both the initiator and participants hope to recruit more consumers to join order to aggregate larger orders and thus get cheaper price. Traditionally, consumers always invite their friends or families to join group-buying in order to collect more orders. Hope the relationship could affect their behavior. As the communication and coordination through the Internet are getting more convenient, it is easy and popular to recruit friends in larger range to join group-buying via e-mail. Further, the increasing virtual communities result from that, members have same interest, concern, and needs. It is quite possible that the members have same needs and therefore initiate a group-buying activity to fulfill many members¡¦ needs. Since information sharing is a major activity between members of virtual communities, the degree of the interactions will impact the tie strength between them. If members can send peer-to-peer recommendation email to other members who may be interested in the group-buying transaction, it may improve the group-buying performance. In addition, marketing via e-mail is getting common. The different marketing appeal results in different effect. Rational appeals focus on product itself while emotional appeal makes consumer¡¦s feeling change. The purpose of this research is to explore the difference in advertisement attitude between consumers clicking the peer-to-peer recommendation e-mail and consumers not clicking it. We also examined if these two groups have different cognition of tie strength with the e-mail sender. The result shows the group clicking the recommendation mail has better advertisement attitude than the group not clicking. Intergenerational Appeal in Luxury Product Advertising: Impacts of Brand-Gender Extension and Brand Duration

¡§Intergenerational (IG) appeal¡¨ is an ad focusing on the relationship between parents and children in order to enhance heritage image of a brand and facilitate the likelihood that parents introduce the brand to their sons and daughters. This study examines the application of IG appeal on advertising. An experimental study is conducted to examine the moderating effects of brand duration and (in)congruent brand-gender extension on the effect of IG appeal. The experiment in a 4 advertising appeal (IG appeal: male vs. female, non-IG appeal: male vs. female) x 2 brand duration (long vs. short) x 2 brand-gender extension (congruent vs. incongruent) factorial design is developed. A series of analysis of variance (ANOVA) are used to test the proposed hypotheses. Results of the experiment indicate that brand duration facilitates the effects of IG appeal. In addition, congruent brand extension increases the effects of IG appeal. More importantly, a three-way interaction is observed. In incongruent brand-gender extension, IG appeals used to present brands with short brand duration are more effective than Non-IG appeal. These findings should be incorporated into heritage branding when media campaign is developed to increase branding influences.

Self-Focused or Other-Focused Appeal? Impacts of Non-Profit Organization Type and Cultural Differences on Cause-Related Marketing

¡@¡@With the concern of corporate social responsibility, companies acting as a good citizen has become an important issue. Cause-related marketing (CRM) refers to a company¡¦s aliance with a non-profit organization (NPO): when customers buy the company¡¦s products, the company donates a portion of their profits to the NPO. Through CRM, corporates can effectively enhance their images and customer evaluations. NPOs can increase their visiablity and incomes as well. Customers are able to help NPOs through produce purchase. Therefore, how to enhance the effectiveness of CRM has become a very important issue for both researchers and practitioners. ¡@¡@Based on the previous research in CRM, consumer behavior, and cross-cultural psychology literature, the present study develops a theoretical framework and hypotheses. By using the 2*2*2 experimental design with a cross-cultural sample, the present study examines whether impacts of type of NPO (help-self versus help-others) and national cultures (masculinity versus femininity) interact with two types of advertising appeals (self-focuses versus other-focused) in adverstising persuasion (purchase intentions and corporate image evaluation). The data were collected from 82 Taiwan respondents and 62 Germany respondents, with 15 to 20 respondents for each condition. Multivariate analysis of covariance was performed to test the proposed hypotheses. ¡@¡@The results showed that type of NPO interacts with advertising appeals in advertising persuasion: When consumers perceive a NPO¡¦s nature as help-self, self-focused appeal leads to higher purchase intentions and more favorable corporate image evaluation. In addition, the three-way interaction among type of NPO, national culture and advertising appeals is also significant. The effects of self-focused appeal on advertising persuation are strengthened when a NPO wih help-self orientation is chosen as a cause in a country with masculine culture. Theoretical, methodological, and practical implications are discussed.

The Influence Of Visual Appeal On Perceived Usability

Usability is regarded as one of the most important factors that consumers consider while purchasing products, however it is difficult to judge usability unless the user actually uses the product. Perceived usability is influential for consumers when identifying a product as usable and purchasing it. This study concentrates on the relationship between visual appeal and perceived usability especially for consumer products. The influence of visual appeal on perceived usability for consumer products is scrutinized through the findings of an empirical study besides a broad literature review. In the literature, there are many studies -mostly dealing with the HCI products- claiming that visual appeal affects users&rsquo / perceptions of usability. However, the empirical study results indicate that the relationship between visual appeal and perceived usability is not clear for consumer products as the relationship declared in the literature.
