Previous issue date: 2015-08-07 / The present work focuses the interpretation of the penalty reduction cause of the 4th paragraph of the 33th article of the 11.343/06 law, starting from the identification of the exegetical problems contained in its text, reaching to the solution that preserves its concrete application without harming constitutional principles, what´s done throughout the technique of the constitutional conforming interpretation. Basing this conclusion, the analysis begin with the actual modern context of the criminal thought in doctrine, the risks society and it´s influences, that enforce the need of promoting the guarantist constitutionalism proposed by Luigi Ferrajoli, in order to preserve the fundamental rights and of individuals and meet the constitution in all its terms . In this context, we make a criticism of the anti-guarantist practice of basing the penalty dosimetry on judicial discretion, that has been used to enable the application of the rule under consideration / O presente trabalho enfoca a interpretação da causa de diminuição de pena do parágrafo 4º do artigo 33 da Lei nº11.343/06, partindo da identificação dos problemas exegéticos que o texto da lei contém até chegar à solução que preserva a concreta aplicação da norma sem ferir princípios constitucionais, o que é feito através da técnica da interpretação conforme a constituição.

Da leitura poética à prdução do gênero artigo acadêmico-científico: uma proposta para o ensino na educação superior / From poetry reading to the production of article academic-scientific genre: a proposal for teaching Higher EducationSilvia Helena Nogueira 15 April 2008 (has links)
This thesis deals with the Portuguese Language teaching in Higher Education, considering the reading and writing as tools for the expansion of the universe of literacy of students. The strategy chosen was the study the speech genres, in a way that started from the poem - motivating and triggering the process - to got to the production of academic genres with the features and linguistic brands own among which the use of the standard cult default. The main objective was to present an operational proposal of language teaching that took the students of Business Administration course to read and produce texts accord to their academic needs, competently, in the short period of one academic year. The benchmark included theoretical studies on the speech analysis, authorship, dialogical enunciation, enunciative heterogeneity, speech genres, literacy, textual linguistics and linguistic variation developed by several authors, among them Bakhtin, Brandão, Bronckart, Dolz & Schneuwly, Fávero, Kleiman, Koch, Jordan, Maingueneau, Moraes, Quadros Leite, Santos, Silva, Soares and Travaglia. It also consulted texts to support the analysis of literary texts, such as Arrigucci Jr., Cândido, Zilberman and Paz. The result of the search illustrated by the corpus examined in chapter 5 and in the annexes search to show the relevance of the formation of the reader, as vital step in that the student takes the role of producer of texts, as well as the innovative nature and operational of the work supported in the speech genres to form writers of specific discursive genres.

A influência de autores estrangeiros no aumento de citações em periódicos brasileiros de medicina: uma análise bibliométrica / The influence of foreign authors on citations increase in Brazilian medical journals: a bibliometric analysisMontefusco, Adilson Marcos 23 February 2018 (has links)
Idioma, tipo do documento, indicador Scimago (cites per doc - 2 years) e categoria do assunto do periódico influenciaram significantemente o número de citações recebidas / Introduction: The challenge of increasing the impact of Brazilian science has been much discussed. Compared with other countries, Brazil has a high publication rate, but with low citation index per document. While sponsoring and research institutions are proposing international cooperation as a means of increasing the impact of science, journal editors question this demand. Objective: To evaluate whether, in Brazilian medical journals, the number of received citations is influenced by the type of authors affiliation and other variables related to the document or to the journal. Methods: A total of 61 medical journals published in Brazil in 2012 were analyzed, SCImago and Scopus were used to extract the articles and their data. The number of citations of a document over five years was analyzed according to the authors\' affiliation (national, international or in collaboration), language and document type, SCImago index and journal subject category. Results: Univariate analyses showed that all tested variables influenced the number of received citations. After adjusting for covariates by multivariate analysis, we observed an increase of citations in 0.17 (95% CI: 0.094-0.246) for documents with affiliation in collaboration when compared to national affiliation. A significant increase in the number of citations was observed in bilingual documents (English and Portuguese) 0.329 (95% CI: 0.256-0.402) and only English 0.158 (95% CI: 0.086-0.231) when compared to documents in Portuguese, document type: Article 1.716 (95% CI: 1.410-2.021) and Review 2.931 (95% CI: 2.618-3.245) when compared to Article-in-Press and that have subject category Hematology 1.280 (95% CI: 1.019-1.540), among others, when compared to geriatrics and gerontology. Conclusion: Documents with authorship in collaboration increased, in a discreet way, the citation index in journals of interest, when compared to those with national authorship. Language, document type, SCImago index (cites per doc 2 years) and journal subject category significantly influenced the number of received citations

L'insaisissable famille / The elusive familyRongier, Valérie 14 December 2015 (has links)
While it was initially born out of the ideals set out first by the Church and then by the Civil Code, family in the 21st century is really the offspring of the unprecedented upheavals that have shaken society as a whole. For centuries, the essential role of family was linked with cross-generational patrimonial and cultural transmission. Nowadays, family must instead facilitate the individual development and self-realization of every single one of its members. The family is an institution that is decreasingly bounded by predetermined norms, forms, and codes, not least because it must align itself to the individual right to a “normal family-life”, to which Article 8 of the European Convention of Human Rights is dedicated. More or less everything is now possible in terms of family make-up. One can now choose one’s legal sex/gender (transgenderism), decide to establish a family, or live alone, without society being particularly affected by any of it. The ties and roles of each individual in the family are no longer perennial, no clearly defined. Scientific progress (through which efficient contraception became available) and the sexual revolution have completely transformed sexuality, romantic relationships, and procreation. There is no longer a single model for the romantic relationship, based on the marriage of a man to a woman. The couple is now homosexual or heterosexual, and individuals may choose whether they want to live together or be faithful. They can also choose if and when to get married, to separate, to be joined in a civil union (pacs), or to simply live under the same rooftop. In other words, conjugality is now pluralistic and rests on the equality both of the individuals constituting the couple, and between different models of romantic relationships. Relationships between parents and children have also been completely changed. Parenting is gradually gaining on kinship. Filiation will soon be forced to reckon with the different procreational recipes. Various assisted reproductive technologies, including artificial insemination, surrogacy, and the artificial uterus must change the ways in which kinship is established since it can no longer simply be deduced from biological ties. The law will have to respond to new social and sociological aspirations, and will sometimes even have to do so under international influence or pressure. It will, in fact, have to find a new equilibrium between individual freedoms, and the institutional dimensions of the family.

”Delaktighet är ju svårt” : Barns delaktighet i barnavårdsutredningar ur socialsekreterares perspektiv / “Participation is… hard” : Children’s participation in child protection investigation from the perspective of the social workerJohansson, Linnea, Poijes, Matilda January 2019 (has links)
The aim of this study is to examine how social workers within the child protective services define children’s participation and what the strategies are to achieve it. Our method was to interview six social workers about their experiences of their pursuit to make children participate during a child protection investigation. The theoretical framework we used to analyze our results was Shier’s pathways to participation. This model is based on five levels of participation, which has different degrees of participation for children. The main finding of this study was that the social workers define children participation as that they should be listen to, be informed and have the ability to choose in what way they participate. Furthermore, we can see from the social workers descriptions about their strategies and the structure of the organisation that they live up to parts of Shier’s criterias for level one, two and tree. Our results both confirm and contrast international and national studies in this field of research.

Alternatives to the use of unequal voting rights : a propos the potential threat to their effectiveness as a takeover defense / Alternativ till användandet av röstdifferentierade aktier : apropå hotet till deras effektivitet som uppköpsförsvarAhlqvist, Malin January 2004 (has links)
<p>Background: The origin of this study was the negotiations around a EU takeover directive, aimed at making the market for corporate control more open. One of the proposals was to neutralise shares carrying multiple rights in takeover situations when a potential acquirer obtains 75% of the total share capital. For many Swedish ownership groups, this would mean that the system of unequal voting rights, constituting an important defense to their control, would decrease in effectiveness. In the middle of writing this thesis, an EU agreement was finally reached, making the proposal voluntary to adopt. The imminent threat posed to the Swedish system faded, but has though not disappeared since the present rules anew will be brought under inspection in five years. </p><p>Purpose: To give examples on potential tactics to adopt if unequal voting rights would risk to become neutralised in takeover situations, these tactics dependent on two different scenarios: (1) Present Swedish ownership structure is considered advantageous for the country and thus to be remained or (2) A more open market for takeovers is desired. Course of action: Interviews have been conducted with parties within Swedish trade and industry, partly in order to assess the value and necessity of the content of this thesis. </p><p>Conclusion: The threat of an abolition of the unequal voting rights is not perceived as imminent by parties within Swedish trade and industry and few alternative resistance strategies are suggested. If current Swedish ownership structure is to be remained, the author proposes competition-reducing defenses, if a more open market for takeovers is aimed for, auction-inducing resistance strategies. The choice of how to proceed should depend on how afraid the Swedish Government and Swedish companies are of a change in present ownership structure.</p>

Suggested actions to improve the warehouse layout at Nordic E-commerce groupEricsson, Sandra, Frid, Marielle January 2013 (has links)
Background: Nordic E-commerce group (NECG) consists of affiliated companies NordicInk, NordicFeel and PetsOnline. Three different types of companies in one warehouse area contribute to a wide range of products held in inventory. NECG’s problem derives in the fact that the company’s warehouse layout needs to handle a larger volume of sales, but is not capable of doing this in a structured way today. This matter of fact has led to new thoughts concerning improvements of the layout. The warehouse layout referred to in this thesis includes input and output doors, receiving and outgoing areas, material handling equipment and the placement of articles in inventory. Although article placement is per definition a part of warehouse layout, it will be given extra emphasis in this thesis as it is one of NECG’s most critical issues. Purpose: The purpose of this thesis is to identify NECG’s current warehouse layout and article placement and the problems associated with it, as well as to provide suggested actions for improvements. This is to be done so NECG can better utilize the warehouse space, and thus prepare the warehouse to handle a larger volume of sales. Methodology: Qualitative and quantitative data was collected through semi-structured interviews and observations at NECG, as well as through excel files containing transactional data for NordicInk’s products. Through a non-probability, snowball selection the respondents were chosen. There have not been any requirements from NECG regarding confidentiality in terms of the warehouse layout. Findings: There are a number of suggested actions that NECG may apply to improve the warehouse layout; two separate doors for incoming and outgoing deliveries, one designated receiving and one outgoing area, and a flow shop layout combined with a U-form layout would be the most beneficial for NECG’s warehouse. Furthermore, NECG needs a more consistent article placement and it is recommended for the company to apply a floating location system to its high-picked products and a fixed location system for its low-picked products. This will make NECG take better use of the available space and a more structured warehouse will be achieved.
