It also originated claims for stronger regulatory framework in order to avoid another threat in the financial market. The Dodd Frank Act was proposed and approved in the United States in the aftermath of the crisis and brought, among many other features, the creation of the Financial Stability Oversight Council and the tougher inspection of financial institutions with asset above 50 billion dollars. The objective of this work is to study the causal effect of the Dodd Frank Act on the behavior of the treatment group subject to monitoring by the Financial Stability Oversight Council (financial institutions with assets above 50 billion dollars) regarding capital and compensation structure in comparison to the group that was not treated. We use data from Compustat and our empirical strategy is the Regression Discontinuity Design, not usually applied to the banking literature, but very useful for the present work since it allows us to compare the treatment group and the non-treatment group in the year of the enactment of the law (2010). No change of behavior was observed for the Capital Structure. In the Compensation Schemes, however, a decrease was found in the item other compensation for CEOs and CFOs. We also performed a robustness check by running a placebo test on the variables in the year before the law was enacted. No significance was found, which supports the conclusion that our main results were caused by the enactment of the DFA. / A crise financeira com características sistêmicas que começou em 2008 nos Estados Unidos teve efeitos severos na atividade econômica e demandou o salvamento de algumas instituições financeiras com o uso do dinheiro dos impostos. Também gerou clamores por uma regulação mais estrita de forma a evitar uma nova ameaça no mercado financeiro. O Dodd Frank Act foi proposto e aprovado nos Estados Unidos após a crise e trouxe, além de outras características, a criação do Financial Stability Oversight Council e a maior fiscalização das instituições financeiras com ativos acima de 50 bilhões de dólares. O objetivo deste trabalho é estudar o efeito causal do Dodd Frank Act no comportamento do grupo de tratamento sujeito ao monitoramento do Financial Stability Oversight Council (instituições financeiras com ativos acima de 50 bilhões de dólares) com relação à estrutura de capital e de remuneração em comparação com o grupo que não recebeu o tratamento. Usamos dados do Compustat e nossa estratégia empírica é o Regression Discontinuity Design, que não é usual na literatura que analisa bancos, mas que nos permite comparar o grupo de tratamento e o grupo não tratado no ano em que a lei entrou em vigor (2010). Nenhuma mudança de comportamento foi observada na estrutura de capital. Com relação à remuneração. No entanto, encontramos uma queda no item Other Compensation para CEOs e CFOs. Também rodamos um cheque de robustez com um teste placebo nas variáveis no ano anterior à entrada em vigor da lei. A eficácia da regulação prudencial, no sentido de manter o sistema financeiro saudável, depende do modelo de ciclo econômico considerado na sua elaboração, na medida em que estes afetam os valores dos ativos que compõem os balanços e os passivos contingentes das instituições financeiras. Este trabalho trata da evolução que o Acordo da Basiléia II e os novos modelos de risco a ele associados representam em relação ao primeiro Acordo, bem como das limitações que continuam pendentes / Abstract: Accordingly with economic theory employed, foreseeing economic cycles acquires proper characteristics: some suppose a pre-existing regularity, which is foreseeable by stochastic models on real business supply costs; other ones include temporary deviations from market to real values during the cycle time period but real values are detectable if we work in a longer time horizon; a third model has also considered permanent changes in market attributed values although they are not always predictable. The prudential regulation effectiveness - in the sense of reaching a soundness financial system ¿ depends on economic cycle model used in its development because of their influence in banks¿ balance asset values and contingent liabilities. Řešení bankovních krizí / Resolving banking crises

The Diploma Thesis deals with the banking crisis and aims to account for different approaches to the understanding of the nature of banking crisis. The Thesis further aims to provide answers why the banking crisis are caused and why so far there are no measures that would effectivelly prevent such crisis. At first, the Thesis states the definition of banking with the emphasis on banks as the institutional backbone of the current functioning of the financial system. The Thesis pays specific attention to the characteristics of two basic legal banking instruments, particulary loans and deposits. While acknowledging the loan expansion, the thesis argues the role of regulatory authorities and the limits of their competences in regards to the prevention of crisis. Followingly, the Thesis offers a view on a banking crisis phenomenon with appropriate historical overview outlining the banking crisis in Czechoslovakia in years 1918 to 1939 and after 1989, the loan expension influence on the business cycles and approaches to banking crisis solving in respect to stabilization of the banking system and restructuring of banks. At last but not least, the Thesis sums up the global financial crisis that started as a banking crisis, respectively as a crisis of one segment of the banking market in the United States...

Essais sur l'incidence de l'environnement institutionnel sur les décisions financières des firmes / Essays on the incidence of the institutional environment on corporate financial decisions

Les imperfections des marchés financiers et l'incomplétude des contrats financiers compliquent la conclusion d'ententes entre les firmes et les parties prenantes. Plusieurs solutions sont proposées pour réduire ces problèmes et faciliter la conclusion des contrats financiers. Les contrats étant enveloppés par un cadre institutionnel, ils en sont imprégnés et affectés. Les institutions sont donc une des solutions aux imperfections des marchés et à l'incomplétude des contrats. Les résultats de notre étude le prouvent clairement. Cette étude montre que le niveau de développement et la structure du système financier (en particulier la part relative des financements bancaires et de marché), les conditions de régulation du système bancaire (les formes et l’étendue de la supervision) et certaines caractéristiques des systèmes juridiques (la protection des créditeurs), ont un effet significatif sur les contraintes d'investissement. Il apparaît que la bonne qualité des institutions facilite l'accès aux financements et qu'elle renforce les garanties exigées pour l'octroi de la dette. De fait, la piètre qualité des institutions d’un pays constitue une entrave à l'accès au financement par le secteur privé. / The imperfections of financial markets and the incompleteness of financial contracts cause commitments between firms and stakeholders to become more complex. Several solutions are suggested in order to reduce such problems and to facilitate the conclusion of financial contracts. Contracts evolve within an institutional structure, an environment by which they are conditioned. Institutions are one of many solutions to market imperfections and to contract incompleteness. Results bring out relevant effects of the financial system’s development and structure (particularly the amount of banking over market financing), banking regulation (the supervisory methods and their extent) and some characteristics of the legal systems (such as creditor protection) on investment constraints. It appears that sound and healthy institutions facilitate access to funding and strengthen the collateral required to secure bank financing. Consequently, poor quality of a country’s institutions hinders access to financing by the private sector.

Studien har hämtat empiri genom semistrukturerade intervjuer med fem olika AML-chefer på den svenska bankmarknaden.  Resultat/Slutsatser: Studiens resultat visar hur AML-chefer i Sverige har en kritisk syn på penningtvätts-regelverken. Regelverken upplevs ställa höga, men rimliga, krav på bankerna. Flera fördelar med det riskbaserade förhållningssättet lyfts upp, där riskbedömning och kundkännedom ger en god överblick av verksamheten i ett bolagsstyrnings-perspektiv. Regelverken låter bankerna stänga ute de kunder som inte vill samarbeta. Tyvärr kan dessa kunder gå vidare till nästa bank och fortsätta sitt misstänksamma beteende. Detta problem grundar sig i banksekretessen som gör det omöjligt för banker att dela information och samarbeta i arbetet mot penningtvätt. These regulations set strict requirements at the same time as the risk- based approach allows banks to interpret and implement the regulations in various degrees. By studying how Swedish AML-managers experience these regulations, this study contributes with a point of view that has not been considered in Sweden previously.  Purpose: This study aims to increase the understanding of attitudes and experience towards AML and its regulations within Swedish banks, if it differs between banks and what it could signify for involved parties.  Method: A qualitative study with an abductive research approach has been conducted. The study has gained empirical data through semi-structured interviews with five different AML managers in the Swedish banking market.  Results/Conclusions: The results of the study show how AML managers in Sweden have a critical view of the money laundering regulations. The regulations are perceived to put high, but appropriate, requirements in the banks. Various advantages of the risk-based approach are highlighted, where risk assessment and customer awareness (KYC) provide a good overview of the business from a corporate governance perspective. The regulations allow banks to end their business relationship with customers who do not want to cooperate. Unfortunately, these customers are able continue their suspicious behavior throughout different banks. This problem is based on the bank secrecy, which makes it impossible for banks to share information and cooperate in the work against money laundering. The study shows how the incentives behind compliance with the regulations are largely based on the fear of damaging reputation or receiving heavy fines. The focus has shifted from actually trying to stop money laundering, to only avoiding being subjected to money laundering themselves.
