Ses principales propriétés sont : confluence, forte normalisation, conservation du type (dans une forme parallélisée de réduction). Seuls les termes équivalents aux entiers de Church ont le type entier. La comparaison avec le système d'exceptions du langage Caml est développée. Mais le plus remarquable est que la logique du système n'est pas la logique classique mais la logique intuitionniste.

La justification du droit d'auteur dans l'environnement numérique

Les progrès techniques qui caractérisent la révolution numérique modifient les rapports au sein de la société. Elle est sans conteste à la base d'une profonde modification du caractère de la création artistique. L'avènement de nouveaux moyens de communication de masse tels que l'Internet permettent la diffusion des oeuvres et cela sans frontières géo-temporelles. À ce contexte se superposent des prouesses techniques défiant les rêves les plus irréels. Le droit d'auteur se trouve confronté aux nouvelles techniques qui s'améliorent sans cesse. En réponse à cela, la gestion numérique des droits est apparue en tant que solution la plus appropriée: la technologie venant contrer à son tour la technologie. Cette approche a nécessairement influencé les initiatives législatives menant ainsi à une refonte du cadre légal tant en Amérique du Nord qu'en Europe. La récente vague de lois a-t-elle eu pour effet de modifier la conception du droit d'auteur ? Le droit d'auteur apparaît alors tel un instrument permettant la métamorphose économique du droit d'auteur. Le droit d'auteur se perd et se dissout non seulement par l'influence croisée avec le copyright mais notamment par la prolifération des droits au profit de personnes non auteur. Face à un tel constat, il est primordial de s'interroger sur l'opportunité économique que procure le droit d'auteur. Toutes ces réformes n'ont-elles pas eu lieu pour des enjeux financiers ? L'analyse économique s'avère indispensable afin de déterminer dans quelle mesure le droit des marchés s'en trouve affecté. Au regard de l'analyse économique, est-il possible de rendre la loi pour la protection du droit d'auteur plus optimale? En tant que propriété utile et vouée à circuler, une logique d'investissement semble dominer. Le cas de l'industrie musicale est une bonne illustration. Avec la construction d'un marché du téléchargement légal, la concurrence s'ouvre et amorce l'avènement d'un nouveau modèle d'exploitation des oeuvres. / The technical advances characterising the digital revolution do modify relations within society. This revolution is without dispute the basis of a complete change in the character of artistic creation. The arrivaI of new mass media such as the Internet allows works of art to be spread regardless of space and time boundaries. Technical miracles defying even the most unrealistic dreams are added to this context. Authors' rights are confronted to new technologies which are continually changing. In response to this, digital rights management has appeared as the most appropriate solution: it is a case of technology confronting technology. This approach has necessarily influenced legislative initiatives and led to an overhaul of the legal framework in North America as weIl as in Europe. Ras this recent wave of laws changed the conception of authors' rights? Authors' rights thus appear as an instrument for the economic metamorphosis of authors' rights. Authors' rights become lost and dissolve not only through cross influence with copyright but particularly through the proliferation of rights for the benefit of persons other than authors. In the face of such an acknowledgement, it is of the utmost importance to look into the economical opportunity offered by authors' rights. Raven't aIl these reforms been implemented for a financial stake? An economical analysis becomes essential in order to determine to what extent market law is affected. Is it possible, in regard to the economical analysis, to optimize the law for the protection of authors' rights? As useful property destined to circulate, the logic of investment appears to dominate. Exploiting Context in Dealing with Programming Errors and Exceptions in the IDE

Studies show that software developers spend about 19% of their development time in web surfing. While collecting necessary information using traditional web search, they face several practical challenges. First, it does not consider context (i.e., surroundings, circumstances) of the programming problems during search unless the developers do so in search query formulation, and forces the developers to frequently switch between their working environment (e.g., IDE) and the web browser. Second, technical details (e.g., stack trace) of an encountered exception often contain a lot of information, and they cannot be directly used as a search query given that the traditional search engines do not support long queries. Third, traditional search generally returns hundreds of search results, and the developers need to manually analyze the result pages one by one in order to extract a working solution. Both manual analysis of a page for content relevant to the encountered exception (and its context) and working an appropriate solution out are non-trivial tasks. Traditional code search engines share the same set of limitations of the web search ones, and they also do not help much in collecting the code examples that can be used for handling the encountered exceptions. In this thesis, we present a context-aware and IDE-based approach that helps one overcome those four challenges above. In our first study, we propose and evaluate a context-aware meta search engine for programming errors and exceptions. The meta search collects results for any encountered exception in the IDE from three popular search engines- Google, Bing and Yahoo and one programming Q & A site- StackOverflow, refines and ranks the results against the detailed context of the encountered exception, and then recommends them within the IDE. From this study, we not only explore the potential of the context-aware and meta search based approach but also realize the significance of appropriate search queries in searching for programming solutions. In the second study, we propose and evaluate an automated query recommendation approach that exploits the technical details of an encountered exception, and recommends a ranked list of search queries. We found the recommended queries quite promising and comparable to the queries suggested by experts. We also note that the support for the developers can be further complemented by post-search content analysis. In the third study, we propose and evaluate an IDE-based context-aware content recommendation approach that identifies and recommends sections of a web page that are relevant to the encountered exception in the IDE. The idea is to reduce the cognitive effort of the developers in searching for content of interest (i.e., relevance) in the page, and we found the approach quite effective through extensive experiments and a limited user study. In our fourth study, we propose and evaluate a context-aware code search engine that collects code examples from a number of code repositories of GitHub, and the examples contain high quality handlers for the exception of interest. We validate the performance of each of our proposed approaches against existing relevant literature and also through several mini user studies. Finally, in order to further validate the applicability of our approaches, we integrate them into an Eclipse plug in prototype--ExcClipse. We then conduct a task-oriented user study with six participants, and report the findings which are significantly promising.

O trabalho faz um histórico do debate sobre comércio e meio ambiente - a partir da Conferência de Estocolmo, em 1972, considerada por este trabalho como marco do Direito Ambiental Internacional - e também analisa como esta temática foi inserida no sistema Acordo Geral sobre Tarifas e Comércio (GATT/OMC). Além disso, discorre sobre a emergência e posterior consolidação do princípio do desenvolvimento sustentável, de conceito multifacetado, que visa conciliar as várias formas de desenvolvimento, como o econômico e o social, com a proteção e preservação do meio ambiente. A preocupação com a preservação do meio ambiente e com os problemas ambientais ganhou relevância, principalmente, a partir dos anos 90, com o estabelecimento de grandes conferências internacionais no âmbito da Organização das Nações Unidas, o que influenciou outras organizações internacionais, como a OMC, a também adotarem algumas regras ambientais. No âmbito da OMC, a temática ambiental é centrada no artigo XX do GATT 1994, foco deste trabalho, que trata das exceções gerais. Por este artigo os Membros da OMC podem adotar regras contrárias ao sistema multilateral de comércio para salvaguardar, por exemplo, a vida e a saúde das pessoas e demais seres vivos e para a conservação dos recursos naturais não-renováveis. Pela análise deste artigo e de alguns casos estabelecidos perante o Órgão de Solução de Controvérsias, tentaremos entender se num embate real entre regras comerciais e ambientais, o interesse econômico irá prevalecer sobre os interesses ambientais / Abstract: This research aims to understand and analyze the interaction between issues of trade and environment since the creation of the sustainable development principle in the early 1970s, until the adoption of the Marrakesh Agreement in 1994, which established the World Trade Organization (WTO). The work makes a description of the debate on commerce and environment - from the Stockholm Conference in 1972, considered by this study the landmark of the International Environmental Law - and also analyzes how this thematic was included in the General Agreement on Tariffs and Trade (GATT/WTO) system. Moreover, it discourses on the emergency and subsequent consolidation of the sustainable development principle, multifaceted concept, which seeks to conciliate the various forms of development, such as economic and social development, with the protection and preservation of the environment. The concern for environmental preservation and environmental issues gained prominence, mainly from the 90s with the establishment of major international conferences in the United Nations, which has influenced other international organizations like WTO, also to adopt some environmental rules. In the WTO, the environmental theme is centered on Article XX of GATT 1994, the focus of this work, which deals with general exceptions. For this article, WTO Members may adopt rules that conflict with the multilateral trading system to safeguard, for example, life and health of humans and other living beings and for the conservation of nonrenewable resources. Na atual economia de mercado, mostra-se cada vez mais relevante a estruturação equilibrada do sistema de patentes, em razão das controvérsias geradas em torno do pêndulo: estímulo à inovação e desenvolvimento técnico-científico de um lado, e ônus sociais, de outro. Isso porque, o direito de exclusividade sobre a invenção - que envolve o desenvolvimento técnico com base em conhecimentos pré-existentes - gera custos sociais, uma vez que a sociedade, como um todo, fica impedida de usufruir dos avanços tecnológicos durante um período de tempo (prazo da patente), bem como fica submetida aos preços e à forma de exploração econômica ditada pelo titular. O sistema de patentes precisa ser minuciosamente equacionado de maneira a lidar com os benefícios do titular da patente e da sociedade. Nesse contexto, surge a importância de dois institutos jurídicos: a exclusão ao patenteamento (ou proibição do patenteamento de determinadas matérias) e a exceção ao exercício do direito de exclusividade do titular da patente (ou limitação do direito de patente). O presente estudo tem por objetivo analisar, no Direito Comparado (tratados internacionais, tratados regionais e legislações estrangeiras), os institutos das exclusões e das exceções ao direito de patente diante, principalmente, dos novos desenvolvimentos em áreas como engenharia genética, biologia molecular e informática, a fim de verificar se há uma harmonização internacional; se há diferença em posições adotadas de acordo com o nível de desenvolvimento do país; e a regulamentação dessas hipóteses no Brasil. Ao final, pôde-se verificar, com base na análise de Direito Comparado, como os países estrangeiros lidam com as novas invenções, as diferentes posições adotadas na legislação ou na contrução jurisprudencial, o que torna qualquer intenção de harmonização um caminho ainda longe de ser alcançado; e o posicionamento adotado no Brasil e eventual proposta de interpretação. / The market economy today has evidenced the increasing importance of a structured and balanced patent system in view of the controversy that has arisen, creating a pendulum that swings between the stimulus for technological-scientific innovation and development on the one end, and the resulting social burden on the other. This is because the right to exclusivity of an invention which involves technological development based on preexisting knowledge - generates social costs since the society at large is impeded from enjoying technological advances during a certain period of time (the patent term), and moreover is submitted to prices and methods of economic exploitation determined by the patent holder. The patent system must be thoroughly restructured to deal with the patent holders benefits versus the demands of society. Within this context, the importance of two legal principles emerges: patenting exclusions (or prohibited patenting of certain items) and exceptions and limitations on the exercise of the right to exclusivity granted the patent holder (or limitation of the patent right). The purpose of this study is to analyze from the standpoint of Comparative Law (international treaties, regional treaties and foreign legislation) the principles of exclusions and exceptions and limitations on patent rights, mainly considering the new developments in areas such as genetic engineering, molecular biology and information technology to confirm whether there is international harmonization; whether there is a difference in the stands adopted according to the level of development in the country and regulation of these events in Brazil. Finally, based on Comparative Law it can be seen how foreign counties deal with new inventions, the different stands adopted in their laws or in construction of case law, all of which make any intention for attaining harmonization a long path to be tread; and to conclude the stand adopted in Brazil with proposals for interpretation.

Au 20è siècle, l’Internet a commencé à se développer. En matière de propriété littéraire et artistique, l’incidence des nouvelles technologies sur la création fut réelle et parfois positive. Cependant, les nouvelles technologies causent des conséquences négatives sur la création elle-même. C’est le phénomène du piratage des œuvres sur l’Internet. Les prérogatives d’auteur sont alors menacées, car tous les citoyens peuvent être des consommateurs des œuvres sans difficulté, ni rémunération pour l’auteur. Alors que la législation vietnamienne dans cette matière est encore silencieuse, aucune étude pertinente et approfondie n’existe pour l’instant au Vietnam. Cette thèse vise à apprécier l’efficacité de la protection et de l’exploitation du droit d’auteur dans le cyberespace au Vietnam tant en théorie qu’en pratique.La première partie se consacre à l’étude des enjeux de l’application du droit d’auteur dans le cyberespace. L’analyse porte au premier rang sur les influences de l’Internet sur les droits d’auteur. Il s’agit donc d’étudier les caractères ainsi que les attributs des prérogatives morales et patrimoniales de l’auteur afin d’analyser pourquoi et comment l’Internet peut les influencer. Le développement de ce travail aborde ensuite l’exploitation du droit d’auteur dans cet environnement. La pertinence de l’étude de cette question se trouve dans l’idée selon laquelle sans l’exploitation, les prérogatives de l’auteur sont dépourvues de valeur.La deuxième partie porte sur les mesures de protection du droit d’auteur ainsi que les aspects de droit international privé. À ce titre, deux types de mesures de protection des droit d’auteur sur l’Internet sont envisagés, à savoir d’une part, l’engagement de la responsabilité des acteurs relatifs à l’exploitation des œuvres sur l’Internet, et d’autre part, le renforcement des sanctions civiles, administratives tant que pénales. En outre, pour une meilleure protection du droit d’auteur sur l’Internet, les conflits de juridictions ainsi que les conflits de lois pour des litiges ayant des éléments d’extranéité provoqués par l’espace sans frontière comme Internet doivent être résolus. En effet, est retenu en général pour la détermination du tribunal compétent, un principe selon lequel le tribunal du domicile du défendeur est compétent de juger ainsi que le tribunal du lieu du délit. Quant à la loi applicable, d’après un principe posé par la Convention de Berne, dit lex loci protectionis, l’étendue et les moyens de recours garantis à l’auteur pour sauvegarder ses droits sont réglés exclusivement par la législation du pays où la protection est réclamée. / In the 20th century, the Internet began to develop. In terms of literary and artistic property, the impact of new technologies on the creation was real and sometimes positive. However, new technologies are causing a negative impact on the creation itself. This is a piracy phenomenon on the Internet. The prerogatives of author are so threatened because all persons can become consumers of the works without difficulty, or compensation for the author. While the Vietnamese law in this area is still quiet, the relevant study is currently rare in Vietnam. This thesis aims to assess the effectiveness of the protection and of the exploitation of copyright in cyberspace in Vietnam both in theory and practice.The first part is devoted to study of issues in the application of copyright in cyberspace. In this part, the influences of the Internet on copyright are firstly mentioned. It is therefore to study the characteristics and the attributes of prerogatives of the author to analyze why and how the Internet can influence them. The development of this work addresses the exploitation of copyright in this environment. The relevance of the study of this question lies in the idea that without the operation, the prerogatives of the author have no value.The second part focuses on copyright protection measures and aspects of private international law concerning copyright. As such, two types of measures to protect copyright on the Internet are considered, namely the one hand, the commitment of the responsibility of actors of the Internet for the exploitation of works in cyberspace, and the other hand, the strengthening of civil remedies as well as administrative and criminal penalties. In addition, for better protection of copyright on the Internet, conflicts of jurisdiction and conflicts of law in disputes with foreign elements caused by the border-free area such as the Internet must be resolved. In fact, is usually chosen for the determination of the competent court, a principle that the court of the place of the defendant is competent to judge and the court of the place of the offence. For the applicable law, according to principle laid down by the Berne Convention, said lex loci protectionis, the extent and the remedies afforded to the author to protect his rights shall be settled exclusively by the law of the country where the protection is claimed.

La condition, la forme et la justification théorique des exceptions sont aujourd’hui au coeur du débat sur l’avenir du droit d’auteur. L’objectif primaire de ces normes particulières est de garantir la cohérence du droit d’auteur. Et pourtant les chercheurs s’accordent sur la nécessité de leur reconceptualisation.Cette thèse a pour but de découvrir la signification, les origines et les conséquences de la crise qu’engendre le ressentiment à l’égard des exceptions aux droits de l’auteur dans leur forme actuelle. Tenant compte d’une certaine fragilité axiologique de la matière, elle essaie d’appréhender les phénomènes étudiés selon une posture épistémologique neutre. À cet égard, la théorie des paradigmes scientifiques lui offre un cadre d’analyse scindé en deux. La reconstruction de l’état normal et voulu des principes élaborés par la tradition française du droit d’auteur en matière des exceptions permet de repérer les signes de leur dépassement par la réalité juridique mouvante.De cette analyse résulte d’abord le modèle d’une exception cohérente, internalisé par le droit d’auteur objectif qui a complètement résolu le conflit entre la création et la consommation des oeuvres de l’esprit. Cette image est ensuite confrontée à des forces destructrices ayant leur origine dans des normes extérieures au droit d’auteur objectif. Celles-ci se substituent aux exceptions prévues par le droit d’auteur et remettent en question l’idée de son autarcie.L’idylle du droit d’auteur autosuffisant n’est toutefois pas une utopie. Entre l’état normal et la maladie des exceptions se noue un lien dialectique. The main objective of these particular rules is to ensure the consistency of copyright law. Yet, researchers agree on the need of their reconceptualization.This doctoral thesis aims to explore the meaning, origins and consequences of the crisis that brings resentment toward copyright exceptions in their present form. Taking into account a certain axiological fragility of the subject, it tries to apprehend it in the respect of a neutral epistemological posture. Therein, the theory of scientific paradigms offers a framework split in two. The reconstruction of the normal and wanted state of the principles developed by the French tradition of copyright in the field of exceptions allows to identify the signs of their violation by the changing legal reality.This analysis reveals, on the one hand, the model of a consistent exception, internalized by the copyright law which completely resolved the conflict between creation and consumption of works of the mind. On the other hand, this image is faced with the destructive forces that originate in the norms that are external to copyright law. These replace the copyright exceptions and, therefore, question the idea of its autarchy.The idyll of the self-sufficient copyright law is, however, not a utopia. A dialectical link can be traced between the normal state of exceptions and their illness.Seen together, these two elements illuminate each other, so that the crisis that summarize them becomes a reversible process.

La contrefaçon en ligne : le traitement judiciaire des atteintes aux droits de propriété intellectuelle / Cyber counterfeiting : the judicial treatment of infringements of intellectual property right

La rencontre intervenue entre les biens protégés par le droit de la propriété intellectuelle et l'internet ne s'est pas faite sans heurts. Ubiquitaire, immatériel, anonyme et transfrontalier sont autant de spécificités de l'internet qui mettent en péril les prérogatives des titulaires de droit de propriété intellectuelle. Dans cette optique, l'identification des usages couverts par un droit de propriété intellectuelle est un enjeu essentiel pour déterminer le périmètre de la contrefaçon en ligne. Ainsi, la portée des droits de propriété intellectuelle sur l'internet détermine le périmètre de la contrefaçon en ligne. Dans cet environnement numérique, la portée des droits de propriété intellectuels ne peut être révélé qu'à l'étude de la masse des atteintes qu'ils endurent. Or, cette analyse ne souffre aucune ambiguïté. Il en résulte incontestablement le constat d'une limitation de la portée des droits exclusifs dans l'environnement numérique. Par ailleurs, la protection des droits de propriété intellectuelle est également affaiblie lors du traitement de la contrefaçon en ligne. En ce domaine, l'intervention du droit international privé est fréquente puisque les atteintes aux droits de la propriété intellectuelle présente souvent un élément d'extranéité. Toutefois, les critères de rattachement territoriaux prévus par la règle de conflit rendent difficile la détermination de la juridiction compétente dans un contentieux partiellement ou totalement dématérialisé. La responsabilité des acteurs de l'internet présente également de nombreuses faiblesses favorisant la diffusion de tout type de contenu / The meeting between property, protected by property rights an the internet has not been easy. In this context the identification of uses covere by an intellectual property right is a key issue in determining the scope of online counterfeiting. In this digital environment, the scope of intellectual property rights can be revealed by studying the mass of infringements they are subjected to. The above analysis is unbiased. This undeniably results in a limitation of the scope of exclusive rights in the digital environment. In addition, the protection of intellectual property rights is also weakened when dealing with cyber-counterfeiting. In this field, the intervention of private international law is frequent since when the infringements of intellectual property rights begin having an element of foreignness. However, the territorial attachment criteria provided by the conflict’s rule make it difficult to determine the competent jurisdiction in a partially or totally dematerialized legal dispute.
