CONSTITUTIONAL REVIEW OF THE LIMITS OF POWERS OF THE EU IN THE CR AND GERMANY (THE LISBON TREATY AND FURTHER DEVELOPMENT) The purpose of the thesis is to analyze the case-law of the Constitutional Court of the Czech Republic and the Federal Constitutional Court of Germany relevant to the question of the relationship between Union law and national law, paying attention especially to the problematic area of ultra vires review claims, ie to the right of the constitutional court of a Member State to take the final decision whether an act of any European institution exceeds powers that have been transferred from the Member States to the EU according to the Treaties. The thesis consists beside introduction and conclusion of four chapters. Chapter one introduces the key provisions of the national constitutions both in Germany and in the Czech Republic, which allow to the Member States to delegate some of their sovereign powers to the EU. Chapter two deals with earlier decisions of both constitutional courts regarding the matter of EU law (before the Lisbon judgement) and points out the leading premises which were most important for the future development of the case-law on relationship between Union law and national law. L'objet de la présente thèse est de procéder à l'étude comparée des doctrines et jurisprudences françaises et allemandes consacrées au principe de la séparation des pouvoirs. D'origine philosophique, ce principe n'est pas, aujourd'hui, dépourvu d'effets juridiques pratiques, comme le montrent les problèmes récents, soulevés dans la jurisprudence du conseil constitutionnel et de la cour constitutionnelle allemande. Toutefois, on ne saurait comparer la mise en oeuvre d'un principe dans deux ordres juridiques différents sans faire l'effort d'un retour nécessaire sur la genèse doctrinale de ce principe, sans apporter au travail comparatif une dimension d'histoire de la culture juridique dans les pays comparés. Le point essentiel de ce travail serait d'expliquer les développements jurisprudentiels les plus récents à la lumière de l'histoire des doctrines. Si notre travail sera essentiellement centré sur une comparaison franco-allemande, il doit rester ouvert à toute perspective intéressante que pourraient fournir, sur le sujet, d'autres jurisprudences nationales et européennes. / The thesis focuses on the german constitutional case law and doctrine relating to the principle of the separation of powers. The analysis of the problems concerning the meaning of the rule deducted under article 20 paragraph 2 of the German Basic Law of 23 May 1949 point up its practical application today. The interpretation of the solutions of the Federal Constitutional Court constitues the main part of this research however it is impossible to globally appreciate and understand the principle of the separation of powers without make the necessary effort to explain its genesis in the german constitutionnal law. Ergo, the theories of the Vormärz also the thought of the legal scolars of the Empire and the Weimar Republic are an important key stage that permit to grasp the present form of the principle in the decisions of the judge. The functional justice or the theory of the substantial decision complete the definition of the constitutional separation of powers. The concretisation of these integral elements of the principle create the system of checks and balances that govern the conflicting relations between legislative, executive and judicial powers.

As an empirical base, the Brazilian Federal Constitution of 1988 is adopted and an analysis is done of the rapid and complex historical process which led to the dismantling of Magna Charta. This process occurred as a consequence of the removal from the constitutional text of several provisions which indicated the application of new and fundamental social rights, rights which created the foundations and conditions necessary for the implementation of the Welfare State in Brazil. The reasons for this overthrow of rights are examined, consubstantiated in the expulsion of live work in the 1988 Federal Constitution and then in the change that redefined the bases of Brazilian Welfare State to the creation of Neoliberal State. This change in shape of the contemporary Brazilian state took place by the constitutional and state reforms combined with the dialect resolution of crises in the structure of capital from affecting, essentially, the class war and the new international division of work, in the context beyond Fordism and globalization. / Estudo baseado nos referenciais contidos na obra marxiana nos termos do silogismo do Estado capitalista. Adota-se como base empírica a Constituição Federal brasileira de 1988 e analisa-se o rápido e complexo processo histórico que levou ao desmonte e à desfiguração da Carta Magna. Este processo ocorreu em conseqüência da retirada do texto constitucional de vários dispositivos que indicavam a aplicação de novos direitos sociais fundamentais, direitos estes que lançavam os fundamentos e as condições necessárias para a implementação de um Estado social no Brasil. Examinam-se as razões que levaram a essa derrocada dos direitos sociais, consubstanciada na expulsão do trabalho vivo da Constituição Federal de 1988 e, por conseguinte, na transformação que redefiniu as bases do Estado social brasileiro para a instalação de um Estado neoliberal. Essa mudança da forma do Estado capitalista brasileiro contemporâneo se deu através da Reforma Constitucional e da Reforma do Estado, articulada com a resolução dialética da crise estrutural do capital, afetando, essencialmente, a luta de classes e a nova divisão internacional do trabalho, no contexto situado para além do fordismo e na globalização.

The aim of this diploma thesis called The Human Rights Commissioner of the Russian Federation is to provide a comprehensive insight into the formation and development process of the institute of the human rights commissioner by means of description and analysis. At the same time, it attempts to facilitate a better understanding of this institute inside the Russian social system. The opening section defines the institute of ombudsman from the historical and theoretical point of view and puts it in the post-Soviet context. The following section touches on the key legislation related to this institute in the Russian Federation and on the way it was formed and embedded in Russia. A separate chapter addresses the competences and specific tasks of the public defender of rights. This chapter is supported by annual reports issued by the Russian ombudsman's office. The last section of the thesis deals with the relationship between the ombudsman, the Russian establishment and non-governmental human rights organizations. The relationship is defined theoretically and illustrated by practical examples and specific cases. This master thesis aims the analysis of the constitutional Institute of dissolution of the Bundestag in the Basic law of Germany and the Chamber of Deputies in the Constitution of the Czech Republic and its usage in the constitutional and political praxis. It is a two-case-study with the goal to compare how the dissolution of parliament is defined in both constitutions, which restrictions are set for its usage, who is the decision maker and for which situations the dissolution of parliament is defined in those constitutions. At the very beginning, the basic theory of the dissolution and its types are presented followed by the two case studies that include the historical background of the actual valid constitutional modification the dissolution of parliament. The second part of each case study consists of the analysis of the actual modification and presentation of its specifics and relation to other articles of the constitution. The third part of both case studies covers the actual political and constitutional usage of the Institute of dissolution, its attempts and also the decisions of the constitutional courts in each country. Dialogue of the Courts in Europe: Interactions between the European Court of Human Rights, the Court of Justice of the European Union and the Courts of the ECHR Member States

Aufgrund des wachsenden Bedarfs an kohärenter Interaktion zwischen dem Europäischen Gerichtshof für Menschenrechte, dem Gerichtshof der Europäischen Union und den Gerichten der EMRK-Mitgliedstaaten, untersucht diese Arbeit die Problematik von Kompetenzkonflikten, die die Glaubwürdigkeit der europäischen und nationalen Gerichtshöfe untergraben und die Effektivität des gerichtlichen Rechtsschutzes in Europa schwächen, und schlägt die Lösungen vor, um Rechtsprechungskonflikte zwischen den Gerichtshöfen zu verringern. Es erfolgt eine Betrachtung der Fragen, wie Inkonsistenzen der gerichtlichen Rechtsprechung der europäischen und nationalen Gerichte vermieden werden können, wie der Beitritt der EU zur EMRK angegangen werden kann und wie das Piloturteilsverfahren des EGMR und nationalen gerichtlichen Überprüfungsverfahren wirksam funktionieren kann. Die Arbeit kommt zu dem Schluss, dass es für die Koordination der Zusammenarbeit zwischen den Gerichten wichtig ist, ihre Interaktionen zu verstärken, indem bewährte Verfahren auf allen Ebenen ausgetauscht werden. Um eine tiefere Integration der Staaten in die europäische und internationale Gemeinschaft zu erreichen und das Risiko von sich widersprechenden gerichtlichen Entscheidungen zu reduzieren, wird von den Mitgliedstaaten erwartet, dass sie ihre Verpflichtungen aus dem EU-Recht und der EMRK verlässlich erfüllen, und die europäischen Gerichtshöfe werden ihrerseits die Möglichkeit eines Eingriffs in die Souveränität der Staaten ausschlieβen lassen. Nur wenn einvernehmlich beschlossene Lösungen angenommen werden, wird eine größere Kohärenz in Rechtsprechung der europäischen und nationalen Gerichtshöfe erreicht und ein einheitliches System zum Schutz der Menschenrechte gewährleistet. / In light of the growing need to establish a coherent relationship between the European Court of Human Rights, the Court of Justice of the European Union and the courts of the ECHR member states, this study explores the challenges of jurisdictional competition that undermine the credibility of the courts and weaken the effectiveness of judicial protection of fundamental rights in Europe, and suggests ways to reduce emerging judicial tensions between these courts. It examines how to avoid inconsistencies in judicial practices of the European and national courts, how to approach accession of the EU to the ECHR, and how to ensure effective functioning of the pilot judgment mechanism and national judicial review procedures. It concludes that in order to coordinate cooperation between the courts it is important to strengthen their interactions through adhering to best practices at all levels. To pursue deeper integration of states into the European and international community and minimise the chance of rendering contradicting judgments by the courts, member states are expected to comply faithfully with their obligations under EU law and the ECHR, and the European courts shall exclude the possibility of encroachment on state sovereignty. Only if mutually agreed solutions are adopted will a greater consistency in their case law be achieved and a uniform system of protection of human rights ensured.

Die philosophischen Grundlagen der Meta-Dimension des Rechts auf Menschenwürde lösen eine Fragestellung aus, die die Grenzen der Disziplin des Rechts übertrifft: wie könnte das Transzendentale als ein Aspekt der Bedeutung von Menschenwürde dargestellt werden? Das Beharren auf der nicht-Bestimmung des Menschenbildes oder auf dem Begriff ‚Gott’ in der Präambel des Deutschen Grundgesetzes, wie es sich in der Deutschen Dogmatik widerspiegelt, gepaart mit dem Bestreben nach einer Fall-zu-Fall ad hoc Konkretisierung dessen, was Menschenwürde bedeutet, inspiriert diese Untersuchung von ‚etwas fehlt’ [‘something missing’]. In postmoderner Art und Weise beschreibt diese Geschichte das Gesetz der Menschenwürde als Trojanisches Pferd und bietet hermeneutische und literarische Grundlagen für eine affirmative Haltung gegenüber einer ''leeren'' Rede im juristischen Diskurs. Die Forschungsfrage erweckt und umkreist die polemisch verbrämten Begriffe von ‚Leere’ und ‚Black Box’: Warum erscheint der Rechtsbegriff der Menschenwürde ‚leer’? Oder wie ist er ‚leer’? Warum und wie ist er eine ‚Black Box’? Wie erscheinen Manifestationen des Konzepts abstrakt wie Universalien, aber im Einzelnen konkret? Die ontologischen, sprachlich-analytischen und phänomenologischen philosophischen Erkenntnisse, vorgestellt im ersten Kapitel, bilden die Linse, durch die fünf maßgebliche Fälle des Bundesverfassungsgerichtes – über Abtreibung, lebenslange Freiheitsstrafe, Transsexualität, staatliche Reaktion auf Terroranschläge und die Gewährleistung eines menschenwürdigen Existenzminimums – im zweiten Kapitel analysiert werden. Die philosophischen Quellen werden nicht als Momente im langen Verlauf der Menschenwürde in der Geschichte der Ideen eingeklammert. / The philosophical underpinnings of what may be called the meta-dimension of the law of human dignity trigger a question that surpasses the boundaries of the discipline of law: how could the transcendental as an aspect of human dignity meaning be portrayed? The insistence on non-determination of the Menschenbild [human image] or ‘God’ in the Preamble to the German Basic Law [Grundgesetz] reflected in German legal doctrine, paired with the commitment to case-by-case ad hoc concretization of what human dignity means inspire this story of ‘something missing’. In postmodern fashion, this story portrays the law of human dignity as a Trojan Horse and provides hermeneutic and literary foundations for an affirmative stance towards ‘emptiness’ talk in legal discourse. The research question rekindles and twists polemically framed ‘emptiness’ and ‘black box’ contentions: Why does the legal concept of human dignity appear ‘empty’? Or, how is it ‘empty’? Why and how is it a ‘black box’? How do manifestations of the concept appear abstract as universals and concrete as particulars? The ontological, linguistic-analytical, and phenomenological philosophical insights presented in Chapter One compose the lens through which five benchmark Bundesverfassungsgericht cases – on abortion, life imprisonment, transsexuals, state response to terrorist attacks, and the guarantee of a dignified subsistence minimum – are analyzed in Chapter Two. The philosophical sources are not bracketed as moments in the long course of human dignity in the history of ideas.
