Al-Wandi, Karar January 2023 (has links)
Purpose: The purpose of this study is to identify problems and shortcomings in the process of building permits from the perspective of small house owners in Stockholm. The purpose of this study is also to present future improvements. Methods: The method for this study contains both literature study and a case study. The case study consisted of a digital survey and interviews with small house owners and with the municipality´s building permit department. The digital survey consisted of questions about previous experiences of the building permit process to then investigate where there are shortcomings and weaknesses. Results: The results gave a wider perspective of how the small house owners experience the building permit process and how the municipality works through challenges and improves the process. The digital survey showed that several were dissatisfied with the processing time and experienced it as a long period. The respondents also experienced it as a difficulty when it comes to submitting correct documents requested by the municipality and that there are high building permit fees. A concrete improvement measure is that Stockholm municipality clarifies the building permit process steps regarding processing times and other weaknesses that arise on the website. Conclusions: The conclusion of this work is that Stockholm municipality updates the website, so that applicants with less knowledge and experience regarding building permits can get a better idea and possibly follow the schedule and budget they planned for the project. To avoid damage caused by damp during the project, it is possible to undergo a so-called moisture safety design. Stockholm municipality can introduce more employees within the building permit department to be prepared for periods where there is high pressure in building permit matters.

Fallstudie om förfaranderegel handläggning inom skälig tid

Susi, Ly, Trawén, Linnea January 2013 (has links)
Fair trials’ rights under Swedish law of public administration (FL) are regulated by Article 7 of the Statute. Similarly, fair trials’ right under the European Convention of Human Rights (EU Convention) is regulated by Article 6.1. The essay conducts a comparative study of the two legislations and seeks to determine whether Article 7 of the Swedish law of public administration is consistent and compliance with Article 6.1 of the EU Convention. The essay identifies and examines ten cases that have been handled in different courts in Sweden on a comparative basis with samples of other cases handled by Justitieombudsmannen. The objective is to compare and determine whether fair trial process as provided for under Swedish legislation are consistent, or in compliance, with the EU Convention. In the determination of the fairness or otherwise of the procedural process, including the time-line it takes to dispose of a given case and whether the Swedish Court’s procedure is consistent with speedy trials’ requirements stipulated in the EU Convention, the essay examines the modalities adopted in interpretation of the different laws, rules and regulations by the different courts in Sweden. Where errors are identified, the essay will examine what corrective measures, if any, may be taken to redress these possible mistakes that may have resulted in violations of the rights of an applicant as a result of incompetence, failure or mistake of an employee in the public administration.  The analysis is focused on cases that have been poorly handled in the sense that the process was slow or ineffective and did not meet the threshold of fair trial and good governance. The essay examines situation where, in event of a violation of the applicable law by a public administrator, there are no sanctions provided, or corrective measures in the statute that may be available to an aggrieved party. The essay considers whether, as a result of a violation, there needs to be a provision in the law for compensating that aggrieved party. In conclusion, the essay suggests possible remedies, including compensation or a re-hearing of the application before a different panel of judges. These proposals may be considered if deemed useful or relevant in amending the Swedish law to provide corrective measures to an aggrieved party.

Hansson, Emelie, Svensson, Lena January 2021 (has links)
During a long time period, processing times considering property formation have been a challenge for the cadastral authorities. It is specified in the Administrative Procedure Act that an errand shall be handled as simply, quickly and cost-effectively as possible. Due to the ongoing urbanisation this has been difficult to maintain. The Swedish mapping, cadastral and land registration authority has an assignment from the government to prioritize errands that are important to the society which often includes newbuildt households, infrastructure and facilities. Agricultural and forestry property units belong to the category which often has to stand back in this process and therefore do not get prioritized. The aim of the thesis is to examine how the state cadastral authorities and the municipal cadastral authorities management of errands affects rural development. The thesis was performed through several methods to receive appropriate data information to answer the thesis research focuses. Through a literature review, public documents have been processed containing information about processing times for property formation errands and rural areas' role and challenges in society. The thesis also used two surveys and two interviews. These methods received data from property owners with their own experiences of processing times. Also information and work related experiences was received from a rural real estate agent, forestry businessman and from several cadastral surveyors. The result showed that a lot of property owners get negatively affected. Also the professionals agree that there is an effect due to long processing times. Therefore the thesis conclusion shows that the problems that can occur mainly indicates that property sales get more difficult which also can have a negative effect on rural development.
