The interaction of indigenous law and Western law in South Africa : a historical and comparative perspective

Historically South African law has been dominated by Western law. Indigenous law and the jural postulates which underpin that law are insufficiently accommodated in the South African legal order. The Western component of the official legal system is regarded as institutionally and politically superior and is as such perceived to be the dominant system. In contrast indigenous law is regarded as a servient system. The monopolistic control of the legal order by the Western section of the population resulted in the creation of a legal order primarily suited to its own needs. The fact that few of the values of indigenous law are reflected in the official legal system and the fact that there is a measure of conflict and tension between the fundamental precepts of indigenous law and those of Western law, gave rise to a crisis of legitimacy of the official legal system in South Africa. This in turn lead to the emergence of unofficial alternative structures for the administration of justice. Indigenous law should receive full recognition and enjoy the same status as Western law. To accomplish this, legislative measures which entrench a distorted indigenous law, limit the application of indigenous law, or affect its status in the South African legal order, should be revoked. Even in a multicultural society such as that of South Africa, there is a common nucleus of core values that are shared by the whole society. But different cultures have different conceptions of these basic values and their role in legal, political and social ordering. The Bill of Rights should give due recognition to the postulates which underscore both Western and indigenous law. This should be done by providing that the values the Bill entrenches, must be interpreted in their proper cultural perspective where circumstances so demand. But this will be possible only if the level of knowledge of indigenous law and its fundamental precepts is drastically improved. / LL.D

Neste trabalho foi avaliada a dose efetiva recebida pelos trabalhadores da Gerência de Rejeitos Radioativos do IPEN devido à inalação de 222Rn nos galpões de armazenamento de rejeitos radioativos tratados e não tratados. As concentrações de 222Rn no interior dos galpões foram determinadas por meio da técnica de detecção passiva com detectores de traços nucleares do estado sólido (SSNTD). O detector utilizado foi o CR-39 inserido em uma câmara de difusão do tipo NRPB. Foram monitorados um total de 12 pontos internos e 1 ponto externo no galpão de rejeitos radioativos tratados G4 e 13 pontos no galpão de rejeitos radioativos não tratados G3, durante um período de 11 meses, entre junho de 2012 e maio de 2013. As concentrações variaram de 0,73 ± 0,08 e 4,55 ± 0,16 kBqm-3 entre os períodos de monitoramento no galpão G4 e entre 0,61 ± 0,07 e 2,94 ± 0,12 kBqm-3 no galpão G3. A dose efetiva devido à inalação de 222Rn no interior dos galpões de rejeitos radioativos foi calculada de acordo com os procedimentos da Comissão Internacional de Proteção Radiológica (ICRP) a partir de um fator de conversão de dose, da concentração média do 222Rn no ar e do tempo de exposição dos indivíduos. Os valores de doses apresentados são uma média das concentrações entre os períodos de monitoramento que variam 15,70 mSva-1 no G4 e de 9,27 mSva-1 no G3, sendo que em um dos períodos obteve-se valores superiores ao estabelecidos pelo órgão regulador (CNEN) e recomendados pela Comissão Internacional de Proteção Radiológica (ICRP) de 20 mSva-1 para indivíduos ocupacionalmente expostos, indicando a necessidade de medidas mitigadoras. Cabe, contudo, informar que foi considerada uma hipótese bastante conservativa de 2000 horas de trabalho no local. / Some radionuclides that make up the radioactive series are noted for their contribution to the total exposure to which individuals are subjected, an important example is known as radon 222Rn and their descendants, responsible for more than half of the radiation dose received by the population due to natural sources. In this work the effective dose received by the workers of the Management of Radioactive Waste in IPEN due to inhalation of 222Rn in storage sheds from treated and untreated radioactive waste was evaluated. Zwischennutzungen in Berlin

Die vorliegende Arbeit untersucht Zwischennutzungen in Berlin aus Akteurssicht. Zwischennutzungen sind von Beginn an und von allen Beteiligten als temporär gedacht. Sie finden in bzw. auf leerstehenden Immobilien statt und sind mit einer Nutzungsänderung verbunden, d.h. eine Zwischennutzung unterscheidet sich sowohl von der vorigen Nutzung der Immobilie als auch von der geplanten neuen Nutzung. Ausgehend von dieser erarbeiteten Definition wird das Phänomen empirisch am Beispiel Berlins untersucht. Die mehr als 100 recherchierten Berliner Zwischennutzungsprojekte konzentrieren sich räumlich auf attraktive innerstädtische Lagen. Zwischennutzungsverträge erlauben finanzschwachen Akteuren, Grundstücke günstig zu mieten. Sie akzeptieren dafür Einschränkungen wie die begrenzte Nutzungsdauer und kurze Kündigungsfristen. Es konnten fünf Motivationstypen von Zwischennutzern erarbeitet werden: Für „Pioniere“ und „Profi-Zwischennutzer“ steht der ökonomische Aspekt bei der Zwischennutzung im Vordergrund. Das Hauptmotiv von „ehrenamtlichen, subkulturellen und künstlerischen Zwischennutzern“ ist dagegen die eigene Selbstverwirklichung. Die meisten Nutzer streben die langfristige Sicherung ihres Projektes an. Die Grundstückseigentümer handeln überwiegend ökonomisch-rational. Zwischennutzungen sind aus ihrer Sicht eine sinnvolle Lösung, wenn das Nutzungskonzept passend ist und die Mieteinnahmen den Aufwand und das Risiko einer kurzfristigen Vermietung übersteigen. Gute persönliche Beziehungen werden sowohl von Nutzer- als auch von Eigentümerseite als wichtige Komponenten für den Abschluss eines Zwischennutzungsvertrags gesehen. In vielen Fällen finden Zwischennutzungsprojekte in Berlin auf Grundstücken statt, auf denen aus stadtplanerischer Sicht kein Handlungsbedarf besteht. Die Planungsämter arbeiten überwiegend mit Duldungen und Befreiungen. Das Baurecht auf Zeit wird nicht angewendet, informelle Instrumente kommen nur vereinzelt zur Anwendung. / This work examines temporary uses in Berlin and the involved participants. Temporary (or interim) uses are seen as temporary from the beginning and by all involved stakeholders. They take place on brownfield sites or in abandoned buildings, and are always associated with a change in use. A temporary use differs both from the previous use of the land as well as the proposed new use. Based on this definition, the phenomenon is investigated empirically in Berlin. Most temporary uses arise in or near the urban centre. About half of the temporarily used property is located in the three inner-city districts of Mitte, Prenzlauer Berg and Friedrichshain. Financially weak actors have to pay lower rents for these properties because of temporary use contracts. In return they have to accept short periods of notice and other limitations. Based upon their motivation, five types of temporary users have been identified: For “pioneers” and “professional temporary users”, the economic aspect is most important. The main motive of “voluntary, subcultural and artistic temporary users”, however, is self-fulfilment. Although the users make short-term leases, most of them are aiming for long-term security for their projects. The landlords act predominantly economically and rationally. In their opinion temporary uses are good solutions if the concept fits and the rental income exceeds the cost and the risk of short-term rent. Both temporary users and landlords see good personal relationships as an important component for the signing of a temporary use contract. In many cases temporary uses in Berlin are located on properties where no action for urban planning is required. The planning authorities mainly deal with them by way of toleration and immunities. The “Baurecht auf Zeit” (temporary building law) is not applied and informal instruments are only sporadically applied.

É função da Justiça tutelar os direitos, prestando-se o processo como o meio pelo qual a parte pode alcançar a tutela almejada ao direito em crise de efetividade. Ocorre que, a duração do processo muitas vezes desponta como óbice a gerar prejuízos e situações injustas, lançando ônus precisamente sobre aquele que se encontra na condição de merecedor da tutela jurisdicional. Nesse sentido, fala-se então em tutelas diferenciadas, que prestam-se como meios de regulação provisória da crise de direito em que se encontram o(s) litigante(s). O Código de Processo Civil (Lei nº 13.105/2015) promoveu grandes mudanças em sede dessas tutelas, ditas ‘tutelas provisórias’, que são remédios processuais, em termos efetivos, para a busca de celeridade na prestação jurisdicional, seja para salvaguardar um direito, para satisfazê-lo, ou mesmo para reconhecê-lo como evidente. Daí que fala-se em um redimensionamento do tempo, a fim de tratar aquilo que François Ost já denominou de destemporalização do Direito. Contudo, para além de uma análise dogmática de todas as inovações advindas com a nova legislação, se mostra necessária uma investigação da própria práxis em sede de cognição sumária, como forma de verificar como o Estado-juiz, a um nível qualitativo, as tem prestado. Nesse especial, surge a Teoria Estruturante do Direito de Friedrich Müller, preocupada diretamente com a concretização da norma (e, assim, do próprio Direito). É uma teoria que parte de um viés indutivo, sendo considera pós-positivistas, isto é, apta a superar os limites dos positivismo jurídico (mera formalidade em detrimento da substancialidade). Diretamente ligada a corrente jusconstitucionalista (constitucionalismo contemporâneo) que aproxima o Direito da realidade, permite além de maior racionalidade ao trabalho do judiciário, a concretização de direitos e normatividade da norma decisória voltada ao caso concreto. No estanto, não se pode desconsiderar que os provimentos jurisdicionais, à luz do Estado Democrático de Direito, devem abarcar os conceitos de ‘coerência e integridade’, vetores principiológicos pelos quais todo o sistema jurídico deve ser lido. Nesse viés, possibilita-se o diálogo da TED com a Teoria de Ronald Dworkin, inclusive porque o novo Código de Processo Civil adotou os preceitos dworkinianos como “ferramentas” aptas a diminuir o voluntarismo judicial, sem, contudo, refletir como objetivo a promoção de tutelas exaurientes (onde há maior grau de certeza jurídica quanto à controvérsia). Tomando-se em consideração este cenário e sendo esta uma área da processualística onde denuncia-se o protagonismo judicial, surge a celeuma: como a Teoria e Metódica Estruturante de Friedrich Müller pode contribuir para a concretização da norma decisória em cognição sumária? Essa estruturação da norma reflete à promoção de coerência e integridade’, incentivando, por conseguinte, a uma teoria da decisão judicial que se coadune com o Estado de Direito fruto de uma democracia constitucional? / In the Democratic State of Right, the real practice lies in the effective realization of the fundamental rights and guarantees of individuals, and no longer solely in the realization of the concrete will of the law. It is a function of Justice provides the guardianship of the rights, rendering the process as the means by which the part can reach the tutelage aimed for the right in crisis of effectiveness. In this special, there is Friedrich Müller's Theory of Law, concerned directly with the concretization of the norm (and thus of the right itself). It is a theory that starts from an inductive bias, being considered post-positivist, that is, able to overcome the limits of legal positivism (mere formality to the detriment of substantiality). Directly linked to the current jusconstitutionalism (contemporary constitutionalism) that approximates the law to the reality, it allows, in addition to a greater rationality to the work of the judiciary, the concretization of rights and provides the normativity to the decisory rule directed to the concrete case. In this respect, it can not be disregarded that jurisdictional appeals, in the light of the Democratic Rule of Law, should embrace the concepts of 'coherence and integrity', the principle vectors by which the entire legal system must be read. In this bias, is it possible the dialogue between TED's and Ronald Dworkin's Theory, also because the new Code of Civil Procedure adopted the Dworkinian precepts as "tools" capable of diminishing judicial voluntarism, without, however, reflect that as an objective of promoting tutelages in exhaust cognition(where there is greater degree of legal certainty about the controversy). Taking this scenario into account and being an area of the procedural where the judicial protagonism is denounced, there is a stir: how can Friedrich Müller's Theory and Structural Methodology contribute to the realization of the normative decision-making in summary cognition? Does this structuring of the norm reflect the promotion of 'coherence and integrity', thus encouraging a theory of judicial decision that is consistent with the rule of law resulting from a constitutional democracy?

Buscando combater uma cultura de encarceramento em massa, já enraizada, encontram-se institutos como a audiência de apresentação, a qual garante que o acusado seja levado à presença de um juiz em até 24 horas. Tal instituto tem como primeiro pilar a Declaração Universal de Direitos Humanos de 1948, além de outros Pactos internacionais dos quais o Brasil é signatário. Objetivou-se demonstrar que o referido instituto salvaguarda princípios constitucionais, dentre eles o da presunção da inocência e tem sua eficácia comprovada no sentido de redução do índice de presos, economia aos cofres públicos e ser aplicado em outros países da América Latina já há alguns anos. Em solo pátrio, apenas em 2015 após projeto de incentivo do CNJ, a referida audiência ganhou maior visibilidade e passou a ser aplicada em alguns estados da federação. Dada a comprovação de todos os benefícios adquiridos com a implantação da audiência de apresentação, defende-se sua aplicação integral no país com o objetivo de salvaguardar os direitos humanos. / According to the scenario of gross violations of human rights carried out inside prisons in Brazil, it is questioned the implementation of mechanisms to reduce the number of temporary prisoners, who in our country currently represent 40% of the total prison population. Seeking to combat a culture of mass incarceration, already ingrained, are institutes such as the presentation hearing, which ensures that the accused is brought before a judge within 24 hours. This institute has as its first pillar the Universal Declaration of Human Rights of 1948, in addition to other international covenants of which Brazil is a signatory. The objective was to demonstrate that this institute safeguards constitutional principles, including the presumption of innocence and its proven effectiveness in the sense of reducing the prisoners' index, economy to the public coffers and to be applied in other countries of Latin America already a few years ago . In our country, only in 2015 after the CNJ's incentive project, the referred audience gained greater visibility and began to be applied in some states of the federation. Given the proof of all the benefits acquired with the implementation of the presentation hearing, it is defended its full implementation in the country with the objective of safeguarding human rights.

No entry without strategy : an evaluation of UN transitional administration approaches to building the rule of law in disrupted states

As a mode of intervention in which the UN assumed direct authority over disrupted states, transitional administrations represent unique examples of ambitious state-building projects. This thesis investigates the apparent failure of transitional administrations to establish the rule of law in Cambodia, Kosovo and East Timor. It identifies nine explanatory factors which are tested against each case study. In addition, it seeks to enhance conceptual understandings of the UN???s state-building agenda and to add to empirical studies regarding attempts by external actors to establish the rule of law in disrupted states. Three findings emerge. First, in each case, UN transitional administrations failed in each of the following ways: to make the best use of their mandate; to establish effective state justice institutions; to build local commitment to the rule of law as a value system; to promote social relationships supportive of the rule of law; to ensure sufficient state capacity post-intervention; to maintain adequate levels of security; to address the existence of informal justice structures; to deal with the legacies of the past; and to ensure an adequate level of mission performance. Of these, establishing effective state justice institutions, building local commitment and addressing informal justice structures proved most crucial. Second, the state-based ???enforcement??? approach adopted by transitional administrations proved ineffective. Enacting laws and establishing coercive state structures such as judicial, police and prison services were critical to, but could not be equated with the rule of law. This approach did not account sufficiently for the importance of entrenched informal justice institutions, of the voluntary consent of local actors, or of appropriate institutional design choices. As a result, it did not offer real solutions to real problems faced by local actors. Finally, the UN failed to consider fully how to create an enabling ???space??? in which internal processes of change could occur, to engage appropriately with local actors, to overcome the tyrannies of truncated deployment, or to address these issues at the ???front-end??? of the mission. This ???entry without strategy??? approach to state-building seriously undermined the UN???s ability to establish the rule of law, as the self-declared touchstone of its state-building agenda.

ISBN: 978-91-7636-557-1 The overall aim of the dissertation is to analyse the general features of academic writing skills that students’ texts show at the beginning and at the end of their undergraduate education, and to investigate the paths chosen by students from different study backgrounds when they acquire competence in academic writing. The dissertation studies changes of level within the educational system from a student perspective. The empirical material consists of qualitative research interviews with student teachers at different stages of their training, and of the analyses of texts written by the same students. The study shows that both new and experienced students find it difficult to see a link between the tuition in Swedish in high school and their university studies, especially when it comes to academic writing. The new students therefore feel frustration and confusion in the transition phase. The experienced students say that they have mainly developed competence in academic writing during their studies through supervision in essay writing, which is felt to be crucial for linguistic development. The new students’ interim texts are characterized by the clear personal presence of an author, a varying degree of copying from source texts, and uncertain handling of references. Expressions of critical-analytical thinking are not common, and the texts usually have an everyday tone. The experienced students do not copy texts, yet they show great insecurity in their use of the content of the source texts. They write “academically” by using frequent reference markers and adopting a bombastic style. The linguistic tools of academic writing are used by the experienced students as decoration, to strengthen the impression of familiarity with the academic discourse.
