Závazky v partnerských vztazích / Commitment in Love Relationships

In my diploma thesis I intend to look into the issue of commitment in love relationships. I wonder how it is influenced by the nature of nowadays society enhancing individualism and flexibility. These commitments are based in merging our own identity with identity of our partner. But crucial is to also balance it with our own autonomy and freedom. Commitment means putting certain restrictions to our future choices. I made sixteen semi-structured qualitative interviews based on grounded theory with sixteen women and men in young adulthood and I looked for answers on how they perceive commitments in love relationships, what meaningful partnership means to them and how they cope with comparing potential alternatives and overall which strategies they use in making decision about commitment and behavior for its lasting, deepening or ending them. HISTORICAL INTIMACY: CONTEMPORARY RECLAMATIONS OF AFRICAN AMERICAN HISTORY IN THE DRAMA, POETRY, AND FICTION OF SUZAN-LORI PARKS, NATASHA TRETHEWAY, AND COLSON WHITEHEAD

Three contemporary authors – Suzan-Lori Parks, Natasha Trethewey, and Colson Whitehead – within the African American Literary Tradition explore relationships to history in light of a dominant rhetoric that represents African American history through a white, hegemonic lens. In Parks’ The America Play, Trethewey’s Bellocq’s Ophelia, and Whitehead’s The Intuitionist, these authors comment on historical representation through such symbols as iconic figures like Abraham Lincoln, photographs, and elevators as starting points to explore the possibility of an independent space for African American history. Rather than remarking on just the representation of the artifact, however, the authors enter a conversation on how history is remembered and experienced. Parks, Trethewey, and Whitehead each form their own expression on historical representation; in each case, their works address the ability, or inability, to achieve historical intimacy amidst a push back from hegemonic narratives in the public eye. Historical intimacy, as the leading concept of the dissertation, refers to developing a close proximity to history not as a mere representation but as lived experience. Parks sees historical insight developing only through brief moments of intimate contact, if at all. Trethewey imagines personal, even sensual, familiarity with the subjects of her poems as a way of breaking through social frames and learning to connect with the past. Whitehead works through paradoxes to dissolve representational patterns of discourse, like verticality, and reach for a post-rational space wherein both open historical possibility, which stresses self-reflexivity, and a foundation in a “real,” experienced history unlock the opportunity for the construction of an intimate history. Although no author presents historical intimacy as an achieved goal, their works suggest varying degrees of potential and connection.

(some col.) / Although the web appears to be a welcoming space for women, online spaces--like offline spaces--are rendered female through associations with the personal/private, embodiment, or an emphasis on intimacy. As such, these spaces are marked, marginalized, and often dismissed. Using an explicitly interdisciplinary approach that combines cultural studies models with feminist theory, new media studies, and performance, Beyond Resistance uses fandom as a way to render visible the invisible ways that repressive discourses of gender are woven throughout digital culture. I examine a variety of online fan practices that use popular media to perform individual negotiations of repressive ideologies of sex and gender, such as fan-authored fiction, role-playing games, and vids and machinima--digital videos created from re-editing television and video game texts. Although many of these negotiations are potentially resistive, I demonstrate how that potential is being limited and redirected in ways that actually reinforce constructions of gender that support the dominant culture. The centrality of traditional notions of sex and gender in determining the value of fan practices, through both popular representation and critical analysis, serves as a microcosm of how discourses of gender are operating within digital culture to support the continued gendering of the public and private spheres within digital space. O objeto escolhido foi o TV Fama, programa da televisão brasileira que apresenta notícias sobre artistas nacionais e internacionais. O amor e a sexualidade são os principais temas tratados pelo TV Fama e pela mídia sobre as celebridades. Esses assuntos associam-se à privacidade e à intimidade e sua transmissão no programa permite a reflexão sobre o público e o privado na mídia atualmente. / In the last years, there was a big technological progress. Limites ao poder de fiscalização nas relações de trabalho / Limits to the supervisory power in labor relations

A maioria das demandas envolvendo pedidos de danos morais no judiciário trabalhista brasileiro é originada a partir de abusos patronais cometidos no exercício do poder diretivo, em especial de sua dimensão fiscalizatória. Embora inexista, no Brasil, disciplina normativa específica quanto aos limites à maior parte das manifestações do poder de fiscalização, seu exercício é restringido pela dignidade da pessoa humana, que deve ser compreendida de acordo com a noção de trabalho decente propugnada pela OIT. A dignidade humana constitui cláusula geral de proteção aos direitos da personalidade, dentre eles, os direitos à intimidade e à vida privada, os mais ofendidos por meio da fiscalização patronal abusiva nas fases précontratual, contratual e pós-contratual. Práticas como a revista pessoal nos trabalhadores e em seus pertences, a limitação à utilização de banheiros, a instalação de câmeras e microfones no local de trabalho e o monitoramento dos computadores utilizados na empresa revelam, por vezes, violações a esses direitos. A revista não encontra fundamento no poder de fiscalização e no direito de propriedade do empregador, salvo quando tiver por objetivo a garantia da saúde ou segurança no ambiente laboral. A instalação de equipamentos audiovisuais, quando visar a proteção patrimonial do empregador ou for essencial ao procedimento de gestão, somente pode se dar nos espaços em que o trabalho for efetivamente desenvolvido e por tempo determinado, fundada em situação específica, sendo imprescindível a ciência dos monitorados quanto à instalação e à localização dos equipamentos. A escuta telefônica e o monitoramento de computadores e e-mails somente será possível quando o empregador determinar a utilização dos meios exclusivamente para os fins da prestação laboral, com ciência inequívoca dos trabalhadores, além de disponibilizar ou autorizar a utilização de meios alternativos para a comunicação pessoal. Não devem ser admitidas quaisquer limitações à utilização de banheiros, bem como o estabelecimento de escala de gravidez no âmbito empresarial. Sendo o tomador de serviços legitimado a exercer o poder fiscalizatório sobre a atividade produtiva empreendida no estabelecimento e havendo a indiscutível imperatividade da proteção aos direitos da personalidade obreiros, é necessária a fixação normativa de limites ao poder patronal, em prol do estabelecimento da segurança jurídica. O direito de resistência é contraface do poder diretivo, no sentido de que o uso irregular deste faz nascer aquele e, consequentemente, os limites do poder diretivo condicionam os do ius resistentiae. Os trabalhadores devem exercê-lo com fulcro nos direitos à vida privada, à intimidade, à honra e à dignidade humana. A doutrina deve valer-se da técnica da ponderação para estabelecer os limites ao poder fiscalizatório patronal, com fulcro no princípio da proporcionalidade. A divergência jurisprudencial deve ser minimizada pela atividade criativa dos juízes quanto aos limites ao poder fiscalizatório, consoante o princípio da proporcionalidade, e por meio da utilização de mecanismos específicos voltados à redução da insegurança jurídica no Judiciário Trabalhista, tais como recursos de revista, embargos de divergência, incidentes de uniformização de jurisprudência, súmulas, precedentes normativos e orientações jurisprudenciais. Nada impede, ainda, que limites ao poder fiscalizatório patronal sejam estabelecidos por meio de negociação coletiva. / Most lawsuits involving claims for moral damages in Brazilian labor courts are originated from abuses committed in employer\'s power of direction, especially on its supervisory dimension. Although there is no specific normative discipline, in Brazil, about the limits of most of the supervisory power demonstrations, its exercise is restricted by humans dignity, which must be understood according to the concept of decent work proposed by the ILO. Humans dignity is a general protection principle to the personality rights, including the rights to intimacy and private life, the most offended by abusive employers supervision in precontractual, contractual and post-contractual phases. Practices such as inspecting workers and their belongings, limiting the use of toilets, installing cameras and microphones in the workplace and monitoring the computers used at the company reveal sometimes violations of these rights. The inspection has no basis in the supervisory power nor in the employers right to property, except when it is intended to guarantee the health or safety in the work environment. The installation of audiovisual equipment to protect employers heritage or when its essential to the management procedure can only occur in areas where the work is effectively developed and for a specified time, based on the specific situation. The monitored workers knowledge about the installation and location of equipment is essential. Wiretapping and monitoring computers and emails will be possible only when the employer determine the use of the means exclusively for the labor purposes with workers\' unequivocal knowledge, and provide or authorize the use of alternative means for personal communication. Any limitations on the use of bathrooms as well as the establishment of \"pregnancy scale\" should not be allowed in the workplace. Once the employer is legitimated to exercise the supervisory power on the productive activity undertaken on his property and since there is the indisputable imperative protection of the workers personality rights, rules prescribing limits to the employers power are needed for the establishment of legal certainty. The right to resistance is the counterface of the power of direction, insofar as the irregular use of this power raises the right to resistance and, consequently, the limits of the power of direction condition the limits of the ius resistentiae. Workers must exercise it based on the rights to privacy, intimacy, honor and humans dignity. Doctrine should use the weighting technique to establish the limits to employers supervisory power, based on the principle of proportionality. The jurisprudential divergence should be minimized by the creative activity of the judges based on the principle of proportionality, and through the use of specific mechanisms developed to reduce legal uncertainty in Labour Courts, including recursos de revista, embargos de divergência, jurisprudence uniformity incidents, súmulas, regulatory precedents and jurisprudential guidelines. Limits to the employers supervisory power can also be established through collective bargaining.

For this, we are based on the theoretical reflections engendered in the scope of Discourse Analysis, especially on the resonances from the lucubration of Michael Foucault for this theoretical dimension. By conceiving that the notion of intimacy is set in the continuous slide of historical discontinuities, we aim, from a genealogical perspective, to investigate the conditions of possibility that contribute to the (re)configuration of this notion along the time, assuming other modes of existence. We add to this observation the mutant constitution of subjects who, along the history, were tied to fame, glory and stardom. When we associate these two assertive, we see modifications in how the discourse about the celebrity subject’s intimacy is constructed, in the media spaces, more precisely in the actual web features, which influence the ample proliferation of discourses around the intimate life. The advent of a more collaborative web in convergence with other media sustained the irruption of possibilities in which the subject can be seen in the interior of the digital network. In this sense, the choice of the corpus for this thesis, formed by 38 (thirty eight) news from Ego website, was anchored in these ascertainments about the rhizomatic character of web, which was intensified, especially, by the popularization of social interconnection networks. In order to organize the inevitable dispersion of discourses about the intimacy of the famous subject in the limits of the focused website, we consider the following thematic path: sexuality, family and love. Despite we, sometimes, exceed the limits of this path, it was precise in the process of immersion and entanglement of the sparse wires that form the discursive weaving of the statements published in the Ego website. In synthesis, the analysis allowed us to observe the functioning of a certain subject position in the production of news disseminated by Ego. This position is based on the use of discursive strategies mobilized by the subject author of the news, in which some sense effects are registered. We can emphasize, among these strategies, the use of celebrities’ direct discourse, aiming to produce sensational confessions of intimate life, published by such subjects in various web spaces; the crop undertaken by this position that is enunciated in Ego, related to the voice, in direct discourse, of celebrities, indicating certain argumentative directions and, finally, the treatment given to celebrity, specially marked by a particular familiarity in the use of determined forms of referring to the celebrity subject, or even in relation to insinuations about the famous’ particularities, allow us to conclude that the journalist subject do not only inform, a function commonly spread by discourses about a certain journalistic impartiality, but also orients senses about how the celebrity subject is constructed in the context of digital media. / Esta tese analisa o modo através do qual o site Ego espetaculariza a intimidade do sujeito celebridade. Para tanto, partimos das reflexões teóricas engendradas no âmbito da Análise do Discurso, especialmente das ressonâncias advindas das elucubrações de Michel Foucault para essa vertente teórica. Ao concebermos que a noção de intimidade erige-se no contínuo deslizar das descontinuidades históricas, objetivamos, a partir de uma visada, genealógica, aventar as condições de possibilidade que fazem com que essa noção se (re)configure ao longo do tempo, assumindo outros modos de existência. Acrescentamos a essa constatação a constituição mutante dos sujeitos os quais, ao longo da história, estiveram atrelados à fama, à glória, ao estrelato. Quando associamos essas duas assertivas, vislumbramos modificações nos modos de discursivizar a intimidade do sujeito celebridade, nos espaços de visibilidade da mídia, mais exatamente das atuais feições da web, as quais influem de maneira incisiva sobre a maciça proliferação de discursos em torno da vida íntima. O advento de uma web de cunho mais colaborativo e em convergência com outras mídias sustentou a irrupção de possibilidades de ser visto no interior da rede digital. Nesse sentido, a escolha do corpus para esta tese, formado por 38 (trinta e oito) notícias veiculadas no site Ego, ancorou-se nessas constatações a respeito do caráter rizomático da web, recrudescido, especialmente, a partir da popularização das redes de interconexão social. Boa parte das notícias que tematizam a intimidade do sujeito famoso provêm das confissões, corporificadas na natureza semiológica dos enunciados produzidos no âmbito das redes sociais. Com vistas a organizar a inevitável dispersão dos discursos sobre a intimidade do sujeito famoso nos limites do site em foco, partimos do seguinte trajeto temático: sexualidade, família e amor. A despeito de, em alguns momentos, ultrapassarmos os limites desse trajeto, ele se mostrou preciso no processo de imersão e de enredamento dos fios esparsos que formam a tessitura discursiva dos dizeres veiculados no site Ego. Em síntese, a análise nos permitiu entrever o funcionamento de uma dada posição sujeito na produção das notícias veiculadas em Ego. Essa posição pauta-se no uso de estratégias discursivas mobilizadas pelo sujeito enunciador das notícias, das quais decorrem alguns efeitos de sentido. Podemos enfatizar, dentre essas estratégias, a utilização do discurso direto das celebridades, com vistas a tornar sensacionais as confissões da vida íntima, publicizadas por tais sujeitos em variados espaços da web; o recorte empreendido por essa posição que enuncia em Ego, no que toca à voz, em discurso direto, das celebridades, sinalizando para determinadas direções argumentativas e, por fim, o tratamento conferido à celebridade, marcado sobremaneira por uma dada familiaridade no uso de determinadas formas para se referir ao sujeito celebridade, ou ainda em relação a insinuações veladas a respeito de particularidades do famoso, faz-nos constatar que o sujeito jornalista não apenas informa, função comumente alardeada por discursos acerca de uma dada imparcialidade jornalística, como orienta sentidos sobre os modos de constituição do sujeito celebridade no âmbito da mídia digital.

Potřeba intimity a její zajištění v ošetřovatelské péči u vybraných minoritních skupin / The need for intimacy and security in the provision of nursing care for selected minority roups

The Need for Intimacy and its Assurance in Nursing Care for Selected Minority Groups The need for intimacy is an important part of everyday life, and it is necessary to assure it at hospitalization. This need is individual, specific to each person and the culture the person comes from. The theoretical part of this thesis is devoted to this issue. The concept of intimacy and the need to assure intimacy in nursing care with a focus on specifics of the nursing care for members of minority groups are described. The master´s thesis objective was to identify the specifics to assure the need for intimacy of selected minority groups and to determine whether nurses know the specifics of intimacy in nursing care for patients from selected minority groups. To meet the objectives, the following hypotheses were stated: H1: There are specifics in the need for intimacy in selected minority groups, and H2: Nurses know the specifics in the need for intimacy in selected minority groups. One research question was asked: Is the need for intimacy in patients from selected minority groups assured at hospitalization? To conduct the diploma thesis research, a quantitative-qualitative survey was selected and the interview method was used ? questionnaires for nurses and the general public, and the interview technique for representatives of selected minority groups. The research set consisted of nurses in hospitals, the general public and representatives of selected minority groups. The survey was carried out during the months of February and March 2011. Specifics in the need for intimacy assurance in selected minority groups exist, and nurses are familiar with them. They know them mainly form their nursing practice when they have met a member of a minority group. The answer to the research question was unequivocal. Yes, the need for intimacy in patients from selected minority groups is assured. It is assured primarily by using the fittings of individual departments, which are the curtains or blinds, as well as by a helpful and sympathetic attitude of the medical staff who try not to unnecessarily unveil the patients´ bodies and according to available means to provide them with as much privacy as possible either during examination, a treatment intervention or while on bed rest. The outcomes show that both objectives were met and the hypotheses were confirmed. The research results were the basis for elaboration of an informational brochure for nurses, which may help in nursing care for minority groups members. And not only for assuring the needs for intimacy, but for a general overview of specifics in nursing care for minority groups members.
