O presente trabalho é dedicado ao estudo do direito à intimidade do empregado e busca definir o papel do empregador diante de conflitos entre esse direito e outros direitos fundamentais no ambiente de trabalho. No primeiro capítulo examina-se o poder diretivo, dando-se ênfase à sua natureza jurídica, ao seu fundamento jurídico e aos limites que lhe são impostos, a fim de delimitar o âmbito de atuação legitimamente reconhecido ao empregador. No segundo capítulo analisa-se a teoria geral dos direitos da personalidade, a fim de compreender as características gerais aplicáveis ao direito à intimidade. O terceiro capítulo é dedicado exclusivamente ao estudo do direito à intimidade: sua origem, evolução histórica, conceito, alcance, características específicas, limitações e regime jurídico. No quarto capítulo o direito à intimidade é examinado enquanto direito fundamental. Nesse capítulo também é estudada a eficácia horizontal dos direitos fundamentais, a fim de compreender de que forma eles devem ser observados nas relações de trabalho. São apresentadas, ainda, duas propostas de solução para a colisão entre esses direitos: a de José Joaquim Gomes Canotilho e a de Virgílio Afonso da Silva. Por fim, são avaliadas algumas situações hipotéticas em que frequentemente se observa o conflito entre o direito à intimidade e outros direitos fundamentais no ambiente de trabalho e propostas soluções para esses conflitos com base nas ideias dos constitucionalistas mencionados. / This work is devoted to the study of the right to the employees intimacy and its attempt is to define the role of employer before the conflicts between this right and other fundamental rights in the working environment. The first chapter examines the employers directive power, emphasizing their legal nature, legal base and the limits imposed, in order to delimit the scope of action legitimately acknowledged the employer. The second chapter analyzes the general theory of the personality rights, in order to understand the general characteristics applied for the intimacy rights. The third chapter is exclusively devoted to the study of the intimacy rights: their origin, historical evolution, concept, scope, specific characteristics, limitations and legal regime. In the fourth chapter the intimacy right is examined as a fundamental right. In this chapter is either studied the horizontal effectiveness to the fundamental rights, in order to understand how they should be observed in working relationships. There are, in addition, two proposals presented as the solution to the collision between these rights: José Joaquim Gomes Canotilho and Virgílio Afonso da Silva. Finally, some hypothetical situations are assessed where the conflict between the intimacy right and other fundamental rights can be frequently observed in the work environment and it is proposed various solutions to these conflicts based on the ideas of the scholars mentioned.

Previous issue date: 2011 / A análise de dois romances de Rachel Jardim, Vazio pleno: relatório do cotidiano (1976) e Inventário das cinzas (1980), demonstra a ênfase das obras em um caráter intimista. Tal aspecto se manifesta por meio da exploração do espaço biográfico – o qual se evidencia nas implicações da incorporação na diegese de traços autobiográficos – e também se exprime através dos elementos que instauram uma dialética entre o binômio exterior/interior. Este estudo é baseado no levantamento e na análise de elementos estruturais e de temas comuns às obras, o que promoveu a elaboração de um processo
metodológico projetado sobre a distribuição dos dados em “células” e “motivos”. Esses motivos convergem para dois grandes blocos, chamados “células”, que, juntos, formam um mosaico de assuntos itemizados os quais orbitam o intimismo. A análise detalhada das duas células é distribuída em dois capítulos com os títulos de Traços autobiográficos e A dialética exterior/interior. Em vista de que o conceito de intimismo, ainda pouco explorado pela historiografia literária brasileira, recebe diferentes nomenclaturas, busco defini-lo, bem como delimitar as suas principais características. Enfoco, também, de que forma o romance de artista e alguns aspectos atinentes à estética romântica, associados à escrita do eu, emolduram o corpus, sobretudo no que respeita à tematização dos processos que envolvem a leitura e a escrita literárias. A análise fundamenta-se em conceitos fornecidos pela Teoria Literária e reflexões de distintos teóricos, não só no que concerne ao intimismo na Literatura Brasileira, mas também ao espaço ocupado por Rachel Jardim na História da Literatura Brasileira. Os procedimentos analíticos mostram o vínculo das obras de Rachel Jardim estudadas com o veio intimista no âmbito do sistema literário brasileiro. / The analysis of two novels by Rachel Jardim, Vazio pleno: relatório do cotidiano (1976) e Inventário das cinzas (1980) aims at demonstrating the emphasis of these works on an intimist character. Such an aspect arises throughout the exploration of the biographical space – which becomes evident in the implications of the incorporation of autobiographical traces in the narrative tissue – and also springs up throughout the elements that establish a dialectical relationship within the pair exterior/interior. The present work is based on the survey and the analysis of structural elements and common themes found in the two novels, fact that supported the elaboration of a methodological process designed on the distribution of the data in “cells” and “motives”. These motives are gathered in two blocks, called “cells”, which unite to form a mosaic made of itemized matters that revolve around intimacy. The detailed analysis of the two cells is distributed in two chapters under the titles of Traços autobiográgicos and A dialética exterior/interior. Due to the fact that the concept of intimacy, still slightly investigated by the literary Brazilian historiography, receives many different names, we look forward to its definition as well as to the demarcation of its main features. We also focus on the ways the artist novel and some principles of the Romantic aesthetics related to the writing of the “I” frame the corpus mainly in what concerns the thematization of the pertinent procedures linked to the literary acts of reading and writing. The analysis is grounded on concepts taken from the Literary Theory and from distinct theorist ́s stands not only in what concerns to intimacy in Brazilian Literature but also related to Rachel Jardim ́s place within the Brazilian literary history. The analytical proceedings show the connection between Rachel Jardim ́s works and the intimist thread in literature within the scope of the literary Brazilian system.

O presente trabalho ressalta as valiosas contribuiÃÃes do romance O CortiÃo, de AluÃsio Azevedo para a compreensÃo do contexto social fluminense de final de sÃculo XIX. O CortiÃo à um painel em que se vislumbram vÃrios tipos representativos da Ãpoca. A obra narra o cotidiano, em Botafogo, dos habitantes de uma estalagem e de um sobrado a ela vizinho, sendo um rico apanhado de flagrantes das realidades afetivas experimentadas pelos personagens. As relaÃÃes familiares e suas conseqÃÃncias tematizam o assunto aqui tratado. SÃo postas em evidÃncia as diversas formas de interaÃÃo entre os personagens do romance, inclusive as que envolvem o adultÃrio e a prostituiÃÃo. AtravÃs de uma anÃlise do comportamento dos personagens, a pesquisa busca comprovar as teses do determinismo social e genÃtico defendidas pelo autor. Utilizando o mÃtodo investigativo hermenÃutico, o estudo partiu do texto literÃrio para a anÃlise do tema proposto, analisando a concretizaÃÃo verbal obtida por AluÃsio Azevedo, nesse particular, e valendo-se ainda do aporte teÃrico de textos ligados à Sociologia e à HistÃria. / This study highlights the valuable contributions of the novel O CortiÃo of AluÃsio Azevedo for understanding the social context of Rio de Janeiro at the end of the nineteenth century. O CortiÃo is a panel that comes out several representative types of the time. The book recounts the everyday, of an inn house in Botafogo. The residents of her neighbor, and a rich collection of blatant emotional realities experienced by the characters. Family relationships and their consequences guide the subject matter hereof. They are drawn to the various forms of interaction between the characters in the novel, including those involving adultery and prostitution. Through an analysis of the behavior of the characters, the research aims at the thesis of social and genetic determinism advocated by the author. Using the investigative method of interpretation, the study came from literary text to the analysis of the subject, the verbal context obtained by AluÃsio Azevedo, and the advantage of the theoretical texts related to sociology and history.

A obra de Al Berto insere-se em quadro estético no qual se recupera uma dicção mais afetiva e sentimental, se cultiva uma tônica no contato com a realidade mais imediata e se estreita (e também se embaralha) os vínculos entre vida e arte. Para melhor delinear esse contexto, evocam-se alguns conceitos teóricos tais como os de autenticidade, de poesia sentimental e ingênua ou ainda o de coincidência ou não ente poema e poesia. Uma das questões de fundo fulcrais e aglutinadoras das características supracitadas é a intimidade ou, melhor, uma escrita da intimidade, que é atravessada pelas tensões e impasses do espaço biográfico contemporâneo. Como estratégia analítica, organiza-se a dissertação a partir dos dois movimentos constituintes da sondagem íntima: a objetivação do sujeito e a subjetivação dos objetos. Assim sendo, busca-se, primeiramente, discutir a noção de narcisismo poético e explicitar o processo de constituição daquilo que o poeta denominou de texto-corpo e suas figurações: pequeno demiurgo, o centro sísmico do mundo, monge noctívago e o último habitante. Especificamente neste momento do trabalho, conceitos como os de trauma e abjeto auxiliam na leitura dos poemas. Na sequência, investiga-se a relação do sujeito poético, atento e solitário, com seus objetos cotidianos, que são considerados como sinais da realidade e do próprio indivíduo. Articula-se a essa análise o repetido uso estilístico de enumerações e inventários, manifesto de forma bivalente: uma, como expressão da fragmentação do mundo e, outra, como discurso de desconstrução e resistência. A estrutura da dissertação, portanto, tem caráter complementar se considerada em suas partes: tanto em uma quanto em outra, o que está em questão é a possibilidade de uma escritura da intimidade apresentada paradoxal e simultaneamente enquanto presença e ausência do real, enquanto afirmação e negação de uma subjetividade, enquanto assimilação e deslocamento dos lugares canônicos das escritas de si. / The work of Al Berto is inserted in an aesthetic framework which recovers a more emotional and sentimental poetic diction, places greater emphasis on the contact with immediate reality and narrows and blurs the limits between life and art. In order to clearly outline this context, we also evoke some questions such as the concept of authenticity, of sentimental and naïve poetry, or that of concurrence or not between poem and poetry, among others. One of the background issues related to these traits is intimacy or the writing of intimacy, which is full of tensions and dilemmas in the contemporary biographical space. The analytical structure of the dissertation is based on the two movements of the self-questioning intimacy: objectification of the subject and subjectification of objects. Thus, we primarily seek to discuss the notion of poetic narcissism and elucidate the process of constitution of the so-called \"text-body\" and its figurations: \"small demiurge\", \"the seismic center of the world\", \"the nocturnal monk\" and \"the last inhabitant. Trauma and abjection are concepts that help us read the poems in this specific part of the study. Finally, we investigate the relations of the attentive and lonely poetic subject to his everyday objects regarded as signs of reality and of the individual himself. We also articulate this analysis with the stylistic use of enumerations and inventories in a bivalent form: a) as an expression of the fragmentation of the world and another, and b) as a discourse of deconstruction and resistance. Hence, the structure of the dissertation should be considered in its complementary chapters: both deal with the writing of intimacy paradoxically and simultaneously regarded as presence and absence of the real, or as affirmation and denial of subjectivity, or even as assimilation and displacement of canonical writings of the self.

L’intime est un défi lancé à la représentation : comment montrer ce qui est par essence caché, ce qui échappe à l’espace public pour se loger dans le privé, entre les murs des foyers, ou dans le for intérieur ? A ce questionnement esthétique – que peut la représentation face au paradoxe de l’intime ? – s’ajoute un enjeu éthique : qu’a-t-on le droit de montrer de cette sphère régie par le secret et la pudeur ? Notre recherche se propose comme objet l’oeuvre du metteur en scène et cinéaste Patrice Chéreau. A la scène comme à l’écran, les corps y sont exposés jusqu’à l’excès, suscitant chez le spectateur malaise et fascination. Deux postures s’y dessinent : intrus ou voyeur, le spectateur est appelé à réfléchir son activité. Au théâtre, c’est l’articulation d’un dispositif scénique épuré et d’un jeu d’acteur puissamment charnel qui place le spectateur dans une proximité physique dérangeante à un corps débordant. Au cinéma, c’est en donnant à voir une nudité suintante, loin des standards lisses des images photoshoppées, que le cinéaste en appelle à une pulsion scopique qui met en branle une fonctionnalité haptique du regard. Ainsi, la représentation de l’intime suscite un besoin d’outrepasser la vision pour palper le visible. Or c’est précisément par le relais du directeur d’acteur que ceci est rendu possible. Ce que nous regardons, en dernière instance, est la relation qui unit Patrice Chéreau à ses comédiens, relation au sein de laquelle se joue une érotique de l’acteur, mais aussi une éthique de l’intime, entendue comme le moyen de dépasser obscénité, exhibitionnisme ou pornographie qui caractériseraient la représentation de l’intimité. / Privacy is a challenge launched to representation: how do we show what is hidden in essence, that which escapes the public sphere to find place in the private realm, between the walls of homes, or in conscience? In this aesthetic questioning - what can the representation accomplish in front of the paradox of privacy ? – here, an ethical stake is added: what can we show of this sphere governed by the secret and the decent ? The basis of our research is the work of the director and film-maker Patrice Chéreau. Both on stage as well as on screen, bodies are given to be seen until excess, creating embarrassment and fascination in the audience. Two postures take shape here: intruder or Peeping Tom. The spectator is called to reflect his activity. To the theater, it is the link between an uncluttered scenic device and a powerfully carnal act, that places the spectator in disturbing physical proximity to an overflowing body. In the cinema, by exposing the audience to a secreting nudity, far from the standards of images produced by Photoshop, the film-maker calls forth a magnified drive which creates a haptic feature of the glance. So, the representation of privacy arouses a need to exceed the vision in order to feel the visible. This is made possible via the director. In the final analysis, we look at the relationship between Patrice Chéreau and his actors, the relationship where not only the actor’s erotic, but also the ethics of privacy, take shape, both considered as the means to overtake obscenity, exhibitionism or pornography, characterizing the representation of intimacy.

Didier-Georges Gabily, Jean-Luc Lagarce et Jean-François Peyret ont la particularité d’avoir tenu, entre 1977 et 2008, un journal personnel. S’il s’agit d’explorer ces matériaux, encore peu étudiés dans le champ des études théâtrales, l’enjeu de la réflexion est de mesurer les apports du jeu diaristique à l’exercice théâtral. Les déplacements de l’un à l’autre sont envisagés dans ce que Philippe Lejeune nomme l’« espace autobiographique ». Dans cette perspective, les journaux ne constituent pas de nouvelles clés de lecture pour l’œuvre mais bel et bien des pièces maîtresses d’un jeu identitaire, ouvrant un dialogue sans fin entre fictions théâtrales, romanesques et textes autobiographiques. La première partie de la réflexion propose de cartographier ces journaux d’un genre particulier en observant d’abord comment la vie de l’homme et celle du théâtre y cohabitent. Comme pour de nombreux! autres artistes, le journal incarne l’espace d’un atelier : on tentera alors d’observer l’élaboration de l’écriture dramatique et on se demandera dans quelle mesure le journal peut constituer une mémoire de l’acte théâtral, par essence éphémère. La seconde partie est divisée en chapitres monographiques : pour chacun des trois auteurs, on arpentera le chemin du journal au théâtre sous l’angle d’une perspective unique ; la tentation autobiographique chez Jean-Luc Lagarce, la question lyrique chez Didier-Georges Gabily et celle du rapport à l’Autre chez Jean-François Peyret. / A common feature of Didier-Georges Gabily, Jean-Luc Lagarce and Jean-François Peyret is that they all kept personal diaries between 1977 and 2008. A study of this as of yet unexplored material from the point of view of theatrical studies can help measure the contribution of the diaristic play to theatrical practice. Movements from one to the other are considered in what Philippe Lejeune calls the “autobiographical space”. In this perspective, diaries do not constitute new reading keys for the works, but rather the cornerstones of an identity game that opens an endless dialogue between theatrical fictions, novels and autobiographical texts. The first part of the work attempts to map these distinctive diaries by observing how they account for both the artist’s life and his theatrical life more generally. As for many other artists, the diary embodies the space of a workshop: I will endeavour to observe the elaboration of dramatic writi! ng and speculate as to the extent to which the diary can constitute a memory of the theatrical act, which is essentially ephemeral. The second part is divided into monographic chapters. For each of the three authors, the path from diary to theatre will be viewed from a single perspective: the autobiographical temptation for Jean-Luc Lagarce, the questions of lyricism for Didier-Georges Gabily, and of inter-personal relationship for Jean-François Peyret.

With The Cuddle Club, I intended to make a film that sought to examine intimacy as it relates to the extremes; in the film I subvert expectations of intimacy to make the audience reconsider why we draw our physical boundaries where we do. And while everybody may need a little cuddle every now and then, men have no right to touch women without their express permission.
This paper will be an examination of the story behind the story. Of my thoughts on the process of creating my thesis film The Cuddle Club as it pertains to the screenwriting, preproduction, production and postproduction process. There will be a step-by-step analysis of the plot, as well as an introduction explaining how The Cuddle Club came to be. The Appendix will include all of the documents created during the preproduction process.

In recent years technology has developed significantly and rapidly become an intricate part of people’s daily life in the globalised world. There is a growing recognition that within intimate relationships, technology usage has many functions which can create both negative and positive impacts on intimacy. Yet research on intimacy in online social relationships is still underdeveloped. This paper maps the literature on long-distance relationships and how its participants use information and communication technologies to overcome the physical detachment. The purpose of this study is to examine whether intimacy changes over Erasmus+ exchange studies in long-distance romantic and parental relationships. Data from an online survey of 100 Erasmus+ exchange students residing in Budapest, Hungary were analysed to see whether the quality of their relationship worsens during the exchange period. Based on the data collected it can be concluded that the majority of respondents does not experience critical decay in neither of their relationships and that preparation for distance communication with ICTs is not strongly connected to preventing a decay in intimacy.

Magister Artium - MA / This thesis explores the different ways in which labour migrants in contemporary South Africa make use of cell phones in their daily lives to maintain their love relationships. I start by tracing the history of labour migration and show how the gradual change of migration has played a role in the assertion of labour migrants in their communities in Cape Town. I look specifically into the use of cell phone by Setswana and Sesotho speaking migrants in Delft, Thornton, Brackenfell and Gugulethu. While the focus of the research is on the role of cell phones in maintaining love relationships between migrants and the partners they left behind
‘at home’, I also show how the negotiation of the cell phone in the social lives of migrants helps build wider social networks. The value of the functions of the cell phone through employed communication patterns that encourage social relations and interactions are also the focus of this thesis.
