In this article the author develops a jurisprudential analysis of the right to negative freedom of association, as an essential part of the right to freedom of association, and how certain agreements, concluded within the framework of collective bargaining, contain provisions that go against the principle non-discrimination. Such agreements are declared null and void, and sometimes are admitted and incorporated into the constitutionality and legality. Based on typical cases will be discussed in which situations the agreements concluded by unions violate the right to negative freedom of association of the unaffiliated and become a discriminatory act and an unjustified pressure to join a union. / En el presente artículo se desarrolla un análisis jurisprudencial del derecho a la libertad sindical negativa, como parte esencial del derecho a la libertad sindical, y cómo ciertos acuerdos, concluidos en el marco de la negociación colectiva, contienen disposiciones que van en contra del principio de no discriminación. Dichos acuerdos son declarados nulos y sin efectos, y en otras ocasiones son admitidas e incardinados dentro de la constitucionalidad y legalidad. Sobre la base de casos paradigmáticos se expondrá en qué situaciones los acuerdos celebrados por los sindicatos atentan contra el derecho de libertad sindical negativa de los no afiliados y devienen en un acto discriminatorio y una presión injustificada a afiliarse a un sindicato.

Identifica-se a estreita relação entre a capitalização do mercado das diversões no Rio de Janeiro e Buenos Aires com a maior exploração e disciplinarização do artista. Enquanto um estudo de caso, aborda-se peculiaridades do trabalho artístico, como a singular relação entre capital e trabalho e as hierarquias internas da categoria que contrapunham artistas por critérios subjetivos e, como consequência, complexificaram a identificação dos artistas como trabalhadores no geral. Além disso, o mercado artístico é interpretado como um espaço de trabalho inclusivo, apesar de hierarquizado. Os desdobramentos da Crise Mundial de 1929 nas duas cidades acentuaram o uso da tecnologia e popularizaram o rádio e o cinema, meios que levaram a fortes transformações no mercado de trabalho do setor. Em meio a altas taxas de desemprego e precárias condições de trabalho as associações de artistas das duas cidades buscaram se articularam com o Estado para se converterem em sindicatos e pleitear direitos trabalhistas. Enquanto isso, a política da Boa Vizinhança e o OCIAA usavam os mercados de diversões de países latino-americanos como uma das formas fazer valer sua influência no contexto da Segunda Guerra Mundial. Com isso, aumentou o intercâmbio entre artistas e empresários artísticos da América Latina e o mercado hollywoodiano e da Broadway, como também as possibilidades de diálogos e negócios entre os mercados artísticos latino-americanos. / In this present thesis, the identity shaping articulation process of the artists in the means of entertainment of the portenhos and cariocas as workers was historicized. The close relationship between a market capitalization amusement in Rio de Janeiro and Buenos is identified with the artist’s greater exploration and discipline. As a case study, peculiarities of artistic work are discussed, such as the singular relation among capital, labor and the internal hierarchies of the category that opposed artists by subjective criteria and, as a consequence, have complicated the identification of artists as workers in general. Besides, the amusement market is interpreted as an inclusive work space, even though hierarchical. The unfolding of the 1929 World Crisis in the two cities accentuated the use of technology and popularized radio and film, which led to major transformations in the sector's labor market. In the midst of high unemployment rates and precarious working conditions, the associations of artists from both cities sought to articulate with the state to become unions and to claim labor rights. Meanwhile, the Good Neighbor policy and the OCIAA used the amusement markets of Latin American countries as one of the ways to assert their influence in the context of World War II. As a result, there has been an increase in the exchange between artists and entrepreneur in Latin America and the Hollywood and Broadway markets, as well as the possibilities for dialogue and business within Latin American amusement markets.

Para tanto, realizamos pesquisa bibliográfica, documental e empírica, com aplicação de entrevista semiestruturada. Como nossa intenção era estudar as gestões anteriores, entrevistamos o presidente e o vice-presidente da APEOESP (São Paulo) das gestões de 2002 a 2005 e 2005 a 2008, em janeiro de 2008, pois, no final do primeiro semestre do mesmo ano, haveria novo processo eletivo. Em 2009, entrevistamos os diretores da subsede de Marília, além dos professores membros dos Conselhos de Escola de três Escolas Estaduais do município de Marília, que fazem parte da amostra selecionada pelo Grupo de Pesquisa Organizações e Democracia, para o projeto Gestão democrática nas escolas públicas de educação básica de Marília, ao qual esta pesquisa está integrada, totalizando treze entrevistas com professores. Em sua trajetória, a APEOESP encaminhou, além das lutas salariais, mobilizações de caráter educacional, como a relativa ao Estatuto do Magistério de 1985, que regulamentou o Conselho de Escola Deliberativo, considerado uma importante conquista na democratização da gestão da escola. A entidade, juntamente com outras organizações da sociedade civil, participou ativamente também da luta em defesa do ensino público e gratuito, durante a elaboração da Carta Constitucional de 1988. O Conselho Deliberativo é fruto de um amplo processo de negociação na Assembleia Legislativa, no qual os diretores fizeram pressão contrária à sua aprovação, os pais e alunos estiveram ausentes das discussões, e a garantia do caráter... / The objective of this work is to analyze the role of the Teachers’ Labor Union of Official Teaching of the State of São Paulo (APEOESP) in the democratization process of public school management, as well as its current claims with regard to democratic management. For this we conducted a bibliographical, documentary and empirical investigation by using a semi-structured interview. Former Presidents and Vice-Presidents of APEOESP from 2002 to 2005 and from 2005 to 2008 were interviewed in January, 2008, since by the end of the first semester, 2008, there would be new elections, and we intended to study previous administrations and the directors of Marília branch in 2009. We also made interviews with teachers members of the School Council of three public schools of Marília municipality, taking part in the sample selected by the Organizations and Democracy research group , for the project Democratic Management in the public schools of fundamental education in Marília, which this investigation concerns, amounting to 13 interviews. In its history, APEOESP had been leading, besides struggles for better salaries, mobilizations with educational purposes such as the Teaching Statute in 1985 that regulated the Deliberative School Council, reputed as an important achievement in the school democratization management. APEOESP, together with other civil society organizations, also actively participated in the struggle for free public education when Constitutional Law of 1988 was being worked out. The Deliberative Council was the result of a long process of negotiations at the Legislative Assembly, in which school directors brought pressure against its approbation, - parents and students were not present at the debates-, and the guarantee about deliberative nature and equally composition between intra and extra school community... La France et l’OIT (1890-1953) : vers une « Europe sociale » ? / France and ILO : towards a " social Europe "?

L’année 1919 a été décisive dans l’histoire sociale. En effet, elle fut marquée par la création de l’Organisation internationale du travail (OIT), issue de la partie XIII du traité de Versailles. Cette institution à vocation universelle se plaçait dans la continuité d'expérimentations et de réflexions menées, depuis le XIXe siècle, sur le Vieux Continent. L’objectif des puissances européennes était de définir un cadre international de règles, communes aux Etats, pour empêcher à la fois les excès de certains patrons, les conflits avec les travailleurs, tout en combattant la pratique du dumping social et en garantissant une concurrence loyale, non seulement entre eux mais aussi à l’échelle internationale. La France joua un rôle majeur dans la rédaction de ces textes et dans la création de l’OIT, chargée de poursuivre ce travail. De ce fait, cette institution dut concilier l’européocentrisme dominant le BIT et sa vocation universelle. La solution apparut, durant la Seconde Guerre mondiale, à travers l’interrégionalisme développé par Paul van Zeeland, et que l’institution tenta de mettre en œuvre durant l’après-guerre et la guerre froide. Il s’agissait de créer des regroupements régionaux et de les faire coopérer dans les domaines politique, économique et social pour garantir la paix dans le monde ; l’Europe occidentale devait en être le laboratoire. Cette région, notamment la France, influença donc durablement les réflexions de l’OIT. / The year 1919 was decisive in the social history. Indeed, it was marked by the creation of the International Labour Organization (ILO), resulting from part XIII of the treaty of Versailles. This institution with universal vocation placed itself in continuity of experiments and of carried out reflections, since the 19th century, on the Old continent. The objective of the European powers was to define an international framework of common rules for States, to prevent at the same time excesses of some managers, the conflicts with the workers, while fighting the practice of the social dumping and guaranteeing a fair competition, not only between them but also on an international scale. France played a major role in the writing of these texts and the creation of the ILO, charged to continue this work. So this institution had to reconcile the europeocentrism dominating the International Labour Office and its universal vocation. The solution appeared, during the Second World War, through the interregionalism developed by Paul van Zeeland, and that the institution tried to implement during the post-war period and the cold war. It was a question of creating regional regroupings and of making them cooperate in the policy fields, economic and social to guarantee peace in the world; Western Europe had to be the laboratory about it. This region, in particular France, thus influenced durably the reflections of the ILO.

The Impacts of Change in Governance on Faculty and Staff at Higher Education Institutions: A Case Study of OHSU

In the early 1990s, Oregon Health and Science University leadership examined the political and economic landscape and determined it needed a new operational model to survive and thrive. In 1995 OHSU separated from the state higher education system and became a public corporation, with goals of increased efficiency, customer-focus, ability to attract world-class researchers and physicians, and salaries commensurate with an urban academic health center. This research examines the internal impacts when universities undergo significant change, using OHSU's governance change as a case study. Central is the question: what effect(s) did OHSU's decision to become a unique public corporation have on specific employee groups? This study looks at two groups and their perceptions of the change: faculty, and union-represented staff. The author interviewed the leadership team who led the transition, reviewed historical and organizational documents and archives, and examined quantitative data such as tuition, state funding, research, and salaries. Interviews were then conducted with longtime and former employees to obtain employee perceptions. Finally, the study compares employee perceptions about process, culture, and job satisfaction, to the goals established by the leadership. The results of this study reveal that, while there were internal and external challenges, the transition to a public corporation was successful according to the perceptions of most employees when compared to the goals. After the transition, OHSU did become more efficient and more nimble for a time, able to recruit world-class employees and pay competitive salaries. Staff felt empowered and some faculty felt it made OHSU a better institution. However, some faculty felt that OHSU's transition to the public corporation eventually led to increased bureaucracy, as well as to the loss of shared governance, tenure practices, and other cultural norms inherent to academic institutions. By examining OHSU's transition and the impacts on employee groups, this study provides insight to other universities contemplating this type of change. While each institution is unique, understanding the impacts to these key stakeholders can help universities plan for and implement significant governance change.

Together We Bargain, Divided We Beg The Question: How Do Minimum Wages Impact Labor Union Election Results?

Thesis advisor: Geoffrey Sanzenbacher / Labor unions are generally considered to be beneficial for workers wages and benefits, but have been on the decline for decades. This analysis questions why workers appear more hesitant to vote for labor unions now than in the past by investigating what factors influence individual labor union votes. Specifically, this analysis aims to pinpoint the effect that outside minimum wages have on union election outcomes. Using data from the United States National Labor Relations Board, Michigan State, IPUMS USA and the US Census Bureau, I generated two models – a logistic regression, and an ordinary least squares regression – that each predict the likelihood of union support based upon outside minimum wages, after controlling for a variety of factors including but not limited to the county unemployment rate, the existence of the Right to Work law, and county-level demographics. I find that the difference between state-level or city-level minimum wages and the federal minimum wage has a positive relationship with the likelihood of union certification. Specifically, I find that union support is most likely in areas where the local-level minimum wage is $4.18 higher than the federal minimum wage in the logistic model, and $5.13 higher than the federal minimum in the ordinary least squares model, ceteris paribus. Put differently, with a federal minimum wage of $7.25, areas with minimum wages around $12 are most likely to see union elections pass. Overall, these results suggest that workers are more likely to vote for a union when local exogenous economic environments are strong. / Thesis (BA) — Boston College, 2022. / Submitted to: Boston College. This is a historical study of AWG Champion, the former leader of the Industrial and Commercial Workers' Union (ICU) and provincial President of the African National Congress, in the politics of Zululand and Natal from 1965 to 1975. The study examines the introduction of the Zulu homeland and how different political forces in that region of South Africa responded to the idea of a Zulu homeland during the period under review. It also deals with Champion's political alienation from the ANC. This dissertation is also a study of the development of Zulu ethnic nationalism within the structures of apartheid or separate development, the homelands. Issues running throughout the study are the questions of how and why Champion tried and failed to manipulate `separate development' in order to build a Zulu ethnic political base. / History / M.A. (History)

Are single classified women's needs being addressed by the union in a university environment?

The initial research question for this study asked whether single women were having their employment needs met by the union in a university setting. Twelve single women who were members of a union at a university participated in semi-structured interviews about their experiences with the union. To the surprise of the researcher, the single women interviewed felt they had no needs. Drawing from feminist literature on the social construction of gender, this analysis argues that because of the patriarchal nature of our culture, women were raised to be mindful of other's needs and not their own, which made it difficult for participants to identify their own needs. / Graduation date: 2013
