Master of Music / Department of Music / Frank C. Tracz / The following report is an in depth research and analysis project based on the graduation requirement for a Masters in Music Degree from Kansas State University. The product of this project was a conducting recital performed by Michael E. Bistline with the Union High School Concert Band. This performance was held on May 5, 2009 in Matt Auditorium at Union High School. The repertoire included National Emblem March by E.E. Bagley/edited by Frederick Fennell, On An American Spiritual by David Holsinger, Portraits by Jim Colonna, and Serenade Op. 22 (c) by Derek Bourgeois. The theoretical, historical and technical analyses of this project was collected using the Unit of the Teacher Resource Guide, developed by Richard Miles and the Macro, Micro, Macro score analysis form developed by Dr. Frank Tracz. This report also includes documentation of the planning and evaluation of each rehearsal.

The effect of the 1996 Constitution on section 5 of the Regulation of Gatherings Act 205 of 1993

The Regulation of Gatherings Act 205 of 1993 is a old order piece of legislation, but gives full recognition to the right to freedom of assembly and expression. These rights are entrenched in sections 16 and 17 of the Bill of Rights and enjoy a generous interpretation. Section 5 of the Act creates limitations on these rights, as the responsible officer of a local authority is allowed to prohibit a gathering when he has reasonable grounds to believe that the police will not be able to prevent traffic disruption, injury or substantial damage to property. Given the fact that this limitation serves to protect a compelling state interest, it constitutes a reasonable and justifiable limitation in terms of section section 36 of the Bill of Rights. / Law / LL.M.

Teve por objetivo compreender de que modo os professores e coordenadores da referida rede, podem participar de forma horizontal na construção de um possível processo de regulamentação da eleição como forma de provimento do cargo de diretor, uma vez que ela já se encontra instituída através das Leis municipais nº. 894/2011, que dispõe sobre o Plano de Carreira, Cargos, Funções Públicas e Remuneração dos Servidores do Magistério; da Lei nº. 895/2011, que regulamenta o Estatuto do Magistério Público do Município e da Lei nº 1017/2015, que estabelece o Plano Municipal de Educação do Município de Irecê. Considerando a possibilidade de regulamentação da eleição como forma de provimento do cargo de diretor na Rede municipal de Irecê, assim reflito: de que modo os professores e coordenadores podem participar de forma horizontal na construção desse processo? Para isso, a metodologia aplicada consistiu em um estudo bibliográfico, pesquisa documental e um estudo de caso que teve como instrumento de coleta de dados, uma oficina metodológica, na qual utilizei-me da estratégia “rodadas de conversa” com 40 participantes (professores e coordenadores da rede municipal), além da aplicação de um formulário com um grupo de 28 docentes da Rede Municipal de Irecê. No tocante ao referencial teórico, esse PI se fundamentou nos postulados defendidos por (Cruz, 2015, Dourado, 1990; 2000; Lück, 2013; 2014; Oliveira, 1996; Oliveira, 2014; Paro, 2003; 2015; 2011; 2007; 2001, Saviani; 2012) e outros autores que versam sobre gestão democrática, eleição e outras formas de provimento do cargo de diretor. Este trabalho defende a eleição como uma contraproposta a indicação/nomeação política, atual modelo de escolha do diretor escolar na Rede de ensino investigada, pois acredita que a eleição é uma das formas mais democráticas de escolha do diretor e a indicação/nomeação uma prática autoritária exercida pelo Poder Público. Nesse viés, proponho a criação de uma Comissão Especial- CE para uma construção horizontal e colaborativa do processo de escolha para diretores via eleição direta, no qual o professorado da Rede atue de forma participativa na regulamentação das leis municipais nº 894/2011, 895/2011 e 1017/2015, pois corre-se o risco de ela ser regulamentada conforme os interesses do Poder Executivo, constituindo uma construção vertical que não atenda aos anseios da comunidade escolar. Para materialização dessas CE, apresento a sugestão de um cronograma com as etapas do processo participativo intituladas: Pré-comissão, Pós-comissão e Finalização. Este PI contribui na discussão da regulamentação das leis municipais nº 894/2011, 895/2011 e 1017/2015 e fomenta uma ação inovadora, no sentido de garantir a participação horizontal dos segmentos dos professores e coordenadores na elaboração de dispositivos normativos que viabilizem a implementação dessas leis, no que se refere a eleição como forma de provimento, viabilizando que a gestão democrática escolar se efetive de fato na Rede Municipal de ensino de Irecê- Bahia. / ABSTRACT This PI-Intervention Project titled "Election for School Directors in the Municipality of Irecê: A Proposal for Regulation in a Horizontal Way" emphasizes the importance of direct election as a form of provision for the position of school director, and as a mechanism of participation to more for effective democratic school management in the Municipal Education Network of Irecê-Bahia. Its objective was to understand how the teachers and coordinators of this network can participate horizontally in the construction of a possible process of regulation of the election as a form of filling the position of director, since it is already established through the Laws municipalities no. 894/2011, which provides for the Career Plan, Positions, Public Functions and Remuneration of the Teaching Staff; of Law no. 895/2011, which regulates the Statute of the Public Magisterium of the Municipality and Law 1017/2015, which establishes the Municipal Education Plan of the Municipality of Irecê. Considering the possibility of regulation of the election as a form of filling the position of director in the Municipal Network of Irecê, I reflect: how can teachers and coordinators can participate horizontally in the construction of this process? For this, the applied methodology consisted of a bibliographical study, documentary research and a case study that had as instrument of data collection, a methodological workshop, in which I used the strategy "rounds of conversation" with 40 participants (teachers and coordinators of the municipal network), as well as the application of a form with a group of 28 teachers from the Irecê Municipal Network. With regard to the theoretical reference, this PI was based on the postulates defended by (Cruz, 2015, Dourado, 1990, 2000, Lück, 2013, 2014, Oliveira, 1996, Oliveira, 2014, Paro, 2003, 2015, 2011, 2007; , Saviani, 2012) and other authors that deal with democratic management, election and other forms of appointment of director. This work defends the election as a counterproposal to the political appointment / nomination, current model of choice of the school director in the researched teaching network, because he believes that the election is one of the most democratic forms of choice of the director and nomination / nomination an authoritarian practice exercised by the Public Power. In this bias, I propose the creation of a Special Commission - CE for a horizontal and collaborative construction of the selection process for directors through direct election, in which the Network's faculty acts in a participatory way in the regulation of municipal laws nº 894/2011, 895 / 2011 and 1017/2015, because it runs the risk of being regulated in the interests of the Executive Branch, constituting a vertical construction that does not meet the wishes of the school community. To materialize these CE, I present a suggestion of a timetable with the participatory process stages entitled: Pre-commission, Post-commission and Completion. This IP contributes to the discussion of the regulation of municipal laws nº 894/2011, 895/2011 and 1017/2015 and promotes an innovative action, in order to guarantee the horizontal participation of the segments of the teachers and coordinators in the elaboration of normative devices that allow the implementation of these laws, regarding the election as a form of provision, enabling the democratic school management to take effect in the Municipal Education Network of Irecê-Bahia.

Teve como objetivo de pesquisa, a investigação de duas situações principais: primeiro, a análise de como o trabalho pedagógico, realizado no ambiente escolar, com relação à temática pode ser considerado processo de efetivação da legislação em estudo. Nessa abordagem a escola é vista como campo propício para afirmação de uma construção identitária reconhecendo que nossa identidade é também social e culturalmente construída. Segundo, investigar como o município de Lapão está organizado em termos legais e com relação à política de formação continuada para professores, especificamente no trato com as questões etnicorraciais. Os estudos que norteiam a pesquisa estão fundamentados no tripé, identidade, currículo e interculturalidade. A metodologia utilizada foi de caráter qualitativo, de inspiração etnográfica e utilizei os dispositivos metodológicos de: observação participante, entrevistas individuais semiestruturadas, oficina metodológica e análise documental. O processo de investigação possibilitou identificar que ao longo da década observada (2006-2016), o Sistema Municipal de Ensino de Lapão já possui um aparato que normatizam políticas públicas que colocam em prática as ações das referidas leis. Porém, as propostas curriculares das escolas devem promover tempos educativos, nos quais os professores que lecionam principalmente as Disciplinas de História, Arte e Língua Portuguesa possam contemplar nos planejamentos, ações pedagógicas que abordem a temática de forma natural e não como algo esporádico, como ocorre de fato. A proposta da interculturalidade como elemento norteador do currículo de Lapão, pode contribuir para galgar resultados positivos no que se refere à educação que valoriza a diversidade local existente. E neste ínterim propõe-se esta intervenção. / ABSTRACT This Intervention Project examines the implementation of Laws 10.639 / 2003 and 11.645 / 2008 in the Lapão-Ba Municipal Network of Education, from the perspective of the intercultural curriculum and represents a continuity of studies and research that I carry out in the area of education and diversity. The main objective of this research was to investigate two main situations: first, the analysis of how the pedagogical work carried out in the school environment, in relation to the subject matter, can be considered a process of effecting the legislation under study. In this approach the school is seen as a propitious field for the affirmation of an identity construction recognizing that our identity is also socially and culturally constructed. Second, to investigate how the municipality of Lapão is organized in legal terms and in relation to the policy of continuing education for teachers, specifically in dealing with ethno-racial issues. The studies that guide the research are based on the tripod, identity, curriculum and interculturality. The methodology used was qualitative, with ethnographic inspiration and I used the methodological devices of: participant observation, semi-structured individual interviews, methodological workshop and documentary analysis. The research process made it possible to identify that throughout the observed decade (2006-2016), the Municipal System of Education of Lapão already has an apparatus that standardize public policies that put into practice the actions of the referred laws. However, the curricular proposals of the schools should promote educational times, in which the teachers who teach mainly the Disciplines of History, Art and Portuguese Language can contemplate in the planning, pedagogical actions that approach the subject in a natural way and not as something sporadic, as it occurs indeed. The proposal of interculturality as a guiding element in the Lapoan curriculum can contribute to positive results in terms of education that values the existing local diversity. And in the meantime this intervention is proposed

Given the doubtfulness of the legal justification of Crimea’s declaration of independence on March 11 2014, which was followed by a referendum on March 16 that culminated in the peninsula’s treaty with Moscow to join the Russian Federation, Mr Putin used his speech on March 18 to put historical arguments forward in an effort to legitimise the Russian course of action in front of his own population. The speech counters the international community’s legal assessment, which classified Crimea’s accession to Russia as an annexation, with a historical legitimisation full of symbolism and mysticism that blatantly reinterprets Russian history and delegitimises the territorial integrity of Ukraine. This article analyses Putin’s attempt to justify Russia’s annexation of Crimea and tries to infer the mindset and aims that lie behind his historic-political argumentation.

Service Honest and Faithful: The Thirty-Third Volunteer Infantry Regiment in the Philippine War, 1899-1901

This manuscript is a study of the Thirty-Third Infantry, United States Volunteers, a regiment that was recruited in Texas, the South, and the Midwest and was trained by officers experienced from the Indian Wars and the Spanish-American War. This regiment served as a front-line infantry unit and then as a constabulary force during the Philippine War from 1899 until 1901. While famous in the United States as a highly effective infantry regiment during the Philippine War, the unit's fame and the lessons that it offered American war planners faded in time and were overlooked in favor of conventional fighting. In addition, the experiences of the men of the regiment belie the argument that the Philippine War was a brutal and racist imperial conflict akin to later interventions such as the Vietnam War. An examination of the Thirty-Third Infantry thus provides valuable context into a war not often studied in the United States and serves as a successful example of a counterinsurgency.

Beethoven's Orchestra at the Romantic Piano: Understanding the Piano Transcriptions of "Marcia alla turca" from Beethoven's The Ruins of Athens by Franz Liszt and Anton Rubinstein

The transcriptions of Franz Liszt (1811-1886) and Anton Rubinstein (1829-1894) on Beethoven's "Marcia alla turca" serve as unique examples within the area of transcription since each of these important virtuosos transcribed the movement with drastically different results. Liszt's Capriccio alla turca (1846) is built on Beethoven's thematic materials although it is presented with a greatly embellished accompaniment providing countermelodies, expanded passages, and vigorous rhythmic features. In contrast, Rubinstein's Turkish March (1848) attempts to capture Beethoven's original (1811) as closely as possible adhering to the form and harmonies. Each composer's approach served to showcase new pianistic innovations capturing orchestral sonorities at the piano previously unimagined. This dissertation offers musical insight for two less well-known works from significant pianist-composers which should receive further attention. Additionally, this research provides greater documentation for the compositions of Rubinstein, supplementing the historical accounts of his abilities as a performer. Examination and comparative analysis of each transcription not only illuminates the creative approaches each composer employed in creating his transcription, but also serves pianists wishing to perform these neglected works.
