This dissertation explored the ways in which the everyday life practices of most urban Indians embodied the "modernization of tradition" (Hancock, 1999) and the role that media texts played in facilitating and encouraging this modernization. The research is based on six months of ethnographic fieldwork conducted from June through December 2005, in the south-Indian city of Chennai, which has traditionally been regarded as a conservative city. Examining the Indian media as a discursive site where normative ideologies are not only constructed but also co-constructed, the study explored and examined how the discourses of tradition and modernity were contested in the south Indian media. It also identified and interpreted the ways in which dominant ideologies at the nexus of color/caste and gender/morality were negotiated by an urban city and its residents in the move towards modernity.Data included three different but inter-related sub-genres of print media texts -- visual images, textual advertisements, and news articles. The primary dataset of visual images consisted of 300 product advertisements culled from four, nationally available, English-language magazines gathered from the two genres of news and film. Textual data sets comprising the matrimonial advertisements and the news articles were gathered from the local editions of two nationally-available English-language newspapers. The broader ethnographic investigation included participant observations, individual formal and informal interviews, and focus group discussions with adult residents of Chennai. The data were analyzed using a multi-discursive and multidisciplinary approach. The analyses were informed by conceptual approaches which included: social semiotics and the multimodal theory of communication, genre analysis, critical discourse and feminist critical discourse analyses, and alternative modernities.In examining the media texts as the site where dominant sociocultural ideologies were being constantly configured and reconfigured, the analyses identified and examined the workings of three interconnected themes - fairness (in relation to skin color), gender, and morality. Through these themes, the dissertation examined the larger contestations and negotiations between the discourses of traditions and modernities as experienced by adult residents of urban Chennai. The discourses of identity construction and reconstruction were thus examined at the nexus of the individual self situated within the larger frame of the city.

O presente trabalho busca compreender as estratégias utilizadas por viúvas para sobreviver em uma sociedade de Antigo Regime no sul da América portuguesa. Para tanto, por meio das trajetórias de quatro moradoras das freguesias de Nossa Senhora da Conceição de Viamão e Nossa Senhora dos Anjos na segunda metade do século XVIII, procuramos entender as estratégias utilizadas para se conseguir um segundo matrimônio e os fatores que nele influenciavam como o número de filhos dependentes, a idade e os bens possuídos ao enviuvar. Além disso, investigamos a participação dessas mulheres na economia e na circulação de riquezas dentro de suas freguesias. Por fim, analisamos as redes de relações estabelecidas por essas viúvas por meio do compadrio. / This work seeks to understand the strategies used by widows to survive in an Ancien Régime society in the South of Portuguese America. To this end, through the lives of four residents of the parishes of Nossa Senhora da Conceição de Viamão and Nossa Senhora dos Anjos in the second half of the eighteenth century, we aim to understand the strategies used to achieve a second marriage and the factors that influenced in it as the number of dependent children, widow´s age and the property owned by her when she becomes a widow. Furthermore, we investigated the involvement of these women in the economy and circulation of wealth within their parishes. Finally, we analyze the relations established by these widows through compadrazgo.

Suprimiu-se o regime dotal, acrescentou-se o regime de participação final nos aqüestos, além do que, se previu a possibilidade de alteração do regime de bens no curso do casamento. A mais importante das alterações referentes ao regime de bens, certamente foi a autorização para que os cônjuges pudessem mudar o regime de bens ainda quando em curso o casamento. Trouxe, como isso, um novo paradigma, revogando o princípio da imutabilidade dos pactos antenupciais. A presente pesquisa tem por objetivo analisar a nova regra a mutabilidade do regime de bens, seus requisitos, forma, efeitos, procedimento, bem como a realidade de outros países. O pedido deve ser submetido ao controle judicial, através de petição conjunta dos cônjuges, no qual farão exposição dos motivos que fundamentam o pedido, devendo comprovar a procedência das razões que invocam. Também há, no texto legal, a ressalva de direitos de terceiros, porventura prejudicados com a alteração do regime de bens, sendo ineficaz em relação a este. Os efeitos da modificação do regime de bens, semelhante ao pacto antenupcial, se condicionam ao registro junto ao Cartório de Registro Imobiliário no domicílio dos cônjuges. O procedimento é de jurisdição voluntária, não cabendo intervenção de quem quer que seja, além dos próprios cônjuges. E o juiz poderá designar audiência de ratificação do pedido ou mesmo de justificação, para comprovação da procedência das razões alegadas pelas partes. A análise da realidade de outros países, também objeto da pesquisa, se constitui um instrumento importante para conduzir o intérprete na aplicação do novo instrumento de garantia da liberdade contratual no âmbito do casamento. Por fim, faz-se uma avaliação positiva em relação à inserção da nova regra no ordenamento jurídico brasileiro.

Embora as riquezas adquiridas nem sempre fossem imponentes, essa região apresentou durante o século XVIII distintas características comumentemente ligadas às nações de Antigo Regime. Com famílias, muitas vezes, formadas por maridos portugueses e mulheres da região, os interesses que contornavam esses indivíduos geralmente perpassavam pela ótica do casamento, no qual era possível estabelecer diferentes alianças vantajosas entre as principais famílias de elite da freguesia. Para que então esses matrimônios fossem concretizados diversas estratégias foram realizadas, entre elas as dispensas ou banhos matrimoniais que permitiam que indivíduos consanguíneos se unissem e sujeitos portugueses se cassassem sem muita comprovação de seu celibato. A concessão de dotes foi outro artifício empregado pelas famílias na obtenção de um “bom partido” às filhas. Ao dotar as filhas com bens, como escravos, dinheiro, ouro, terras, animais entre outros, o genitor alcançava a realização do matrimônio com um indivíduo que oferecia à família privilégios sociais, econômicos e políticos e o genro, por sua vez, abiscoitava os bens dotais e se inseria na sociedade, no caso dos portugueses, como membro permanente e benquisto. Este trabalho, portanto, analisa os diferentes elementos que circundavam a sociedade da freguesia de Guarapiranga, ressaltando os artifícios empregados pelas famílias através dos casamentos e de suas aparentes características associadas ao Antigo Regime. / Nearby to the effervescent miner cycle the patronage of Nossa Senhora da Conceição de Guarapiranga presented to your inhabitants the possibility to obtain prestige and economic success through the exploration of your ore bed of gold and your crescent and satisfactory propensity to the agriculture and cattle raising. Although the richness obtained even always been magnificent, this region presented during 18th century different characteristics usually connected the nations of Old Government. With families, many times, formed to Portuguese husbands and women of region, the interests that contoured this individuals usually to pass over for optics of marriage, in the wich was possible establish different advantageous alliances between the principal affluent families of patronage. So that then this matrimonies were concretized various artifices were realized, like the dispenses or matrimonial baths hat consented what consaguineous individuals united and Portuguese vassals married without much confirmation of your celibacy. The concession of dowers was another artifice employed to the families in the acquisition of a “good catch” to the daughters. On it dower the daughters with properties, as slaves, money, gold, lands, animals and another, the father got the realization of the matrimony with an individual that offered to the family social, economic and political privileges and the son-in-law, often, stealed the dower properties and inserted in the society, in case of the Portugueses, as a permanent member and wellliked. This work, therefore, analyses the different elements that encircled the society of the patronage of Guarapiranga, emphasizing the artifices utilized for the families through the marriages and the your apparent characteristics associated to the Old Government.

This thesis discusses insolvency proceedings regarding an insolvency of one or both spouses. The author aims to explain problems occurring during such insolvency proceedings. The thesis is not limited to a description of these procedural peculiarities, but also discusses their impact on the matrimonial property. The author addresses above all a debt discharge and a bankruptcy, for these are the most frequent mechanisms to resolve an insolvency of the debtor. On the contrary the author does not address the reorganization, for it is not very frequently used in practise. Furthermore, the author does not address a position of legal persons in insolvency proceedings, since it is not of any importance for this thesis. The author only describes the current legislation as it is. The author therefore neither discusses legislation and court rulings prior the 2013 insolvency act revision, nor considers the revision of the insolvency law that is currently (2017) under way.
