A mineração de agregados para a construção civil no novo marco regulatório : tratamento (in) diferenciado

A presente pesquisa examina a mineração de agregados para a construção civil e o tratamento dispensado no processo legislativo que visa instituir um novo marco regulatório para mineração brasileira. O escopo da pesquisa é verificar a pertinência de tratamento específico aos agregados minerais sob a ótica do princípio do desenvolvimento sustentável. A metodologia aplicada evidencia ser fundamental contextualizar a proposta legal, conceituar e compreender os bens e a atividade minerária, diferenciando os minerais agregados dos demais minérios. Verificadas suas especificidades, a mineração de agregados é analisada sob a ótica da sustentabilidade. O referencial teórico de José Eli da Veiga, na obra “Desenvolvimento sustentável: o desafio do século XXI” orienta a pesquisa no sentido de tecer as relações da atividade com o meio ambiente e a dignidade da pessoa humana. A pesquisa ressalta os impactos causados pela atividade, negativos ao meio ambiente e positivos no alcance da melhoria da qualidade de vida das pessoas. O estudo faz referência ao Direito Mineral Brasileiro e estudar o PL n. 5.087/2013 e seu substitutivo, reivindica aporte sobre políticas públicas e acerca do processo legislativo em tramitação. Ao final analisa os regimes de aproveitamento mineral, especificando o regime da autorização, a pesquisa mineral, a proposta acerca de ordenamento territorial mineral, a compensação financeira sobre a exploração mineral (CFEM) e quanto ao poder concedente dos direitos minerários. Pode-se concluir e confirmar a hipótese levantada que a legislação sempre privilegiou os minerais agregados dada sua essencialidade no alcance da melhoria da qualidade de vida, sendo imprescindível que seja mantido este direcionamento no tratamento deste bem social para alcance da sustentabilidade, enquanto preceito em processo de construção. / Coordenação de Aperfeiçoamento de Pessoal de Nível Superior, CAPES. / The research presents an approach of mining of aggregates for construction and the treatment designated in the legislative process which is being prepared to establish a New Regulatory Framework for Brazilian Mining. The scope of the research is to verify the relevance of specific treatment to mineral aggregates from the perspective of sustainable development. The applied methodology showed to be critical to contextualize the legal proposal, conceptualize and understand the assets and mining activities, differentiating the mineral aggregates of other mineral resources. Due to its specificities, mining of aggregates was analyzed from the perspective of sustainability. The theoretical reference of José Eli da Veiga, in the book "Sustainable development: the challenge of the XXI century" has oriented the research in order to identify relations of mining of aggregates to the environment and human dignity. The research highlighted the impacts caused by mining of aggregates, negative for the environment and positive due to improving quality of life. The study refers to The Brazilian Mineral Law, the Law Project n° 5087/2013, and its replacement, that inputs public policy. At the end, mineral exploitation regimes were analyzed, specifying the “regime of authorization”, mineral exploration, the proposal concerning mineral land planning, the financial compensation for mineral exploration (CFEM) and the mining rights. It was possible to conclude and confirm the hypothesis that the law has always privileged the mineral aggregates given its essentiality to improve quality of life and it is essential to maintain this condition to achieve sustainability while precept in process of construction.

A research report submitted to the Faculty of Engineering and the Built Environment, University of the Witwatersrand, in partial fulfilment of the requirements for the degree of Master of Science in Engineering Johannesburg 2015 / Regardless of the strategic role that mining plays in South Africa‟s economic growth and development, there are perceptions that mining benefits are still enjoyed by a few elite individuals. This is partly due to high expectations from lower level workers in the sector and communities where mining takes place. Failures in the implementation of some of the policies that are social in nature are making people question the wisdom of the current mining legislation, the Mineral and Petroleum Resources Development Act (MPRDA). The main question of this research paper is whether the MPRDA, in its current form, is a suitable mining legislative framework that can usher a better dispensation for all or whether there is a need to overhaul it in order to deliver the desired end results that are expected by the majority of South Africans. It is against this background that this research was undertaken, by studying best practice in other mining jurisdictions and conducting a survey of those involved in the South African mining sector. From the research and surveys, recommendations are proposed on what amendments could be effected on the MPRDA to make the South African mining sector more attractive and simultaneously, meet the citizens‟ expectations.

This thesis focuses on legislation governing the use and protection of natural resources. In each chapter this thesis undertakes a comparison of Czech and Slovak legislation which governs the use and protection of natural resources. This thesis is divided into five main chapters. The first chapter contains a general introduction of the role of natural resources in the society. The next chapter is focused on the regulation of the use and protection of natural resources through legislation, including international, EU law and national law. The third chapter deals with non renewables with an accent on the use and protection of mineral resources. Part of the third chapter is also focused on the use and protection of soil and water. The fourth chapter discusses renewables and specifically deals with the use and protection of flora, forests, fauna and renewable sources of energy. The final chapter contains a short excursion into the field of legal regulation of France.The use and protection of natural resources also has significance beyond national borders, so it is necessary to regulate the matter through instruments of international law and EU law. Dessa forma a mineração sempre foi uma das bases da economia local. No entanto, problemas começaram a surgir após o fechamento da Mina do Camaquã, tendo em vista que o Município detinha forte dependência econômica, social e tributária. Com isso, alguns impactos sociais, econômicos e ambientais foram sentidos pela comunidade. Surge daí a preocupação em se conduzir um futuro melhor para cidade buscando equilibrar os três pilares da sustentabilidade de forma que nenhum deles saia prejudicado. Nesse caso, os órgãos fiscalizadores, os empreendedores e a sociedade assumem importante papel na busca por esse equilíbrio. Logo, o trabalho aqui proposto, realizado primeiramente sob a ótica do Ministério Público, mas, certamente, direcionado para toda sociedade, inclusive para o empreendedor, visa a busca de mecanismos mais eficientes de fiscalização para construção de uma base sólida na tomada de decisões por parte dos agentes ministeriais, acelerando procedimentos, direcionando o problema, tornando a investigação mais efetiva e eliminando barreiras desnecessárias na busca pelo equilíbrio econômico, social e ambiental. Para isso, realizou-se um estudo doutrinário, jurisprudencial, técnico e prático, de questões relacionadas à mineração e ao meio ambiente com foco na atuação do Ministério Público através de uma análise profunda da legislação, jurisprudência e procedimentos internos. Como principais conclusões citam-se problemas estruturais detectados nos procedimentos bem como na atuação dos atores envolvidos, principalmente devido à complexidade da legislação correlata à mineração. Como resultado do presente trabalho estão as proposições para solucionar esta problemática e tornar mais efetivo e mais célere os procedimentos internos do órgão relacionados ao meio ambiente e mineração. / The county of Caçapava do Sul has maintained a close relation with the mining. It`s a privileged region because of the many species of mineral good. In this way, the mining has always been one of the basis of the local economy. However, problems began to arise after the closing of the Mina do Camaquã. The county had a strong economic, social and tax dependency. Therefore, some social, economic and environmental impacts were felt by the community. That cames a concern to build a better future to the city. Seeking to balance the three pillars of sustainability so that none of them is harmed. In this case, regulatory agencies, entrepreneurs and society play an important role in the search for this balance. Therefore, the work proposed here, carried out primarily from the perspective of the Public Ministry, but certainly directed at every society, including the entrepreneur. The work seeks to find more efficient mechanisms of supervision to build a solid basis for decision-making by part of the ministerial agents. Thereafter, accelerating procedures, directing the problem, making research more effective and eliminating unnecessary barriers in the pursuit of economic, social and environmental balance. For this, a doctrinal, jurisprudential, technical and practical study of issues related to mining and the environment focused on the performance of the Public Ministry through an in-depth analysis of the legislation, jurisprudence and internal procedures. The main conclusions are the structural problems detected in the procedures as well as the actions of the actors involved, mainly due to the complexity of the mining legislation. The results of the present work are the propositions to solve this problematic and to make more effective and faster the internal procedures of the organ related to the environment and mining.

Environmental impacts of prospecting and mining in Namibian national parks : implications for legislative compliance

Thesis (MA (Geography and Environmental Studies))--University of Stellenbosch, 2006. / Namibia’s environmental legislation is fragmented and outdated, and in particular mining and prospecting in parks of Namibia is poorly legislated. This problem was analysed with the Skeleton Coast Park being chosen as the study region, as it was considered to be a representative example for parks in Namibia. The Skeleton Coast Park offers both pre-mining and post-mining characteristics; therefore affording the possibility to ascertain the environmental impacts that mining and prospecting have on the environment. The aims of the study were to illustrate the gaps in legislation in regard to mining and prospecting in parks of Namibia and to provide management guidelines for mining and prospecting in these parks. Objectives of this study included gathering baseline environmental information for the Skeleton Coast Park; creating and analysing a spatial database for the occurrence and type of current prospecting and mining activities in the Skeleton Coast Park; analysing and documenting techniques currently practiced for prospecting and mining; and identifying shortcomings in legislation and policy guidelines regulating these activities. The study results highlight the extraordinary sensitivity and uniqueness of the natural environment in terms of physiography, ecological functioning and vulnerability to human interference of the life forms occurring here. Results confirm that mining and prospecting techniques can have detrimental environmental effects given the poor management practices recorded. Also, prospecting in the Skeleton Coast Park indicates no lucrative source of diamonds. Even though currently the entire coast line is given out to Exclusive Prospecting Licences, results do not indicate that any company is undertaking serious active prospecting. Regarding regulation it is evident that new, more encompassing legislation has been drafted, but that the promulgation of the legislation is hampered by the non-finalisation of the process. Several new draft bills currently in place contradict each other and need proper alignment.

Shortly after a brief introduction to the public policies, there is a criticism against the absence of a systematic measure for the desactivation of the mineral industry in the Brazilian jurisdiction. The resources that are not renegotiable should be managed by the appropriate sectors within the policy of administration in order to prevent environmental damage. The desactivation of its activities would be considered one more step is the licensing that should be monitored since its research phase, emphasizing the preservation of natural resources such as air, water ¿ superficial and underground, earth, fauna and flora and their exhaustion. Finally, a new legislative model of regulation has been proposed, with the cooperation of instruments foreseen in the public administration policies analyzed, as to their legal and social efficacies for an environmental license, aiming towards the prevention of environmental damage that could be originated by the mineral activities from the periods of research until their closure plan by proposing a License of Desactivation. Highlight the economic and social importance of mining, through the analysis of positive and negative aspects of this human activity. Mine closure is introduced as new stage of the mining project. It is presented the concepts of some tenns usually employed in studies related to mine closure. Emphasize the main causes that can direct to closure, the types of closure that can occur and the steps part of this processo The main environmental, economic and social impacts from the mine closure process are analysed. Deal with technical, legal, social and environmental aspects in the law of some selected countries. Synthesize mine closure regulation in the Brazilian Law. Preservation or exploitation? : a study of the development of the mining rights legislation on the Witwatersrand goldfields from 1886 to 2008

Elinor Ostrom (2005: 238) assumes that in understanding the make up and behaviour of institutional systems governing natural resources: “Resource users are explicitly thought of as rational egoists who plunder local resources so as to maximise their own short-term benefits. Government officials are implicitly depicted, on the other hand, as seeking, the more general public interest, having the relevant information at hand and the capability of designing optimal policies.” This thesis examines the validity of this assumption through an historical analysis of the deep-level gold mining industry of the Witwatersrand, South Africa. The main focus of the assessment is on the institutions of ownership – that is, the development of mining rights and title legislation between 1886 and 2008. The study looks at the legislations’ transformation and implementation from the perspective of the gold mining industry – made up of the mining finance houses and the Chamber of Mines of South Africa – and that of the state. The transformation of the mining industry’s institutional framework was both a choice by government as well as that of the firms in the mining industry. The theoretical framework is constructed from four areas of economic thought. These include: the neoclassical and Keynesian schools of macroeconomic thought; industrial organisation and its relevance to the relationship between firms and the market; institutional and new institutional economics; and finally property rights. The determinants of policy design and the impact of such design on firms and industry is examined. The development, implementation and use of the aforementioned legislation is examined from two perspectives, namely, that of preserver or exploiter. Throughout the history of this prominent South African industry, the motivation for action from the industry or government has oscillated between the two extremes of preserver or exploiter over the time period examined. The conclusion is drawn on an overall and broad focus of actions – with a strong focus on the most recent developments in mining legislation – post-1992.
