Possibilities and Constraints Facing the International Cooperation in Negotiating Global Climate Change RegimesZakaria, Mohamad January 2010 (has links)
This thesis analysis the problems facing the negotiators during their international efforts to create global climate change regimes. Without understanding why such negotiations failed in the past, it is difficult to learn how to negotiate them successfully in the future. The US and China are responsible for emitting almost half of the greenhouse emissions to the atmosphere. However, they are still laggards in the efforts to create an effective global climate change regime and are running away from their global responsibility by blaming each other for the failure to reach a global climate change deal. The EU has been taking the leadership in efforts to negotiate global climate change regimes. However, they can not influence and force the main two hegemonic powers to follow their leadership. This is because the EU is not hegemony in the global political arena. The EU persistence to find compromises during negotiations for future global climate change regimes is a source of hope to humankind. Flexibility during negotiations, openness to consider the views of other global actors to find optimum solutions, and the understanding that no one is secure from the threats of climate change are essential to bring the world leaders into a compromise global climate change regime.

Om fredsförhandlingarna efter kriget mellan Ecuador och Peru, och varför ursprungsbefolkningen inte tog del. / n this paper, the role of the indigenous communities in the conflict, war, and peace process relating to the disputed border region between Ecuador and Peru, settled in 1998, is analysed and discussed. The hypothesis is that to establish an enduring and positive peace, the indigenous communities living at the frontier should not be excluded from the process. The research question is How does the integration of Indians into the peace process in Ecuador and Peru influence the prospects for development of positive peace? The student looks at the ties indigenous have to the states of Ecuador and Peru, both as individual citizens and as Indian communities, and uses this basis for recommending in the conclusion that although the indigenous were not party to the peace negotiations, they should be party to the development of positive peace.

This thesis is an attempt to find a sustainable solution for the Palestinian refugee problem. It analyzes the Palestinian refugee case and how different actors in the Palestine-Israeli conflict view it. The Palestinian refugees issue is one of the most complicated matters in the peace negotiations between the two parties and without solving it there will be no permanent and sustainable peace in the Middle East region. There is a need for compromise from both the Israelis as well as the Palestinians to find a sustainable solution for the Palestinian refugee problem. The international community in general and those who have the political, military as well as economic power in particular must play an important role in the final settlement of the issue by providing economic incentives to repatriate and compensate the Palestinian refugees. The Right of Return should be respected in any case. While some Palestinian refugees might go back to their historic home land in what nowadays is called Israel, others might have no choice but to be permanently settled in their current host countries provided that they are given full citizenship rights in their host country as well as in the promised Palestinian State.

LAJKONIK OF TUCSON - A PIECE OF TRUE POLAND: CONSTRUCTING POLISH - AMERICAN IDENTITIES IN AN ETHNICALLY HETEROGENEOUS SOCIETYGlowacka-Musial, Monika January 2009 (has links)
Tucson, Arizona is a site of a lively Polish-American community. Initially associated with a political organization ("Solidarity Tucson"), which actively supported the Solidarity Movement throughout the 1980s, the Polish diaspora has gradually transformed into an ethnic community very much focused on maintaining its distinctive heritage. Recent formation of the Polish folkloric dance group Lajkonik was directly stimulated by the local multicultural establishment, which promotes ethnic diversity in the Old Pueblo. Having become an integral part of the Southwestern society, Lajkonik has developed a collection of identity practices, which despite diverse influences continues to reproduce Polish cultural traits. In my ethnographic account, I examine ways, by which members of the Lajkonik group construct their diasporic identities. First, I focus on the core activities of the group, which include the practice of Polish traditions, learning folk dances and songs in a wide cultural context, and negotiating the speaking of Polish. Additional analyses, based on video recordings, of Polish classes and dance rehearsals, which show the actual mechanics of the production processes, as well as the narratives of the teacher and parent of performers, further support the account of the ethnographer. Secondly, I look into the development of Polishness for public consumption, which involves negotiation of multiple images in accordance with specific cultural events, creation of engaging stage programs, and presenting the essence of Polishness to festival audiences in Tucson. Regardless of the particular purpose of identities' productions, either for integrating community or public display, these processes simultaneously involve the quest for authenticity, building ethnic pride, and negotiations of diverse traditions. / Anthropology

influence over the global trade agenda. This article highlights the increasing activism and impact of African
states through a detailed study of the current Economic Partnership Agreement (EPAs) negotiations with the
European Union (EU). In examining African resistance to EPAs, the article develops a constructivist
approach to North-South trade negotiations that pays close attention to the role of development discourses.
We argue that the growing willingness of African states to challenge the EU to deliver on its development
promises during the decade-long EPA process was crucial to informing their sustained opposition to the EU’s
goal of completing a comprehensive set of sub-regional economic agreements. We document African resistance
to EU trade diplomacy in the EPAs, exploring how these otherwise weak countries were able to pursue
normative-based negotiation strategies by recourse to the EU’s promise of a ‘development partnership.’

Auf der 27. Vertragsstaatenkonferenz der Klimarahmenkonvention der Vereinten Nationen (UNFCCC) im Jahr 2022 gelang es den Entwicklungsländern, einen Verlust- und Schadensfonds (engl. „Loss and Damage“ - L&D) einzurichten. L&D, umrissen als die unvermeidbaren Risiken und Auswirkungen des Klimawandels, hat für Entwicklungsländer, deren Vulnerabilität und Exposition gegenüber dem Klimawandel besonders hoch ist, hohe Priorität bei gleichzeitig dünner Beweislage.
Die vorliegende Promotion richtet ihr Augenmerk auf diesen Mangel an L&D „Beweisen“ um die Rolle von Evidenzen im Rahmen der L&D Verhandlungen zu verstehen und Ansätze zu entwickeln, die negative Folgen ihres Mangels für Entwicklungsländer begrenzen.
Der erste Teil dieser Arbeit zeigt, wie Verhandlungsführerinnen und -führer aus Entwicklungsländern generische Erkenntnisse zu Klimaauswirkungen nutzten, um eine hermeneutische Ungerechtigkeit zu überwinden. Politischer Nutzen von Evidenzen kann Akteuren ein Gefühl der Legitimität zu vermitteln, jedoch ohne Überzeugung der Gegenseite.
Der zweite Teil dieser Arbeit hinterfragt die Rolle von Attributionswissenschaften im neuen L&D-Fonds und liefert eine normative Analyse, anhand derer rein qualitativ getroffene Attributionsaussagen einen Anspruch auf Gelder aus dem L&D Fond hinreichend legitimieren. Die Rolle von Vulnerabilität und Exposition sollten demnach keine Rolle bei der Verteilung der Gelder spielen, jedoch bei deren Verwendung in Betracht gezogen werden.
Der letzte Teil dieser Promotion befasst sich mit klimatischen Risiken auf die Anpassungsfähigkeit in Entwicklungsländern und deren Konsequenzen im Rahmen von Klimarisikobewertungen. Ein Protokoll wird entworfen, um Annahmen über Anpassungsfähigkeit angesichts erwarteter Klimaschäden, einzugrenzen – was ein verringertes Risiko einer Unterschätzungen zukünftiger L&D in Klimarisikobewertungen zur Folge hätte. / At the 27th Conference of the Parties in 2022, developing countries succeeded in establishing a Loss and Damage (L&D) Fund under the United Nations Framework Convention on Climate Change (UNFCCC). L&D, here understood as the residual risks and impacts of climate change that cannot be avoided, has been of high priority to developing countries, who also experience a lack in L&D evidence.
This thesis takes the lack of L&D evidence into focus to understand the role of evidence in L&D negotiations and develop approaches to limit adverse consequences of its lack for developing countries.
The first part of this thesis shows how developing country negotiators worked to overcome a hermeneutic injustice that had resulted from a lack of L&D evidence. By using publications on climate impacts to claim these risks were “beyond adaptation” negotiators managed to establish L&D as a theme under the UNFCCC. The analysis shows how the political use of evidence can strengthen the resolve of individual negotiators by giving them a sense of legitimacy, although it does not lead to persuasion of political opponents.
The second part of this thesis focuses on the role of event attribution in funding decisions under the L&D fund and provides the normative basis for legitimizing claims to the L&D fund with purely qualitative attribution statements. It challenges the view that vulnerability and exposure ought to be considered in L&D funding decisions, and argues that these factors ought to inform spending decisions.
Finally, this thesis turns to evidence of climatic risks on adaptive capacity. It develops a protocol for constraining assumptions on adaptive capacity in qualitative climate risk assessments, which, if implemented, could reduce the risk of underestimating future L&D in developing countries.

The dissertation examines a case of industrial espionage by one of the parties involved in a forthcoming international negotiation. We want to know what consequences a burglary has for the actual negotiation. The dissertation consist of five hypothesis, of which the three first were empirically tested. The discussion of thesis four and five is supported basically by research literature, but have also found indirect support in the empirical study. A game theoretical model of four information sets is used. Vienas iš darbo santykių požymių yra jų konfliktiškumas, todėl tarp darbo teisinio santykio šalių neišvengiamai kyla konfliktai, kurių dalis tampa darbo ginčais. Aktualus darbo ginčų skirstymas į kolektyvinius bei individualius, nes priklausomai nuo darbo ginčo rūšies, skiriasi jų sprendimo procedūra bei metodai. Ginčo objektu gali būti įvairūs teisiniai gėriai, tačiau šiame darbe analizuojamas ginčų, kilusių dėl kolektyvinių derybų ir kolektyvinės sutarties sprendimas Lietuvos teismų praktikoje. Neapsiribojama vien tik ginčais dėl kolektyvinių derybų ir kolektyvinės sutarties, pateikiama ir Lietuvos teismuose nagrinėjamų bylų dėl streiko teisėtumo analizė, nes šiose bylose yra nagrinėjami kolektyvinių sutarčių vykdymo klausimai bei aptariama kolektyvinių derybų procedūra ir principai, kurių privalo laikytis subjektai, dalyvaujantys kolektyvinėse derybose. Atlikus teisminio precedento analizę galima teigti, jog kai kuriais atvejais teismai netinkmai taiko teisės normas, reguliuojančias kolektyvinius darbo santykius: nepagrįstai apriboja darbuotojams priklausančią teisę streikuoti, nesiremia kolektyvinės sutarties nuostatomis, nors normatyvinės kolektyvinės sutarties nuostatos yra reikšmingas darbo teisės šaltinis. [toliau žr. visą tekstą] / One of the features of relationship is its susceptibility to conflicts, therefore it is inevitable for conflicts to occur in legal relationships in work and some of the conflicts become work disputes. Categorization of work disputes to collective and individual is relevant because procedure and methods of resolution of work disputes depend on their type. Various legal goods can be the object of a dispute; however, this paper analyzes disputes which occur due to resolution of collective negotiations and collective contracts in the practice of courts in Lithuania. The paper is not limited only by disputes which occur due to collective negotiations and collective contracts, it also provides an analysis of Lithuanian court cases of legality of strikes because these cases judge the issues of execution of collective contracts and discuss a procedure and principals of collective negotiations. Everyone who is involved with collective negotiations must follow these principals and the procedure. After conducting the analysis of court precedent, we can say that in some cases courts inappropriately apply legal norms which regulate collective work relationships: they limit workers’ right to strike with having no ground for that, they fail to follow the term of collective contracts even though normative terms of collective contracts are a significant source of labor law. From strategic partners to strategic enemies and back to pragmatic tolerance, both countries have maintained a troublesome relationship which entered a new era of cooperation with the implementation of the Nuclear Deal in January 2016. This deal is a geopolitical breakthrough that should improve the relations between the two countries as it is in both their strategic interests to collaborate.
